Minutes. of a special meeting of the Common Council of the City of Rochester,
Minnesota, held in the Council Chambers in the City Hall, in said City on August 30,
1948.
President Lemmon called the meeting to order at 4:00 o'clock P. M. , the.
following members being present: President Lemmon, Aldermen Akenhead, Anderson, Kennedy,
and Theel. Absent: Aldermen K jerner and Yaeger, due to illness. -
The call of the special meeting was read and President Lemmon. ordered that the
same be placed on file, the said meeting having been called for the purpose of consider-
ing the emergency now existing after the recent action of the Mayor in regard to the •
Parking Ordinance and any other business the said Common Council may deem proper.
The following veto of Ordinance No. 695 was read and the same was ordered
placed on file:
August 27, 1949
"Members of the Common Council:
Gentlemen:
Am returning ordinance 695 with my veto attached, and am not
taking the five days as permitted because I believe there is
no point in delaying action on this ordinance.
I have no special objection to this ordinance except that
particular line of Section 5- (H) which refers to any person
injured in such accident and reads "including the carrying of
such person to a physician, surgeon or hospital etc".
I believe that if the Council imposed this obligation, the
City would become liable for the death of any patient, if the
moving or carrying of said patient caused the death. Would
it not be advisable to consult a doctor regarding such a
procedure?
Also please note that this ordinance carries neither the
signature of the City Clerk nor the seal of the City.

A motion was made by Kennedy, second by Theel, that the Mayor's Veto of the said
ordinance be overridden and upon roll call and all present voting in favor thereof,
President Lemmon declared the said veto duly overridden.
The recommendation of the Street & Alley Committee that the Common Council
adopt a resolution ordering the City Engineer to notify the owners of Lots 7, S and 9,
Block 1, Westlawn Addition on the east side of 16th Avenue Southwest between 2nd Street
and 5th Street Southwest to construct sidewalks in front- of the said lots within 30 days
was read. Upon motion by Theel, second by Anderson, the same was approved.
The recommendation of the Street & Alley Committee that bids be taken at an
early date for the furnishing of 100 tons (more or less) of hot asphaltic concrete and
100 tons (more or less) of sheet asphalt mixture for patching paved streets in.the City
of Rochester, was read. Upon motion by Kennedy, second by Anderson, the recommendation
was approved and ordered placed on file.
A motion was made by Kennedy, second by Anderson, instructing the City Clerk

to notify the Mayor that it was the desire of the Common Council that he issue an
energency order to the City Engineer for the purchase of 100 tons (more'or less) of hot
asphaltic concrete and 100 tons (more or less) of sheet asphalt mixture; due to the
fact that repairs are urgently needed in many places. All present voted in favor of the
motion.
Upon motion by Kennedy, second by Theel, the meeting was adjourned.
