Record of Official Proceedings of the Common Council 41 of the City of Rochester, Minn., March 21, 1949 Minutes 'of an adjourned of th'e City of regular meeting of the Common Council Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City on M arch 21, 1949. President Lemmon called the meeting to order at 7: 30 o'clock P.t2. , the following members being present: President Lemmon, Aldermen Akenhead, Anderson, Kennedy, Kjerner, Morris and Theel. Absent: None. Upon motion by Morris,'second by*Theel, the minutes of the meetings of March 7th and 9th, 1949 were approved. • President Lemmon stated this as being the time and place set'for the second hearing on the construction of a curb and gutter on 9th Avenue Southeast from 3rd to 4th Street Southeast. Th-Te was no one present wishing to be heard. President Lemmon stated this as being the time and place set for the second hearing on the construction of a curb and gutter on both sides of llth Street Northwest from North Broadway to 2nd Avenue Northwest. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set for the second hearing on the construction of a curb and gutter on 9th Avenue Southeast from 12th to 13th Streets Southeast. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set for the second hearing on the grading and surfacing of 6th Avenue Southeast from 5th to 6th Street Southeast; 5th Avenue Southeast from 4th to 6th Street Southeast and 5th Street Southeast from 4th to 6th Avenue Southeast. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set for the second hearing on the construction of a sanitary sewer on 5th Street Northeast from the State Hospital Sewer to 15th Avenue Northeast and on 1.5th Avenue Northeast from 5th Street Northeast to the south line of Lot 3, Block 2, Morningside Addition. There was no one present wishing to be heard. • . President Lemmon stated this as being the time and place set for receiving and opening bids for the furnishing of sewer castings for use in the City Engineer's Department. The bids of Neenah Foundry Company showing 50 catchbasin frames and grates 36.00 each $1900.00, 20 manhole frames and covers @ 28.50 each-$570.00, 5 grated covers for above @ 9.25 each-46.25, and 15 solid covers ® 9.25 each-135.75 and Allis Machine & Foundry Company showing 50 catchbasin frames and grates @ 49.00 each-2450.00, 20 manhole frames and covers ® 54.00 each-1080.00, 5 grated covers for above 16.50 each-92.50, and 15 solid covers ® 16.50 each-247.50, were each received and opened. The recommendation of the Sewer Committee that the bid of the Neenah Foundry Company for the furnishing of sewer castings be accepted was read and upon motion by Morris, second by Theel, the recommendation was approved. • 2 Record ©f Official. S. Treasury bonds to make funds available for the construction of a new City warehouse was read and upon motion by Anderson, second by i gjerner, the action of the Sinking Fund Commission was'approve,d. t Mr. E. A. Zuehlke was before the Council and -asked for changes to be made in • the bus service to the Veterans Project at the fairgrounds. Alderman Theel reported that members of the Council had .met with the 'Safety Council and the Chief of Police on a i prior date and had discussed.the matter. Acting Chief of Police Nelson was instructed to 'i Lrk .again take the matter up with the Safety Council. The request of the Public Health and Welfare Board £.or permission to employ Mrs. Raymo-nd-Peterson as clerk in the clinics of. the Health Department to replace Mrs. 'Pauline Billman at a salary of $160.00 per month was read and .upon motion by-Akenhead, 'second by Theel, the request was granted. - The request of the Public Health & Welfare Board that the sum of $3,319.45 be 'I I transferred from. the General Fund to the Public Health & Welfare. Fund for the purchase �I f � ofa garbage collection truck was read and the same was ordered placed on file, The request that the amount of $2, 886.27 be. appropriated from the Permanent �I Improvement Fund to the Public Health & Welfare Fund for reimbursement of items paid in -- connection with the new Public Health Center Building was read and ordered placed on file. I A communication from the Police Civil Service. Commission which reads in part l as follows was read and -the same was ordered placed on file: "May we therefore.respectfully recommend to the Common Council t� that careful consideration be given to the men on the Police Department, who have, and in the future will, serve the l Department with years of experience and past training. As a suggestion, possibly men of five (5) to ten (10) years of (' permenant service, five dollars above regular scale, and ten (10) i to fifteen (15) year men, ten dollars above scale. And fifteen (15) to twenty (20) year men, fifteen dollars above scale, ,per month. i Few; if any, business firms demand or expect employe's to goon year after year without some expe.etat.ions of advancement or compensation adjustment. A resolution dated March 9, 1949 signed by Clarence Berg, President of, the Rochester Central Labor Union and Robert Petersdorf, Representative of the Rochester Building & Construction Trades Council, requesting that. Alderman J. T. Lemmon and Alderman Austin A. Kennedy resign from the City Council was read and upon motion by Akenhead, second by Morris, the same was ordered placed on file. A communication from Mr. H. S. Patterson objecting to any change In zoning of the property now occupied by the Marigold Dairies, Inc. was read and upon motion by • Theel, second by Kjerner, the same was ordered placed on file. A communication from the North States Enterprises, Inc. asking for information as to what had been done concerning the.fee for license on the outdoor theater was read and ordered placed on file. Requests of the Rochester Junior Chamber of Commerce, the Holmes P.T.A. and, the I.O.O.F. Lodge for permission to operate bingo games were each read and President Lemmon ordered that the same be placed on file. The petition of Max Shapiro to have Lot S, except the East 49 feet thereof, in Block 92, Original Plat changed from a residential to an industrial zone was read and upon motion by Theel, second by Kennedy, the same was referred to the Board of Zoning. A communication from the Hawthorne's Men's Club in regard to the congested condition of traffic on 92 and loth Street Southeast between lst and 3rd Avenues ,Southeast was read and upon motion by Theel, second by Kennedy, the matter was referred to the Police Committee, the Acting Chief of Police, the City Engineer and the City Attorney. A protest against the change of zoning of Lots 9 and 10, Block 64, Original Plat was read and upon motion by! Theel, second by Morris, the same - was referred to -the Zoning Board. The statement of receipts and disbursements. in the Park Improvement Fund for the month of February, 1949 was read and the same was ordered placed on file. The reports of the Clerk of the Municipal Court for the -week ended March 5, 1949 showing total criminal fines and costs collected $737.95, civil fees received $10.7.9, and conciliation court fees 22.00; f.or the week ended March 12, 1949 showing total criminal fines apd costs collected $7.02.20, civil fees received $2.60, and conciliation court fees $1.50; and for the week ended March 19, 1949 showing total criminal fines and costs collected $624.00, civil fees received $7.65 and conciliation court fees $3.75, were each read and having been previously approved by the City Attorney • 0r� R&bfd of Official Proceedings of the Common. Alderman Akenhead introduced a resolution authorizing the City Clerk to. advertise for bids for being designated as City Depository for 1949-1950, which was read. Upon motion by Morris, second by Anderson, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution ordering.bids for official printing and publications during 1949-1950, which was read. Upon motion by Anderson, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution ordering bids for furnishing cutback asphalt and/or tarvia for the year 1949, which was read. r Upon motion by ennedy, second by Akenhead, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Theel introduced a resolution appropriating $1,776.25 from the Parking Meter Fund and ordering payment made to Duncan Meter Corp. for z collections made during February, 1949, which was read. Alderman Morris introduced a resolution appropriating $469.13 from the Lightin, Fund and ordering payment made to City of Rochester, Public Utilities for lighting at the airport, which was read. Alderman Anderson introduced a resolution appropriating $662.',75 from the General Fund and ordering payment made to Cooperative Oil Company for gasoline and ha.ulin'g, I which was read. Alderman Anderson introduced a resolution appropriating $10.70 from the Street & Alley Fund and $192.95 from the Fire Protection Fund and ordering payment made to the Gopher Welding Supply Company, which was read. Upon motion by Morris, second by Anderson, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Morris introduced a resolution calling public -attention to House File 699- Senate File 559, permitting the Railroad and Warehouse Commission to impose the • cost of protecting grade crossings and separating grades upon the local communities in which the crossings are located, which was read. Upon motion by Kennedy, second by Kjerner, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Morris introduced the following resolution which was read: "WHEREAS, the City of Rochester did adopt an amendment to its Charter enabling the governing body of said City, to distribute the cost of the disposal of -sewage among the users of that facility on a meter basis, should the said body so determine such method advisable, and WHEREAS, at the present time there is a provision in the Laws of the State of Minnesota which in effect, precludes a City of the second class in so operating. YOW THEREFORE Be it _resolved by the Common Council of the City of Rochester! That an immediate request be made of the members -of the State Legislature and particularly those representing the City of Rochester and the County of Olmsted, to remedy the existing legislation so as to permit the City of Rochester to proceed according to the expressed intentions of the citizens of said City.'1 Upon motion by Kennedy, second by Akenhead, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted.
