President Lemmon called the meeting to order at 7: 30 0' clock P. M. , the following members being present: President Lemmon, Aldermen Akenhead,' Anderson, Kennedy, Kjerner, Morris and Theel. Absent: None. The call of the special meeting was read and President Lemmon ordered that i same be placed on file, the said meeting having been called for the purpose of considers • Ing the approval of plans and specifications for a Health Center Building and the it advertisement for bids for the construction of same and any other business the said II Common Council maydeem proper. �I Mr. Sonnenberg from the First Avenue Motor Sales Company was before the Council and stated that he wished to rent a part of the City property adjacent to his used car lot. President Lemmon referred the matter to the Public Grounds Committee and I Q I: the Fire Committee. i! I . The following resolution adopted by the Public Utility Board was read and President Lemmon ordered that same be placed on file: I! .I "WHEREAS, additional funds are, required to meet payments becoming due on the Silver"Lake Plant, THEREFORE, be it, and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Sinking Fund !, Commission be and is hereby requested to sell $154,860.00, par value, U. S. Treasury Notes -Series C-maturing 1-1-1950 from: the Sinking Fund for Electric -Department Extensions, and $103,24o.00 I! par value, U. S. Treasury -Notes -Series C-maturing 1-1-1950 from the Sinking Fund for Electric Department Depreciation Reserve, and that the funds realized be appropriated to the Public Utility Fund for the purposes herein stipulated.n The Mayor l a' appointment of Mr. P. F. Donovan as Weed Inspector for the City I�of Rochester for the year beginning January 1, 1949 and ending December 31, 1949 was ;. I! read and the same was ordered placed on file. The request of the Public Health & Welfare Department for the Council's o!I . I approval of their appointment of Miss Ruth Slade, R. N. to fill the vacancy_ caused by •the resignation of Margaret C. Lawler was read and upon motion by Akenhead, second by ,! Theel, the said appointment was approved. Ij ;I The following permit from the State of Minnesota, Water Pollution Control Commission, for operation of sewage disposal facilities was read and President Lemmon II ordered that same be placed on files "Pursuant to authorization of the Minnesota Water Pollution Control Commission at a meeting held on December 17, 1948, and in accordance with the provisions of the Water Pollution Control Act, Laws of 1945, Chapter 395, permission is granted to the city of Rochester for operation of'sewage facilities described in the report of this Division dated June 29, 1948, consisting of 14,093 feet of S inch diameter sanitary sewer extensions. Plans for these sewers were approved by the Water Pollution Control Commission July 29, 1949, and are on file (WPC-375). This permit is granted with the reservation that as a condition for the continuance of this permit in force and for the consideration of any further applications that may be made for approval of additional sewer extensions, the city awthorities shall proceed with all possible 24 Record of Official Proceedings of the Common, Council of the City _of Rochester; Minn.; January' 17,•'1949 diligence to expedite the adequate sewage treatment proceedings facilities for the construction of including provisions for financing and other arrangement's for construction as soon as possible. Chesley Secretary Dated- January 7, 1949" The request of Anne Pietrek that a street sign be placed at the intersection of Third Street and Ninth Avenue Southwest was read and President Lemmon referred the same to the Street & Alley Committee and the City Engineer. A notice by the Conciliation Court in the case of George Brumm, Plaintiff vs. • City of Rochester, Defendant, that judgement was entered in favor of the defendant was read and President Lemmon ordered that same be placed on file. The recommendation of the Street & Alley Committee that bids be taken for one Pulverizer -Mixer at the estimated cost of $4000.00; one Single Drum Tamping Roller at the estimated cost of $600.00 and one I ton panel truck at the estimated cost of $1800.00 the same being purchased for use in the City Engineer's Department was read and upon motion by Akenhead, second by Kjerner, the said recommendation was approved. The City Engineer's estimated for the construction of a new sewage disposal plant, trunk sewer to plant and storm and relief sewers totaling $2,7689495.00 was read. The said estimates being submitted for the purpose of furnishing information in determining the amount of a bond issue necessary for the construction of said sewage facilities. President Lemmon ordered that same be placed on file. The City Engineer's trial balance for the month of December, 1948 was read and the same was ordered placed on file. The report of the City Weighmaster for the month of December, 1948 showing 444 loads weighed and receipts in the amount of $44.40 was read and President Lemmon referred the same to the Finance Committee. A statement of receipts and expenditures in the Park Improvement Fund from April through December, 1949 was read and the same was ordered placedon file. The reports of the Clerk of Municipal Court for the week ended January 8, 1949 • showing total criminal fines and costs collected $287.00 and civil fees received $4.40 and for the week ended January 15. 1949 showing total criminal fines and costs collected $584.00, civil fees received $.25 and conciliation court fees $2.00, were each read and having been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file. The requests of the Northrup P.T.A. and the Lincoln P.T.A. for permission to operate a bingo game were each read and the same were ordered placed on file. The application of George Darst for transfer of 3.2 Beer 00n Sale" License No. 631 and "'Off Sale" License No. 1164 from William Meany to George Darst was read and upon motion by Akenhead, second by Theel, the transfers were granted. The application of Clements Chevrolet Company for permission to place and maintain a sign was read and upon motion by Theel, second by Kjerner,.the permit was was granted. The applications of George Darst and Dean Leaf for license to sell soft drinks were each read and upon motion by Anderson, second by Morris, the licenses were granted. The license bond of The Sanitary Company in the amount of $1,000.00 with the �I Aetna Casualty and Surety Company was read and upon motion by Akenhead, second by Theel,i� the bond was approved, the surety thereon accepted and it was ordered that the same be placed on file. Alderman Anderson introduced a resolution ordering bids for construction of a� Health Center Building and acceptiing plans, specifications and estimate of cost of same,'; which was read. Upon motion by Kennedy, second by Akenhead, that the said resolution be adopteid as read, and all voting in favor thereof, President Lemmon declared the said resolution �I duly passed and adopted. Alderman Theel introduced a resolution appropriating $800,00 from the General Fund and ordering payment made to Kris Nielson for purchase of Lots 10,11,12,13 and 14 and part of Lot 9, Block 17, Northern Addition, which was read. Upon motion by Morris, second by Anderson, that the said resolution be'adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. • Alderman Theel introduced a resolution appropriating $383.50 f romthe General Fund, $1, 622.04 from the Street & Alley Fund, $403, 65 from the Sewer Fund and $12. 00 from the Bridge Fund and ordering payment made to the Street & Alley Fund for use of equipment during December, 1948, which was read. Upon motion by Anderson, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution appropriating $742,57 from the Street & Alley Fund and ordering payment made to Olmsted County Road & Bridge Fund for calcium chloride, which was read. Upon motion by Kennedy, second by Akenhead, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution appropriating $293.42 from the Street & Alley Fund and ordering payment made to Firestone Stores for tires, tubes, etc., which was read. Upon.motion by Akenhead, second by Kjerner, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution appropriating $540.00 from the Sewer • Fund and ordering payment made to Neenah Foundry Company for manhole frames and grates, which was read. Upon motion by Kjerner, second by Morris, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kjerner introduced a resolution appropriating $2.843.40 from the Park Improvement Fund and ordering payment made to the Mayo Civic Auditorium Revolving Fund to reimburse revolving fund, which was read. Alderman Kjerner introduced a resolution appropriating $1,000.00 from the Lighting Fund and ordering payment made to Rochester Poster Advertising Company for City's share of Christmas Street Lighting, which was read. Upon motion by Kennedy, second by Akenhead, that the said resolution be adopted �I as read, and all voting 'in favor thereof, President Lemmon declared the said resolution duly.passed and adopted. Alderman Akenhead introduced a resolution appropriating $44100 from the Permanent Improvement Fund and ordering payment made to Alpek Sheet Metal Works for a unit heater at the city warehouse, which was read. tl Upon motion by Akenhead, second by Kjerner, that the said resolution be adoptedd as read, and all voting in favor thereof, President•Lemmon declared the said resolution duly passed and adopted. 1'I Alderman Akenhead introduced a resolution granting a dance permit to Gerald F.11 Wright, which was read. Upon motion by Anderson, second by Morris, the Acting Chief of Police and the City Clerk were authorized to open sealed envelopes containing keys for the city jail.
