HomeMy WebLinkAbout04-04-1949�a Record of Official Proceedings of the Common Council of the City of Rochester, Minn., April 4, 1949 Minutes of the annual meeting of the Common Council of the City of Rochester, Minneso.ta, held in the Council Chambers, in the City Hall in said City, on April 4,1949.;i ;i President Lemmon called the meeting to order at 2:00 o'clock P.M., the a following members being present: President Lemmon, Aldermen Amundsen, Anderson, Kennedy; I Miner, Morris and Theel. Absent: None. Upon motion by Morris, second by Theel, the minutes of the meetings of March 21? ii and March 29, 1949 were approved. President Lemmon addressed the Mayor, the Members of the Common Council and • the guests present at the meeting and extended a welcome to the new members of the it Council. He then introduced Mayor McQuillan who in his address stated'that Rochester wa'e no longer operating as a 4th class City b4t now had the problems of a 1st class City and' among other things, recommended than amendments should be made to our present City �.• Charter, better service should be rendered the tax paying public at reduced costs and some plan should be made to finance the building and maintenance of a new Sewago Treatment d Plant. He also announced the appointment of a Committee to assist in the study of the i City's finances which are involved in the transfer of funds from the Public Utility Department to the General Fund. On this Committee he appointed Charles Da.belstein, M.M.; Hayden, A. U. Habberstad, A. C. Gooding and James T. Spillane. After hearing the Mayor, President Lemmon explained the financial situation in the General Fund at the present time and recommended to the Council that no appointments of City officials be made and no salaries be set at this meeting. The Mayor's appointment of Robert Petersdorf to the Police Civil Service Commission was read and a motion was made by Alderman Anderson that the said appointment, be approved. President Lemmon declared the motion out of order for want of a second. A, motion was made by Morris., second by Theel, that the appointment be laid on the table until the meeting of April 11, `1949. Ali voted in favor of the motion. The Mayors appointment of Rev. A., G. Hansen to the Public Health & Welfare Board was read and upon motion by Theel, second by Morris, the said appointment was ' approved. The. M ayor ' s appointment of Carl C. Hooper as secretary to the Mayor was read and upon motion by Morris, second by Kennedy, the same was•a.pproved. The following copy of'a letter addressed to Mayor Claude H. McQuillan was read and President' Lemmon ordered that the samd be placed on file: ."Hon. Mayor C. A. McQuillan City of Rochester Rochester, Minnesota The Rochester Police Civil Service Commission,, does hereby certify to from the official eligibility you, register, the man standing highest on said list in the class of POLICE CHIEF. JAMES J. MACKEN 'JR. This certification is in response to requests on file, from your office and from the Common Council, in accordance with civil service laws and r.egulations. . Tingley, Secretary • POLICE CIVIL SERVICE COMMISSION" i Record of Official Proceedings of the Common Council of the City_ of Rochester, Minn., April 4, 1949 Three members from the Cascade Township Board were before the Council and c•ompla,ined that due to the excessive traffic over the road between the new Dumping Grounds and the -City of Rochester, the road was now in very bad condition and requested -that the City aid in the maintenance of the said road. After some discussion on the matter, a motion was made by Theel, second by Kennedy, that the Council go on record as being in favor of County aid being furnished for the maintenance of the said road. All voted in favor thereof. The action also authorized the Street & Alley Committee and the City Engineer to confer with the County Commissioners on the matter. Mr. Henry Vihstadt, County Commissioner, asked that the Common Council support a request for State Aid on a proposed truck route connecting Highways 52 and 63, this • road would leave Highway 52 near -the Valencia Ballroom and intersect Highway 63 near the North line of the old City Dumping Grounds. The State would be further requested to maintain the said route under the 'stub Highway" law. If this proposal is approved by the Council the next step would be to request the State Legislature for action approving the plan. President Lemmon referred the matter to the City Engineer and the Street & Alley Committee to meet with the County Board. The matter of papers and rubbish being blown off of rubbish hauler's trucks was again brought,to the attention of the Common Council.- A motion was made by Kennedy, second by Morris, that the -City Attorney draft an amendment to the rubbish Yfauling ordinance.which would require that end gates be used and that truck boxes be covered in such a manner that rubbish could not be strewn along the streets and roads. All voted in favor of the motion. Amundsen Alderman Theel introduced the following resolution which was read: "WHEREAS, It is deemed expedient and necessary that the Common Council of the City of Rochester, Minnesota, adopt rules of order for the conduct of its business, and WHEREAS, A copy of Robert's Rules -of Order (revised) of the 1915 Copyright, is before this Common Council: SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, •M- innesota: That the said Roberts Rules of Order be adopted by this Common Council as rules of -order for the conduct of its busin6-ss.11 'mac, Record of' Official Proceedings ofthe'.Comm, on Council of the Citv of Rochester,; Minn., April. 4 ..194.9 1 1 Upon motion by Anderson, second by Kennedy, that the -said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the; said resolution' J duly passed and adopted. Alderman Theel introduced the following resolution which was 'read: "Be it resolved by the Comnon Council of the City of Rochester Minnesota: That the said Common Council of the City of Rochester, Minnesota, hereby adopts the following rules and regulations forthe order of business of said Common Council: 1. Roll Call. The roll call of the Common Council shall be had and taken in its alphabetical order according to the names of the members, except that the name of the President of the Common Council shall be called only at the.first roll call of each meeting and then after that, at that meeting, only in case of a tie vote when his name shall be called and vote taken after the expression of each of the other members of the. said Common Council, or when a 5/ 7 vote is required. 2. Reading and approval of the minutes of the proceeding meeting. 3. At first meeting, the appointment of officers and committees. 4. Public hearings. 5. Reading of.petitions and communications. 6. Reports of committees. All reports of committees shall hereafter'be made in writing, unless ordered otherwise.by said Common Council, 7. Unfinished business 8. Resolutions and Ordinances. 9. Upon motion by Morris, second by Miner, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution iuly passed and adopted. President Lemmon stated this as being the time and place set 'for the first tearing on the construction of a sanitary sewer and watermain on North'Broadway Street from the end of the present main, approximately 240 feet north of the north line of 16th, >treet Northeast, to a -point approximately 747 feet northerly thereof. President Lemmon stated this as being the time and place set for receiving and ,pening proposals for doing the official printing for the City.of -Rochester for the year 949-1950. The proposal of the Rochester Post Bulletin Company was received and opened. Record of Official Proceedings of the Common Council of the City of. Rochester, Minn., April .4, 1949 The recommendation of the,Finance Committee that the Rochester Post Bulletin Company be appointed to publish the official printing and advertising for the City of Rochester for the ensuing official year, at the legal rate established by the statutes of the State.of Minnesota, was read and.upon motion by Theel, second by Amundsen, the same was approved and ordered placed on file. Alderman Amundsen introduced a -resolution designating the Rochester Post Bulletin Company as the official City newspaper for the ensuing official year, which was read. Upon motion by Theel, second by Anderson, that the said resolution be adopted • as read, and all voting in favor thereof, President Lemmon d"eclared.:the Said resolution duly' passed .' a-nd adopted .President Lemmon stated this as -being ;the time and place set for receiving a.nd opening proposals for being designated as City Depositories. The proposals of the First National Bank for appointment and designation as a depository for $400,000.00 of funds belonging to the City.of Rochester; of the Union National Bank for appointment and designation as a depository for $300,000.00 of funds belonging to the City of Rochester; and of the Olmsted County Bank and Trust Company for appointment and designation as a depository for $200,000.00 of funds belonging to the City of Rochester, were each read and the same were ordered placed on file. Alderman Anderson introduced a resolution designating the first National Bank, the Union National Bank and the Olmsted County Banff: & Trust Company as City Depositories for the ensuing official year, which was read. Upon motion by Theel, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon 6e•dlared :th.e- said wresolution duly gassed and adopted. President Lemmon stated this as being the time and place set for receiving and opening bids for the furnishing of cutback asphalt for the City of Rochester, Minnesota for the 1949 season. The bids of Standard Oil Company for 150,00 gallons cutback asphalt • in the amount of $15,255.00; of -the Shelly Oil Company for 150,000 gallons cutback asphalt in the amount of $16,140.00 and of the Northwestern Refining Company for 150,000 .gallons cutback asphalt in the amount of $17,130.00 were each read and President Lemmon referred the same.to the Street & Alley Committee and the City Engineer for tabulation and recommendation. President Lemmon stated this as being the time and place set for receiving and opening bids for the furnishing of the 1949 seasons supply of crushed rock and gravel for use in the City Engineer's Department. The following recommendation of the Plumbing & Heating Investigating Committeell itwas read and President Lemmon ordered that the same be placed.on file: l I "We, the undersigned, members of the investigation committee appointed and acting under the provisions of Ordinance #629, hereby recommend that any license_ be denied the Holland Furnace Co., making application as a heating contractor, and William P. Smith, ,rho has applied for a license as a journeyman. That the reasons for the recommendation to deny said licenses are: First, the Holland Furnace I Co..refuses to appear before this committee. Second, because the said William P. Smith, upon examination by this committee failed to show such practical knowledge in ventilation and air-conditioning as conformed to the rules applying to journeymen working in said trade. j Ruger M. The City Engineer's estimate of cost, of revised plpns,,for the cgnstruction of Parking -Lot #2 near the old Ci.ty Warehouse between Broadway Street South and Fi.rst Avenue Southwest in the amount of $4,225.10 was read and upon motion by Anderson, second by Miner, the same was approved .and ordered placed on file. Three applications to remove certain pieces of property owned by the City of Rochester from the tax rolls was read and upon motion by Anderson, second by Morris, the . Mayor and City Clerk were authorized to sign the applications and file same with the County Auditor. . A petition to have the South 92.07 f.eet, East 131.15 feet, West-262.30 feet of Outlot #101 Auditors Plat A in the City of .Rochester changed from a residential to a. commercial zone was read and upon motion by Theel,.second by Kennedy, the same was referred to the Board of Zoning. The annual report of the Department of the City Engineer was presented and ordered placed on file. , The.annual report of the Rochester Bus Line, Inc. was read and the same was ordered placed on file. The reports for the month of March, 1949 of the Building Inspector showing fees collected for. building.permits issued in the amount of $1,703.00; of the Electrical Inspector. showing fees collected for electrical permits issued in the amount of $596.50; of the Plumbing Inspector showing fees.collect.ed.for plumbing permits issued in the amount of $24.00 and of the Heating Inspector showing fees collected for heating permits issued in the .amouzlt of $22. 50, were each. read and President Lemmon ordered that the same be placed on file. The report of the City Weighmaster..for the month of March, 1949 showing 723 loads weighed and receipts in the amount of $72.30 was read and President Lemmon ordered • that the same be placed on file. The report of the Clerk of Municipal Court for the creek ended April 2, .1949 showing total criminal fines and costs collected $475.00, civil fees received $.25 and conciliation court fees $1.50., was read and having been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file.
