February .7. 1949 1 1 • 1 11 • Minutes of a regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers -in the City Hall in said City on February 7, 1949. i President Lemmon called the meeting to order at 2:00 o1clock.P.M., the following members being present: President Lemmon, Aldermen Akenhead, Anderson, Kennedy, Kjerner,! Morris and Theel. Absent: None. Upon motion by Anderson, second by Kennedy, the minutes of .the meetings of January 3rd, January loth and January 17th, 1949 were approved. The petition of Marigold Dairies, Inc. to change Lots 9 and 10, in Block 64,, I Original Plat of the City of Rochester, Minnesota from commercial to industrial zoning was read and upon motion by Theel, second by Kjerner, the same was referred to the Board of Zoning. The petition of.Luella and Rhoda Olson that the North 78 feet of Lots 5 and 6, Block 84, Moe & Olds Addition changed from a residential to a commercial zone was read and upon motion by Akenhead, second by Anderson, the same was referred to the Board of i Zoning. A communication from the Elgin Sweeper Company requesting the approval by they' City of a revised change in pries and also change in specifications of a contract for a street sweeper dated February 2, 194,8 was read and upon motion by Kennedy, second by q i Akenhead, the Mayor and the City Clerk were authorized to sign the certificate approving' the requested changes. ') A request by Knute Olson, City Assessor, that the office space on the second floor of the City .Hall now occupied by the Public Health & Welfare Department be made available for the office of the City Assessor was read and President Lemmon ordered that'' i the same be placed on file. The following copy -of a communication from the Police Civil Service Commission' II laddressed to the Honorable Mayor, the Common Council of the City of Rochester and the City Attorney was read and the same was ordered placed on file: "Honorable Mayor Common Council City Attorney The action of the Mayor in asking the City Attorney to petition the Courts for writ of Mandamus, to force the Police Civil Service Commission -to hold examinations for the office of Chief of Police regardless of their readiness, has of course been noticed by the members of the Commission. It appears that the Mayor has been so busy that he has been relying upon misinformation by someone who knows nothing of what has transpired or what the problems have been that.the Commission has had to solve during.its tenure of office. Due to the controversy being waged between the Mayor and City Attorney it appears that some clarification from the Commission might be in order, that the record may be kept straight and the citizens be informed of just what is going on. This Commission took office during April,*1949, and a few days later. wasfaced with the findings of the; Supreme Court of the State of. Minnesota. Affirming the action of the District Court in reversing the certification of H. W. Fitzpatrick and this decision was broad in scope, in fact effecting all Civil Service agencies within the state • Record of Official Proceedings of the Common Council of the City of Rochester, Minn., February T. 1949 borders. In fact our State Civil Service was forced by this decision to make many changes in the Civil Service setup, by this new interpretation of the Civil Service Laws.. The Courts in their decision, reversed the certification on the grounds that the examination was not based upon existing records of EFFICIENCY, CONDUCT, CHARACTER and SENIORITY as well as competition in accordance with requirements of 419.o6 (9). Quote from the Supreme Court decision: The records in question are required to be kept in the regular course of the administration of civil service. Information obtained or gathered for the occasion will not suffice. That sort of thing opens the door to personal favoritism and influence which the law was designed to prevent. That rule, as we read it, requires a carefully prepared record, made from month to month, of the services which have been rendered; it contemplates a record made at -a time when the person is not an active candidate for an advance, and is to deal with comparative conduct, seniority and efficiency in previous service. UNQUOTE. Civil service was established in Rochester Police Dept. in 1931. Many commissions have served during the years, but few and in some cases no - records at all were kept of efficiency, conduct or character, and the new commission was forced to reclassify and set up records and continue them until such a time as they felt they would satisfy the statutes and be in accord with the interpretations of the Supreme Court. The present Commission has taken the State Municipal Civil Service law and followed it step by step, keeping in mind the interpretation of the courts; first, classify each position on the Police Department. Setting up just what each of the twelve positions demanded and creating standards upon which to base an examination. Efficiency report rating system was established after investigating many and varied systems throughout the country. , The Civil Service rules which were written in 1931, were entirely revised and rewritten and now ready for publication. During this period at the request of the Mayor and Chief of Police an examination for new Patrolmen was given and new patrolmen were added to the force, for the protection of Rochester citizens and property. The Commission has held 36 official meetings during the past S months in addition to unofficial meeting and meetings where the Common Council and the Mayor were invited. To expidite and advance the date for holding examination for Chief of Police, the services of the Public Administration Service, of Chicago. Illinois, were secured and exp:erts assisted the Commission in many ways in setting up a civil service that would be outstanding and a credit to the City of Rochester. In view of what transpired following the Chief's examination in 1947 it would be folly indeed for this commission.to proceed with an examination until all records were in conformity with the court's decision. Records made from month.to month of services rendered were what the courts required and that is just what this commission were making every effort to give. The Mayor, knowing that the commission were nearing the point where examination would be held has thru hisaetion injected into politics a campaign issue that the Civil Service Law was designed to prevent. Had the Mayor given the Commission the cooperation it had every right to expect, undoubtedly the work of the Commission would have been shortened and the time of the examination would have been advanced. Members of this Commission have no desire to enter into the controversy between other city officials, but in all fairness the work of the Commission has not been deterred or unnecessarily delayed by any actions of theCity Attorney, on the other hand he has assisted the Commission with legal advice and securing attorney general opinions when requested by the Commission. The Police Civil Service Commission thru several hundred hours of labor has set up a civil service that conforms with the laws of Minnesota. It has proceeded to a point where definite results are a matter of course, no action of the Mayor or any other party could have brought this about at an earlier date without sacrificing efficiency, or short cutting some of the civil service requirements. Akenhead, second by Theel, the same was ordered placed on file. The recommendation of the Street & Alley Committee and the Public Grounds Committee that the City Engineer be instructed to proceed immediately .with the l construction of the parking lot adjacent to the old City Warehouse and the Firehall in accordance with plans on file with the City Council was read and upon motion by Akenhead, second by Kjerner, the -same was approved. The recommendations of the _Street & Alley Committee that a curb and gutter be;l constructed on both sides of Eighth Avenue Southeast. from 12th to 13th. Street Southeast And on 6th Avenue Southeast from loth Street to llth Street Southeast and the I� recommendation of the Sewer Committee that a sanitary sewer be constructed on 5th Street' Northeast from the State Hospital sewer to Fifteenth Avenue Northeast and on Fifteenth Avenue Northeast from. 5th Street -Northeast to. th.e east line of hot 3, Block 2, Morningside Addition, were each read and upon motion by Kjerner, second by.Theel, the ;I same were approved. The following recommendation of the Police Committee was read.and upon motion�� by Kennedy, second by Akenhead, the same was approved: "Honorable Mayor and Common Council Of the City of Rochester, Minnesota Gentlemen: We, the undersigned members of the Police Committee, recommend the following: 1. That new fixed -time automatic traffic control signals be installed on South Broadway at the intersection of First - Street and Broadway,, and Third Street and Broadway, 2. That the existing traffic signals on Broadway be equipped with pedestrian signals and flashing off -time signals. 3. That the Broadway - signals be synchronized and adjusted to provide as uniform a traffic flow on Broadway as is possible. 4. That the cost of these installations be pats from the Parking Meter Fund. We further recommend that'the recommendations of the Rochester and Olmsted County Safety Council as communicated to the Common Council December 20, 1945 be given further study." I The recommendation of the Public Grounds Committee' and the Fire Committee that; the property that the First Avenue Motor Sales Company wished to rent Has not available' - for rental purposes was read and upon motion by Kennedy, second by Kjerner, the recommendation was approved and the City Clerk was instructed to notify the First Avenue II Motor Sales Company of the action taken by the Common. I 252 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., February.-J. 1949 • 1 The reports for the month of January, 1949 of the Buildii)g Inspector showing fees collected for building permits .issued in the, amount of $1,149.00, of the Electrical Inspector showing fees collected for electrical permits issued in the amount of $52.00, of the Plumbing Inspector showing fees collected for plumbing permits issued in the amount of $422.25 and of the Heating Inspector showing fees collected for heating permits issued in the amount of $257,50 were each read and President Lemmon ordered that the same be placed on file. The report of the City Weighmaster for the month of January, 1949 showing 377 loads weighed and receipts in the amount of $3T.7j0 was read and President Lemmon ordered that the same be placed on file. The City Engineers trial balance for the month of January, 1949 was read and the same was ordered placed on file. -The reports of the Clerk of the Municipal Court for the week ended January 22, 1949 showing total criminal fines and costs collected $497.00, civil fees received $3.70 and conciliation court fees $2.50; for the week ended January 29, 1949 showing total criminal fines and costs collected $360.00, civil fees received $2.35 and conciliation capurt fees $1.00 and for the week ended February 5, 1949 showing total criminal fines and costs collected $391.37, civil fees received $2.00 and conciliation court fees $1,50, were each read and having been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file. The application of the Yellow Cab Company for transfer of License No. 13 from a five passenger buick License No. 216-013 to a 1948 Plymouth 4 door sedan with License No. 526-112; license No. 32 from a five passenger buick with License No. 216-032 to a 1948 Chrysler 4 door 7 passenger with License No. 525-946; license No. '31 from a five passenger buick with License No. 216-131 to a 1949 Chrysler 4 door 7 passenger with License No. 525-945 and license No. 11 from a five passenger buick with License No. 216-011-to a 1949 Plymouth 4 door sedan with License No. 525-735 was read and upon motion by Akenhead, second by Kjerner, the transfers were -granted, The application of Virgil W. Johnson for a non -intoxicating malt liquor ."OFF Sale" license was read and upon motion by Kennedy, second by Morris, the license was granted. The contract bonds of Universal Motors, Inc. in the amount of $1,030.00 and Allen Lloyd Company in the amount of $1,317.99 with the Western Surety Company as surety; Ellis Motor Company in the amount of $:$2,;47,5 T5 with the Fireman's Fund Indemnity Company as surety; and Minnesota Toro, Inc.'in the amount of $2,735.00 with the United States Fidelity and Guaranty Company as surety were each read and the same were referred to the Mayor. "WHEREAS, the Laws of the State of'Minnesota now provide for a limitation 11 in the sum of $50, 000.00 set up as a special fund for Firemen's Relief or I' Retirement Fund, and WHEREAS., the present law provides that there shall be a limitation of not more than $75.00 per month payable on retirement, and WHEREAS, there is now a bill before the legislature of the State of Minnesota to increase the maximum fund to not less than $75,000.00 and to increase the retirement payments to not more than $100.00 per month. �I j� I Record of Official Proceedings of the Common Council of the City..of Rochester, Minn., February: 7., ..1949 NOW THEREFORE, B. it resolved by the Common Council of the City of Rochester, Minnesota, that an amendment to the law as hereinbefore set forth be'adopted by our State Legislature. Alderman Anderson introduced a resolution appropriating $233.33 from the General Fund, $36.48 from the Fire Protection Fund and $8.75 from the Sewer Fund and ordering' payment made to the N. W. Bell Telephone Company, which was read. Upon motion by Theel, second by Morris, that the said resolution be adooed as read, and all vesting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution appropriating $126.92 from the General Fund and $215.50 from the Street & Alley Fund and ordering payment made to Postier & Eggers Company, which was read. Upon motion by Morris, second by Anderson, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution • duly passed and adopted. Alderman Anderson introduced a resolution appropriating $268.20 from the General Fnad and ordering payment made to the Rochester Electric Company, which was read. Upon motion by Anderson, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution appointing Judges of Election for the year 1949, which was read. The City Engineer stated that Mr. Clarence Hanson had returned from his leave f absence and upon motion by Theel, second by Kennedy, the City Engineer was authorized o place him on the payroll from the date he returned from his leave of' absence.
