Minutes of a regular meeting of the Common Council of the City of Rochester,
Minnesota, held in theCouncil Chambers in the City Hall, in said City, on March 7,.1949.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the following
members being present: President Lemmon, Aldermen Akenhead, Anderson, Kennedy,-Kjerner,
Morris, and Theel. Absent: None.
Upon motion by Norris, second by gjerner, the minutes of the meetings of
February 23rd and March 1st, 1949 were approved.
President Lemmon stated this as being the time and place set for the first
hearing on the construction of a curb and gutter on 4th Avenue Southeast from llth to •
12th Avenue Southeast. Mrs. S. J. Wentworth was present at the meeting and opposed the
improvement.
President Lemmon stated this as being the time and place set for the first
hearing on the construction of a curb and gutter on 9th Avenue Southeast from 3rd to
4th Street Southeast. There was no one present wishing to be heard.
President Lemmon stated this as being the time and place set for the first
hearing on the construction of a curb and gutter on llth Street Northwest from North
Broadway to Second Avenue Northwest. There was no one present wishing to be heard.
President Lemmon stated this as being the time and place set for the first
hearing on the construction.of a curb and gutter on 6th Avenue Southeast from loth to
llth Street Southeast. Mrs. S. J. Wentworth was present at the meeting and opposed the
improvement.
President Lemmon stated this as being the time and place set for the first
hearing on the construction of a curb and gutter on Sth Avenue Southeast from 12th to
13th Street Southeast. There was no one present wishing to be heard.
President Lemmon stated this as being the time and place set for the first
hearing on the grading and surfacing of 6th Avenue Southeast from 5th to 6th Street
Southeast; 5th Avenue Southeast from 4th to 6th Street Southeast and 5th Street Southeast
from 4th to 6th Street Southeast. Mr. Kobi was present at the meeting and urged that the
improvement be made as soon as possible. •
President Lemmon stated this as being the time and place set for the first
hearing on the construction of &. sanitary sewer on 5th Street Northeast from the State
Hospital sewer to 15th Avenue Northeast and on 15th Avenue Northeast from 5th Street
Northeast to the south line of Lot 3, Block 2, Morningside Addition. There was no one
present wishing to be heard.
President Lemmon stated this as being the time and place set for the second
hearing on the construction of a sanitary sewer and watermain in 12th Street North west
from 2nd Avenue to 4th Avenue Northwest. There was no one present wishing to be heard.
Mr. Harold Roth, representing a group of business men on Broadway, was present
at the meeting and stated that he wished to remind the Council that at the time the

A protest against the construction of a curb and gutter on 7th Street Southeast
from 3rd Avenue Southeast to 5th Avenue Southeast was read and upon motion by Anderson,
second by Kennedy, the same was referred to the Street & Alley Committee.
The following veto of a resolution presented by the Mayor was read and President
Lemmon declared the resolution defeated:
"Members of the Common Council
Gentlemen:
Am returning check and resolution ordering transfer of
$12,960.00 from the General Fund to the Public Utility Fund
(3rd installment due on loan from Public Utility Department
•
$12,000.00 principle, $960.00 interest at 1% on unpaid
balance of Loan).
Gentlemen; since there is, as of January 31st. $14,926.62 and
approximately $1,"500.00 more from the February income of
Parking meters- or better than $16,000.00 available in the
Parking Meter Fund as of right now, and since you are
complaining about a shortage in the General Fund- and again
since the Parking Meter Fund can only be used for Parking
and traffic purposes. It would seem that the only sensible
thing to do would be to pay the $12,960.00 out of the Parking
Meter Fund.
Now therefore, if you insist on overriding my veto, I will
have to sign the check as you originally sent it to this
office. You have the right to pay this $12,960.00 out of
either fund, after you have overriden my veto.

Should you take such an action, ygu will responsible if the
transfer causes the General Fund additional distress.

A petition by the property owners in Blocks 1 and 2, Original Plat of the City
of Rochester, requesting that the property be rezoned as residential instead of
commercial was read and President Lemmon referred the same -to the Board of Zoning for
recommendation, when and if the said Board is qualified to act on same.
The request of the Public Health & Welfare Board for permission to employ
Mrs. Elizabeth Bowman as secretary in the Counselling Clinic of the Health Department
was read and upon motion by Theel, second by Akenhead, the request was granted and
ordered placed on file. •
The City Engineer s estimate of cost for grading and surfacing of 5th Street
Southeast from 4th to 6th Avenue Southeast, 5th Avenue Southeast from hth to 6th Street
Southeast and 6th Avenue Southeast from 5th to 6th Street Southeast in the amount of
$19,195.10 was read and President Lemmon ordered that the same be placed on file.
The recommendation of the Police Committee and the Acting Chief of Police that
the Acting Chief of Police be authorized to hire some Electrical Company to install new
wiring and place the Gamewell System in workable condition was read and upon motion by
Kennedy, second by Morris, the recommendation was accepted, the work to be done when
funds are available in the General Fund to pay for same.

The recommendation of the Street & Alley Committee that the East and West
(alley in Block 5, Head & McMahon's Addition be graded, surfaced and oiled and the cost
Ithereof assessed against the abutting property owners was read and upon motion by
Akenhead, second by Kjerner, the same was approved and ordered placed on file.
The recommendation of the Street & Alley Committee that the unvacated portion
of the alley from the- South line of Sixth Street Northwest to the North line of Block 5, 1

(Cummings Addition be graded and that Mr. Earl Cooke be permitted to do this grading at 'i

This own expense was read and upon motion by Kjerner, second by Theel, the recommendation,
was approved. j
The recommendation of the Sewer Committee that a sanitary sewer be constructed
on North Broadway fromthe end of the present sewer approximately 240 feet north of the
north line of 16 Street Northeast to a point approximately 747 feet northerly thereof,
the cost of said sewer to be assessed agasint the property benefitted, was read and upon,

motion by Theel, second by Morris, the recommendation was approved.'
The recommendation of the Water Committee that a watermain be constructed on.
5th Avenue Northwest from the South line of Lot 8; Block 8, Manley's Addition to 14th

Street Northwest and that the cost be assessed against the property benefited was read
and upon motion by Theel, second by Morris, the recommendation was approved.
The recommendation of the Water Committee that the matter of supplying water
to the State Hospital for fighting fire or other emergency used be referred to the_ !

Public Utility Board for action wag read and upon motion by Kennedy, second by Theel, the
recommendation was approved.
The recommendation of the Water Committee that a watermain be constructed on

The report of the City Weighmaster for the month of February,' 1949 showing
94 loads weighed and receipts in the amount of $49.40 was read and President Lemmon
eferred the same to the .Finance Committee.
The reports for the month of February, 1949 of the Building Inspector showing
fees collected for building permits issued in the amount of $136.00; of the Electrical
nspector showing fees collected for electrical permits issued in the amount of $90.50;
f the Plumbing Inspector showing fees collected for plumbing permits issued in the amount

$294.25 and of the Heating Inspector showing fees collected for heating permits in the
amount of $321.75 were each read and President Lemmon ordered that the same be placed on
file.
The report of the Clerk of Municipal Court for the week ended February 26,
1949 showing total criminal fines and costs collected $752.25, civil fees received $8.95
and conciliation court fees $1.00 was read and having been previously approved by the
City Attorney, President Lemmon ordered that the.same be placed on file.
The City Engineer's Trial Balance for the month of February, 1049 was read
and President Lemmon ordered that the same be placed on file. •
The applications of Charles Bemel and Bernard Perlmutter for soft drink
license, cigarette license and "off sale" 3.2 beer license were each read and upon
motion by Theel, second by Akenhead, the licenses were granted.
The application of David Bemel for a permit to place and maintain a sign was
read and upon motion by Anderson, second by Kennedy, the permit was granted.
The application of Lysne Construction Company for permission to move two
frame dwellings over certain city streets was read and upon motion by Theel, second by
Morris, the permits were granted.
Alderman Anderson introduced a resolution ordering plans, specifications
profile and estimate of cost and 2nd hearing on construction of a curb and gutter on 9th
Avenue Southeast from 3rd to 4th Street Southeast, which was read.
Upon motion by Anderson, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Anderson introduced a resolution ordering plans, specifications,
profile and estimate of cost and 2nd hearing on construction of a curb and gutter on both
sides of llth Street Northwest from North Broadway to 2nd Avenue Northwest, which was

Street Northeast from the State Hospital sewer to 15th Avenue Northeast and on 15th
Aventine Northeast from 5th Street Northeast to the south line of Lot 3, Block 2,
Morningside Addition, which was read.

Alley Fund and ordering payment made to Roddis Feed Company for crushed rock, which was i

as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.

Alderman Kjerner introduced a resolution appropriating $735.50 from the General
Fund and ordering payment made to the Rochester Post Bulletin for publishing notices, i
proceedings, dog lists, etc., which was read-.
Upon motion by Akenhead, second by Kjerner., that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly. -passed and adopted.

Alderman Theel introduced a resolution granting four public dance permits to
Archie Dieter, which was read.
Upon motion by Theel, second by Morris, that the said resolution be adopted
as read, and all -voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Theel introduced a resolution granting a public dance permit to
Employees Club of the Cooperative Oil Company, which was read.
Upon motion by Morris, second by Anderson, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Theel introduced a resolution appropriating $274.75 from the General
Fund, $500.13 from the Street & Alley Fund and $690.25 from the Sewer Fund and ordering
payment made to the Street & Alley Fund for use of equipment during February, 1949,
which was read.
Upon motion by Anderson, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon 'declared the said
resolution duly passed and adopted.
Alderman Moi,ris introduced a resolution appropriating $238.07 from the Street &
Alley Fund and ordering payment made to the George T. Ryan Company for one draw bar
assembly, which was read.
Upon motion by Kennedy, second by Akenhead, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Morris introduced a resolution appropriating $207.93 from the
Lighting Fund and $1,222.92 from the Park Improvement and ordering payment made to the
City of Rochester, Public Utilities, which was read.
Upon motion by Akenhead, second by Kjerner, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Morris introduced a resolution appropriating $2,789.82 from the Park
Improvement Fund and ordering payment made to the Mayo Civic Auditorium Revolving Fund,
which was read.
Upon motion by Kjerner, second by Theel, that the said resolution be adapted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.

admission taxes collected at the auditorium during February, 1949, which was read.

An Ordinance amending an Ordinance entitled, "An Ordinance for the regulation I)
and government of Public Parks and Parkways in the City of Rochester", was given its
first reading.
Upon motion by Kennedy, second by Kjerner-, and upon roll call and all voting it

in favor thereof, the rules were suspended and the Ordinance was given its second reading.

An Ordinance entitled, "An Ordinance limiting the Gross Weight of.Vehicles
over certain streets and avenues in the City of Rochester, Minnesota", was given its
First reading.
Upon motion by Theel, second by Morris, and upon roll call and all voting in
favor thereof, the rules were suspended and the Ordinance was given its second reading.
Upon motion by Morris, second by Kennedy, e.nd upon roll cal].' and all voting in'f

favor thereof, the rules were suspended and the Ordinance was given its third and final

Upon motion by Akenhead, second by Theel, that the said Ordinance be adopted

as read, -and all voting in favor thereof., President Lemmon declared the said Ordinance
duly passed and adopted.
Upon motion by Anderson, second by Kennedy, the City Clerk was instructed to
request the various boards and departments to submit inventories as of February 28, 1949;
Mr. A. .D. LaSalle was present at the meeting and requested that action be
taken by the Common Council to have street crossings ower' the railroads repaired. Upon
Motion by Akenhead, second'by Theel, the matter was referred to the Street & Alley

Committee, the Mayor and the City Engineer, with power to act, to see that necessary

repairs are made to the crossings.
