Minutes of an adjourned regular meeting of the Common Council of the City of
Rochester, Minnesota held in the Council Chambers, in the City Hall in said City, on
March 15, 1950--
President pro tem Anderson called the meeting to order at 7:30 o'clock P.M.,
the following members being present: Aldermen Amundsen, Anderson, Kennedy, Miner, Morris,
and Theel. Absent: President Lemmon, due to illness.
Upon motion by Amundsen, second by Theel, the minutes of the meetings of
March let and Marth 6th, 1950 wer-e approved.
President pro tem Anderson stated this as being the time and place set for the
first hearing on the widening of Second Street Southeast from First Avenue to -the Mayo
Park Bridge. There was no one present wishing to be heard.
President pro tem Anderson stated this as being the time and place set for the
first hearing on the construction of a sanitary sewer and watermain on 16th Street
Northeast from Broadway to 3rd Avenue Northeast and on 3rd Avenue Northeast from 16th to
14th Street Northeast. There was no one present wishing to be heard.
President pro tem Anderson stated this as being the time and place set for the
first hearing on the construction of a watermain in 7th Street Northeast from 13th
Avenue to 15th Avenue Northeast and on 14th Avenue Northeast from 7th to 9th Street and
on 15th Avenue Northeast from 7th to 9th Street Northeast. There was no one present
wishing to be heard.
President pro tem Anderson stated this as being the time and place set for the
first hearing on the construction of a sanitary sewer on 7th Street'Northeast from lath
to 14th Avenue and extending through sewer easement in Block 9, Mohn & Hodge Sub -Division
to 15th Avenue Northeast and in 14th Avenue Northeast from 7th to 9th Street Northeast
and in 15th Avenue Northeast from 7th to 9th Street Northeast. There was no one
present- wishing-: to be heard.
President pro tem Anderson stated this as being the time and place @et for the
second hearing on the construction of a curb and .gutter on 4th Avenue Southeast from
loth to llth Street Southeast. There was no one present wishing to be heard., '
President pro tem Anderson stated this as being the time and place set for a
hearing on the levying of special assessments for the construction of a watermain on
North Broadway from 14th Street to the R. E. A. Building. There was' no one present
wishing to be heard.
Alderman Amundsen introduced the following resolution which was read$
"Be it resolved by the Common Council of the City of Rochester, Minnesota:
That the fo113wing is a tabulated statement and list of the number
of votes cast for each person at the Charter Election held March 14,1950,
in.the City of Rochester, Minnesota, as determined by said Common Council
on the canvass of the returns of said election made the 15th day of
March, 1950, the said statement is hereby declared to show the result
of said election.

SO THEREFORE, Be it resolved by the Common Council of the City of Rochester
Minnesota:
That S. Smith Fryer is hereby declared to be elected to the office of
Alderman at Large of said City, at the Charter Election held March 14, 1950, to
hold office for two years and until his successor is elected and qualified;
That Karl H. Postier is hereby declared to be elected to the office of
City Treasurer of said City, at the Charter Election held March 14, 1950, to
hold office for one year and until his successor is elected and qualified;
That there is hereby declared to be a tie vote for Justice of the Peace,
styled "City Justice" of said City;
That Leo C. Anderson is hereby declared to be elected to the office of
Alderman of the First Ward of said City, at the Charter Election held March 14,
1950 to hold office for two years and until his successor is elected and qualified;
- That William K. Helmkay is hereby declared to be elected to the office of
Alderman of the Second Ward of said City, at the Charter Election held March 14,
1950 to hold office for two years and until his successor is elected and qualified;
That Raymond F. McPherson is hereby declared to be elected to the office of
Alderman of the Third Ward of said City, at the Charter Election held March 14,
1950, to hold office for two years and until his successor is elected and qualified;
That there is hereby declared to be a tie vote for Justice of Peace of the
First Ward of said City;

Two letters from Mr. A. C. Gooding transmitting deeds .for property described
as Lot 1, Cook's Sub -Division and a strip of land eighteen feet wide running east and
west through the block bounded by Fifth Avenue Northwest on the west, Seventh Street
Northwest on the north, Sixth Street Northwest- on the south and the quarter section line
of Sec. 35-107-14 on the east, were each read and upon motion by Theel, second by
Kennedy, the same were referred to the City Attorney for his approval and the City Clerk
was instructed to have the said deeds filed at the office of the Register of Deeds when
approved by the City Attorney.
A communication from the transportation committee of the Rochester Chamber of
Commerce, Inc. recommending that certain routes through the City of Rochester be
presented to the Commissioner of Highways with the recommendation that he recommend
these to the Commissioner of Public Roads as a part of the Federal -Aid Highway system
eligible to receive Federal -Aid was read and the same was ordered placed on file.
A notice of claim for personal injury by Herbert C. Sandberg was read and upon
motion by Kennedy, second by Miner, the same was referred to the City Attorney.
A petition for the construction of a sanitary sewer and watermain and grading.
of 13th Avenue Southeast from 6th to 7th Street Southeast was read and President pro tem
Anderson referred the same to the Sewer Committee, the Water Committee and the City
Engineer.'.
The City Engineer's estimate of cost in the amount of $12,500.00 together with
the plans and specifications for the construction of a second section of the City
Warehouse at the Sewage Treatment Plant site was read and the same was ordered placed
on file.
The request of Lester Fawcett to connect certain lots with the Rochester State
Hospital trunk line sewer was read and the same was referred to the Sewer Committee and
the City Engineer.
The following recommendation of the Finance Committee was read and upon motion
by Theel, second by Amundsen, the same
was approved:

collection bills be paid in the

shall perform such extra duties, -

paid from the Public Health.and
Welfare Fund. The date
same to take effect is March 1,

The recommendation of the Board of Zoning that the petition to have Lot 11,

Block 91, in Original Plat of the City of Rochester changed from a residential zone to a!
commercial zone be granted was read and upon motion by Theel, .second by Kennedy, the ij
recommendation was approved and a public hearing on the same was -set for the meeting to

be held on March 27, 1950 at 7:30 o'clock P. M.

The recommendation of the Board of Zoning that the petition to have Lot 4,
Block 92, Original Plat of the City of Rochester changed from a_ residential zone to a'
multiple dwelling zone be granted was read and upon motion by Theel, second by Kennedy,
it
the recommendation was approved and a public hearing on the same was set for the meeting,
to be held on March 27, 1950 at 7:30 o'clock P, M.
The recommendation of the Board of Zoning that setback and building lines of l
20 feet be established on Lots 1, 2, 3, 4, 5, 6, 7 and g, in Block 2, of Miner's Heightslj
was read and upon motion by Kennedy, second by Amundsen, the same was approved and the
City.Attorney was instructed to prepare an amendment to the ordinance establishing the
said setback and building lines.

The following recommendation of the Public Grounds Committee was read and upon
motion by Theel, second by Miner, the same was approved and ordered placed on file:

Gentlemen:
We, the undersigned members of the Public Grounds
Committee, recommend that a parcel of land on the west
side of North Broadway immediately south of the north
.City limits be leased to Podein Freightways at a rental
of $1.00 per year with the provision that any improvement
necessary on the property be provided and paid for by
said Podein Freightways, and provided further that the
area be returned to at least as good condition as at
present upon termination o,f the rental agreement.
It is further recommended that the City Attorney i
be instructed to prepare the necessary agreements, and
the proper City officials authorized to sign said
agreements on behalf of the City. i

$690.00 and civil fees received $7.05, were each read and having been previously, approved

by the City Attorney, President pro tem Anderson ordered that the same be placed on
file.

The City Treasurer's statement of funds for the month of February, 1950 was
read and the same was ordered placed on file.
The statement of receipts and expenditures in the Park Improvement Fund for
the month of February, 1950 was read and the same was ordered placed on file.
Alderman Kennedy introduced a resolution levying special assessments for the
construction of a watermain on North Broadway from 14th Street, North to the R. E. A.
Building, which was read.
Upon motion by Kennedy, second by Miner, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said .
resolution duly passed and adopted.
Alderman Kennedy introduced a resolution accepting plans and specifications
and ordering bids for the construction of a second section of the City Warehouse at the
Sewage Treatment Plant Site, which was read.
Upon motion by Amundsen, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said

Alderman Theel introduced a resolution appropriating $477.71 from the Sewer t

Fund and ordering payment made to What Cheer Clay Products Company for sewer pipe, which
was read.
Upon motion by Amundsen, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $1, 794.07 from the Park
Improvement. Fund and ordering payment made to Collector of Internal Revenue for -admission
taxes collected at the auditoriu, which was read.
Upon motion by Kennedy, second by Miner, that the said resolution be adopted •
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $394. g0 from the Park
Improvement Fund and ordering payment made to General Mills, Inc. for vigoro and
milorganite, which was read.
Upon motion by Miner, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $317.19 from the Park
Improvement Fuid and ordering payment made to Reynolds Wholesale Company for merchandise
delivered to concession stands, which was read.
Upon motion by Theel, second by Amundsen, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $512.01 from the Park
Improvement Fund and ordering payment made to The Kruse Company for lumber and supplies,
which was read.
Upon motion by Amundsen, second
by Kennedy, that the said resolution

as read, and all voting in favor thereof,

Alderman Amundsen introduced a resolution appropriating $256.69 from the Park
Improvement Fund and ordering.payment made to American Ticket Company, which was read.

as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.

Alderman Amundsen introduced a resolution appropriating $7,815.29 from the
Park Improvement Fund and ordering payment made to Mayo Civic Auditorium Revolving Fund,j
which was read.

A notice that the annual meeting for the instruction of Assessors and a memberi
of the Board of Equalization to be held at the County court house on March 21, 1950 was
read and upon motion by Theel, second by Amundsen, Alderman Miner was authorized to
attend same.
The matter of the management of the Veterans Housing Project at the fairground ai1
was discussed at the meeting and upon motion by Miner, second by Theel„ the same was
referred to the Public Grounds Committee.
A motion was made by Theel, second by Kennedy, authorizing the Street & Alley
(Committee and the City Engineer to contact Mr. Bert Leitzen in regard to widening loth j
Street Northeast from 13th Avenue to block east. All voted in favor of the motion.
Upon motion by Kennedy, second by Miner,..the meeting was adjourned until 7:30
o'clock P. M. on March 27, 1950.
