Minutes of an adjourned regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on
March 1, 1950-
President pro tem Anderson called the meeting to order at 7:30 o'clock P.M.,
the following members being present: Aldermen Amundsen, Anderson, Kennedy, Miner,
Morris, and Theel. Absent: President Lemmon, due to illness.
Upon motion by Amundsen, second by Theel, the minutes of the meeting of
February 15, 1950 were approved.
A notice from the State of Minnesota, Department of Taxation, that an
application for the removal of certain property owned by the Rochester Airport from the
tax rolls submitted by the County Auditor under number 2647 would be heard on March S,
1950 was read and President pro tem Anderson referred the same to the Mayor.
Notice of claim filed by R. W. Scanlan, Attorney for Mrs. Marion Fogarty, for
personal Injury was read and President pro tem Anderson referred the same to the City
Attorney.
Three copies of certifications by the Police Civil Service Commission to
Claude H. McQuillan, Mayor of the City of Rochester, certifying Harold M. Fitzpatrick
to the position of Detective Captain; Lynn D. Peeler to the position of Police Records
Clerk; and Joseph L. McDermott to the position of Assistant Juvenile Officer were each
"read and the same were ordered placed o.n file.
The Mayors appointment of Mr. Joseph L. McDermott as Assistant Juvenile
Officer of the Rochester Police Department was read and upon motion by Miner, second by
Morris, the same was approved effective as of March 3, 1950.
The following letter was read and President pro tem Anderson ordered that the
same be placed on file:
"Members of the Common Council
City of Rochester
Gentlemen:
There have been certified to me, by the Rochester Police Civil Service
Commission the following names standing highest in competitive examina-
tions for the various positions in the Police Department.
Lynn'D. Peeler - Police Records Clerk
Harold M. Fitzpatrick - Detective Captain
Joseph L. McDermott - Asst. Supt. Juvenile Division
I have letters from Irving J. Renning, and George E. Rohde protesting
the certifications of others than themselves for the positions which
they now hold and have been holding for five years and eleven years
respectively.. They claim that there exists "no vacancy" in the
positions which they now hold and have requested that I investigate
their claims of having acquired a permanent status in the Police
Department for these positions.
There seems to be reasonable grounds for their claims; and until I
have proceeded to investigate this matter thoroughly, I feel that I am
not in a position to commit myself, and will, they ifore, hold these
appointments in abeyance.
The certification of Joseph L. McDermott to the position of Assistant,
Superintendent of Juvenile Division has not been contested. There is a
vacancy in this department, I bel.I.eve: but whether the Council has
created the office of "Assistant Superintendent" I do not know.
Assuming that it has been done, and that you have officially set the
salary for such an office, I submit the attached appointment for
your approval.

The Mayor's veto of a resolution authorizing appointment of a Committee.to
determine as nearly as possible names of individuals desiring Federal housing, the
street address of said individual, their occupation, their age, their average wage
earned per year, the number in their family and the length of residence in the City of
Rochester, Minnesota, was read. No action was taken on the matter..
The request of the Board of Public Health & Welfare that garbage collections
fees be paid at the office of the City Treasurer in the City Hall building after the J
Health Department moves to the new Health Center Building on Fourth Street Southeast was
read and upon motion by Morris, second by.Kennedy, the matter was referred to the Finance
Committee to confer with the City Treasurer and report at the meeting of March 6, 1950.
The recommendation of the Board of Public Health & Welfare that Dr. Robert
Fawcett be appointed as Psychiatrist on..a part time basis and without salary in the
Counseling Clinic -of the Health Department was read and upon motion by,Theel, second by.i
Miner, the request was approved.
The following communication was read and upon motion by Kennedy, second by
Amundsen, the same was referred to the'.'Board of Zoning:
"Being dissatisfied with.the provisions of the Zoning
Ordinance I appeal to the Common Council to grant me
a special permit to operate a beauty shop at 1301
Second Street Southwest; because of the peculiar
hardships.which.would come with the street appliance
of this ordinance.

A notice from the League of Minnesota Municipalities of Municipal short courses
to be held at the University of Minnesota beginning March 9 and ending March.19, 1950 was
read and upon motion -by Theel, second by.Amundsen, department officers interested were
authorized to attend, including deputy assessors.
The request of the B'Nai Israel Synagogue and Center for permission to hold a
bingo game on Saturday, March u, 1950 was read and President pro tem.Anderson ordered
that the same be placed on file.
The recommendation of the Street & Alley Committee that Second Street Southeast
(from First Avenue to the Mayo Park bridge be widened and repaved and that the. cost of

widening be assessed against the adjacent property was'read and upon motion by Theel,
second by Kennedy, the same was approved.
The recommendation of the Public Health & Welfare Board that Mr. Vincent.
IBowron and Mr. Marshall Gray be employed as custodians of the new Health Center Building'
at $200.00 per month each, effective March 3, 1950, was read and the City Clerk was
instructed to.have a resolution prepared for the neat meeting setting up'the said
salaries.
The matter of calling a special election for the purpose of submitting to the
voters of the City a bond issue for the construction of the proposed sewage disposal
plant and sewers within the City of Rochester was discussed and upon motion by Theel,

the purpose for which such bonds are to be issued, the amount, the rate of interest and
how payable, the time or times vhen the premium shall become due, and all other conditions
of the issue of such bonds and setting the date of May 2, 1950 as the date of the
special election.
The reports for the month of February, 1950 of -the Building Inspector showing
fees collected for building permits issued in the amount of $230.50; of the Electrical
Inspector showing fees collected for electrical permits issued in the amount of $43.75;
of the Plumbing Inspector showing fees collected for plumbing permits issued in the
amount of $91.00; and of the Heating Inspector showing heating permits issued and fees
collected in the amount of $150.50. were each read and President pro tem Anderson
ordered that the same beplaced on file.
The report of -the Clerk of the Municipal Court for the week ended February 25.
1950 showing total criminal fines and costs collected $898.15 and civil fees received
$3.05 was read and having been previously approved by the City Attorney, President pro
tem Anderson ordered that the same be placed on file.
The application of Burnham Motor Sales for license to sell cigarettes was
read and upon motion by Theel, second by Miner, the license was granted.
The application of Fred Sauer for a real estate salesman license was read and
upon motion by Theel, second by Miner, the license was granted.
The license of bond of Fred Sauer in the amount of $1,000.0.0, with the Globe
Indemnity Company as surety was read and upon motion by Morris, second by Miner, the
bond was approved, the surety thereon accepted and it was ordered that the same be
placed on file. -

candidates for Alderman at Large of the City of Rochester, Minnesota, at

Alderman Amundsen introduced a resolution granting one public dance permit to ,I
the Cooperative Oil Company Employees Club, which was read.

as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $200.00,from the General
Fund and ordering payment made to the Park Improvement Fund for 'interest on payment for
purchase of Outlot #l, Cook's Sub -Division, which was read.
Upon motion by Miner, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said

Alderman Amundsen introduced a resolution appropriating $3,626.70 from the
• General Fund and ordering.payment made to the Board of Park Commissioners for dredging
Silver Lake, which was read.

Alderman Kennedy introduced a resolution appropriating $397.77 from the
General Fund and ordering payment made to the Mayo Civic Auditorium for auditorium
(rentals, which was read.

Alderman Kennedy introduced a resolution appropriating $430.90 from the General
Fund and ordering payment made to the Rochester Post Bulletin for publishing proceedings,
notices, etc., which was read.
Upon motion by Amundsen, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President pro tem Anderson declared
the said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution approrp riating $18.i5 from the
General Fund and $270.00 from the Lighting Fund and ordering payment made to the City of
Rochester, Public Utilities, which was read.
Upon motion by Kennedy, second by Miner, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $14.50 from the General
Fund and $204.50 from the Street & Alley Fund and ordering payment made to the Rochester,
Minnesota Fire Extinguisher Company, which was read.
Upon motion by Miner, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $244.92 from the Park
Improvement Fund and ordering payment made to Squires Electric Company, which was read.
Upon motion by Morris, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Miner introduced a resolution appropriating $221,96 from the Park
Improvement Fund and ordering payment made to the Rochester Poster Advertising Company,
which was read.
Upon motion by Theel, second by Amundsen, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Miner introduced a resolution appropriating $271.00 from the Park
Improvement Fund and ordering payment made to the Globe Poster Corporation, which was
read.
Upon motion by Amundsen, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Miner introduced a resolution appropriating $5,400.00 from the Park
Improvement Fund and ordering payment made to A. C. Gooding for last payment on Outlot
#1 Cook1s Sub -Division, which was read.

Alderman Theel introduced a resolution appropriating $2,619.26 from the Park
Improvement Fund and ordering payment made to the Mayo Civic Auditorium Revolving Fund,
which was read.
Upon motion by Amundsen, second by Kennedy; that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $2,509.76 from the Park
Improvement Fund and ordering payment made to the Collector of Internal Reveue for
admission taxes collected at the auditorium during February, which was read.
Upon motion by Kennedy, second by Miner, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $2,657.22 from the Park
Improvement Fund and $479.11 from the Lighting Fund and ordering payment made to the
City of Rochester, Public Utilities, which was read..
Upon motion by Miner, second by Morris', that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $3,407.90 from the F. E.
Williams Estate Fund and ordering payment made to A. E. Briese, County Treasurer for
1949 real estate taxes, which was read.
Upon"motion by Morris, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof, President pro Lem Anderson declared the said
resolution duly passed and adopted.
