Minutes of an adjourned regular meeting of the Common Council of the City of
Rochester, Minnesota held in the Council Chambers in the City Hall in said City on
December 6, 194s.
President Lemmon called the meeting to order at 2:00 o'clock P.M., the following
members being present: President Lemmon, Aldermen Akenhead, Anderson, Kennedy, K jerner,
Morris and Theel. Absent: None.
Upon motion by Akenhead, second by Morris, the minutes of the meetings of
November 15th'and 22nd, 1948 were approved.
President Lemmon stated this as being the time and place set for receiving and •
opening bids for a gas unit heater to be used at the City Warehouse. The bid of Alpek
Sheet Metal Works in the amount of $441.70 was received and opened.
President Lemmon stated this as being the time and place set for receiving and
opening bids for gas unit heaters for the Sewage Disposal Plant. The bid of Alpek Sheet
Metal Works in the amount of $2,528.00 was received and opened.
President Lemmon stated this as being the time and place set for receiving and -
opening bids for remodeling Seagraves 1000 Gallon Pumper at the Rochester Fire Department.
The bids of Power Brake and Equipment, Inc. in the amount of $3,422.50 and Flour City
Body Corporation in the amount of $3,597.00 were each received and opened.
President Lemmon stated this as being the time and place set for receiving and
opening bids for a chassis for fire equipment to be used at the Rochester Fire Department.
The bids of Universal Motors, Inc. in the amount of $3,334. 15 and Storlie Sales & Service
in the amount of $3, 686. 88 were each received and opened.
A letter from the Public Health & Welfare Department advising the Common
Council that tke cost of the Health Center Building was estimated at $225,562.50,
$15,000.00 of this amount would be available for the purchase of equipment. The Board
further advised that an application for a grant of Federal funds in the amount of
$75,187.50 had been applied for, this amount together with $150,375.00 now on hand would
provide the $225,562.50. The letter was ordered placed on file.
A communication from the Board of Public Health & Welfare transmitting plans
and specifications for the Public Health Center Building and requesting the Common
Council's approval of the same was read and ordered placed on file.
The following resolution adopted by the Rochester Liquor Dealers Association
was read:
"WHEREAS, Retail Liquor Dealers of Rochester have large
investments in real estate and business property; and
WHEREAS, Retail Liquor Dealers of Rochester, operating
under a private enterprise system of operation, employ a
large number of persons; and
WHEREAS, the Liquor Dealers and their employees contribute
substantially to the econcmic welfare of our City through the
expenditure -of wages and salaries, and through the payment of
personal property and real estate taxes; and
WHEREAS, the persons engaged in the retail sale of alcoholic
beverages are local Citizens who actively participate in the
activities of this Community; and

WHEREAS, there has been discussion by the Rochester City jl
Council on the proposal of the Minnesota League of Municipalities
to recommend action by the Minnesota Legislature to permit
Cities of all classes to establish municipal liquor stores,as
a substitute for private enterprise operation; i
NOW THEREFORE, BE IT RESOLVED by the Rochester Liquor Dealers
Association, in meeting assembled this 16th day of November, !I
1949, to respectfully request the City Council of Rochester to
oppose any such efforts and action; and
BE IT FURTHER RESOLVED, that the. Rochester Liquor_ Dealers
Association request the Rochester City. Council to provide an �JJ'
opportunity for representatives of the Liquor Dealers to appear
before the City Council to present facts and information
relative to the adve.ntages of the' present private enterprise
system of sale of alcoholic beverages.

made by Morris, second by Theel, and all voting in favor thereof, that the action of the
Common Council on November 1, 1949 approving the following recommendation of the Minnesota
League of Municipalities be rescinded:
"that the League should recommend to the 1049 legislature that first,
second and third class cities should have the right, subject to
approval by popular referendum in each case, to establish municipal
exclusive off -sale liquor stores, along with continuation of private
licensing of on -sale liquor establishments".
Alderman Anderson introduced an Ordinance entitled "An Ordinance relating to
(Unlawful Detainer Actions and to the Issuance of Writs of -Restitution therein in certain
cases during an emergency declared to exist", which was given its first reading. Among
those present at the meeting, Mr. H. S. Patterson, .Mr. Emil Reiter and. Mir. 0. G. Schaefer;

protested the adoption of this Ordinance.
A communication from Nicols, Dean & Gregg requesting that a loading zone on a
15 minute parking zone be established in front of their place of business was read and
11 pon motion by Anderson, second by Theel, the matter was referred to the', Acting Chief of
Police, with power to act.
. A communication.f rom the Board of Park Commissioners requesting that the
Common Council instruct the City Attorney to notify the United States Fidelity &
Guaranty Company of New York that the Barrett Company.had not repaired a defective roof
tyo Civic Auditorium was read.. Upon motion by Kennedy, second by Kjerner, the
City Attorney was instructed to take any action necessary in the matter.,
A request from Esther A. Schwanke for a refund in the amount of $96.65 covering
Van assessment against her property for grading was read and the same was ordered placed
on file.
The following communication .was read and ordered placed on file:

A letter from
Knute Olson, City Assessor, calling attention
to the
filing of
deeds for two lots purchased
for street openings in Lot 13, Auditor's
Plat "Al' was read
and the same was ordered
placed on file.
An assignment
in the amount of $400.00 given by Carl Hooper
to the
Olmsted
County Bank and Trust Company and a request by the Olmsted County Bank and Trust Company
to return an assignment dated July, 3, 1949 were each read and a motion was made by •
Kennedy, second by Akenhead, that the assignment in the amount of $1100.00 be approved.
An invitation from the League of Minnesota Municipalities to attend a legislative
conference to be held on December 10, 1949 at the Lowry Hotel, St. Paul was read and the
same was ordered placed on file.
A rental agreement between the City of Rochester and General Mills, Inc. for
space in the Mill Building was read and upon motion by Theel, second by Anderson, the
agreement was approved and the Mayor and City Clerk were authorized to execute same.
The City Engineers preliminary estimate of cost in the amount of $651.00 for
the construction of a sanitary sewer in the boulevard on the east side of Fourth Street
Southeast from the manhole at the center of Fourth Avenue to a point 185 feet east was
read and ordered placed on file.
The Mayors emergency order given to the City Clerk for the purchase of
approximately 10,000 gallons of gasoline was read and upon motion by Anderson, second by
Morris, the same was approved.
The petition of Harold Bethke and Harlan F. Tracy for permission to use the
building at the rear of 815 North Broadway as a sign painting shop was read and upon
motion by Theel, second by Akenhead, the same was referred to the Board of Zoning.
A petition to have the property on the South side of 2nd Street Southwest
between 6th and 7th Avenue Southwest changed from a multiple dwelling to a commercial
zone was read andupon motion by Anderson, second by Theel, the same was referred to the
Board of Zoning.
A notice of damage to a car owned by,Gary D. Davis which
was struck by a fire
department truck was read and President Lemmon referred the same to
the City Attorney.
The following resolution adopted by the Public utility Board
was read and the
. same was ordered placed on file:
"Be it, and it is hereby resolved by the PUBLIC UTILITY
BOARD
of the City of Rochester, Minnesota that the Common Council
of the
said City be, and is hereby requested to authorize the
said Board
to enter into the following contracts:
(1) with the OKINITE COMPANY for 5,000 ft.-#4-3
conductor,
5-kv, self-supporting, pre -assembled aerial
cable; and
for 17,000 ft. of various sized, varnished,
cambric
cable at prices of $3,535•00 and $11,650.25
respectively.

(2) with the GENERAL ELECTRIC SUPPLY CORPORATION for
30,000 lbs. of Weatherproff wire at a. price
$9,437.40 and 7,000 ft. of service drops cable
at a price of $1, 247.00.
Said companies being the lowest responsible bidders."
A request by Henry and Catherine Waters for a refund in the amount of $64.46
or a sanitary sewer and watermain assessment against their property was read.. President
emmon referred the same to the Sewer Committee and the City Engineer for report at the
eeting of December 20, 1948.
The recommendation of the Sewer Committee that a sanitary sewer be constructed
in the boulevard, on the South side of Fourth Street Southeast from the present manhole
at the center of Fourth Avenue to a point 185 feet east to provide sewer for the
proposed Health Center the cost to be paid from the Sewer Fund, was read and upon motion
by Theel, second by Anderson, the recommendation wa-a approved.
The recommendation of the Public Grounds Committee that the bid of Alpek
heet Metal Works for the furnishing and installation of one gas unit heater in the City
arehouse in the amount of $441.70 be accepted was read and upon motion by Akenhead,
econd by Morris, the recommendation was approved.
The recommendation of the Public Grounds Committee that action o.n the bid of

ewage Disposal Plant be postponed until the meeting of December 20, 1948 was read and
pon motion by Morris, second by Akenhead, the recommendation was approved.
The recommendation of the Fire Committee that the bid of Power Brake &
quipment Company for remodeling the Seagraves 1000 gallon pumper in the amount of
3,422.50 be accepted and checks be returned to the unsuccessful bidders was read and
pon motion by Kjerner, second by.Kennedy, the recommendation was approved.
The recommendation of the Fire Committee that the bid of Universal Motors, Inc.',
or the furnishing of a chassis for use in the Fire Department in the amount of $3,334.15

ennedy, second by Theel, the recommendation was approved.
The Lockup Inspection Report submitted by the Health Officer was read and the
ame was ordered placed on file.
The reports for the month of November., 194E of the Building Inspector showing
ees received for building permits issued in the amount of $216.00; of the Electrical
Inspector showing fees received for electrical permits issued in the amount of $106.00;
of the Plumbing Inspector showing fees received for plumbing. permits issued in the amount
f $329.25; and of the Heating Inspector showing fees collected for heating permits issu(
n the amount of $39.75, were each read and the same were, referred to the Finance
ommittee.
The report of the City Treasurer for the month of October, 1948 'was read and
the same was ordered placed on file.

The report of the City Weighmaster for the month of November, 1948 showing
536 loads weighed and receipts in the amount of $53.60 was read and President Lemmon
referred the same to the Finance Committee.
The reports of the Clerk of the Municipal Court for the week ended November 20,
1949 showing total criminal fines and costs collected $517.00; civil fees received $6.85
and conciliation court fees $1.00; for the week ended November 27, 1948 showing total
criminal fines and costs collected $721.49 and conciliation court fees $.50; and for the
week ended December 4, 1948 showing total criminal fines and costs collected $460.00,
civil fees received $10.05 and conciliation court fees $2.50, were each read and having .
been previously approved by the City Attorney, President Lemmon ordered that the same
be placed on file.
The applications -of Nick K. Chonis for license to sell soft drinks and license
to sell cigarettes were each read and upon motion by Kjerner, second by Theel, the
licenses were granted.
The application of Lysne Construction Company for a permit to move a house
over certain streets in the City of Rochester was read and upon motion by Akenhead,
second by Kennedy, the permit was granted. `
An indemnity bond in the amount of $15.04 covering a lost warrant payable
to the Chicago Northwestern Railway Company was read and upon motion by Kjerner, second
by Akenhead, the bond was approved, sursty thereon accepted and it was ordered that the
same be placed on file.
Alderman Kjerner introduced a resolution granting a public dance permit to
Mike Sternberg, which was read.
Upon motion by Kjerner, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said- resolution
duly passed and adopted.
Alderman Kjerner introduced a resolution authorizing the Public Utility Board
to enter into contract with the Okinite Company and the General Electric Supply Company,
which was read.
Upon motion by Akenhead, second by Theel, that• the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $852.00 from the
General Fund and ordering payment made to Rochester Post Bulletin for publishing notices,
minutes, ordinances, dog lists, etc., which was read.
Upon motion by Theel, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $227.69 from the

cars, which was read.
Upon motion by Morris, second by Anderson, that the said resolution be adopted

Alderman Akenhead-introduced a resolution appropriating $34.13 from the General
Fund, $206.25 from the Street & Alley Fund and $63.62 from the P.I.R. Fund and ordering
payment made to Rochester Sand & Gravel Company, which was read. i

Alderman Akenhead introduced ,a resolution appropriating $85. 32 from the General
Fund, $2.00 from the Street & Alley Fund, $8.10 from the Fire Protection Fund and $4,207I65
from the Lighting Fund and ordering payment made to City of Rochester, Public Utilities,
which was read.
Upon motion by Kjerner, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Akenhead introduced a resolution appropriating $691.25.from the Street
Alley Fund and ordering payment made to Lyle Signs, Inc., for street name signs, which
as read.
Upon motion by Theel, second by Morris, that the said resolution be adopted

Alderman Akenhead introduced a resolution appropriating $292.80 from the Street

Alderman Kennedy introduced a resolution appropriating $1,085.11 from
the Sewer Fund and $706.58 from the Street & Alley Fund and ordering payment made to
City of Rochester for grading and sewer in Fratzke's First Sub -Division, which was read.
Upon motion by Akenhead, second by Kjerner, that the said resolution be adopted
as read, and all voting -in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.-

freight on beams, which was read.

Upon motion by Anderson, second by. Kjerner, that the said resolution be

Alderman Kennedy introduced a resolution appropriating.$1,999.95 from the
Park Improvement Fund and ordering payment made to Collector of .Internal Revenue for it

Alderman Theel introduced a resolution appropriating $4,570.12 from t-he Park
Improvement Fund and ordering payment made to Mayo Civic Auditorium Revolving Fund, which
was read.
Upon motion by Kennedy, second by Akenhead; that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
.Alderman Morris introduced a resolution appropriating $7, 375, 00 from the
Permanent Improvement Fund and ordering payment made to C. M. Boutelle for estimate No.
2 for construction of warehouse and garage, which was read.
Upon motion by Akenhead, second by Kjerner, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Morris introduced a resolution appropriating $2,369.75 from the
Parking Meter Fund and ordering payment made to Duncan Meter Company for I collections
from parking meters during November, 1949, which was read.
Upon motion by Kjerner, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Morris introduced a resolution accepting the bid of Alpek Street Metal
Works for the furnishing of one gas unit heater for use in the City warehouse, which
was read.
Upon motion by Theel, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.

and estimate of cost and ordering bids for construction of a Health Center Building
(subject to final approval of Federal Government), which was read.

and the arrangements of building on lots, and the density of population within the City •

AN ORDINANCE PROVIDING FOR CONNECTING OF CERTAIN
LOTS AND PORTIONS OF VACATED STREETS IN WILLSON'S ADDITIODi
IN BLOCKS 104 AND 106 ADJACENT THERETO TO THE SANITARY SEWER
ON FIRST AVENUE S. W. FROM NORTH LINE OF SEVENTH STREET S. W.
VACATED TO SOUTH LINE OF LOTS, BLOCK 104.
The Common Council of the City of Rochester, Minnesota, do ordain:
Section 1. That Kathleen Fitzgerald is the owner of certain lots and

portions of vacated streets in Willson's Addition in Blocks 104 and 106 on
First Avenue S. W. from the North line of Seventh Street S. W. vacated to
South line of Lot 9, Block 104 according to the records of the Register of
Deeds County of Olmsted, City of Rochester, State of Minnesota, and is
hereby granted permission to connect said property with the sanitary sewer
on First Avenue S.W. recently constructed by the. said City of Rochester,
Minnesota.
Section 2. That any assessment now standing against the property
described in this ordinance is hereby voided.
Section 3. That there is to be no -assessment levied against the
said lots or any piece or parcel thereof, abutting on the said sewer
unless and until some of the lots or any piece or parcel thereof shall
be connected with the said sanitary sewer, but at the time that the said
Kathleen Fitzgerald or any heirs or assigns connect any part, piece, lot
or parcel of the above mentioned lots or parts thereof to the said sewer
they shall pay to the City of Rochester, Minnesota, at the time of the
making of such connection or connections the sum applicable to their
property, in accordance with the following statement:
