Minn., January 10, 199 O L 1 1 n U 1 1 Minutes of a special meeting of the Common Council of the City of Rochester, Minnesota held in the Council Chambers, in the City Hail in said City, on January 10, 19 49 President Lemmon called the meeting to order at 14:00 otclock P.M., the following members being present: President Lemmon, Aldermen Akenhead, Anderson, Kenne Kjerner, Morris and Theel. Absent: None. The call of the special meeting was read and President Lemmon ordered that th same be placed on file, the said meeting having been called for the purpose of consideri the Mayor's action in vetoing a resolution adopted by the Common Council on January 3, 1949 and any other business the said Common Council may deem proper. The following veto message from the Mayor was read: "Members of the Common Council City of Rochester Gentlemen: I am returning your resolution of'January 3rd., 1949 appropriating $8,827.00 from the Permanent Improvement Revolving Fund and ordering payment made to the General Fund of the City of Rochester to reimburse the said General Fund for payment made from the General Fund to Leon Joyce for,grading streets and avenues in Manley's Sub -division, with my veto attached. As I stated in my original veto of a resolution to pay Leon Joyce out of the Permanent Improvement Revolving Fund, it is my firm conviction that .every provision of the Charter. covering assessments for public improvements as well as Article 1, Section 13 of,the Constitution have been utterly disregarded. and therefore a transfer of funds from the Permanent Improvement Revolving Fund to the General Fund for the purpose stated in the resolution is as illegal as paying Leon Joyce directly, out of the Permanent Improvement Revolving Fund. MC gUILLAN Mayor of Rochesteru' A motion was made by Kennedy, second by Morris, that the Mayor's veto be overridden and lupon roll call and all voting in favor thereof, President Lemmon declared the said -,-,veto duly overridden. A motion was made by Theel, second by 114orris, instructing the City Attorney tol, take such legal steps as may be necessary to determine whether or not the General Fund should be reimbursed from the Permanent Improvement Revolving Fund for the amount of the, contract paid Leon Joyce for grading of streets and avenues in Manley's Sub -Division in the event the Mayor refuses to'sign a warrant in the amount of $8,827.00 covering the II labove'mentioned transfer. All voted in favor of the motion. A request by the Rochester Fire Department Relief Association that the Council' approve.a loan to George A. Moore in the amount of $3500.00 on his home located at 1411 Tenth Avenue Northeast, Rochester, Minnesota and also a loan to Stanley Ellringer of St. Charles, Minnesota in the amount of $2900,00 on his gasoline station, was read and hpon motion by Akenhead, second by Kennedy, the said loans were approved. A motion was made by Anderson, second by Kjerner, to the effect that it is the :onwensusl of opinion of the members of the Common Council that effective as of April 1, ;� Record of Official .Proceedings of the Common Council of .the City. of Rochester, Minn., January 10, 1949 1949 the City Treasurer handle only the duties of the office of City Treasurer.
