President Lemmon called the meeting to order at 7: 30 o'clock P. M.,, the following members being present: President Lemmon, Aldermen Akenhead, Anderson, Kennedy; Morris and Theel. Absent: Alderman Kjerner, due to illness. j Upon motion by Anderson, second by Akenhead, the minutes of the meetings of September 7, 1948 and September 10,. 1948 were approved, President Lemmon stated this as being the time and place.set for the first hearing on the construction of a sanitary sewer and watermain in 12th Street Northwest from 2nd to 4th Avenue Northwest. There was no one present wishing to be heard. Upon motion by Theel, second by Akenhead, the City Engineer was instructed to prepare plans, specifications, profile and estimate .of cost for installation of the said sanitary sewer and watermain. President Lemmon stated this as being the time and place set for a hearing on the levying of special assessments for the cost and expense of constructing a curb and gutter on 6th Avenue Southeast from 8th to loth Street Southeast. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set.for a hearing on the levying.of special assessments for the cost and expense of constructing a curb and gutter on 5th Avenue Southeast from loth to llth Street Southeast. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set for a hearing on the levying of special assessments for the cost and expense of constructing a sanitary sewer and watermain and grading in Cascade Sub -Division. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set for a hearing on the levying of special assessments for the cost and expense of grading 9th Street Northeast from the west line of Miner's Heights to the east City limits. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set for receiving and opening bids for the construction of a curb and gutter on First Avenue Southwest from 3rd to 4th Street Southwest. The bids of C. Id. Boutelle in the amount of $959.00 and Gordon Winslow Company in the amount of $1,118.75 were each received and opened. President Lemmon stated this as being the time and place set for receiving and opening bids for the construction of a warehouse and garage (first section). The bids of C. 14. Boutelle in the amount of $22,477.69; Alvin E. Benike in the amount of $25,800.00; &Sather and Ramthum in the amount of $21,323.75 were each received and opened. A committee from the Chamber of Commerce was present at the meeting and asked that a Planning Commission for the City of Rochester be created. After hearing Mr. Erwin Briese, Secretary of the Chamber of Commerce and 14r. 0. J. Allerton on the matter, a motion was made by Kennedy, second by Akenhead, instructing the City Attorney to prepare an Ordinance or resolution setting up a. Planning Commission for the City of Rochester. Dr. If. C. Popp from the Rochester and Olmsted County Safety Council requested that traffic signals be installed at the intersection of 1st Street Southwest .and 3rd Street Southwest and Broadway. Also that a study be made of other intersections in the City where traffic signals might be used to advantage. Upon -motion by Kennedy, second by Anderson, the matter was referred to the Police Committee and the Acting Chief of Police for study and report at the next meeting. Mr. Harvey Jewson was present at the meeting and stated that he had been instructed to discontinue using a part of the street in Northeast Rochester as a garden. President Lemmon referred the matter to the Street & Alley Committee. A letter from the Traveler's Indemnity Company transmitting Power of Attorney issued to Arthur A. Hirman and A. William Hirman to execute fidelity and surety on behalf of the Traverler's Indemnity Company was read and Upon motion by Anderson, second by Morris, the same was accepted and ordered placed on file. 1 fl • 1 • I 1 0 151 Record of. 'I } A request by the Board of Public Health & Welfare for permission to employ Missi Helen Marcy beginning October 1, 1948 at a salary of $232.00 per month was read and the i Il same was ordered placed on file. A communication from the Board of Public Health & Welfare requesting that the Common Council approve in principle of the employment of a psychiatrist and psychiatric social worker for .the development of the counselling clinic program was read and upon motion by Kennedy, second by Akenhead, the request was approved. A communication from Dudley C. Ericson, Liquor Control Commislsioner, suggesting", I ,I (!that when "on sale" club liquor licenses are renewed a fee of $100.00 instead of $300.00) Abe charged as provided for in Minnesota Statutes 1945, Section 340.11 Subdivision 6, was � read and the same was ordered placed on file. i A letter from C. J. Tierney, Chief of Police of St. Paul, Minnesota, asking .that the Council consider authorizing Acting Chief A. M. Nelson to attend the annual con- :i ference of the International Association of Chiefs of Police to be held October 10 to • I 14, 1949 at Nev, York City was read and the same was ordered placed on file. An invitation to attend a convention of the American Society of Sanitary Engineering to be held in Phoenix, Arizona on October 17 and 18, 1948 was read and the same was ordered placed on filed A notice from the League of Minnesota Municipalities of regional meetings to be held in the State was read and the same was ordered placed on file. An invitation from the City of St. Charles to attend the regional meeting to be" held on September 29, 1949 was read and the same was ordered placed on file. i A letter from Mr. James T. Spillane, Attorney for I. J. Renning, suggesting i that the matter of paying Mr. Renn•ing an additional salary of $20.00 per month be referred to the City Attorney for an opinion on the question as to whether or not the Council can; I reduce Mr. Renningis Salary during the official year was read and upon motion by Akenheadi, second by Kennedy, the matter was referred to the City Attorney. The City Engineer's estimate of cost for the construction of a curb and gutter I on 1st Avenue Southwest from 3rd to 4th Street Southwest .in the amount of $S84.40 was i read and the same was ordered placed on file. II ,I The following offer by Mr. C. M. Boutelle was read and the sane was ordered placed on file: "Honorable Mayor and Common Council Of the City of Rochester, Minn. Gentlemen: In the matter of correcting the unsatisfactory portion of the paving in the alley between South Broadway Street and the City Parking Lot from Second Street to Fourth Street Southwest, I offer the following proposition: 0 Record of Official Proceedings of.the Common Council .of .the City, of Rochester, Minn., September 20, 1948 1. I will remove and replace approximately 60 Sq. Yds. of pavement as directed by the City Engineer, work to be completed this fall. 2. I will pay the City the sum of $400.00(said sum being one half of the Engineer's estimate of the cost of resurfacing the entire alley with a sheet I" inch thick of asphalt wearing 'course) as liquidated damage. Sincerely yours, C. M. Boutelle" A petition requesting the Common Council to take action to remedy the condition of the flooding of streets*in the area of 4th Avenue and loth Street Southeast was read. • Mr. R. Ramsdell representing a group from thatloca.lity was before the Council and urged that action be taken as soon as possible. The matter was referred to the Street & Alley Committee. The petition of Francis Washburn to construct an addition nine feet by twenty seven feet on the West side of his present building at 724 Ninth Street Southeast was read and upon motion by Theel, second by Akenhead, the same was referred to the Board of Zoning. The petition of Norris F. Nutting to operate an upholstery shop at 18 - llth Avenue Northwest was read and upon motion by Akenhead, second by Theel, the request was granted. A petition to construct a sanitary sewer and watermain in Lots 1 and 2, Block 2, Morningside Subdivision was read and the same was referred to the Sewer Committee, the Water Committee and the City Engineer. The recommendation of the Public Grounds Committee that the bids for construction of a new warehouse and garage for the City of Rochester, Minnesota be rejected and checks returned to the bidders and the project re -advertised for October4, 1948 was read and upon motion by Akenhead, second by Anderson, the same was approved and ordered placed on file. The recommendation of the Street & Alley Committee that the contract for the construction of a curb and gutter on both sides of 1st Avenue Southwest between 3rd • and 4th Street Southwest be awarded to C. M. Boutelle for the sum of $958.00 was read and upon motion by Kennedy, second by Theel, the same was approved and ordered placed on file. The recommendation of the Street & Alley Committee that the alley between Broadway Street North and the Chicago Great Western Railway from Center Street to First Street Northeast be graded and paved and the cost thereof be assessed against the abutting property was read and upon motion by K e nnedy, second by Theel, the recommendation was approved and the same was ordered placed on file. The recommendation of the Street & Alley Committee that the offer of C. M. The applications of William T. Meany for an "On Sale" 3.2. beer license, an "Off Sale" 3.2 Beer License, a cigarette license and a soft drink license were each read and the same were referred to the License Committee. The application of Francis E. O'Hearn, Manager of Pepsi Cola Bottling Company, for an "Off Sale" 3.2 Beer License was read and upon moti-on by Anderson, second by Theel;� t the license was granted. The application of Harold E. Kullberg for a license to sell cigarettes at Ii retail was read and upon motion by Theel, second by Kennedy, the license was .granted. l The applications of Milo E. Brown and Herbert G. Hohenthauer for Journeyman Plumbers License were each read and upon motion by Akenhead, second by Morris, the i licenses were granted. The application of Harold E. Kullberg for a license to sell soft drinks was 'I read andupon motion by Kennedy, second by Akenhead, the license was granted. } The application of Kris Nielson for a license to connect with sewers and drains; was read and upon motion by Anderson, second by Kennedy, the license was granted subject'; to the approval of the Plumbing Inspector. The reports of the Clerk of the Municipal Court for the week ended September 11�, 'I 1948 showing total criminal fines and costs collected $397.00, civil fees received $2.20 and conciliation court fees $3.50and for the week ended September 18, 1949 showing totall ,criminal fines and costs collected $967.00, civil fees received $10.00 and conciliation court fees $3.05, were each read and having been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file. The surety bonds of Earl J. Seabright, Marion C. Visser, Melvin J. Mertz, Arnold K. Mork, Paul B. Runyan, Rex G. Waldron, William Cunningham, Richard C. McDermott,' i Gerald A. Kingsley, Charles A. Campbell each in the sum of $500.00 with the Saint Paul i Indemnity Company as surety; Hankee Heating Company in the amount of $1,000.00 with the I Saint Paul Indemnity Company as surety; Clifford E. Pauver in the amount of $1,000.00 �. i f with the Western Surety Company as surety and Kris Nielson in the amount of $1,000,00 with the Western Surety Company as surety, were each read and upon motion by Akenhead, second by Theel, the bonds were approved, the surety thereon accepted and it was orderedii that the same be placed on file. A quit claim deed given by the Mayo Association to the City of Rochester deeding the West thirty. -three (33) feet of the North 329.33 feet of Lot Thirty-one (31), Auditors Plat A of the East One-half and Southwest One -quarter of Section One (1), Township 106, North, Range 14 West, was read and upon motion by Akenhead, second by • Morris the said deed was accepted and the City Clerk was instructed to place the same on file with the Register of Deeds. Upon motion by Akenhead, second by Kennedy, the sum of .$2.00 was appropriated from the General Fund and ordered paid to the Mayo Association as stipulated in the above mentioned quit Claim Deed and Lease. Upon motion by Kennedy, second by Akenhead, the City Engineer was instructed to take such steps as may be necessary to start operation of a sanitary fill on the property leased from the Mayo Association. Alderman Akenhead introduced the following resolution which was read: "WHEREAS, John A. Yaeger having served as Alderman of the Second Ward of the City of Rochester, Minnesota, since April, 1941 and WHEREAS, the said John A. Yaeger, during his years of service, gave willingly and unselfishly of his time, having sacrificed his own private business to that of public interests, and WH3REAS Alderman Yaeger has tendered his resignation to the Common Council, dub to illness, and WHEREAS, said resignation was accepted by the Common Council at a meeting thereof held on September 7, 1949; NVOW THEREFORE, BE IT RESOLVED; by the City Council of the City of Rochester, Minnesota, in behalf of the public of said City, that an expression of sincere gratitude for his many years of loyal service be extended to the said John A. Yaeger, BE IT FURTHER RESOLVED, That this resolution be made a part of the permanent records of the City of Rochester, and that a certified copy of said resolution be presented to him." Alderman Akenhead introduced a resolution accepting the bid of C. M. Boutelle for construction of a curb and gutter on 1st Avenue Southwest from 3rd to 4th Street Southwest, which was read. Upon motion by Kennedy, second by Theel, that the said resolution be adopted as read, and all present voting in favor thereof, president Lemmon declared the said resolution duly passed and adopted. Alderman Akenhead introduced a resolution ordering advertisement for bids for Christmas Street Lighting, which was read. Alderman Theel introduced a resolution ordering a hearing on'the levying of special assessments for construction of a sanitary se;•!er and watermain in Fratzke's I First Addition and Silver Lake Sub -Division, which was read. Upon motion by Kennedy, second by Akenhead, that the said resolution be adopted as read, and all present voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. j Alderman Theel introduced a resolution appropriating $245.55 from the General .i (-Fund and ordering payment made to Whiting Press, Inc. for office supplies, which was read. Upon motion by Anderson, second by Morris, that the said resolution be adopted,` i as read, and all present voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Upon motion by Anderson, second by Theel, that the said resolution be adopted, as read, and all present voting in favor thereof, President Lemmon declared the said • resolution duly passed and adopted. Alderman Morris introduced a resolution appropriating $320.97 from the P.I.R. Fund and ordering payment made to Carlisle G. Fraser for estimate ido. 3 for installation of a watermain in Mohn & Hodge Sub-Divsion, which was read. Upon motion by Kennedy, second by Anderson, that the said resolution be adopted as read, and all present voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Morris introduced a resolution appropriating $1,113.27 from the P.I.R. Fund and ordering payment made to Carlisle G. Fraser for estimate No. 2 for construction of a storm sewer in loth Street Northwest from Cascade Creek to 7th Avenue Northwest, which was read. Upon motion b;; Anderson, second by Theel, that the said resolution be adopted as read, and all present voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Morris introduced a resolution appropriating $2,153.26 from the P.I.R. Fund and ordering payment made to C. M. Boutelle for estimate No. 2 for construction of a curb and gutter on 3rd Street Southeast from 6th to llth Avenue Southeast, which was read. Upon motion by Akenhead, second by Anderson, that the said resolution be adopted as read, and all present voting in favor thereof, rresident Lemmon declared the said resolution duly passed and adopted. Alderman Morris introduced a resolution appropriating $1,272.15 from the P.I.R. Fund and ordering payment made to Gordon Winslow Company for estimate No. 1 for construction of a curb and gutter on 7th Avenue Northwest from loth to llth Street Northwest, which was read. Upon motion by Theel, second by Akenhead, that the said resolution be adopted as read, and all present voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Anderson brought up the matter of a petition for bus service on 9th (Avenue Northeast and the same was referred to the Police Committee and the Acting Chief i of Police to meet with representatives of the Rochester Bits Lines, Inc. Alderman Theel stated that he had made an inspection at the City Fire Hall and that certain repairs should be made. Upon motion by Morris second by son' Anderthe I matter was referred to the Public Grounds Committee to have the necessary repairs ' completed. President Lemmon stated that he had received a call from the General Mills asking that their lease be extended on the Mill Building. After discussing the matter a mat ion was made, by Theel, secoadl by. Kennedy, instructing the City Clerk to notify all tenants in the Mill Building that the City would continue to rent the property on the present basis for a period of one year. President Lemmon also stated that Mr. Kris Nielson had proposed to remove fill from. Silver Lake at 150 per yard and the matter was referred to the Public Grounds Committee.
