Minutes of an adjourned regular meeting of the Common Council of the City of
Rochester, Minnesota held in the Council Chambers in the City Hall in said City on
December 20, 1949.
President Lemmon called the meeting to order_ at 7:30 o'clock P. M., the following
members being present: President Lemmon, Aldermen Akenhead, Anderson, Kennedy, Kjerner,
Morris and Theel. Absent: None.
Upon motion by Kjerner second by Theel, the minutes of the meeting of
December 6th, 1948 were approved.
President Lemmon stated this as being the date set for receiving bids for the
construction of a sanitary sewer in Fourth Street Southeast to serve the proposed County
Hospital and Health Center buildings. No bids were received.
President Lemmon stated this as being the date.set for receiving proposals for
the purchase of $170,000.00 Permanent Improvement Revolving Fund Bonds. The bid of
Juran & Moody for $170,000.00 plus a premium of $2,290.00 and accrued interest; and
also the bid of Allisons Williams & Company, J. M. Dain & Company, Piper, Jaffray &
Hopwood for $170,000.00 plus a premium of $5,797.00, provided the bonds are a.General
Obligation of the City,or a premium of $1,780.00 .if the bonds are a Special Obligation
plus accrued interest, either bid being conditioned upon 'their' attorneys approving the
bonds as legal obligation under law and charter, were each read. President Lemmon
referred the same to the Finance Committee.
The recommendation of the Finance Committee that the bid of Juran & Moody for
$170,000.00 P. I. R. bonds at par value plus accrued interest and a premium of $2,290.00
be accepted, was read. Upon motion by Kennedy, second by Anderson, the recommendation
was approved and the City Clerk was instructed to return the certified check of the
unsuccessful bidder.
A communication from Borchert - Ingersoll, Inc., St. Paul request.iAg the
approval of an increase in price from $6,040.50 to $6,936.39 for a tractor with bull-
dozer in accordance with the terms of their contract with the City, was read.and
President Lemmon ordered same placed on file.
A communication addressed to the Mayor wherein Caroline Bedney of Owatonna,
Minnesota requested a refund in the amount of $38.05 for an assessment made against
her property for grading in Manley's Addition be made, was read. The same was referred
to the City Attorney.
A recommendation of the Sewer Committee that the matter of constructing a
sanitary sewer in Fourth Street Southeast to serve the proposed County Hospital and
Health Center be ref.erred to the Sewer Committee and the City Engineer with power to
act was read, and upon motion by Theel, second by Kjerner, the same was approved.
The recommendation of the Sewer Committee that the bids for gas unit heaters
for the Sewage Disposal Plant be rejected, and certified checks returned to the bidders
and that the City Engineer be instructed to purchase a new section to replace the leak-

ing section in the present steam -boiler at a cost nct to exceed $350.00, was read.

Upon motion by T heel, second by Morris, the recommendation was approved.
A recommendation of the City Engineer that the City enter into an agreement fo
the maintenance of trunk highways within the City limits as submitted'by the Minnesota
Department of Highways, was read and same was ordered placed on file.
A communication from Mr. A. G. Berens,, Vice President of the Rochester -Olmsted
County.Safety Council and also a resolution adopted by them on December 15th, 1948
making the following recommendations was read:
°1. That the present four-way stationary "stop" signs be
eliminated from the intersections of First Street and
Second Avenue. S.W. and from the intersection of Second
Street and Second Avenue S.W.

2. That suitable traffic control signals of the automatic I
"stop" and""go" type be installed at said intersections.
3. That such traffic control signals be equipped with .an
automatic "walk" signal for the control of pedestrian
traffic.
4. That the east -west walk in the middle of the 'clock on
second Avenue between First Street and Second Street
S.W. be eliminated as a designated crosswalk.
5. That the parking of automobiles on Second Avenue between II
First Street and Second Street S.W. be eliminated except II
for loading and unloading purposes. I�
6. That a four -space loading zone be established on the south

side of First Street immediately east of Second Avenue S.W."

Upon motion by Akenhead, second by Morris the matter. was referred to the Police Committee,

the Acting Chief of Police and the City Engineer to make a .survey of the requested ;I
traffic control changes.
The statement of receipts and expenditures in the Park Improvement Fund for

the month of November was read and the - same was ordered placed on file. �
The City Engineer's Trial Balance for the month of November 1949 was read and i

The -report of the Clerk of the Municipal Court for the week ended December llth;

The apnlication of W. L. Roscoe for a license to sell cigarettes was read and

The .applications of D. S. Fulton and Earl. J. Squires for a permit to place and

maintain a sign were each read and upon motion by Kjerner, second by Anderson, the permits
were granted. j

The Surety Bond of the Power Brake & Equipment, Inc. in the amount of $3,422.50;
with the Seaboard Surety Company as surety and the Surety Bond.of the Alpek. Sheet Metal.:

Works in the amount of $4,41.70 with the Western Surety Company were each read and i!
President Lemmon referred the same to the Mayor. h

duly passed and•adopted.
Alderman Kennedy introduced a resolution app.topri.ating $511.50 from the General
Fund and ordering payment made to the Rochester Post Bulletin for the publishing of
notices, minutes, ordinances, dog lists, etc., which was read..
Upon motion by Kjerner, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $2,147.00 from the
General Fund and ordering payment made to Big Four Oil Company for 11,300 gallons of
gasoline, which was read.
Upon motion by Theel, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating.$350.00 from the General •
Fund and ordering payment made to Wm. B. Shinn for one month's tractor and bulldozer
rental, which was read.
Upon motion by Morris, second by Anderson, that the said res'clution be adopted
as read, and all voting in -favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $315.94 from the General
fund and ordering payment made to Rundell.Lumber and Fuel Company for the insulation
of house at dog farm, which was read.
Upon motion by Anderson, second by Kennedy, that•the said resolution be_a.dopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.

Alderman Kennedy introduced a resolution appropriating.$474.65 from the General ;I
Fund, $1691.36 from the Street & Alley Fund, $40.50 from the P. I. R. Fund, $550.75 from

the Sewer Fund, $76.00 from the Bridge Fund and $6.00 from the Parking Meter Fund and
ordering payment made to the.Street & Alley Fund for use of equipment during.November,
1948, which was reed.

Alderman Theel introduced a resolution appropriating $6,170.00 from the Fire
Protection Fund and ordering payment made to City of Rochester, Public Utilities, fo.r ;o.ne-
halfrof'hydrant rental for 1948 - 1949 on 617 hydrants, which was read.
Upon motion by Anderson, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Theel introduced a resolution appropriating $2,077.60 from the Fire

C. M. Boutelle for 5% retained on 3rd Street Southeast

for curb and gutter, which was read.
Upon motion by Akenhead,
second by Kjerner, that the said resolution be adopted
as read,
and all voting in favor
thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Theel introduced a "resolution appropriating $19,000.00 from the P.I.R. •
Fund and ordering payment made to the First National Bank for P. I. R. bonds d.uo
January lst, 1949, which was read.
Upon motion by Kjerner, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Theel introduced a resolution appropriating $530.00 from the P. I. R.
Fund and ordering payment made to the First National Bank for interest on P.I.A. bonds
due January 1st, 1949, which was read.
Upon motion by Theel, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Theel introduced a resolution appropriating $1,195.12 from the Sewer
fund and ordering payment made to Elk River Concrete Products Company for 144 feet
sewer pipe, which was read.
Upon motion by Morris, second by Anderson, that the said resolution be adopted
as read, and all voting in favor -thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $12,735.56,from the
Bridge Fund and ordering payment made to'Carnegie Illi4ois Steel Corporation for
steel for bridge between 2nd and 3rd Avenue Southeast, which was read. •
Upon motion by Anderson, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $217.92 from the Park
Improvment Fund and ordering payment made to Globe Ticket Company for six sets tickets,
which was read.
Upon motion by Kennedy, second by Akenhead, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.

Alderman Anderson introduced a resolution appropriating $567.36 from the
Lighting fund and ordering payment made to the City of Rochester, Public Utilities for !j

for a concrete foundation for the new warehouse and garage at the Disposal Plant, which'

Upon motion by Akenhead, second by Kjerner, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution

Alderman Anderson introduced a resolution appropriating $2,967.19 from the
Police Relief Fund and ordering payment made to Police Relief Association for the
November 30th, 1949 tax settlement, which was read.
Upon motion by Kjerner, second by Theel, that the said resolution be adopted
as read, and all -voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted. •
Alderman Anderson introduced a respolution appropriating $57,000.00 from the
Airport Construction fund and ordering payment made to Fielding & Shepley, Inc., for
balance on Estimate No. 3, Contract 117, State Project 5501-02, which was read.
Upon motion by Theel, second by Morris, that the said resolution be.adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $69 !2.fkom the General
fund; $6.69 from the Street & Alley fund, $20.41 from the Fire Protection fund and
$4,278.00 from the Lighting fund and ordering payment made to the City of Rochester,
Public Utilities for street lighting and lighting of public buildings, which was read.
Upon motion by Morris, second by Anderson, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Morris introduced a resolution approving the sale of $170,000.00
Permanent Improvement Revolving fund bonds, which was read.
Upon motion by Morris, second by Akenhead, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Kennedy introduced a resolution approving the purchase price of 1 •
Allis Chalmers tractor complete with bulldozer, which was read.
Upon motion by Akenhead, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.

favor thereof, the City Attorney was authorized to take such legal action as might be
necessary to have the roof repair under the guarantee.
