Recordof Official Proceedings of the Common -Council of the City of Rochester Minn., April 17, 1950 1 n Minutes of an adjourned regular meeting of.the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall,.in.said City, on April 17,1950. President Fryer .called the meeting to order at 7:30 o'clock P. M., the following members being present: President Dryer, Aldermen Amundsen, Anderson, Helmkay,' McPherson, Miner and Morris. Absent: Hone. a Upon motion by Morris, second by Miner, the minutes of the meetings of April 34 and April 10, 1950 were approved. President Fryer stated this as being the time and place set for a hearing on the widening of Center Street East from 6th Avenue to llth Avenue Southeast,.11th Avenue;� ;I Southeast from East Center Street to 4th Street Southeast and on 4th Street Southeast it from llth Avei►ue to 6th Avenue Southeast. A protest against the widening of Center Street East from 6th Avenue to llth Avenue Southeast, unless paid for under general taxation, signed b g y jl residents on East Center Street was read. Also a protest against the � widening of llth Avenue Southeast from East Center Street to 4th Street Southeast, if j the cost of any part of the said project is to be assessed against abutting property, signed by 32 residents on 11th Avenue Southeast was read. The petitioners also objected' to the narrowing of boulevards on the said street. A number of residents on East Center' Street, llth Avenue Southeast and 4th Street Southeast were present and verbally otested the proposed street -widening project. After hearing the protests read and those present, Alderman Morris stated that he was in favor of the entire project being paid from general taxation. President Fryer then announced that a second hearing on the, widening of the said streets would be held on May 1, 1950 at 2:OO P. M. 'i President Fryer stated this as being.the time and place set for receiving and opening bids for the construction of a second section of the City Warehouse at the, Sewage Disposal Plant. The bids of L. M. Sather and Donald A. Ramthum'in the amount of $13.576.50 and C. M. Boutelle in the amount of $15,600.50 were each received and opened ;� • and President Fryer referred for the same to the Street & Alley Committee and City Engineer �( tabulation and report. The recommendation Donald A. Ramthum for the I of the Street & Alley Committee that the bid of L. M.-Sather construction and of a new warehouse and garage (2nd section)in the amount of $13,576.50 and that the alternate extra of $200000 for a matching south i elevation be accepted was read and upon motion by Morris, second by Amundsen, the i recommendation was approved, i� l Mr. Otto Schroeder was present at the.Council meeting and complained about the�� moving of houses over certain streets, stating that the load was to heavy for same and nalso that damage was done to numerous trees. Mayor McQuillan stated that he had received umerous complaints in regard to damage to trees and streets along the routes over -ihich J houses had been moved. Mr. L. E. • Stepp was present -at the meeting and asked permission to open a stand for the purpose of selling fruit and vegetables on Broadway South of the Cooperative 011.Service Station. Upon motion by McPherson, second by Anderson, ,permission was granted Mr. Stepp to operate the said stand at the location as requested. The following opinion submitted by the City Attorney was read and the same was ordered placed on file: April 17th, 1950 In the Matter of the Application of Rose Shattuck The Mayor and Common Council of the City of Rochester, Minnesota Gentlemen: The records indicate that first the owner of the property in question which is now classed as residential made application to change the classification from residential to commercial. This application was rejected. Following this an application was made asking that the provisions of the Zoning Ordinance be varied to permit the operation of a beauty parlor in a residential area. The applicant was not the owner of the property, nor did she maintain the house as her dwelling. Under Section j, Subdivision "A", the offices of one engaged In a profession may be maintained in his dwelling. Clearly this application does not'f all within this provision. A Zoning Ordinance clearly appears to be a law for the purpose of regulating the use of property by the owners thereof and not one governing or regulating.trades or professions by the individual. The necessity for reasonable regulation as to the use of lands and buildings thereon in cities is plain enough. Lack of such regulation stimulates to some extent each owner to use his land or build thereon in a manner oftentimes quite harmful to his neighbor and to the community as well. Absence of adequate regulation *as cost our cities vast sums in property values, and in many instances has materaially interfered with public health, safety and welfare, due to congestion which might have been avoided. InnV opinion, it Is perfectly proper to conclude that the Zoning Ordinance is an ordinance giving this governing body the right to regulate the use of the lands by the owners of the properties in question. It is not broad enough to permit the use of certain properties not even owned by the applicant and to which the owner thereof can not consent. The question -appears as to whether or not this Council can vary the terms of the Zoning Law so as to permit such use of residential property by one who does not own or use the premises as their dwelling. To grant this application under Section 10, Sub -division 3, permitting the use requested of residential property is not within the powers granted by the Ordinance. The power of variation is to be sparingly exercised and only in rare instances and under exceptional circumstances peculiar in their -nature, and with due regard to the main purpose -of a Zoning Ordinance to preserve the property rights of others. In Real Properties Inc. vs. Board -of Appeal of Boston, 65. NE (2d) 199, the Court said, "The unhappy financial position of one single owner, although a factor, is not of itself enough" to justify a decision of the Board of Appeal of Boston varying the application of the City Zoning Law. 'Variance, due to practical difficulties or peculiar hardships where such difficulties or hardships affect the property owner may be considred but, as the Massachusetts Court states, even the unhappy financial position of a single owner is not enough. The applicant therein is not an owner, andthe Zoning Ordinance, adopted for the orderly development of this City, does not permit variances merely for the purpose of furthering a business venture. Council, inquired as to what had been done about a general raise in sal ariea,for the men in (departments which he represented, in the amount of $15.00 per month. President Fryer then asked if an in the audience wished to speak in favor or in opposition to a general increase in salaries.. Mr. William J. Rehn complained that the operating costs SHof the City were increasing.. Alderman Morris stated that he did not think a general raise in salaries should be granted. Alderman Anderson remarked that provisions for a general wage increase had not been included in the City budget when same was prepared last fall. President,Fryer stated that he favored a seniority increase in salaries being included in next years budget. President :Fryer stated this as being the time .and place set for receiving proposals for being designated as City Depositories. The proposals of Union National Bank. in the amount of '$300,000.00, First Aatio.nal Bank in the amount of $400,000.00 and i Olmsted -County Bank & Trust Company in the amount of $200,000,00 were each received and opened. .: A letter from the Public Health & Welfare Board requesting approval of the 'I following change orders was read and President. Johnson, Representative of the Automatic Voting Machine Corporation, asking for an opportunity to meet with the Council relative to the purchase of voting machines for the City of Rochester was read and upon motion by Anderson, second by McPherson, the City Clerk was instructed to notify Mr. Johnson that the Common Council was not interested in the purchase of voting machines at this time. A communication from dames J. Macken, Jr., Chief of Police, requesting -that the Common.Council grant an expense allowance to Joseph L. McDermott for the operation of his car was read and upon motion by Helmkay, second by Amundsen, the matter was referred to the Police Committee. The recommendation of the Police Committee that a new camera be purchased for the Police Department and that the camera presently in us-e be converted for use as a mug camera was read and upon motion by Amundsen, second by Anderson, the recommendation was approved. The report .of the Clerk- of Municipal Court forthe week ended April 15, 1950 showing total criminal fines and costs collected $931.00 and civil fees received $.85 was read and having been previously approved by the City Attorney, President Fryer ordered that the same be placed on file. The City Engineer's trial balance for the month of March, 1950 was read and the same was ordered placed on file. The annual report of th-e Board of Park Commissioners was presented and the same was ordered placed on file. Alderman Helmkay introduced the following resolutian which was read: Record of Official Proceedings of the Common Council of the City of Rochester, Min.n., April 17, 1950 "Be -it resolved by the Common Council of the City of Rochester Minnesota: That the salary and compensation of the •following officials of the City of Rochester. Minnesota, hereinafter named be and the same are hereby fixed, set and allowed as follows, during the ensuing official year: City Clerk $ 4,990.00 per year; City Engineer 6,500.00 per year; City Attorney 4,120.00 per year; City Treasurer 3,300.00 per year; City Weighmaster 2,700.00 per year; Assistant Custodians of the City Hall - One 0 2,160.00 per year; Two 0 2, 40.00 per year; Assistant City Engineer 5;000.00 per year; That the said salaries and compensation shall be paid from the General Fund in equal monthly installments; one half of the monthly salary and compensation being payable on the 16th day and the balance thereof on the last day of each calendar month during the ensuing official year." Upon motion by Amundsen, second by Anderson, that the said resolution be adopted as read, and ell voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Helmkay introduced a resolution fixing the salary of the City Clerk's second stenographer at the sum of $2, 340.00 ,per year for the ensuing official year, which was read. Upon motion by Anderson, second by Helmkay,,that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Helmkay introduced a resolution fixing the salary of the City Clerk's stenographer at the sum of $2,940.00 per year for the ensuing official year, which was read. Upon motion by Helmkay, second by McPherson, that the said resolution be adopted as read, and all voting in favor thereof, president Fryer declared the said resolution duly passed and adopted. Alderman Helmkay introduced a resolution fixing the salary of the assistant in the City Treasurer's office at the sum of $2,520.00 per year for the ensuing official year, which was read. Upon motion by McPherson, second by Miner, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Helmkay introduced a resolution fixing the salary of the City Engineer's Secretary at the sum of $2,940.00 per year for the ensuing official- year, which was read. Upon motion by Miner, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman McPherson introduced a resolution fixing- salaries for the following men in the.City Engineer's Department, which was read: Mechanic at Warehouse- $3,720.00 per year; 1 Aest. Alderman McPherson introduced a resolution fixing salaries at -the Sewage 'Disposal Plant • at $3,120.00 per year for the Chief Operator and $3, 000.00 per year for each of the Assistant Operators for the ensuing official year, which 'was read. Upon., motion by Helmkay,- second by McPherson, that the said resolution be dopted as read, and all voting In favor thereof, President Fryer declared the said (resolution duly passed and adopted. Alderman McPherson introduced a resolution setting the wage scale for the ensuing official year, which was' read. Upon motion by McPherson, second by Miner, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted.
