Minutes of an adjourned regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on I.
April 10, 1950. ,
President. Fryer called the meeting to order at 7:.30 o'clock P. M., the followig

members being -present: President Fryer, Aldermen•Anderson, Helmkay, McPherson, Miner i

and Morris. Absent: Alderman Amundsen, due to illness. f+

President Fryer stated this as being the time and place set for receiving and J
opening bids for the sale of two used motor patrol graders, one Caterpillar Model 11 and';
one Galion, Model 101. P?o bids were received.
President Fryer stated this as being the time and -place set for a hearing on
the application of Mrs..Rose Shattuck appealing from.the decision of the Building
Inspector of the City of Rochester in refusing to grant a special permit for the operation
of a beauty parlor at No. 1301 Second Street Southwest. After hearing Mrs. Shattuck and,
those present who were in favor of a. special permit being granted permitting her t'o
operate a beauty parlor at the above mentioned address and Mr. Oscar Ronken and property
owners represented by him, who opposed the granting of a special permit, President Fryer,
ordered that the matter be taken under advisement until the City Attorney could make a
rther study.
Mr. Douglas Naegle, from the Rochester Poster Advertising Company, appeared
t the Council and. asked permission to display banners across the streets advertising
the Sportsman's Show to be held at the Mayo Civic Auditorium. He also suggested
amendments to the Ordinance governing the construction and erection of signs. A motion
was made by Miner, second by Morris, that the Rochester Poster Advertising Company be
granted permission to display the banners across streets as requested. All voted in
favor of the motion.
.Mr. Russell Sanders, Chairman of the Gypsy Frolic-' Committee,, wa.s present at
the meeting and requested that the Council appropriate $199.00 from the Music and Band
d for the purpose of furnishing music on the public streets and in a public place and
pon .motion by Miner, second by McPherson, the .appropriation was ordered.
A notice from the State of Minnesota, Department of Weights Measures that
one of their inspectors in charge of a Vehicle -Scale Testing Unit is now working on. a i
route of special request inspections which will. include Rochester and in case the City
desires to :take advantage of the testing facilities notice should be sent to the Railroad
and Warehouse Commission, was read. President Fryer referred the. matter to the Public
Grounds Committee with power. to act. j

A communication from the State of Minnesota, Department of Military and Naval
Affairs, Adjutant General's Office, transmitting a schedule of area meetings to be held
relative to the Ground Observer Corps which will become a part of the Civil Defense
Program, was read. The letter was ordered placed -on file and the schedule of meetings
was referred to the Mayor's office,

The request of the Public Health & Welfare Department for approval of the
purchase of the following list of equipment items for. the Health Center Building was
read and upon motion by Morris, second by Anderson, the purchase of the said items was
approved:

represent them at Council meetings was read and the same was ordered placed on file.
The petition of Lillian W. Raetz and Edwin M. Raetz for -the extension of
water service to Lots 13 and 14, in Blcck 3, Stebbins Addition and. also extension of
serer service -to the same lots unless cost same is prohibitive, -and in the event the
State of Minnesota, owner of property on the east side of 15th Avenue would assume part
of the expense they also petition for the extension of service to Lots 15 and 16 was
read and President Fryer referred the same to the Sewer Committee and the Water Committee.
The request of the Rochester Fire Department Relief Association for approval
of a loan in the amount of $3,000.00 to C. E. Ginther at 314 Fourteenth Street Northeast
was read and President Fryer referred the same to the Finance Committee.
A.protest by the owners of real estate abutting on 4th Street Southeast between
6th Avenue Southeast and llth Avenue Southeast against the widening of 4th Street
Southeast if the cost. of said widening is to be made on a special assessment basis and
which was signed by 42 property owners was read. However, the signers of the said
protest did not protest the project if the cost of same be paid out of general taxation.
President Fryer ordered that the same be placed on file.
A letter from Dorsey, Colman, Barker, Scott & Barber addressed to -Mr. Desmond B.
Hunt, City Attorney, setting•forth the procedure which would be necessary for the City
to follow incalling P. special election for the purpose of submitting to the voters of the
City the financing of a bond issue for the construction of a sewage treatment plant,
sanitary sewers and storm sewers, together with a proposed schedule for the maturities
of the $2,900,000 bond issue to cover the estimated cost of the projects, were each read.
President Fryer ordered that the same be placed on file.
The.request of Mohn and Hodge that a set -back of 25 feet on the houses to be
constructed on Lots No. 1 to No. 10, inclusive, of the Mohn & Hodge replat was read
and upon motion by Anderson, second by Morris, the said request for set -backs was
approved.
The following letter from the City Engineer was read and upon motion by
Anderson, second by Helmkay, action on the matter was deferred at this meeting.

The following petition was read and upon motion by Anderson,, second by
McPherson, the City Clerk was instructed to prepare a resolution covering the requested '
street vacations and present`. same at a meeting of the Common Council to be held on
April 17, 1950:

following described Avenue in Mohn and Hodge Subdivision; That

Northeast to a point 1h1.26 feet north, and also that part of

Northeast to a point 141.72 feet north. The reasons for asking
for said vacation•is that the undersigned has given -easement
to the City of Rochester for a street running easterly and

The recommendation of the Street & Alley Committee that bids be taken for the
furnishing of crushed rock, gravel and sand for the use of the Street & Alley Department
for the 1950 season, was read and upon motion by Morris, second by Miner, the recommendation
was approved.
The recommendation of the Street & Alley Committee that bids be taken for the
furnishing of- cut -back and emulsified asphalt and road -oils for use in the Street & Alley
Department for the 1950 season was read and upon motion by Miner, second by nelmka.y, the
recommendation was approved.
The recommendation of the Street & Alley Committee that a sidewalk be ordered
constructed on the North side of 4th Street Northeast from 1st Avenue to 2nd Avenue and
that the City Engineer be instructed to publ.ish.notice as required in the Charter was
read and upon motion by Morris, second by Miner, the recommendation was approved.
The recommendation of the Finance Committee that the action of the Fire
Department Relief Association in making an additional first mortgage real estate loan to
Cecil Earl Ginther at 304 - 14th Street Northeast in the Amount of $3,000.00 with
interest at the rate of 4% be approved was read and upon motion by Anderson, second by
McPherson, the recommendation was approved.
The recommendation of the Realtors Committee that the following list of
applications for real estate brokers and salesman license was read and upon motion by
Morris, second by Miner, the recommendation was approved.

Alderman Anderson introduced a resolution designating the official newspaper
for the ensuing official year.(1950-1951), which was reed.
Upon motion by Anderson, second by Miner, that the said resolution be adopted
as read, and all voting in favor thereof, President Fryer declared the saidresolution
duly passed and adopted.

Alderman Anderson introduced a resolution accepting plans and specifications
and ordering bids for construction of a watermain in 16th Street Northeast from Broadway]
to 3rd Avenue Northeast and in 3rd Avenue Northeast from lhth Street Northeast to North,l
line of Barck & 14erz Addition, which was read.
Upon motion by Helmkay, second by McPherson, that the said resolution beadopte�d
as read,. and.all voting in favor thereof, President Fryer declared the said resolution

Alderman Anderson introduced".a resolution accepting plans and specifications
and ordering bids for construction of a waterma.in in 7th Street Northeast from 13th to.
15th Avenue and in loth and 15th Avenues from 9th Street Northeast to ,the North line of
17th Street Northeast, which was read.

Alderman Anderson introduced a resolution granting a public dance permit to
Rochester Junior Chamber of Commerce, which was read.
Upon motion by Miner, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President Fryer declared the said resolution
duly passed and adopted.
Alderman Helmkay introduced a resolution appropriating $258.80 from the
General Fund and ordering payment made to Quality Print Shop for office supplies, which •
was read.
Upon motion by Morris, second by Anderson, that the said resolution be adopted
as read, and all voting in favor thereof, President Fryer declared the said resolution
a
duly passed and adopted.
Alderman Helmkay introduced a resolution appropriating $517. 80 from the General
Fund and ordering payment made to Rochester Post Bulletin for publishing proceedings,
notices, ordinances, etc., which was read.
Upon motion by Anderson, second by Helmkay, that the said resolution be adopted
as read, and all voting in favor thereof, President Fryer declared the said r esolution
duly passed and adopted.
Alderman Helmkay introduced a resolution appropriating $660.33 from the General
Fund and ordering payment made to Universal Motors, Inc., which was read.
Upon motion by Helmkay, second by McPherson, that the said resolution be adopted
as read, and all voting in favor thereof, President Fryer declared the said. resolution
duly passed and adopted.
Alderman McPherson introduced a resolution appropriating $415.63 from the
Street & Alley Fund and ordering payment made to Rochester Quarry Company for rd.. rock,
which was read.
Upon motion by McPherson, second by Miner, that the said resolution be adopted •
as read, and all voting in favor thereof, President Fryer declared the said resolution
duly passed and adopted.

Fund and ordering payment made to Elk River Concrete Products Company for sewer pipe,
which was -read.
Upon motion by McPherson, second by Miner, that the said resolution be adopted
as read, and all voting in favor thereof,_ President_ Fryer_ declared the said resolution
duly passed and adopted.
Alderman Miner introduced a resolution appropriating $416.661 from the Band
Fund and ordering payment made to Harold Cooke for March salary, which was read.
Upon motion by Miner, second by Morris, that the said resolutionbe adopted
as read, and all voting in favor thereof, President Fryer declared the said resolution
duly passed and adopted.
The following claims were presented and upon motion by Morris, second by
iner, the same were approved and the Mayor and City Clerk were authorized and directed
to draw warrants upon the City Treasurer and make payments accordingly:
