Minutes of an adjourned regular meeting of the Common Council of the City of l

,ochester. Minnesota, held in the Council Chambers in the City Hall, in said City on
ovember 15. 1949.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the following
embers being present: President Lemmon, Aldermen Akenhead, Anderson, Kennedy, Kjerner,
orris and Therl. Absent: None.

Upon motion by Theel, second by Morris, the minutes of the meeting of November
948 were approved.
President Lemmon stated this as being the time and place set for a hearing on

Representatives from the Women's Relief Corps appeared at the Council meeting
nd complained about an $8.00 charge made for the use of the community room during the
ternoon and evening. President Lemmon referred the matter to the Finance Committee.

A notice from the State of Minnesota, Department of Aeronautics, that -the said
epartment had reduced the amount of "Application for Grant Payment" No.' 3, from'
1 50.246.79 to $33,113.43 for State Aid Project �501-02, Federal Project 9-21-047-801 was
ead and upon motion by Kennedy, second by Morris, the same was ordered placed on file.
A notice by the Mayor that a summons and complaint had been served on the City
herein Marian Clare has started suit against the City of Rochester for damages and j
isbursements in the amount of $10,000.00 for personal injury was read and upon motion by:
kenhead, second by Kennedy, the same was referred to the City Attorney.

transmitting an opinion of the Attorney General in which certain provisions of the Water
Pollution Control Act regarding submission and approval of plans.are discussed, was read
and the same was ordered placed on file..
A request by the Odd Fellows Lodge to operate a bingo game on November 13, 1949
in their Lodge Hall and also a request from the Royal Neighbors of America for permission
tooperate a bingo game at their regular meetings held once a month were each read and
upon motion by Theel, second by Kjerner, both requests were ordered placed on file.
A notice by the Police Civil Service Commission that Patrolman Axel Moberg had
been granted an extension of 60 days leave of absence without pay, effective as of •
November 1, 1948 was read and' upon motion by Akenhead, second by Theel, the said leave of
absence was granted.
An Ordinance entitled, "An Ordinance establishing minimum standards for plate
in the City of Rochester, Minnesota, and providing regulations for the submission of
plats to the Common Council for approval" which had been returned to the City Clerk on
November 9, 1948 unsigned by the Mayor, was again read and President Lemmon declared same
duly adopted, the same
having been neither approved or vetoed
within five days of the
date it was presented to
the Mayor.

of Rochester as non -conservation lands was read and upon motion by Kennedy, second by
Morris, the said classification was approved..
The Mayor's request that the Common Council again adopt an ordinance entitled,
"An Ordinance relating to unlawful detainer actions and to the Issuance of Writs of
Restitution therein in Certain Cases During an Emergency declared to exist"was read.
Upon motion by Theel, second by Akenhead, the City Attorney was instructed to prepare
the Ordinance as requested.
A certificate of Insurance issued by the Allied Mutual Casualty Company of
Des Moines, Iowa certifying that Clarence J. McDonald is covered by insurance as required •
by ordinance when doing concrete construction work on the streets of the City of
Rochester, Minnesota was read and the same was ordered placed on file.
An agreement between the City of Rochester and the State of Minnesota. Department
of Highways, for the maintenance of trunk highways within the corporate limits of the
City of Rochester was read and the same was referred to the City Engineer for further
negotiations with the State Highway Department.
The request of Roy Hubler for additional street lighting on loth Avenue
Southeast between 4th and 6th Street Southeast was read and President Lemmon referred
same to the Lighting Committee.
The following copy of a resolution passed by the Public Utility Board was read

and the same was ordered placed on file:
"WHEREAS, it is.necessary that additional funds be made
available for meeting payments, due in the near future, on the II
Silver Lake Plant construction.
THEREFORE, be it, and it is hereby resolved by the Public i)
Utility Board of the City of Rochester, Minnesota, that .the
Sinking Fund Commission of the said City be and is hereby
requested to make available approximately $250,000.00, and l

recommended to the Sinking Fund Commission that the following

The following copy of a resolution passed -by the Sinking Fund Commission was ;I
read and upon motion by Akenhead, second by Kjerner, the action of the said Sinking Fund
Commission was approved:
"WHEREAS, it is necessary that additional funds be made available

Fund of the City of Rochester, Minnesota:
That the said bonds be sold at.the market value of same, and
Be it further resolved: That the proceeds from the.sale of the
said bonds together with the amounts of $17,500.00 and $662.4o
uninvested in the above funds be transferred from the Sinking
Fund to the Public Utility Fund of the City of Rochester,Minnesota."
The recommendations of the Board of Zoning that Anna A. Har be granted
permission to construct an addition to her residence on Lot 23, Block 1, Ireland's
Addition, to be used as a dining room -and that Cleo and Clayton Lyke be granted
permission to build an addition to be used as. a garage on the West side of his present
building located on the East 80 feet of Lot 9 in Block 38 of Morse & Sargentls.Addition,',
known as 924-926 Fourth Street Southeast but that no change be made in the zoning of
the said property, were each read and upon motion by Anderson, second by Kjerner, granting
of the said permits was approved, subject to the approval of the City Attorney. j
The following recommendation by the Board of Zoning was read and upon motion
by Kennedy, second by Akenhead, the City Attorney was instructed to draw an amendment

to the Zoning Ordinance placing the said described lands in a commercial zone;
November 15,1949
"To the Honorable Mayor and
Members of the Common Council
City of Rochester, Minnesota
Gentlemen:
The petition of Clarence Thompson to have his property
on 2nd Street Southwest zoned as commercial area was again
considered by the Board of Zoning together with other real
estate abutting on the south side of 2nd Street Southwest
between 4th and 6th Avenues Southwest.
On July 21, 1941 a recommendation was approved by the
Council that all abutting property on both sides of 3rd
Street Southwest between'4th and 6th Avenues be zoned as
commercial.
The Board of Zoning now recommend that that part of
Block 15, Original Flat -and also that part of Blocks 1 and
14 in Head 63 McMahon's Addition not previously approved as
a commercial zone be now rezoned as commercial property.

The recommendation of the Police Committee that the Council reject the request
for a stop sign at Ninth Street and Fourth Avenue Southeast was read and upon motion by
Kennedy, second by Akenhead, the recommendation was approved.
The recommendation of the Street & Alley Committee that the proposal of the
Minnesota Highway Department to obtain limited access'to trunk highway 63 north of the
North Broadway Bridge be approved in principle, but that the exact designation of such
access points within the City Limits of the City of Rochester be withheld until the City
can prepare a comprehensive plan for -the development of the areas on both sides of North
Broadway and determine where street openings should be placed was read and upon motion
by Akenhead, second by Morris, the recommendation was approved.
The recommendation of the Street & Alley Committee that bids be taken for the
furnishing and installation of one 85,000 B.T.U. combination gas and propane unit for
the City warehouse was read and upon motion by Kennedy, second by Theel, the recommendation
was approved and the City Clerk was instructed to advertise for bids to be received and
opened at the meeting to be held on December 6, 1948.
The recommendation of the Sewer Committee that bids be taken for furnishing
of gas unit heaters, -to be operated on propane until natural gas can be obtained, to
replace the present steam heating plant in the Sewage Disposal Plant was read and upon
motion by Theel, second by Anderson, the recommendation was approved and the City Clerk
was instructed to advertise for bids to be received and opened at the meeting to be held
on December 6, 1948.
The recommendation of the Sewer Committee that the bid of Elk River Concrete
Products Company in the amount of $5,151.36 for the furnishing of reinforced concrete
sewer pipe be accepted and checks returned to the unsuccessful bidders was read and upon
motion by Kjerner, second by Morris, the recommendation was approved.

A recommendation by the Lighting Committee that the Christmas Street decorati.olns
be erected by employees of the Public Utility Department and the Rochester Fire
Department and that the work be done during the.eaid employees regular .hours was read.
Upon motion by Kennedy, second by Anderson, the recommendation was approved with the
provision that if'Additional help is needed, local labor will be employed.
The City Engineer s trial balance for the month of October, 1948 .was read and
the same was ordered placed on file.
A statement of receipts and, disbursements in. the Park Improvement Fund from ;I
April through October, 194.8 was read and the same was ordered placed on file.
The City Weighmasterts report for the month of October, 1948 showing 604 loads)
weighed and receipts in the amount of $60.40 was read and President Lemmon referred the!

same to the Finance Committee. i
The reports of the City Treasurer for the months of August and September, 1948;

were each read and the same were ordered placed on file. j
The reports of the Clerk of the Municipal Court for the week ended October 30,',
1948 showing total criminal fines and costs collected $587.50, civil fees received $1.351
and conciliation court.fees $1.75; for the week ended November 6, 1948,showing total
criminal fines and costs collected $550.00, civil fees received $6.35 and conciliation
court fees $2.00; and for the week ended November 13, 1948 showing total criminal fines
and costs collected $943,00, civil fees received $2.95 and conciliation court fees $4.00I,
were each read and having been previously approved by the City Attorney, President Lemmon
ordered that the same be placed on file, i

The applications of E. M. Outwin 'for cigarette license and soft drink license it
were each read and upon motion by Anderson, second by Theel,.the licenses were granted.!!
The application of Everett A. Engel fora Journeyman Electricians License was
read and upon motion by Kjerner, second by Anderson, the license was granted.
The applications of the Yellow Cab Company for transfer of taxicab license No.
19 from a 5 passenger buick to a 1947 Chevrolet Fleetmaster and taxicab license No. 31
from a 5 passenger buick License No. 216-022 to a 5 passenger Pontiac with License No.
532-820 were each read and upon motion by Akenhead, second by Theel, the transfers were�l

The application of William T. Meany for a sign permit was read and upon motion'

by Theel, second by Kjerner, the permit was granted. l
C. E. Ginther, Chief of the Rochester Fire Department, presented specification's
for remodeling Seagraves 1000 gallon pumper and also specifications for a Chassis to be'

used by the Rochester Fire Department.A motion was made by Akenhead, second by !l
Anderson, and all voting'in favor thereof, that the specifications be accepted and bids
be called for on December 6, 1948.

Concrete Products Company for furnishing reinforced concrete sewer pipe, which was read.
Upon motion by Kennedy, second by Anderson, that the said resolution be adopted
as.read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Kennedy introduced a resolution levying special assessments for the
grading in Fratzke's First Sub -Division, Fratzke's Homestead Addition and Silver Lake
Sub -Division, which was read.
Upon motion by Akenhead, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution •
duly passed and adopted.
Alderman Kennedy introduced a resolution levying special assessments for the
grading in Mohn and Hodge Sub -Division, which was read.
Upon motion by Kjerner, second by Theel, that the said resolution be adopted
as read, and all voting in favor. thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Kennedy.introduced a resolution levying special assessments for the

Public Utility Board requesting the Sinking Fund Commission to make available approximately
$250,000.00, which was read.
Upon motion by Akenhead, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Akenhead introduced a resolution approving the proposal of the

Alderman Theel introduced a resolution appropriating $487.41 from the General
Fund and $1,460,92 from the Street & All-ey Fund and ordering payment made to City of

Rochester for gasoline furnished police and street and alley departments, which was read':

Alderman Theel introduced a resolution appropriating $7.20 from the General

Alderman Theel introduced a resolution appropriating $55.10 from the General

Alderman Theel introduced a resolution appropriating $1490.65 from the General
Fund, $1537.95 from the Street & Alley Fund, $288.50 from the Sewer Fund, $44.13 from the
P.I.R. Fund and $6: 00 from the Permanent Improvement Fund and ordering payment made to
the Street & Alley Fund for use of equipment during October, 1948, which was read.
Upon motion by Akenhead, second by Morris, that the said resolution,be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Theel introduced a resolution appropriating $219.23 from the Street &
Alley Fund and ordering payment made to Firestone Stores for tires, tubes, battery, etc., •
which was read.
Upon motion by Kjerner, second by Akenhead, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Theel introduced a resolution appropriating $449.00 from the Street &
Alley Fund and ordering payment made to Wm. H. Ziegler Co., Inc. for one snow plow, which
was read.
Upon motion by Kennedy, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the said
resolution -duly passed and adopted.
Alderman Theel introduced a resolution appropriating $1;133.88 from the P.I.R.
Fund and ordering payment made to Leon Joyce for estimate No. 3 for grading and surfacing
in Mohn and Hodge Sub -Division, which was read.
Upon motion by Theel, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $1;835.47 from the P.I.R.
Fund and ordering payment made to Leon Joyce for estimate No. 3 for grading and surfacing
in Fratzkess Addition and Silver Lake Sub -Division, which was read.
Upon motion by Anderson, second by Kennedy, that the said resolution be adopted •
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Theel introduced a resolution appropriating $1,599.80 from the Street
& Alley Fund and $28.75 from the P.I.R. Fund and ordering payment made to Rochester
quarry Company for gravel-, which was read.
Upon motion by Akenhead, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $411.57 from the Sewer
Fund and ordering payment made to Municipal Equipment Company for�rod reel and stand and
l flexible power drive, which was read.

Upon motion by Kjerner, second•by-Anderson, that the said resolution be adopte
gas•read, and all voting in favor thereof, President Lemmon declared the said resolution
.duly passed and .adopted.
Alderman Anderson introduced a resolution appropriating $430.42 from the
Lighting Fund and ordering payment made to City of Rochester, Public Utilities for
lighting at airport, which was read.
Upon motion by Kennedy, second by Morris, that the said resolution be adopted
as read, and -all voting in favor thereof, President Lemmon declared the said resolution
duly passed and•adopted.
Alderman Anderson .introduced a resolution appropriating.$41,162.65.from the
Airport Construction Fund and ordering -.payment made to Fielding & Shepley,.Inc. for
partial -payment on -estimate No. 2, State Project 5501-02,~ which was read.
Upon motion by Akenhead, second by ltjerner, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman -Anderson introduced a resolution levying special assessments for -

Alderman Kennedy brought up the matter of purchasing lands for the approach to
the proposed bridge connecting 2nd Avenue Southeast with, 3rd Avenue Southeast. Mr. Theo.'

valuing the real estate to be purchased and used in connection with the construction of it
the proposed bridge..
Alderman Theel stated that a new oil burner heating unit would be needed at the
dog kennels and upon motion by Anderson,, second by Kjerner., the matter was referred to ;I

the Public Grounds Committee with power to act. I

Mr. Garnet Spring, Building- Inspector, asked permission to attend a joint

meeting of the State Planning and Zoning and Building Code Commission to be held at the

University of Minnesota. Upon motion by Akenhead, second by KjerAer, Mr. Spring was
authorized to attend the said meeting at City expense.
Upon motion by Kennedy, second by T heel, the City -Attorney was instructed to
prepare an amendment to the Ordinance regulating advertising in the public parka -of the II

City of Rochester, Minnesota.
An Ordinance entitled, "An Ordinance establishing a Commission to plan for their
physical development of the City of Rochester as.authorized by Laws of 1937, Chapter I'

287, as. amended", was given its first reading.
Upon motion by Kennedy, second by Anderson, the meeting was adjourned.
