Minutes of the annual meeting of the Common Council of the City ,of Rochester,
Minnesota, held in the Council Chambers in the City Hall, in said City on April 3, 1950.
President Fryer called the meeting to order at 2:00 o'clock P. M., the
following members being present: President Fryer, Aldermen Amundsen, Anderson, Helmkay,
McPherson, Miner and M orris. Absent: None.
Upon motion by Morris, second by Miner, the minutes of the meeting of March 27,
1950 were approved.
President Fryer addressed the members of 'the Council, -Department Heads and the •
citizens present, stating that last year at the annual meeting the matter of constructing
a sewbLge treatment plant was brought to the attention of those present by our retiring
President, John T. Lemmon and that since that time considerable work had been done on
the project in the way of preparation of plans, estimate and the study of sewage rental
charges, together with the adoption of an ordinance setting the same up. He further
stated that the proposition of submitting the financing of the project to the voters of
the City will be done at a special election in the near future. Another matter mentioned
by him was the deplorable condition of our streets, as to whether or not this condition
is due to the weather conditions, lack of oil or surface material not being properly
applied he stated he did not know. It was, however, noted by him that to put the streets
in proper shape would require considerable expense but that the matter of repairing the
streets should be started at once. It was brought to the attention of the incoming
members of the Common Council that the governing body is required to operate under
certain regulations as set forth -by our City Chartdr, Ordinances and State Statutes. He
then requested that in the future all committee reports be submitted in writing and the
members of the Council were reminded that if they did not vote on a. question their
silence would be counted as "yes". President Fryer next requested the Clerk to read the
following communication listing the appointments made by him to the various Council
committees.

The Mayor's appointment of Mr. Henry C. Laufenberger to serve on the Band

Committee, his term to expire on the second Monday, April, 1953 was read and upon motionl�
by Miner, second by Amundsen, the appointment was approved.
The Mayor's appointment of Mr. William C. Schacht and Mr. Philip H. Lampman
to serve on the Park Board, their terms to expire on the second Monday in April, 1953
was read and upon motion by Morris, second by Miner, the appointments were approved.
The Mayor's appointment of Mr. Charles W. Fox to serve,on the Public Utility
(Board, his term do expire on the second Monday in April, 1953 was read and upon motion
by Morris; second by McPherson, the appointment was approved.
The Mayor's appointment of Mr. Carl C. Hooper to act as Secretary to the Mayors
to serve at the pleasure of the Mayor was read and upon motion by McPherson, second by
Amundsen, the appointment was approved.

Alderman Amundsen introduced the following resolution which was read:
"WHEREAS, It is deemed expedient and necessary that the Common
.Council of the City of Rochester, Minnesota, adopt rules of order
for the conduct of its business, and
WHEREAS, A copy of Robert's Rules of Order (revised) of the
191.5 Copyright, is before this Common Council:
SO THEREFORE, Be it resolved �y the Common Council of the City
of Rochester, Minnesota:
That the said Robert's Rules of Order be adopted by this Common
Council as rules of order for the conduct of its business."
Upon motion by Miner, second by Anderson, that the said resolution be adopted
las read, and all voting in f avor thereof, President Fryer declared the, said resolution
duly passed and adopted.
Alderman Anderson introduced the following resolution which was read:

"Be it resolved by the Common Council of the City of Rochester,
Minnesota,:
That the said Common Council of the City of Rochester, Minnesota,
hereby adopts the following rules and regulations for the order of

or when a 5/7 vote is required. .

meeting.
3. At first meeting, the appointment of officers and
committees.

Upon motion by Amundsen, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President Fryer declared the said resolution
duly passed and adopted.
The application of F. R. Finch for reappointment to the office of City Clerk
and Commissioner of Registration was read and upon motion by Amundsen, second by Morris,
F. R. Finch was appointed to the office of City Clerk and Commissioner of Registration
for the ensuing official year.
The application of Ralph E. Monson for reappointment to the office of City
Engineer was read and upon motion by Amundsen, second by Helmkay, Ralph E. Monson was
appointed to the office of City Engineer for the ensuing official year.
The applications of Desmond B. Hunt for reappointment and Raymond N. Wieland
for appointment to the office of City Attorney were each read and upon motion by
Anderson, second by Helmkay, Desmond B. Hunt was appointed to the office of City
Attorney for the ensuing official year. Alderman Miner and Alderman McPherson voted "no".
The application of Garnet Spring for reappointment to the office of Building
Inspector was read and upon motion by Amundsen, second by Morris, Garnet Spring was
appointed to the office of Building Inspector, for the ensuing official year.
The application of Paul Plantz for reappointment to the office of Electrical
Inspector was read and upon motion by Miner, second by McPherson, Paul Plantz was
appointed to the office of Electrical Inspector for the ensuing official year.
The application of M. J. Fairley for reappointment to the office of Plumbing
and Heating Inspector was read and upon motion by McPherson, second by Helmkay, M. J.
IFairley was appointed to the office of Plumbing and Heating Inspector for the ensuing
official year.
The application of C. A. Cottingham for reappointment to the office of City
Weighmaster ,was read and upon motion by Anderson, second by Miner, C. A. Cottingham was

President Fryer stated this as being the time and place set for the second
IIhearing on the widening and repaving of Second Street South east from 1st Avenue Southeast)
to Mayo Park Bridge. There was no one present wishing to be'heard,

on the construction of a sanitary sewer and watermain on 16th Street Northeast from North
Broadway to Third Avenge Northeast and on Third Avenue Northeast from 16th Street to l4th!

President Fryer stated this as being the time and place set for the second
hearing on the construction of a sanitary sewer and, watermain on 7th Street Northeast
from 13th to 14th Avenue Northeast and extending through sewer easement in Block 9, Mohn
and Hodge Subdivision to 15th Avenue Northeast; and -in 14th Avenue Northeast from 7th to
9th Street and in 15th Avenue Northeast from 7th to 9th Street. There was no one present
wishing to be heard.
President Fryer stated this as being the time and place set for receiving bids
for the sale of two motor patrol graders, one caterpillar Model 11 and one Galion, model
101. It was noted later that bids for the sale of the said graders on this date -was an
error as bids had been advertised for under the date of April 10, 1950.
President Fryer stated this as being the time and place set for receiving and
opening bids for the construction of a second section of the City Warehouse at the
Sewage Treatment Plant. The bids of C. 14. Boutelle in the amount of $16,200.00 and
Martin Sather Construction Company in the amount.of $12,776.50 were each received and
opened and upon motion by McPherson, second by Helmkay, the same were referred to the
Street & Alley Committee and City Engineer for tabulation and report.
The following recommendation of the -Street & Alley Committee was read and upon
motion by Morris, second by Amundsen, the same was approved and ordered placed on file:
"Honorable Mayor & Common Council
Of the City of Rochester, Minnesota
Gentlemen:
We, the undersigned members of the Street and Alley Committee,
recommend that bids for construction of a new warehouse and garage
(second section] be rejected and certified checks returned to the
bidders.
We further recommend that the City Clerk be instructed to
readvertise this project, bids to be taken on April 17th at 7:-.30

The recommendation of the City Engineer that 35 men be employed.in the City
Engineers Department and that each of these men ;aork 2050 hours per year was read and
upon motion by Amundsen, second' by Helmkay, the recommendation was approved.
The three following communications were each read and President Fryer ordered
that the same be placed on file:

It is the request of the employees of the Park Department,

The Board of Public Health and Welfare submits herewith the

the salary schedule for the City Health Department and the' City Farm
for the year beginning April 1, 1950. In addition to the employees
listed below the Board would like authority as in previous years to
employ a temporary farm worker at the prevailing wages for vacation
relief duty during the summer months.
The Board of Public Health and Welfare is requesting -two minor
salary adjustments to conform with length of service -and increased
responsibility of duties. The City Health Officer, Dr. Viktor 0.
Wilson, has now been employed for two years and has proven very
satisfactory in that capacity. The Board requests a $15.00 a month
increase in his salary, that,is, From $7320,00 to $7500.00 annually.
The City Public Health Engineer, Mr. Thomas Wall, has been employed
by the City for three years,. He has had cost of living salary
increases but has received no "merit" raise. Mr. Wall carries out
his work very well and during the past year has done exceptionally
well in handling the City Farm and more recently has taken over the
responsibility for the work of the custodians of the new building.
The Board requests that Mr. Walll,s salary be increased from $4800.00
to $5000.00 annually.
Salary adjustments to provide increased allowance for privately
owned automobiles are requested for the milk sanitarian, Mr. Manfred
H. Waldron and the general sanitarian, Mr. Walter Zierath. Mr.
Waldron's present salary of $4320.00 includes $500.00 for car
allowance. This allowance was established in 1939 when he supervised
70 farms and travelled 6,00o to 7,900 miles per year. At present,
Mr. Waldron supervises an average of 120 farms and travels 11,OOOto
12000miles per year. The Board requests an increase of $20.00 per
month in his salary, that is, from $4320.00 to $456o.00 annually.
Mr. Zierath's mileage has increased also. His present salary is
$3000 which includes $190.00 allowance for the use of his car. The
Board requests an increase of $5.00 per month in his salary, that is
from $3300.00 to $3360.00 annually.
Should the Common Council award general increases -to all city
employees the Board requests that such increases be given to its
staff as listed below. This general increase to be in addition to
the increases as recommended above since they are either merit
increases or necessary adjustments for car allowance.
The Board appreciates the assistance and sympathetic consideration
YOU have always given the public health program and we assure you that
we will strive to give Rochester the best possible health protection
with the funds available.

The City Engineer's preliminary estimates of cost for construction of a �I
watermain in 16th Street Northeast from Broadway to 3rd Avenue Northeast and in 3rd
Avenue Northeast from 14th Street Northeast to the North line of Barck and Merz 'Addition

in the amount of $14,051.90 and for the construction of a watermain in 7th Street
Northeast from 13th to 15th Avenue and in 14th and 15th Avenues from 9th Street Northeast
to the North line of 7th Street Northeast in the amount of $10,439.00 were each read and
President Fryer ordered that the same be placed on file.
The annual report of the Rochester Bus Line, Inc. for the calendar year ending
December 31, .1949 was read and upon motion by Miner, second by Morris, the same was
ordered placed on file.
The reports for the month of March, 1950 of the Building Inspector showing
feee collected for building permits issued in the amount of $497.00; of the Electrical •
Inspector showing fees collected for electrical permits issued in the amount of $55.25;
of the Plumbing Inspector showing fees collected for plumbing permits issued in the
amount of $130.00 and of the Heating Inspector showing fees collected for heating permits
issued in the amount of $119. i5, were each read and President Fryer referred the same to
the Finance Committee.
The report. of the Clerk of Municipal Court for the week ended April 1, 1950
showing total criminal fines and costs collected $1,019.45 and civil fees received
$2.05 was read and having been previously approved by the City Attorney, President Fryer
ordered that the same be placed on file.
The applications for Non -intoxicating malt liquor "on sale" license of George
Darst, Claude Darst, Whitlock Sonnenberg Post, Margaret M. Walker, Sam DeFosse, Clarence

Alderman Helmkay introduced a resolution ordering the first hearing on the
widening of Center Street East from 6th Avenue to llth Avenue Southeast, 11th Avenue
Southeast from East Center Street to 4th Street Southeast and on 4th Street Southeast
from llth Avenue to 6th Avenue Southeast, which was read.

as read, and. all voting in favor thereof, President Fryer declared the said Resolution
duly passed and adopted.
Alderman Amundsen introduced the following resolution which was read:
"WHEREAS, on the 7th day of March, 1950, an act of bravery which
was recognized throughout the northwest was performed by Mrs. Stephan
Loomis, and
WHEREAS certain members of the Police Department and of the Fire
Department gave assistance far beyond their call of duty.
NOW THEREFORE, BE IT RESOLVED, that the Common Council do hereby
express their appreciation of the bravery of Mrs. Stephan Loomis and
those members of the Police Department and of the Fire Department who
gave assistance in the rescue of the minor children whose lives were
endangered by flood waters and to those members of the Police and Fire
Departments whose thoughtfulness and readiness contributed in any
manner to said rescue.
BE IT FURTHER RESOLVED, that this resolution be made a part of the
permanent records of said City."
Upon motion by Amundsen, second by Anderson, that the said resolution be adopted
as read, and all voting in favor thereof, President Fryer declared the said resolution
duly passed and adopted.

Pres.ident Fryer called to order at 7: 55 o'clock P. M. the
following members being present: President Fryer, Aldermen. Anderson, Amundsen;: Helmkay,
McPherson, Miner and Morris. Absent: None.
A motion was made by Anderson, second by Helmkay, that Harold Mrachek be
reappointed as member of the Firemen's Civil Service Commission to serve for a period
of three years.. All voted, in. favor. thereof.
The matter of assigning of personnel at the two.dumping ground sites was
brought to the attention of the Common Council by the City Engineer and upon motion by
Miner, second by Morris, the same was, referred to the Public Grounds Committee.
Upon motion by Anderson, second by Miner, the.Purchasing Committee was
authorized to purchase an I,-R Industrial Precision Cleaning Machine to be used for the
cleaning of the mechanical works of parking meters.
An Ordinance amending an Ordinance entitled, "An Ordinance for the purpose of
promoting health, safety, order, convenience and general welfare, by regulating the use
of land, the location, size, use and heighth of building, and the arrangement of
buildings on lots, and the density of population within the City of Rochester, Minnesota,
all in accordance with a comprehensive plan(No. 558)" was given its first reading.
Upon motion by Morris, second by Miner, and upon roll call and all voting in
favor thereof, the rules were suspended and the drdinance was given its second reading.
Upon motion by Amurzben, second by Anderson, and upon roll call and all voting in
favor thereof, the rules were suspended and the Ordinance was given its third and final
reading.
Upon motion by Morris, second by Amundsen, that the said Ordinance be adopted
as read, and all voting in favor thereof, ?resident Fryer declared the said Ordinance
duly passed and adopted.
The matter of employing legal services for the preparation of an Attorney s
Opinion'in.ccnnection with the proposed sewer treatment plant bond issue was discussed
by the Council. A motion was made by McPherson, second by Morris, that the firm of
Dorsey Colman Barker Scott & Barber be retained as legal advisors in connection with
the proposed sewer treatment plant bond issue.
Upon motion by Morris, second by Miner, the meeting was adjourned until 7:30
o'clock P. M. on April 10, 1950.
