President pro tem Anderson called.the meeting to order at 7:30 o'clock P. M., he following members being present: .Aldermen Amundsen, Anderson, Kennedy, Miner, Morris, I nd Theel. Absent: President Lemmon, due to illness. Upon motion by Theel, second by Miner,,the minutes of the meetings of January 3 nd January 10, 1950 were approved. ' President pro tem Anderson stated this as being the time and place set for I eceiving and opening bids for construction of footings for a second section of a new I ity warehouse for the Engineer!s,Department.. No bids were received. President pro tem Anderson stated this as being the time and place set for a searing on the proposed change of zoning of Leiferman-Koehnen's Sub -Division from a residential to a commercial zone. Mr. George Leiferman and Mr. Andrew Koehnen were i present and again urged that the change in zoning be made. Mr. Clinton Berkins and Mr. I Frank Steins, residents in that locality, protested the proposed zoning change. Upon motion b y Amundsen, second by Theel, the recommendation of the Board of Zoning that the li I property be rezoned as commercial area was approved and the City Attorney was instructed] to draw an amendment to the.Ordinance designating the said property as commercial. i President pro tem Anderson stated this as being the time and place set for a j I hearing on the proposed change of zoning of Barck & Merz Addition to the City of Rochester, Minnesota except Lots 1 and 2, in Block 4 and Lots 3 and 4 in Block 1 of the said addition from a residential toa multiple dwelling zone. Mr. George Leiferman and Mr. Andrew Koehnen, the petitioners, were present and again urged that the zoning change be made. No one was present protesting the proposed zoning change. Upon motion by Theel, second by Morris, the recommendation of the Board of Zoning that the said property be rezoned as multiple dwelling area was approved and the City Attorney was instructed to prepare an amendment to the Zoning Ordinance designating the said property as multiple dwelling. President pro tem Anderson stated this as being the time and place set for a earing on the proposed change in zoning of Lot 24, Block �+, A. W. Kutzky's First dition from a residential zone to a commercial zone. Mr. Oscar Ronken, Attorney epresenting property owners and residents in the area located on the North side of 2nd Street Southwest and between lath Avenue and 16th Avenue Southwest, protested the roposed zoning change, stating that those interested felt that there was no definite emand for a commercial zone in that area at this time. Mr. Andrew Koeh"nen urged that the above described property be rezoned as commercial. Alderman Miner moved that the recommendation of the Board of. Zoning that the property be rezoned as commercial be_ approved. His motion was declared out of order for want of a second. Upon motion by a.a Record of Official Proceedings of the Common Council S of the City of Rochester, Minn., _ January 16, 1950 Morris, second by Amundsen, the recommendation of the Board of Zoning was denied. A notice from the League of Minnesota Municipalities of municipal short courses to be held at the University of Minnesota on the following dates was read: Councilmen's School Feb. 10-11— Assessors' School Mar. 9-11 ,dater School Mar.13-15 Sewer School Mar. 16-18 Finance School Mar. 16-19 Electric Metermen's School Mar. 2e-24 The said notice was ordered placed on file and the City Clerk was requested to make reservations for Aldermen interested in attending the Councilmen's School to be held on February 10 and 11. • A notice of hearing in the matter of the application of Jefferson Transportation Company for authority to increase its Intrastate Passenger Fares within the State of Minnesota, the said hearing to be held in room 470, State Office Building, on January 27, 1950 at 10:00 A. M. was read and the same was ordered placed on file. An invitation from the Minnesota Police and Peace Officers Association to public officials,whose work is connected with law enforcement, to become members of their association was read and the same was ordered placed on file. The matter of an option for the extension of the lease of the Mill property, for an additional year from November 1, 1950 as requested by General Mills, Inc. was again considered by the Council. Upon motion by Amundsen, second by Miner, the City Clerk was instructed to notify General Mills, Inc. that the Council did not wish to extend the lease at this time. A communication from the Board of Park Commissioners requesting that if the bridge in Mayo Park was moved to loth Street Northwest a. new bridge be constructed in was read. Slatterly Park across Bear Creek and be paid for from the Bridge Fund/ The Communication was ordered placed on file. A plat of lands in the City of Rochester to be known as Fawcett's Sub -Division and described as follows was presented: "The North two hundred seventy eight and five tenths'(278.5) feet of the East two hundred (200) feet of Lot thirty two (32) State Plat of Section • Thirty Six (36) Township One Hundred Seven (107) North of Mange Fourteen (14) West, and that part of Lot Thirty three (33) described as follows: Commencing at the southeast corner of said Lot for a place of beginning and running thence North Fifty five (55) feet, thence Nest Ninety Nine (99) feet,.thence North Fifty (50) feet, thence west one hundred one (101) feet, thence south one hundred five (105) feet, to south line of said Lot, thence east along south line of said lot two hundred (200) feet to place of beginning." Upon motion by Kennedy, second by Theel, the plat was accepted and the City Clerk was authorized to execute the certificate showing the action taken by the Common Council and have the same recorded in .the office of the Register of Deeds. . Upon motion by Kennedy, second by Theel, the plat was accepted and the City Clerk was ,I authorized to execute the certificate showing the action taken bythe Common Council and; have the same recorded in the office of the Register of Deeds. i A petition to install curb and i p gutter on loth Avenue Northeast from 3rd Street; to 5th Street Northeast was read and upon motion by Miner, second by Theel, the same wa referred to the Street & Alley Committee and the City Engineer. The following communication from Desmond B. Hunt, City Attorney, was read and, President pro tem Anderson ordered that the same be placed on file: "The Mayor and the Common Council of the City of Rochester, Minnesota Gentlemen: On December 20th a claim was filed by Helen C. Hadsell ; charging the city with negligence in permitting an accumulation of ice to gather upon the sidewalk near the intersection of First Avenue Northwest and Center Street. Investigation of the facts would warrant'a denial of any payment on this claim. Yours very truly, i Desmond B. Hunt City Attorney" j The recommendation of the Street &Alley Committee that the 'footbridge adjacent to the new Mayo Park bridge be moved to Tenth Street Northwest crossing Cascade Creek, and that the City Engineer be instructed to prepare the necessary abutments immediately was read and upon motion by Theel, second by Miner, the recommendation was approved., and ordered placed on file. The recommendation of the.Street & Alley Committee that no action be taken on,! i i the matter, of an alley in Blocks 20, Northern Addition and 74, Original Plat until a 'I petition is received from a majority of the property owners in said block was read and upon motion by Theel, second by Kennedy, the recommendation was approved and ordered placed on file. ,I The recommendation of the Sewer Committee that bids be taken for the purchase' of 300 lineal feet of 30 inch reinforced concrete sewer pipe for use in extending a storm sewer on Second Avenue Northwest north of Thirteenth Street was read and upon motion by i Amundsen, second by Kennedy, the City Clerk was instructed to prepare a resolution for the meeting of February 6, 1950 ordering bids for same. Kerr conformed to the regulations contained in Ordinance No. 704 and that the same be approved was read and upon motion by Amundsen, second by Kennedy, the said recommendation was approved. The City Engineer's recommendation that the plat of the East one-half of Block S and Blocks 9 and 10, Mohn and Hodge Sub -Division be•approved when the following correction is made, that Lots 19 and 19 be split north and south to provide a 60 foot by 100 foot corner lot and a 55 by 100 foot lot adjacent to it, was read and upon motion by Kennedy, second by Miner, the recommendation was approved. The City Treasurer s report for the month of December, 1949 was read and the same was ordered placed on file. The reports of the Clerk of the Municipal Court for the week ended January 7, 1950 showing total criminal fines and costs collected $541.00 and for the week ended January 14, 1950 showing total criminal fines.and costs collected $681.00 and civil fees received $1.05, were each read and having been -previously approved by the City Attorney, President pro tem Anderson ordered that the same be placed on file. The applications of Walter H. Van Lith for license to sell cigarettes and soft drinks were each read and upon motion by Theel, second by Amundsen, the licenses were granted. The surety bonds of L. J. Fiegel in the amount of $2,500.00 with the Western Surety Company as surety and T. H. Johansen in the amount of $1,000.00 with the Aetna Casualty and Surety Company as surety were each read and upon motion by Theel, second by Amundsen, the bonds were approved; the surety thereon accepted and it was ordered that the same be placed on file. Alderman Miner introduced a resolution appropriating $264.00 from the General Fund and ordering payment made to Rochester Post Bulletin for publishing minutes, notices, ordinances, etc., which was read. Upon motion by Amundsen, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President pro tem Anderson declared the said resolution duly passed and adopted. • Alderman Miner introduced a resolution appropriating $442.75 from the General Fund and ordering payment made to Joe Nelson for drilling test holes at East Center Street Bridge, which was read. Upon motion by Kennedy, second by Miner, that the said resolution be adopted as read, and all voting in favor thereof, President pro tem Anderson declared the said resolution duly passed and adopted. Alderman Miner introduced a resolution appropriating $297.50 from the General Fund and ordering payment made to nersten Furs for police caps, which was read. Alderman Miner introduced a resolution appropriating $13.50 from the Parking eter Fund, $224.75 from the General Fund, $597.50 from the Street & Alley Fund, $2s2.5o rom the Sewer Fund and $90.50 from the Bridge Fund and ordering payment made to the treet & Alley Fund for use of equipment during December, 1949, which was read. Alderman Morris introduced a resolution appropriating $912. 72 from the-P.I.R. 'i and and ordering payment made to Carlisle G. Fraser for 5°p' retained on curb and gutter I obs , which was read. Upon motion by Kennedy, second by Miner, that the said resolution be adopted Is read, and -all voting in favor thereof,. President pro tem Anderson declared the said esolution duly passed and adopted. Alderman Morris introduced a resolution appropriating $275.94 from the-P.I.R. d and ordering payment made to C. M. Boutelle for 5% retained on curb and gutter jobs, hich was read. Upon motion by Miner, second by Morris, that the said resolution be adopted s read, and all -voting in favor -thereof, President pro tem Anderson declared the said esolution duly passed and adopted. Alderman Morris introduced a resolution appropriating $84.24 from the Sewer and and $497.16 from the Lighting .Fund and ordering payment made to City of Rochester, !1 �I ublic.Utilities, which was read. Alderman Kennedy introduced a resolution appropriating $207.93 from the Park Improvement Fund and ordering payment made to Alpek Sheet Metal Works for clamps, repair ice scrapers, etc., which was read. Alderman Kennedy introduced a resolution appropriating $602.03 from the Park Improvement Fund and ordering payment made to Reynolds Wholesale Company for merchandise delivered to auditorium concession stand, which was read. Upon motion by Kennedy, second by Miner, that the said resolution be adopted as read, and all voting in favor thereof, &resident pro tem Anderson declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution appropriating $216.20 from the Park Improvement Fund and ordering payment made to The Kruse Company, which was read. Upon motion by Miner, second by Morris, that the said resolution be adopted as read, and all voting in favor thereof, President pro tem Anderson declared the said resolution duly passed.and adopted. Alderman Kennedy introduced a resolution appropriating $246.00 from the Park Improvement Frond and ordering payment made to Bach Music Company for one Wurlitzer piano, which was read. January 16, 195o 1 CJ 1 • Ll Alderman Miner stated that lights had been removed from both ends of the foot bridge on the East side of Mayo Park and recommended that lights be replaced on the bridge on poles so that the same could not be easily removed. Upon motion by Miner, second by Amundsen, the Public Utility Department was instructed to install the said lights. The matter of sharing the cost of the proposed new radio equipment for the Police Department with Olmsted County, due to the fact that the Sheriff's office will receive service through the Police Radio Station,' was discussed. A motion was made by l q Kennedy, second by Amundsen, that the Police Committee meet with the County Commissioners in regard to. the matter. A letter submitted to Alderman Kennedy,. Chairman and members of the Street & (Alley Committee by the City Engineer requesting that a new motor patrol be purchased for use in the City Engineer's department was read.
