Minutes of an adjourned regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on
October 17, 1949. '

President pro,tem Andersonbcalled the meeting to order at 7:30 o'clock P. M.,
the following members being present: Aldermen Anderson, Amundsen, Kennedy, Miner, Morris,

and Theel. Absent: President Lemmon, due to illness.
Upon motion by Theel, second by Amundsen, the minutes of the meeting of
Gctober 3, 1040 were approved.
President pro tem Anderson stated this as being the time and place set for a
hearing on the levying of special assessments for the grading and surfacing of loth
Avenue Northeast from 5th Street Northeast to Silver Creek. There was no one present
wishing to be heard.

hearing on the levying of special assessments for the grading and surfacing of llth
Avenue Southeast from the Northeast corner of Lot 31, Auditor's Plat "A" to a distance
220 feet South. There was no one present wishing to be heard.

receiving and opening bids for furnishing Of) two patrol cars for use in the Police
Department. The bids of Clements Chevrolet Company, Universal.Motors,.Ine., Marti Nash
IlMotors, K & F Sales Company and Postier & Eggers Co., Inc. were each received and
!opened and the same were referred to the Police Committee.and the Chief of Police for
!tabulation and report.
The recommendation.of the Police Committee that the bid of Clements Chevrolet
Company for the furnishing of two patrol cars for use in the Police Department in the
,amount of $1145.00 (plus tradein of a 194LS and 1949 Ford Fordor Sedans)' be accepted was j

read and upon motion by Amundsen, second by Kennedy, the'recommendation was approved.
Bids for the furnishing of 150 parking meters for the City of Rochester were
��again considered by the Common Council. The recommendation of the Common Council, acting
las a committee of the whole, that 125 parking meters -be purchased from the Park-O-Meter
Company and 25 Miller Meters be purchased from the Duncan Meter Company, meters to be
installed by the City
, was read and upon motion by Amundsen, second by Theel, the
Irecommendation was approved.

An Ordinance entitled, "An Ordinance creating a planning and zoning commission
for the physical development and welfare of. the City of Rochester, Minnesota", -was given
its third and final reading.
Upon motion by Morris, second by Kennedy, that the said Ordinance be adopted as
read and all voting in favor thereof, President pro tem Anderson declared the said
Ordinance duly passed and adopted. 11

Air. Ed Dornack again appeared before the Council and urged that the channel
of Cascade Creek in Northwest Rochester be cleaned. A motion was made by Miner, instructing
the City Engineer to proceed with the cleaning of the said creek and that the sum of •
$499.00 be appropriated for that purpose. The motion was declared out of order for want
of a second.
After discussing the matter further, a motion was made 'by Morris, second by

Theel, instructing the City Attorney to request a ruling from the Attorney General s
office as to the City's right to expend money from the General Fund for the purpose of
cleaning the channel of Cascade Creek between 7th Street Northwest and loth Street
Northwest. All voted in favor of the motion.
Upon motion by Miner, second by Amundsen, the City Engineer was instructed to
bring in a report as to the amount of work necessary for the cleaning of the said Cascade
Creek channel.
Mr. Barry, of the Barry Plumbing & Heating Company, was before the Council and
complained that he had not been examined by the Plumbing and Heating Board as to his
qualifications for operating a plumbing and heating establishment in the City of Rochester.
Upon motion by Miner, second by Kennedy, the City -Attorney was instructed to investigate
the matter and to determine as to why examinations had not been given to those applying
for heating and plumbing licenses. ,
A delegation from Northeast Rochester was present at the Council meeting in ,
regard. to the installation of a sidewalk on the South side of loth Street Northeast
between 12th and 13th Avenue Northeast. Upon motion by Theel, second by Amundsen, the
matter was referred to the Street & Alley Committee for a report at the next meeting.
Mr. J. J. Kerr .presented a plat of the following described lands to be known
as Jane's Addition:
"Commencing at a point fifty (50) feet east of the southwest
corner of lot fifty five (55) State Plat of Section 36,
Township 107 north of range 14 west for a place of beginning
and running thence north one -hundred eighty three (193) feet,
thence east parallel with the south line of said lot to the
east line of lot No. fifty four (5lt) , thence south to the
south line of said lot, thence.south westerly and westerly
to the place of beginning."
Upon motion by Kennedy, second by Theel, the plat was approved as submitted by Mr. J.J.
Kerr and the City Clerk was instructed to complete the certificate showing the action
taken b the Common Council and to have the said plat filed with the Register of Deeds.

Mr. D. W. Hunter, Manager of the Southern Minnesota. Supply Company., was presenll
t the meeting and asked that the City provide a. loading space in front, of their
establishment on -1st Avenue Southwest or that short period parking meters be installed.
Upon motion by Morris, second by Kennedy, the request was referred to the Police
Committee and the Chief of Police.
The request of Raymond D. Pruitt, M. D. , Gordon M. Martin, M. D. , Maurice H.
Stauffer, M. D. and Stanley W. Olson, M. D. to connect a private road with the North end
of 72 Avenue Northeast was read and the same was ordered placed on file.
The recommendation of the Street & Alley Committee that Drs. Pruitt, Martin,
Stauffer and Olson be permitted to connect a private road with the north end of 72
Avenue Northeast, the same to be done under -the supervision of the City Engineer, was
read and upon motion by Morris, second by Theel, the recommendation was,'approved.
The recommendation of the Street & Alley Committee that a -material spreader
purchased for use of the Street and Alley Department,• at a. cost of approximately $380.00,'

was read and upon motion by Morris, second by Kennedy, the recommendation was approved,
The recommendation of the S.treet.& Alley Committee that bids be taken for

the furnishing of an air compressor for use of the St-reet and Alley Department was read
nd upon motion by Theel, second by Kennedy, the recommendation was approved.
The recommendation of the Public Grounds Committee, acting upon the offer of
he Housing and Home .Finance Agency, public housing administration, that the City accept
he transfer of the temporary housing now operated by the federal government on .the
Olmsted County Fairgrounds, was read and upon motion by Theel, second by Miner, the
recommendation was approved.
The following report was read and upon motion by Kennedy, second by Miner., thei

Gentlemen:
On September 6th the Common Council appointed the undersigned
as a committee of -four to investigate and report back to the Council
on the matter of a site for the Community Hospital. More sp'ecifica.11y,
we were to recommend to the Council as to whether or not -they should
make available to Olmsted County land on Fourth Street Southeast at
the present new Health Center location if this site should be selected
for the County Hospital.
We recommend that any of that portion of land already assigned to
the Health Center and not actually occupied by the Health Center
building be made available to the County for the Hospital site.
Further, we see no objection to a. driveway or walkway immediately
west of this tract providing it was left at the approximate present
grade and providing further that no parking be permitted on this
area. However, because good sanitary practices would not permit an
underground sewer within 50 feet of a well(t:h,e preferable practice
being 100 to 150 feet) we recommend that no building be permitted
west of the west line of the present Health Center building.

Mr. C. J. Berg, representing the American Federation of Labor Trades Council,
requested that an adjustment be made in the labor rates in the Public Utility Department.
He stated that their monthly rate wis 5¢ below the City's rate of labor. A motion was
made by Miner, second by Kennedy, that a report be obtained from the Public Utility
Board on the matter.
The request of the Mayo Association for permission to remove the temporary wire
enclosures installed by them in the Old Mill Building was read and upon motion by
Kennedy, second by Amundsen, their request was granted.
A notice of the 1950 Annual Conference of Mayors to be held in New York City
after January lst, 1950 was read and the same was ordered placed on file.
The request of C. R. Holland., M. D. that the parking place assigned to him be
changed -to the east side of the alley in front of Hargesheimer's Restaurant was read and
upon motion by Miner, second by Kennedy, the request was granted.
A communication from T. G. Evensen & Associates Inc. of Minneapolis requesting
an opportunity of explaining their services in connection with the financing of the
proposed sewage treatment plant was read and upon motion by Kennedy, second by Theel,
the same :ias ordered ulaced on file.
An order of the United States District Court for the Eastern Division of the
Eastern Judicial District of Missouri approving a petition for an arrangement and
providing for certain other relief in the matter of Universal Insulation Corporation of
Missouri, Debtor was read and the same was ordered placed on file.

The petition of Corwin Stoppel that Lot 4, Block 6, Irelands First Addition
be changed from a residential to a commercial zone was read a,nd upon motion by Theel,
second by Kennedy, the same was referred to the Zoning Board.
The petition of Robert C. Pagenhart to annex the following described property
to the City of Rochester was read;
"Lot four (4) and the North one half of lot five (5), e
in Block two (2) of Parkin's Subdivision of a part
of the Northeast one quarter (NE4) of Section No.
three (3) in Township No. one hundred six (T 106)
North, of Range No. fourteen (R 14) viest, in Olmsted
County, Idinnesota. "
Upon motion by Theel, second by Kennedy, the City Attorney was instructed to prepare an
Ordinance annexing the above described property to the City of Rochester.
A letter from the Board of Park Commissioners requesting approval of the name
"John R. Cook Park" for the Northwest public park1cXX area on 7th Street Northwest was
read and upon motion by Amundsen, second by Kennedy, the request of the Board of Park
Commissioners was approved.
A communication from McGhie & Armstrong transmitting 9 conies of statement of
engineering services #1, covering engineering fees for plans and specifications on the
bituminous seal coating project at the Rochester Airport was read and upon motion by

Mayor Mcquillan read a letter from the Federal Housing authorities and a i
notice of a conference to be held in St. Paul at the State Capitol on October 29, 1949.

Upon motion by Kennedy, second by Theel, the members of the Survey Committee, the Mayor 'iI
and the Council were authorized to attend the said conference at City expense.
A report by C. E. Ginther, Chief of the Fire Department, on the 76th Annual
Conference of International Association of Fire Chiefs was read and the same was orderedl
placed on file.

The City Treasurer's report for September, 1949 was read and the same was ordered
(placed on file.
The report of the City Weighmaster for the month of September„ 1949 showing
451 loads weighed and fees in the amount of $45.10 was read and the same was ordered
laced. on file.
The City Engineers trial balance for September, 1949 was read and the same
was ordered placed on file.
The reports of the Clerk of the Municipal Court for the week ending October
1949 showing total criminal fines and costs collected-$1,080..00 and civil fees received
$3.65 and for the week ending October 15, 1949 showing total criminal fines and costs
collected $1,086.50 and civil fees received $9.40, were each.read and having been
previously approved by the City Attorney, Preside-nt pro tem Anderson ordered that the
same be placed on file.
The application of William E. Just for "Off Sale" non -intoxicating malt liquorl
icense was read.and upon_ motion by Miner, second by K-ennedy, the license was granted.
The applications of William E. Just and Mike Caffes for license to sell
igarettes were each r-ead and upon motion by Morris, second by Miner, the licenses were
granted.
The applications of William E. Just and Mike Ca.ffes for license to sell soft
(drinks were each read and upon motion by Theel, second -by Amundsen, the licenses were
(granted.
The application of Francis Christopherson for a cement contractors license
(was read and upon motion by Kennedy, second by Amundsen, th-e license was granted.

Alderman Ke-nnedy introduced a resolution accepting the bid of Park-O-Meter
Company for furnishing 125 parking meters and Duncan -Meter Corporation for furnishing 25 it

Alderman Miner introduced a resolution levying special assessments for grading
and paving of the alley in Block 36, Original Plat, which was read.

resolution duly passed and adopted.
Alderman Miner introduced a resolution appropriating $492.90 from the General •
Fundand ordering payment made to Rochester Post Bulletin for publishing proceedings,
notices,, etc., .which was read.

Alderman Miner introduced a resolution appropriating $347.43 from the General
Fund and ordering payment made to A. Dornack for repairs at the City Hall, which was

Alderman Theel introduced a resolution appropriating $69.52 from the Sewer
Fund and $394.09 from the Lighting Fund and ordering payment made to City of Rochester,
Public Utilities, which was read.
Upon motion by Theel, second by Amundsen, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $260.67 from the Park
Improvement Fund and ordering payment made to Scheidel & Company for premium on policy
No. 2772713, which was read. •
Upon motion by Amundsen, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $443.54 from -the Park
Improvement Fund and ordering payment made to Paster Cleaners for redecorating at the
auditorium, which was read.
Upon motion by Kennedy, second by Miner, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $659.00 from the Park
Improvement Fund andordering payment made to Hugh Vincent Feehan, which was read.
Upon motion by Miner, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $1,275.00 from the Park
Improvement Fund and ordering payment made to Speedy Sales Company for one power Ra.kelean,
which was read.
Upon motion by Morris, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said •
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $2,591.55 from the
Park Improvement Fund and ordering payment made to Mayo Civic Auditorium Revolving Fund,
which was read.
Upon motion by Theel, second by Amundsen, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $347.76 from the Park
Improvement Fund and $57.60 from the Lighting Fund and ordering payment made to City of
Rochester, Public Utilities, which was read.
Upon motion by Amundsen, second by Kennedy, that the said resolution be adopted
