Record of Official Proceedings of the Common Council
of -the City of Rochester, Minn., February 6, 1950
Minutes of a regular meeting of the Common Council of the City of Rochester,
Minnesota, held in the Council Chambers, in the City Hall in said City, on February 6,
1950.
President pro tem Anderson called the meeting to order at 2:00 o'clock P. M.,
the following members being present: Aldermen Anderson, Amundsen, Kennedy, Miner,
Morris, and Theel. Absent: President Lemmon, due to illness.
Upon motion by Morris, second by Theel, the minutes of the meetings of
January 13th and January 16th, 1950i were approved.
President pro tem Anderson stated this as being the time and place set for •
receiving and opening bids for furnishing 25,000 Chamber of Commerce City Booklets. The
bids of Whiting Press, Inc. in the amount of $2,995.00 and Schmidt Printing Company in
the amount of $3,070.45 were each received and opened and upon motion by Theel, second
by Miner, the same were referred to the Chamber of Commerce and the Purchasing Committee
of the Council.
The following communication from the Rochester Typographical Union, No. 819
was read and the same was referred to the Chamber of Commerce and the Purchasing Committee
together with the bids for the Chamber of Commerce City Booklets:

The Rochester Typographical Union #819 is very interested in
the Chamber of Commerce City Booklet, soon to be printed.
Due to the wide distribution of this booklet we urge that
every consideration be given to the use of the Union Label and
have it printed in a union shop. The following firms are union
shops in Rochester: Jones ? Schmelzer, Schmidt Printing Company
and The Quality Printing Company.

pro tem Anderson stated this as being the time and
place set for

radio communication
equipment
for use in
the Police department. The bids of Link Radio Corporation
in the.
amount of
$4,672.50
and Motorola, Inc. in the amount of $5,639.50 were
each received
and opened
and upon
motion by Theel, second by Kennedy, the same were
referred to the
Police Committee and the Chief of Police.
The recommendation of the Police Committee and the Chief of Police that all
bids for two-way police radio equipment be rejected and the Council re -advertise for
bids was read and upon motion by Kennedy, second by Amundsen, the same was approved.
Mr. Emil Heintz was present at the meeting and requested permission to hold
the classes of a school on Municipal Government in the Council Chambers. Upon motion by
Kennedy, second by Miner, the request was granted.

A communication from Barnard Curtiss Company, Contractors of Minneapolis,
offering for sale one used Caterpillar diesel motor patrol for the sum of $9,500.00 was
read and -resident pro tem Anderson ordered that the same be placed on file.
A letter from A. C. Allyn and Company of Chicago regarding the proposed bond
issue for the construction of sewers and. a sewage treatment plant was read and the'same
was ordered placed on file.

A request from the Podein Freight Ways that the Council act on their request
to purchase land owned by the City and adjoining their property was read and upon motion'I
by Kennedy, second by Miner, the same was referred to the Public Grounds Committee and
the City Engineer.
A communication from the Gamehaven Area Council of the Boy Scouts expressing

their appreciation for the appropriation made by the Common Council covering auditorium

rentals was read and the same was ordered placed on file.

The request of the Lincoln School F.T.A. for permission to operate a Bingo

Game on February 17, 1950 was read and the same was ordered placed on file.
A notice of the 1950 Annual Conference of Mayors to be held in New York City
Ion May 11 to 13, 1950 iwas read and the same was ordered placed on file.
A summons and complaint in thematter of Walter Crandall, Plaintiff Vs City ofJ

Rochester, Defendant, was read and the same was referred to the City Attorney.
The request of the Library Board that a transfer of $5,000.00 be made from thel

General Fund to the Public Library Fund was read and the City Clerk was instructed to

prepare a resolution for the said appropriation to be presented at the meeting to be
held on February 20, 1950.

The Mayor's appointment of Ambrose L. Campion as Weed Inspector for the City
f Robhester was read and upon motion by Theel, second by Kennedy, the same was approved:

A notice of claim for damages to real estate owned by Ellen G. Chandler, as
submitted by her attorney Joseph A. Streiff, was read and upon motion by Theel, second
by Amundsen, the same was referred to the Street & Alley Committee, the City Engineer
and the City Attorney.
A communication from Ralph E. Aird, Secretary of the Rochester Central Labor
Union, requesting that the Council cooperate in using the union label on all. City
printed matter whenever possible was read and the same was ordered placed on file.
A notice from the Fireman's Civil Service Commission of .the appointments of
Francis Strom, Donald Grimm, Richard Huston, Richard Miller and Charles Hayes, effective
February 6, 1950, was read and upon motion by Amundsen, second by Miner, the appointments
were approved.
The request of Regan and Edwards that Lot 11, Block 91, Original Plat of the
City of Rochester be changed from a residential zone to a commercial zone was read and
upon motion by Kennedy, second by Miner, the same was referred to the Board of Zoning.
A request from Elmo W. Holets, 1st Lt. MNG, Chairman of the Armory Board, that
the Council make an appropriation for the maintenance of the Rochester Armory was read
and the City Clerk was instructed to prepare a resolution to be presented at the meeting
of February 20, 1950 appropriating $500.00 from the General Fund for the maintenance of
the Rochester Armory Building.
Mayor McQuillan brought up the matter of operating a beauty parlor at the
corner of 2nd Street and 13th Avenue Southwest, known as 1301 Second Street Southwest.
After discussing the matter the City Attorney recommended that a public hearing be held
on the matter and upon ,notion by Miner, second by Theel, the City Clerk was instructed
to publish a notice of the hearing at a meeting of the Common Council to be held on
February 20, 1950 at 7:30 o'clock P.M.
The following recommendation of the Street and Alley Committee was read and
upon motion by Theel, second by Morris, the same was approved:
"Honorable Mayor and Common Council
Of the City of Rochester, Minnesota
Gentlemen:
We, the undersigned members of the Street and Alley
Committee, recommend that the request of Mrs. Peter Christiansen,
904 First Street S. E. for a rebate of a portion of the cost of her
Curb and Gutter Assessment be denied. We further recommend that if
Mrs. Christiansen so desires, the work in question be replaced, it
being understood that the contractor will replace the work if the
present concrete is removed by the City.
We further recommend that this same procedure be applied in
other cases where a similar situation has arisen.

A .statement of receipts and disbursements in the_ Park Improvement Fund for they
month of December, 1950 was read and the same was ordered placed on file.
A report by the Department of Highways covering the Rochester Traffic Survey
'conducted in August, 1948 was read and the same was ordered placed on file.
The reports for the month of January, 1950 of the Building Inspector showing
fees collected for building permits issued in the amount of $124.00; of the Electrical
Inspector showing fees collected for. electrical permits issued in the amount of $38.50; "I
lof the Plumbing Inspector showing fees collected for plumbing permits issued in the
amount of $939.00 and of the Heating Inspector showing fees collected for heating permits
issued in the amount of $155. 00, were each read . and the same were ordered placed on file.
The financial report of the Fire Department Relief Association for the calendar
year ending December 31, 1949 was read and the same was ordered placed on file.
The report of the City Weighmaster for the month of January, 19.50 showing 397
loads weighed and fees collected in the amount of $39.70 was read and the same was
ordered placed on file.

The reports of the Clerk of Municipal Court.for the week ending January 21,

1950 showing total criminal fines and costs collected $559.95 and civil fees received
$3.05; for the week ending January 28, 1950 showing total criminal fines and costs
collected $355.00 and civil fees received $.70; and for the week ending February 4, 1950;
showing total criminal fines and costs .collected $793.00 and civil fees received $4.95, ',

The application of G. Lester Goetting for license to sell cigarettes at retail

The application of Emrold Thiem for a permit to place and maintain a sign was

Alderman Amundsen introduced a resolution appointing Judges -of Election for
the year 1950, which was read.
Upon motion by Amundsen, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof. President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution establishing rates for parking and
storage space at the City Parking Lot, which was read.
Upon motion by Kennedy, second by Miner, that the said resolution be adopted
as read, and all voting in favor thereof, President pro, tem Anderson declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution adopting specifications for -
furnishing 300 feet of 30 inch reinforced concrete sewer pipe for use in extending a
storm sewer on 2nd Avenue Northwest north of 13th Street and ordering bids for same,
which was read.
Upon motion by Miner, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution adopting specifications and ordering
bids for the purchase of a motor patrol for use in the City Engineer's Department,.which •
was read.
Upon motion by Morris, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution.duly passed and adopted. -
Alderman Amundsen introduced a resolution ordering a first hearing on the
construction of a curb and gutter on 4th Avenue Southeast from llth to 12th Street
Southeast which was read.
Upon motion by Theel,-second by Amundsen, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.

Alderman Kennedy introduced a resolution ordering the first. hearing on the
construction of a curb and gutter on 9 Avenue Southeast from llth to 12th Street jl
Southeast, which was read.
Upon motion by Amundsen, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President pro tem Anderson declared

Alderman Kennedy introduced a resolution appropriating $12,840.00.from the
General Fund and ordering payment made to the Public Utility Fund for payment and
interest on loan for purchase of parking lot, which was read.
Upon motion by Theel, second by Amundsen, that the said resolution be adopted

Alderman Kennedy introduced a _resolut ion appropriating $5, 2.00.00 from the
General Fund and ordering payment made to the Park Improvement Fund for final payment.

Fund and ordering payment made to Joe Nelson for drilling test holes at East Center 3

Alderman Kennedy introduced a resolution appropriating $324.00 from the Generail
Fund and ordering payment made to Maass Plumbing & Heating Company for refund on plumbinlg
permits, which was read.

Upon motion by Kennedy, second by Miner, that the said resolution be adopted

Alderman Kennedy introduced a resolution appropriating $354.60 from the General
Fund and ordering payment made to Rochester Post Bulletin for publishing minutes, notices,
ordinances, etc., which was read.
Upon motion by Miner, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted. •
Alderman Miner introduced a resolution appropriating $575.65 from the General
Fund, $756.71 from the Street & Alley Fund and $1.10 from the Sewer Fund and ordering
payment made to the City of Rochester for gasoline furnished, which was read.
Upon motion by Morris, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Miner introduced a resolution appropriating $38.50 from the General
Fund, $572.00 from the Street & Alley Fund and $45.20 from the Sewer Fund and ordering
payment made to Alpek Sheet Metal Works for unit heater, steel sink, etc., which was
read.
Upon motion by Theel, second by Amundsen, that the said resolution be adopted
as read, and all voting in -favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Miner introduced a resolution appropriating $21,241.13 from the
Bridge Fund and ordering payment made to L. M. Feller Company for estimate No. 7 for
construction of -Bridge No. 6589, which was read.
Upon motion by Amundsen, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Miner introduced a resolution appropriating $353.11 from the.Street &
Alley Fund and $6.25 from the Sewer Fund and ordering payment made to the Rochester Sand
& Gravel Company for sand, which was read.
Upon motion by Kennedy, second by Miner, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Miner introduced a resolution appropriating $390.45 from the Sewer
Fund and ordering payment made to What Cheer Clay Products Company for sewer pipe,
which was read.
Upon motion by Miner, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.

Alderman Miner introduced a resolution appropriating $3,379.15 from the Park
Improvement Fund and ordering payment made to the Col -lector of Internal Revenue for
ladmission taxes collected at the auditorium during January, 1950, which was read.
Upon motion by Morris, second by Theel, that the said resolution -be adopted

Alderman Morris introduced a resolution appropriating $528.00 from the Street

Alderman Morris introduced a resolution appropriating $7,144.73 from the

Alderman Morris introduced.a resolution appropriating $256.99 from the General'l
Fund and ordering payment made to Federal Laboratories, Inc. for handcuffs, holsters ands
revolvers, which was read.

Alderman Morris introduced a resolution appropriating $17.25 from the General
Fund, $2.00 from the Street & Alley Fund and $5,092.65 from the Lighting Fund and ordering

Alderman Morris introduced a resolution appropriating $206.55 from the General
Fund and $10.00 from the Sewer Fund and ordering payment made to the N. W. Bell Telephone
Company, which was read.
Upon motion by Amundsen, second by Kennedy,. that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed andadopted.
Alderman Morris introduced a resolution appropriating $13,572.00 from.the •
Permanent Improvement Fund and ordering payment made to Stocke & Olson for estimate No.
11 for construction of Health Center Building, which was read.
Upon motion by Kennedy, second by Miner, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution approving change orders on construction
of Bridge #6599, connecting 2nd Avenue and 2nd Street with 3rd Avenue Southeast, which
was read.
Upon moti.on by Miner, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $495.00 from the General
Fund and $11.00 from the Street & Alley Fund and ordering payment made to T. 0. Wellner,
M.D. for examination of prisoners, which was read.
Upon motion by Morris, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof,, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $76.69 from the Fire
Protection Fund and $155.96 from the Sewer Fund and ordering payment made to Botsford
Lumber Company for coal, which was read. •
Upon motion by Theel, second by Amundsen, that the said resolution be adopted
as read, and.all voting in f.avor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $5,686.17 from the Park
Improvement Fund and ordering payment made to Mayo Civic Auditorium Revolving Fund,
which was read.
Upon motion by Amundsen, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly pass.ed and adopted..
Alderman Theel introduced a resolution granting nine public dance permits to
Archie Dieter, which was read.

An Ordinance entitled, "An Ordinance establishing charges and rates for the
use and service of the sewage works of the City of Rochester, Minnesota," was given its
third and final -reading.
Upon motion by Kennedy, second. by Theel, that the said Ordinance be adopted
as read, and all voting in favor. thereof,. President pro tem Anderson declared the said
Ordinance duly passed and adopted.
An Ordinance amending an Ordinance entitled, "An Ordinance for the purpose -of
promoting health, safety, order, convenience and general welfare by regulating the use
of land, the location, daze, use and height of buildings, and the arrangement of .
buildings on lots, and the density of population- within the City of Rochester, Minnesota,
all in accordance with a comprehensive plan (No. 759)", was given its first reading.
Upon motion by Morris-, second by Theel, and upon roll -call and all voting in
favor thereof, the rules were -suspended and the Ordinance. was given its second reading.
Upon motion -by Kennedy, second by Amundsen, the City Engineer was instructed
to prepare plans and specif-ications for the propos-ed foot bridge in Slatterly Park.

Upon motion by Kennedy, second by Theel,-the City Attorney was authorized to
submit a proposal for settlement for damages -to property owned by MTs. Anna Hagen in the
amount -of $3, 375•00 and prepare a resolution amending a resolution previously adopted
by the Common Council offering a settlenient-* i-n the amount of $2,500:00.
The City Attorney requested permission to -attend a meeting of a Personnel
Committee of the Minnesota League of Municipalities -to be held on February 15" 1950 and
upon motion by Miner, second by Morris, Mr. Hunt was authorized to a-ttend the said
meeting.
Alderman Morris stated that the City Treasurer and the -Manager of the Mayo
Civic.Auditorium had requested permission to procure a night deposit box and upon motion
by Morris, second by Miner, the request was approved.

A motion was made. by Kennedy, second by Theel, that the, City Attorney prepare`
la resolution setting up a Committee to be appointed to.determine as near as possible.
the names of all of those desiring to be served by Federal Housing, the address of said',
individual, their age, etc. All present voted in favor of the motion.
Alderman Morris introduced a resolution authorizing the Engineer's Department
to employ McGhie & Armstro,ng,.Engineers to assist in preparing plans for the bridge
over the Zumbro River on East Center Street, which was read.
Upon motion by Morris, second by Kennedy, that -the said resolution be adopted
las read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Upon motion by Theel, second by Morris, the meeting was adjourned until 7:30
