November 7, i. .1949 1 1 • 1 0 ■ Minutes of a regular meeting of the Common Council of the City' of Rochester, Minnesota, held in.the Council Chambers, in the City Hall in,said City, on November 7, 1949. I President nro tem Anderson called the meeting to order at 2:00 o'clock P.M., the following members being present: Aldermen Amundsen, Anderson, ,Kennedy, "diner, Morris, and Theel. Absent: President Lemmon, due to illness. I �I Upon motion by Theel, second by Morris, the minutes of the meetings of I October 17th and October 31st, 1949 were approved. President pro tem Anderson stated this as being the time and place set for receiving and opening bids for the furnishing and installing of two 100,000 BTU Gas i; Fired Unit Heaters for the City Warehouse. The bids of Alpek Sheet Metal Works in the: amount of $572.00 and Utility Sales & Engineering Company in the amount of $627.00 were each received and opened and the same were referred to the Purchasing Committee and.the City Engineer for tabulation and recommendation. The recommendation of the Purchasing Committee that the contract for the, I furnishing of two unit heaters for the City Warehouse be awarded to Alpek Sheet Metal Works in the amount of $572.00 was read and upon motion by Miner, second by Morris, the recommendation was approved., and the City Clerk was authorized to return the check of the unsuccessful bidder. President pro tem Anderson stated this as being the time and place set for a earing on the levying of special assessments for the construction of a sanitary sewer watermain on North Broadway from 14th Street to 50 feet North of the South line of Outlot 25, Northern Addition. Mr. Samuel P. Allen, representing Julius Sonnenberg, asked that the ass.essment costs for sanitary sewer and watermain be set, up by Ordinance as an accounts receivable until such time as connections are made to the said sanitary sewer and watermain. Upon motion by Theel, second by Kennedy, the hearing on the matter: was continued until the meeting of November 21, 1949. I Mr. Jack Batdorf was before the Council and inquired as to whether or not the Council had taken any action on the matter of purchasing land for a street as shown on the plat previously submitted. Upon motion by Ke,nnedy, second by Theel, the matter -was referred to the Common Council as a 'committee of the whole' for further, study. IIMr. Clarence J. Berg again brought to the attention of the Common Council the atter of scales for labor employed by the Electric Department who are now being paid n a monthly basis but who are not employed during the entire year. Upon motion by Theel, econd by Kennedy, the matter was .referred to the Public Utility Board. Mr. Roy Schermerhorn, of Schermerhorn and Fitzpatrick Insurance Agency, requested ermission to solicit the City employees for group life insurance. Upon motion by orris, second by Miner, he was granted the privilege of soliciting the, City employees or group life insurance, the City not to be obligated for the payment 'of any expense or remiums in connection with the same. Record of Official Proceedings of the Common Council of. the.City. of Rochester, Minn., November . 7, 1949 ` Mr. Waterman Hendricks advised the Council that the cars on which the Clements Chevrolet Company bid for the Police Department could not be furnished with the special items which were included in the bid accepted by the Council. However, 1950 models• could be furnished which would include the said special items if the City was willing to wait for the delivery. Upon motion by Theel, second by Miner, the matter was referred to the Police Committee, the Chief •of Police and the City Attorney for report a•t the meeting of November 21, 1949. The recommendation of the Street & Alley Committee that East Center Street from 6th to llth Avenue, Eleventh Avenue Southeast from East Center Street to 4th Street • Southeast and Fourth Street Southeast from llth Avenue to 6th Avenue Southeast be widened, including the construction of new curbs, the same to be assessed against the abutting-property,was read and upon motion by Morris, second by Miner, the• recommendation was approved. The recommendation of the Street & Alley Committee that a sidewalk be ordered constructed on the South side of Tenth Street Northeast from Twelfth Avenue to Thirteenth Avenue Northeast in.abutting Lots 1 and 28, Block 2, Thurber's First Sub - Division, in accordance with charter provisions, was read and• upon motion by Theel, second by Morris, the recommendation was approved. The recommendation of the Zoning Board that that part of the East z of Sec. 34, Town 107, Range 14 bounded as follows, beginning at a point on the east line of said. Sec. 34 which is 313.5 feet south of the south line of the right of the Chicago and Great Western Railroad, thence west on a line at right angles -to said east line of the said Sec. 34, 220 feet, thence south on a line parallel with said east line of Sec. 34 100 feet, thence east on a line at right angles to said east line of Sec. 34, 220 feet to said east line of Sec. 34, thence north along said east line of Sec. •34, 100 feet to place of beginning, subject to easement for existing highways," be changed from a residential to an industrial zone was read and upon motion by Theel, second by Miner, the recommendation was approved and the City Clerk was instructed to publish a notice of hearing to be held on November 21, 1949. Upon motia>n by Theel, second by Miner, the City Attorney was instructed to prepare an amendment to the Zoning Ordinance including the above -described property in the industrial zone. An invitation to the Mayor and the members of the Common Council to attend the open house to be held in the Library on November 14, 1949 was read and the same was ordered placed on file. A communication from the State of Minnesota, Department of . Administra.ti on, i regarding the matter of decontrolling rents in Municipalities in Minnesota was read and the same was ordered placed on file. A complaint by Hermann Klinsmann that the sanitary sewer serving Third Street Southeast between Third Avenue Southeast and the Zumbro -River is not adequate to handle i the sewage in that locality was read together with his request for reimbursement of -two I bills for opening the said sewer line and upon motion by Theel, second by Amundsen, the �I 'I matters were referred to the -City Attorney. A letter from Toltz, King and Day, Inc. calling to the attention of the Coo-uncil that Federal Funds may be borrowed from the Federal Government for the purpose of preparing plans for all sorts of public improvements was read and the same was ordered placed on file. A recommendation, by the Board of Park Commissioners that an underpass on I Second Avenue Northeast under the Chicago Northwest -ern Railway tracks, to handle tra.ffic,l i between north and south Rochester, be constructed was read and. the same was ordered placed on file. it Two requests for.the approval of change orderes in connection with the const-ruction of the new public health center building were each read and the same were ordered placed on file. j A petition for the vacation of Second Avenue Northeast between 14th Street and!' 15th Street Northeast was read and upon motion by Morris, second by Theel, the same was.Il� referred to the Street &.Alley Committee and the City Engineer. A petition signed by 15 members of the Rochester Liquor Dealers Association that the liquor ordinance be amended so as to permit -the serving of patrons at the bar � I ,was read. and upon- motion by Kennedy, second by Amundsen, the same was referred to the l License Committee. �I The City Engineer's trial balance for the month of October, 1949 was read and the same was ordered placed on file. The reports for the month of October, 1949 of the Building Inspector showing fees received for building permits issued in the amount of $299.00; of the Electrical Inspector showing fees received for electrical permits issued in the amount of $75.50; of the Heating Inspector showing fees received for heating permits issued in the amount of $153.75 and of the Plumbing Inspector showing fees received for plumbing permits issued in the amount of $497.75, were each read and the same were ordered placed on file. The reports of the Clerk of the Municipal Court for the week ending October 22, • 1949 showing total criminal fines and costs collected $434.'40 and civil fees received $10.35; for the week ending October 29,, 1949 showing total criminal fines and costs collected $590. So and civil fees received $3.05 and for the week ending November 5, 1949 showing total criminal fines and costs collected $624.00 and civil fees received $3.75, were each read and having been previously approved by the City Attorney, President pro tem Anderson ordered that the same be placed on file. The application of David L. Nichols for license to connect with sewers and drains was read and upon motion by Morris, second by Miner, the same was referred to the License Committee. The application of Nevenheim Motor Service for a permit to place and maintain a. sign was read and upon motion by Miner, second by Morris, the permit was granted. The application of the Fraternal Order of Eagles, Zumbro Aerie #2229, for the transfer of their "On Sale" Liquor License and their cigarette, soft drink and "On Sale" non -intoxicating malt liquor licenses from 121 Fourth Street Southwest to 409-411 First Avenue Southwest was read and upon motion by Morris, second by Amundsen, the transfers were granted. The application of D. Ross Runyon for a Journeyman Heating Workers' and Steam Fitters license was read and upon motion by Amundsen, second by Kennedy, the. license was granted. Alderman Amundsen introduced a resolution appropriating $400.00 from the • General Fund and ordering payment made to the Rochester Airport Company for rental of Rosco Distributor, which was read. Upon motion by Amundsen, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, Pre.sident pro tem Anderson declared the said resolution duly passed and adopted. An Ordinance annexing to the City of Rochester, Minnesota, Lot 4 and the North one half of Lot 5, in Block 2, of Parkin's Sub -Division of a part of the Northeast One Quarter of Section Three, in Township No. One Hundred Six, North, of Range No. 14 West, in Olmsted County, Minnesota was given its first reading. A motion was made by Kennedy, second by Amundsen, that the Chief of Police make an overall survey of parking in the down town area of the City to determine locations for additional parking meters and the limitation of time allowed on the meters for 1parking. All voted in favor of the motion. u i The City Attorney read an opinion from the Attorney General's office in regard to the cleaning of the Cascade Creek Channel between 7th Street and loth Street •Northwest. Upon motion by Miner, second by Theel, the matter was referred to the Public Health & Welfare Department for report at the next Council meeting. it Upon motion by Theel, second by Kennedy, the City Engineer was instructed to set up a plan to operate the parking lot South of 3rd Street Southeast at the location known as the Old Mill Building. The matter of a, location for the proposed Count Hospital Building and p y g pa.rking, ).rea in.connection with same wasagain brought to the attention of the Council. A motion was made by Amundsen, second by Theel, instructing the City Attbrney to prepare the necessary papers for the transfer of the said property should the County' determine to use the said land's for the site of the proposed hospital, certain'stipulations as to the development of the property to be agreed upon by the County and the City.
