Minutes of a special meeting of the Common Council of the/City of Rochester,
Minnesota, held in the Council Chambers in the City Hall, in said City, on August 25,
194s.
President Lemmon called the meeting to order at 7:00 o'clock P. M., the
following memberer being present: President Lemmon, Aldermen Akenhead, Anderson, Kennedy;;
and Theel. Absent: Aldermen Yaeger and Kjerner, due to illness.
Thecall of the special meeting was read and President Lemmon ordered that the
same be placed on file, the said meeting having been called for the purpose of considering
the approval of plans and specifications of a warehouse and the City Engineers estimate ll
of cost for construction of same and any other business the said Common Council may deemjl

The City. Engineer's estimate of cost for the construction of a warehouse and
-
garage (First Section) in the amount of $19,100.00 was read and the same was ordered
placed on file.
Alderman Theel introduced a resolution.accepting plans and specifications and
estimate of :cost and ordering bids for the construction of a warehouse and garage (First
Section), which was read.
Upon motion by Akenhead, second by Theel, that the said resolution be adopted
as read, and all present voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
A Supplemental and Amendatory Agreement to the Lease made and entered -into
between the City of Rochester, Minnesota and the Rochester Airport Company under date of
November 1, 1945 was read and ordered placed on file when executed by the Mayor and the

10ity Clerk.
Alderman Anderson introduced a resolution approving a Supplemental and Amendatory
to the Lease made and entered into between the City of Rochester, Minnesota
,Agreement
and the Rochester Airport Company under date of November 1, 1945 and instructing the,
yor and City Clerk to execute the said Agreement, which was read.
Upon motion by Akenhead, second by Kennedy, that the said resolution be adopted
las read, and all present voting in favor thereof, President Lemmon declared the said
Iresolution duly passed and adopted.

Gentlemen:
I am returning herewith ordinances no: 691, 692, and 693 without
my approval.
It being, in my opinion, that when an ordinance has.been properly
prepared and passed by the Common Council, there should be no delay
in presenting said ordinance to the Mayor for his approval "On the
next day after the passage thereof" (See Section 94 of the City
Charter).

Ordinances and resolutions have been transmitted to me from two (2)
to five (5) days after passage and in the absence of any reasonable
excuse for this delay, I shall now, and in the future, insist that
resolutions and ordinances so transmitted have become void because
of non-compliance with this section of our Charter.
Furthermore, I would suggest that those sections in your resolutions
or ordinances delegating executive or administrative authority to
the Legislative Body is unconstitutional in most instances, and
invites litigation.
In addition to objections to the ordinances as drawn, I wish to
protest the installation of two-hour parking meters without first
having the ordinance duly passed authorizing 2 hour parking.
Kindly recall the decision of Judge Finklinberg in the recent
injunction proceedings relative to installation of parking meters
without proper authorization,

Alderman Kennedy introduced an Ordinance entitled, "An Ordinance repealing an
Ordinance regulating traffic, the operation and parking of vehicles, the use of streets
for driveway entrances and designating arterial highways in the City of Ror-hester,
Minnesota", which was given its first reading.

Upon motion by Anderson, second by Akenhead, and upon roll call and all/voting
in favor thereof, the rules were suspended and the Ordinance was- given its second
reading.
Upon motion by Theel, second by Kennedy, and upon roll call and all present
voting in favor thereof, the rules were suspended and'the Ordinance was given its third
and final reading..
Upon motion by Akenhead, second by Anderson, that the said Ordinance be adopted
as read, and all present voting in favor thereof, President Lemmon declared the said
Ordinance duly passed and adopted.
Alderman Kennedy introduced an Ordinance entitled, "An Ordinance regulating

A communication from the Board of Park Commissioners requesting the Common
Council to instruct the City Attorney to take immediate steps to secure;, damages under
the bond covering the Barrett Roffing on -the Mayo Civic Auditorium was read and upon
motion by Kennedy, second by Theel, the matter was referred to the City Attorney.

The following communication from the Board of Park Commissioners was read and
upon motion by Anderson, second by Kennedy, the same was referred to the Public Grounds
Committee and the City Attorney:

Council .of the City of Rochester
Rochester,: Minnesota
Gentlemen:

Your resolution asking that the Section of Mayo Park west of
Second Avenue and north of Second Street S. E. be converted to
a parking area was considered at our meeting of August lSth.
A majority of th•e members voted in favor of converting that
portion of Mayo Park on Lots 1, 2, 3, 4, 5 and 6, Block 21,
Original Plat, into a parking area for automobiles if and when
our Board is furnished with the written permission of Mayo heirs
to make such a change in Lots 1 and 2, which were deeded to the
city "for" a public park as a part of Mayo Park" by Doctors
William J. Mayo and Charles. H. Mayo and their wives
provided:
The Common Council of the City of Rochester sets aside money
in the General Fund to:
1. Pay the cost of moving statues. now in the area to suitable
sites elsewhere.
2. Pay the cost of converting it to a parking area and:- --main-
taining it as such after conversion.
3. Pay the cost of restoring it, to a park area when it is
no longer required for parking automobiles, or should it
be found necessary to re -develop the area as a part of
the Mayo Memorial.

After discussing the matter of representation for the Second Ward of the City
I,
of Rochester on the Common Council, a motion was made by Theel, second by Anderson, that',
President Lemmon contact Alderman Yaeger regarding his intentions -relative to his
continuous absence on the Council, due to illness. All present voted in favor -of the
motion.
