Minutes of an adjourned regular meeting of the Commca Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City on
October 11, 194s.
Upon motion by Theel, second by Morris, Alderman Austin Kennedy was appointed
President pro tam of the Common Council,.
President pro tam Kennedy called the meeting to order at 7: j0 o o clock P. IM. ,
the following members being present: Aldermen.Akenhead, Anderson, Kennedy, Kjerner,
Morris and Theel. Absent. President Lemmon.
Upon motion by Theel, second by Kjerner, the minutes of the .meeting of 0
October 4, 1949 were approved.
The following copy of a resolution adopted by the Board of Education at a
meeting held on September 22, 1949 was read and the same was ordered placed on file:
"BE IT RESOLVED, by the Board of Education of School District
Number Eight (S). in Olmsted County, Minnesota, being the
school district in the limits of the City of Rochester, Olmsted
County, iinnesota, that there be, and is, hereby levied upon
all taxable property in said district a special school tax for:
iMaint enance 911, 530.00
Capital Outlay. 62,890.00
Debt Service 116,650.00
or a grand total of one million ninety one thousand seventy
and 00/100 dollars ($1,091,070.00) for the use of said
district, and the Clerk of said Board of Education is hereby
Instructed to notify the Common Council of said City of
_Rochester, Minnesota, and to request their approval of the
said Levy in accordance with the provisions of the City
Charter."
Alderman Anderson introduced the following resolution which was read:
"Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the resolution passed and adopted September 22,
1949, by the Board of Education of School District No.
8 levying the "sum of $1,091,070.00 upon the taxable
property of said School District for the year 1948, be
and the same is hereby approved in the sum of
$1, 091, 070.00. "
Upon motion by :Morris, second by Kjerner, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Kennedy declared the said
resolution duly passed and adopted. •
A notice of claim for personal injury to Marian Clare was read and upon motion
by Theel, second by Akenhead, the same was referred to the City Attorney.
The request of Lee M. Nelson, Superintendent of Utilities, to either rent or
purchase the antenna tower on the City Hall was
read and upon motion by Akenhead, second
by Theel, the matter was referred to the Police
Committee and the
Acting Chief of Police.
A communication from Mrs. Charles I.
Turner in regard to
bus service for
Homestead Addition was read and upon motion by
Anderson, second by
Theel, the matter
was referred to the Police Committee.
A notice from the United States Conference
of Mayors of
the .19T9 Annual
Conference to be held in Washington D. C. next winter was read and upon motion by Theel,

second by Kjerner, the same was ordered placed on file.
The Mayor's, veto of an ordinance entitled, "An Ordinance regulating and
licensing real estate brokers and real estate salesmen, defining real estate brokers,
and real estate salesmen, as used in this Ordinance; providing the violation of certain
provisions of this ordinance shall be a misdemeanor and providing certain penalties
therefore", was read: A group of real estate brokers were present at the meeting and

urged that the Ordinance'be adopted over the Mayor's veto. No one was present opposing
the adoption of the Ordinance.A mothnwas_ma.de: by Anderson, second by Theel, that the Mayor;i s
and upon roll call and
veto be overridden,! all voting in favor thereof, President pro tem Kennedy declared the
veto of the said ordinance duly overridden.
The Mayor's veto of an ordinance entitled, "An Ordinance to authorize the
installation, regulation, control and use of parking meters in the City of Rochester,
Minnesota", was read; After hearing a discussion on the matter of fines for parking
violations by members of the Retail Merchants Division of the Chamber of Commerce,a
and upon roll call and
motion was made by Theel, second by Morris, that the Mayor's veto be overridden,/all
voting in favor thereof, President pro tem Kennedy declared the veto of the said
ordinance duly overridden.
A petition for the grading, surfacing and oiling of the East and West alley inJ
Block 5 of Head and McMahon's Addition was read and upon motion by Akenhead, second by
�Theel, the same was referred to the Street & Alley Committee and the City Engineer.
The City Engineer's trial balance for the month of September, 1948 was read
and the same was ordered placed on file.
The reports of th-e Clerk of the Municipal Court for the week'ended October 2, !

1948 showing total criminal fines and costs collected $1103.16, civil fees received I
$9.95 and conciliation court fees $2.50 and for the week ended October 9, 1949 showing
i
total criminal fines and costs collected $1145.00, civil fees received' $1.70 and 1
conciliation court fees $4.Oo, were each read and having been previously approved by
the City Attorney, President pro tem Kennedy ordered that the same be placed on file.

The application of the Rochester Yellow Cab Corporation for transfer of
i
taxicab license No. 28 from a five passenger Buick with Minnesota license No. 216-018 to'1
a 1947 4 door Pontiac with Minnesota license No. 1160-191 and taxicab license No. 21 from,
a five passenger buick with Minnesota license No. 216-oog to a 1947 4 door Dodge with
Minnesota license No. 532-406, was read and upon motion by Akenhead, second by Kjerner,
the transfers were granted.
The contract bonds of Universal Motors, Inc. in the amount of $1, 095. 33 with
the Western Surety Company as surety and Hewitt Rubber Company in the amount of $2,077.60
with the American Surety Company as surety, were each read and the same were referred to
the Mayor for his approval. 11
Mr. John. Young was present and requested that funds be included in the budget !I

for the installation of street lights at -4th Avenue and 7th Street Southwest and 6th ;I
lAvenue and 9th Street Southwest. Upon motion by Akenhead, second by Morris, the matter
was referred to the Lighting Committee and the Public Utility Department.

Alderman Akenhead introduced the following resolution which was read:
"Be it and it is hereby resolved by the Common Council of the
City of Rochester, Minnesota:
That the said Common Council does hereby assess and levy upon
the taxable property in the City of Rochester, for taxes for the
year 1948, the amount aggregating $997,970.00, the following sums
being levied for the several funds of said City, viz:
For the General Fund $ 259,500.00
For the Street & Alley Fand 86,500.00
For the Bridge Fund 86,500.00
For the Sewer Fund 51,900.00
For the Fire Protection Fund 212,790.00
For the Park- Improvement Fund 65, 200.00
For . the Lighting Fund 64, 010. 00
For the Library Fund 34,600.00
For th e Band Fund 8, 6 50.00 i
For the Interest Fund none
For the Sinking Fund none
For the Firemenis Relief Fund 1,730.00
For the Police Relief Fund 5,190.00

Upon motion by Akenhead, second by Kjerner, that" the said 'resolution be adopted
as read, and all voting in favor thereof, President pro tem Kennedy declared the said
resolution duly passed and adopted.
Alderman Kjerner introduced a resolution authorizing the City Engineer to
publish, notice regarding construction of sidewalks, which was read.
Upon motion by Anderson, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Kennedy declared the said
resolution duly passed and adopted,
Alderman Kjerner introduced a resolution appropriating $412.50 from the
General Fund and ordering payment made to Whiting Press, Inc. for office supplies, which
was read.
Upon motion by Akenhead, second by Kjerner, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Kennedy declared the said
resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $1, 202.95 from the
General Fund and ordering payment made to Standard Oil Company for cutback asphalt, •
which was read.
Upon motion by Kjerner, second
by Norris,
that the
said resolution be adopted
as read,
and all voting in favor thereof,

Alderman Kjerner introduced a resolution
appropriating
$207.35 from the

Company for mixing and

Alderman Theel introduced a resolution appropriating $763.70 from the General
Fund and ordering payment made to Rochester Post Bulletin for publishing notices, dog it
lists, minutes and ordinances, which was read.
Upon motion by Morris, second by Akenhead, that the said resolution be adopted';
as read, and all voting in favor thereof, President pro tem Kennedy declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $1883.73 from the General
Fund, $1427- 08 from the Street & Alley Fund, $122. 00 from the P.I.R. Fund and $260. 50

equipment during September, 1948, which was read.
Upon motion by Kjerner, second by Theel, that the said resolution be adopted

Alderman Theel introduced a resolution appropriating- $42.25 from the General
Fund and $207.64 from the Street & Alley Fund and ordering payment made to Firestone

Stores for tires, repairs, etc.., which was read.

Upon motion by Akenhead, second by Morris, that the said resolution be adopted':
as read, and all voting in favor thereof, President pro tem Kennedy declared the said
resolution duly passed and adopted.
Alderman Thee! introduced a resolution 'appropriating $51.20 from the General
Fund,.$1032.04 from the Street & Alley Fund and $576.70 from.the P. I. R. Fund and
ordering payment made to Rochester Sand & Gravel Company for sand and gravel, which was
r ead.
Upon motion by Theel, second by Kjerner, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Kennedy declared the .said
resolution duly passed and adopted.

Alderman Theel introduced a resolution appropriating $917.85 from the P.I.R.
Fund and ordering payment made to Gordon Winslow Company for estimate No. 5 for constr-
uction of a curb and gutter on 6th Avenue Southeast, which was read. i

Upon motion by Morris, second by Anderson, that the said resolution be adopted
as read, and all voting in favor. thereof, President pro tem Kennedy declared the said II

Alderman Morris introduced a resolution appropriating $1,401.94 from the-P.I.R.
Fund and ordering Payment made .to Carlisle G. Fraser for estimate No. 2 for construction:
of a sanitary sewer and wate-rmain in 1st Avenue Southwest from 6th to 7th Street

Southwest, which was read. !
Upon motion by Akenhead, second by Kjerner, that the said resolution be adopted

resolution duly passed and adopted.

Alderman Morris introduced a resolution appropriating $923.69 from the F.I.R.
fund and ordering payment made to Carlisle G. Fraser for estimate No. 2 for installation
of a watermain in 2nd Avenue Northwest from 13th to 132 Street Northwest, which was read.
Upon motion by Theel, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President pro ten Kennedy declared the said
resolution duly passed and adopted.
Alderman Morris introduced a resolution appropriating $397.42 from the Park
Improvement Fund and ordering payment made to the Collector of Internal Revenue for
admission taxes collected during September, 1948, which was read.
Upon motion by Kjerner, second by Akenhead, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Kennedy declared the said
resolulion duly passed and adopted. `
, Alderman Akenhead introduced a resolution appropriating $6,427.84 from the
Airport Construction Fund and ordering payment made to Acchie & Armstrong for professional
services on State Project 5501-02, which was read.
Upon motion by Akenhead, second by Morris, that - the said resolution be adopted
as read, and all voting in favor thereof, eresident pro tem Kennedy declared the said
resolution duly passed and adopted.
Alderman Akenhead introduced a resolution appropriating $45,257.60 from the
Airport Construction Fund and ordering payment made to Fielding & Shepley, Inc. for
partial payment on* State Project 5501-02, which was read.
Upon motion by Anderson, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tern Kennedy declared the said
resolution duly passed and adopted.
Alderman Akenhead introduced a resolution appropriating $2,992.00 from the
Parking Meter Fund and ordering payment made to Duncan Meter Corporation for one half
of collections from parking meters during September, 1948, which was read.
Upon !notion by Morris, second by Anderson, that the said resolution be'adopted
as read, and all voting in favor thereof, President pro tem Kennedy declared the said
resolution duly passed and adopted.
Alderman Akenhead introduced a resolution granting five dance permits to
Archie Dieter, which was read.
Upon motion by Akenhead, second by Theel, that the said resolution be adopted
as read, and all voting in favor. thereof;- President pro tem 'tiennedy declared the said
resolution duly passed and adopted.
The following claims were read and upon motion by Akenhead, second by Kjerner,
the same were approved and the mayor and City Clerk were authorized and directed to
draw warrants upon the City Treasurer and make payments accordingly:
