June 19, 1950.
President Fryer called the meeting to order at 7:30 o'clock P. M., the
;following members being present: President Fryer, Aldermen Amundsen, Helmkay, McPherson ,i
,Miner and Morris. Absent: Alderman Anderson. II

President Fryer stated this as being the time and place set.for receiving and
opening bids for the construction of a sanitary sewer in Block 3, Crown's Sub -Division.
The bid of Carlisle G. Fraser in the amount of $632.10 was received and opened.
The recommendation of the Sewer Committee that the bid of Carlisle G. Fraser in!

the amount of $632.10 for the construction of a sanitary sewer in Block j, Crown's Sub- �(
Division be accepted was read and upon motion by Morris, second by Helmkay, the recommendletion
,was approved.
The petition of Mr. George C. Henke to have Lot 1, Block 29, of Northern
Addition changed from a residential zone to a commercial zone was again considered by
the Council. Mr. Emil Heintz was present and spoke in behalf of those in the area
opposed to the zoning change and also Mr. George Henke, the petitioner, again urged that
the change be made. A motion was made by McPherson, second by Miner, that the petition
of Mr. Henke be denied. All present voted in favor of the motion. °
The request of the Public Health & Welfare Board for permission to employ Mr.

George M. Elwinger at $200.00 per month, effective June 12, 1950, to assist Mr. Waldron
with the milk shed program was read and upon motion by Amundsen, second by McPherson, the:'
'request was approved.
The following communication from the Rochester Chapter of the Izaak Walton
League of America was read and the same was ordered placed on file:
"To the City Council: June 19th,1950
The members of the Committee who appeared before you gentlemen
sometime ago with complaint about dogs molesting the ducks
are out of the city and our President - Mr. Butterfass is also,

but he delegated me to come before you and state that we
would not -like to have an ordinance passed requiring all ,
dogs to be confined or on leash, and to explain to you
that our complaint was and is due to just about three dogs
whose owners live near the lake, and in the early morning
hours when there is no one around. They disturb the nesting
ducks and have killed some, but most of our members are dog
owners and dog lovers including myself, and rather than have
such an ordinance passed, we prefer .to have the matter
dropped, if it meets with your approval.

Numerous citizens interested in the proposed dog ordinance were present; President Fryer'
announced that the proposed ordinance had not been introduced and that action would not
be taken on the matter.
A notice of starting work on airport project No. 5501-03.issued to Leon Joyce
by C. A. Armstrong, project engineer was read and the same was ordered placed on file.
A letter from Lawrence H. Teske requesting permission to connect with the
sanitary sewer at 901 - 9th Avenue Northwest together with a check in the amount of
$60.00 for the sewer connection was read and upon motion by Miner, second by Amundsen,
the fee was accepted and the City Engineer was instructed to issue a permit for the said
sewer connection.
The following resolution adopted by the Public Utility Board was read and the
same we.s ordered placed on file:
"Be'it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota that the Common Council of the
said City be and is hereby requested to authorize the said Board to
enter into a contract with the Crane Company of Minnesota for the
furnishing, in accordance with specifications, of NINE (9) EXPANSION
JOINTS for the City Steam Department, the total amount of the said
contract to be TWENTY EIGHT HUNDRED TWENTY EIGHT DOLLARS AND FORTY
THREE CENTS ($2,829.43) and the said Crane Company of Minnesota
being the lowest responsible bidder."
The City Engineer's preliminary estimate for the construction of a sanitary
sewer in Block 3, Crown's Sub -Division in the amount of $624.35 was read and the same
was ordered placed on file.
The recommendation of the City Engineer that a 50-.ton, 50 foot scale which
would Ve adequate to weigh all trucks permitted on the highways. be installed at the
location of the present scale was read and the.. same was ordered placed on file.
A plat of land to be known as Meredith's Second Subdivision and described as
follows was presented to the Council, also the recommendation of the City Engineer that
the plat be approved was read and upon motion by Miner,_ second by McPherson, the plat wa:
accepted and the City Clerk was instructed to sign the certificate showing the action
taken by the Common Council and'have the said plat filed with the Register of Deeds.
"Commencing at the Northwest corner of Lot 55, in State Plat of
School Section 36 T. 107 North, Range 14 West and running thence.
South along the west line of said Lot 55 a distance of 135.0
feet for a place of beginning. Running thence east parallel with
the north line of said' lot a distance of b40.20 feet, thence
South parallel with the west, line of said Lot 55 a distance of
265.12 feet, thence west parallel with said north line 640.20 feet
to the west line of said Lot 55, thence north along the west line
of said Lot 55 a distance of 265.12 feet to the place of beginning."

A petition for the grading of 5th Avenue Northwest from llth" Street to. 14.th
Street Northwest was read and President Fryer referred the same to the Street e. Alley
Committee and the City Engineer.
A petition for the construction of a curb and gutter on 91 Street Nartheas•t
from Sth to 9th Avenue Northeast *as read and President Fryer referred the same to the
Street & Alley Committee and the City Engineer.
A petition for the construction of a sanitary sewer and watermain and grading
on 9th Avenue Northwest from 14th Street Northwest, North in Pahama Court was read and

A petition for the construction of a curb and gutter on 5th Street Southwest
from 15th to 16th Avenue Southwest was read together with a petition for waiver of .
hearings on the said improvement and President Fryer referred the same to the Street &
Alley Committee and the City Engineer.
A petition to have a part of Outlot 22, in Northern Addition changed from a

residential zone to a commercial zone and also a petition to have a part of Lots 25 andl
26 in Re -Subdivision of Lot 105, Auditor's Plat "A" changed from a residential to a
commercial zone, were each read and upon motion by Amundsen, second by McPherson, the
same were -referred to the Board of Zoning.
The recommendations of the Street & Alley Committee that 3rd Street Southeast'
from let to 2nd Avenue Southeast and First Avenue' Southeast from 3rd Street Southeast
South to the alley in Block 83, Moe .& Olds Addition be regraded and that bids be
requested for the purchase of .two car -loads Portland cement for use in the Street &
Alley Department were each read and upon motion by Morris,second by Amundsen, the same
were approved.
The report of the Purchasing Committee that after investigating the matter of
I purchasing combination sign and flag holders to be attached to lamp standards on the
public streets of 'the City of Rochester they find that Section No. 1 of Ordinance 108

does not permit attaching any signs or advertising devices to lamp posts in the City of
Rochester was read and upon motion by Miner, second by Morris, that as the advertising -
banners which are posted on the light standards at times is now in violation of
Ordinance No, log, the matter was referred to the City Attorney to amend the Ordinance.
The recommendation of the Purchasing Committee that 50,000 ,'f'10, sub. 24-lb.
envelopes, dye stamped in blue ink, be purchased from the quality Printing Company, the
Quality Printing Company being the lowest bidder, was read and upon motion by Morris,
second by Helmkay, the recommendation was approved.
The recommendation of the Public Grounds Committee that bids be requested for
the furnishing and installing of one 50-ton,_50 foot truck scale at the present scale
house was read and upon motion by Morris, second by Helmkay, the recommendation was
accepted.
The recommendation of the License Committee that the application of Leiferman-
Koehnen, Inc. for a license to. construct cement sidewalks, curb and gutter and driveways)
be granted was read and upon motion by Morris, second by Helmkay, the recommendation was'I
approved.
The recommendation of the Chief bf Police and City Engineer that the existing
traffic signals on Broadway at Cent.er Street, Second Street and Fourth Street be replace)
with new signals, and that these signals together with the new signals installed last
year at First and Third Streets be interconnected by a, master controller was read and
the same was referred tc the Police Committee,
The reaommendation of the Sewer Committee and the Street & Alley Committee
that the streets in Parkside Addition be graded and surfaced and sanitary sewer installec
and that a trunk sewer be constructed across Soldiers Field to connect with Parkside
Addition, one third of the cost of said trunk sewer to be assessed ageinst Parkiide
Addition, was read and upon motion by Amundsen, second by Helmkay, the; recommendation
was approved.
The recommendation of the Lighting Committee that street lights be placed at
the following places was read and upon motion by Amundsen, second by Helmkay, the
recommendation was approved; three at the.airport; 112 Street Southeast beteeen 1st and
3rd Avenue Southeast; 101 Street Southwest at end in the circle; 16th Avenue northeast
between 9th and loth Street and also at the end of 16th Avenue 2ortheast; 9th Street
Northwest between 9th and loth Avenue Northwest; 5th Avenue and 15th Street Northwest;
16th Street and 6th Avenue Northwest; loth Street and loth Avenue Northwest and llth
Street and llth Avenue Northwest.
The recommendation of the Public Grounds Committee that Norbert Huit.ing be
appointed machine operator in the City Dump at a salary of $255.00 was, read and the
same was ordered placed on file.
The Mayor's appointment to the Planning Commission of Mr. Oscar Allerton for

done year and Mr. C. R. McDonald for two years, these appointments to be effective from
�:April 1, 1950, was read and upon motion by Amundsen, second by Helmkay, the Mayor's

The reports of -the Clerk of the Municipal Court for the week ended June 10,

1950 showing total criminal fines and costs. collected $599.00 and civil fees received
$.70 and for the week ended June 17, 1950 showing total criminal fines and costs It

Ackerman for license to sell cigarettes were each read and upon motion by Morris, second l

read and upon motion by Amundsen, second by Helmkay, the licenses were granted.'
The application of William 0. Meschke for a Journeyman Electrician's License
was read and upon motion by Miner, second by Helmkay, the license was granted.
The application of George M. Buckley for a Hot Water and Steam Heating I'
Contractors License was read and upon motion by Helmkay, second by Miner, the license
was granted.
The applications of 11. T. Winkler, A. M. Ackerman, Wm. Van Hook(Portable Park,
Stand), Wm. Van Hook(Soldiers Field Concession Stand), Richard Hutchinson, Allen DeFosse,�
Pete's Grocery and J. C. Eppard for license to sell soft drinks were each read and upon
motion by Amundsen, second by Helmkay, the licenses were granted.
The applications of Darst Tap Room and Carlton Hotel for a permit to place and
maintain a sign were each r ead and upon motion by Miner, second by Amundsen,' the permits

Casualty Company as surety; Coca Cola Bottling Company and Emil J. Nietz each in the
amount of $1,000.00 with the Western Surety Company as surety; and the two bondsfor lost
order or warrant of Ni'cols, Dean & Gregg in the amounts of $6.04 and $13.56 were each

The, two contract bonds of Carlisle G. Fraser in the amounts of $9,.997.90 and
$6,459.30 with the United States Guarantee Company as surety were each read and the same

Alderman Amundsen introduced a resolution acce]#ng the bid of Carlisle G.

Alderman Amundsen introduced a resolution accepting'plans and specifications
and ordering bids for the construction of a sanitary sewer and watermain and grading on
13th Avenue Southeast between 6th and 7th Street Southeast, which was 'read.
Upon motion by McPherson, second by Miner, that the said resolution be adopted'
as read, and all present voting in favor thereof, President Fryer declared the said
(resolution duly passed and adopted.
Alderman Helmkay introduced a resolution ordering bids for construction of a
Istorm sewer on 14th Avenue Northeast from 9th Street Northeast to Silver Creek, which was
+read.
Upon motion by Miner, second by Morris, that the said resolution_ be adopted
las read, and all present voting in favor thereof, President Fryer declared the said

Alderman Helmkay introduced a resolution ordering bids for the furnishing of
1200 parking meters, which. was read.
Upon motion by McPherson., second by Amundsen, that_ the said resolution be

said resolution duly passed and adopted.
Alderman Helmkay introduced a resolution ordering bids for the furnishing and
installation of a 50-ton 50 foot truck scale at the present scale house, which was read.

serve Lots 13, 14, 15 and 16, Block 3, Stebbin's Addition, which was read.
Upon, motion by Miner, second by Morris, that the said resolution be adopted

Alderman Miner introduced a resolution appropriating, $5,286.50 from the Generale
Fund and ordering payment made to Quality Printing Company-$299.25 for office supplies;

�Iochester Post Bulletin-$840.90 for publishing minutes, notices, etc.; Continental Oil-
Company-$2,283.08 for 12,247 gallons gasoline and Standard Oil Company-$1,863.27 for
cutback asphalt, which was read.
Upon motion by Amundsen, second by Helmkay; that the said resolution be adopted

Bridge Fund and $.50 from the Parking Meter Fund and ordering payment made to the Street
& Alley Fund for use of equipment during May, 1950, which was read.
Upon motion by Helmkay, second_by McPherson, that the said resolution be adopt
as read, and all present voting in fa.vorthereof, President Fryer declared the said
resolution duly passed and adopted.
Alderman Morris introduced a resolution a.ppropria.ting $58.63 from the General
Fund, $19.41 f rom the Street & Alley. Fund, $75. 24 from the' Sewer Fund and $315, ,g f rom
the Lighting Fund and ordering payment made to City of Rochester, Public Utilities, whi
was read.
Upon motion by McPherson, second by miner, that the said resolution be adopte
as read, and all present voting in favor thereof, President Fryer declared the said
resolution duly passed and adopted.
Alderman Morris introduced a resolution appropriating $704.26 from the Street
& Alley. Fund and ordering payment," made to Quarve & Anderson-330.25 for road rock and
Firestone Stores-374.01 for tires and tubes, which was read.
Upon motion by :diner, second by Morris, that the said resolution be adopted
as read, and all present voting in favor thereof, President Fryer declared the said
resolution duly passed and adopted.
Alderman 14orris introduced a resolution appropriating $1,720.23 from the Park
II Improvement Fund and .ordering payment made to Co_lhector. of Internal Revenue-$1, 409.13
for. admission taxes collected at auditorium and Rochester Dairy Coop.-$311.10 for
merchandise delivered to auditorium concession stand, which was read.
Upon motion by Morris,. second by Amundsen, that the said resolution be adopted+
as read, and all present voting in favor thereof, President Fryer declared the said
resolution duly passed and adopted.
Alderman Morris introduced a. resolution appropriating $245.00 from the P.I.R.
Fund and ordering payment made to the First national Bank for interest on P.I.R. Bonds,
which was read.
Upon motion by Amundsen, second by Helmkay, that the said resolution be adopter
as read, and all present.voting in favor .thereof, President Fryer decls-red the said
Ilresolution duly passed and adopted.
The following claims were read and upon motion by Morris, second by Amundsen,
the same were approved and the Mayor --and City Clerk were authorized and directed to draw
warrants upon the City Treasurer and make payments accordingly:

of the storage tanks to- be installed -at the new Shell St-ation on the corner of Center• 1
•Street and Broadway. Also M-r. Norman Reed spoke in opposition t-o the installation of
gasoline- storage tanks as planned.- Mr. C. E. Ginther, Fire Chief, recommended that gasoline
storage tanks be- limited to 1100 g"all'ons and he further recommended- that storage of

gasoline in excess of 2,000 gallons be not permitted at the said station. A motion was
made'by Miner, second by McPherson, that the Fire Chief and the City Attorney check the
City ordinance to ascertain if possible as to whether or not the amount of.gasoline
stored at filling stations -is limited. All present voted in favor of ,the motion,
Mr. R. L. Barrett, representing the Portland Cement Association, was present
at the Council meeting and encouraged the Council to set. up a long range plan for street
improvements° He presented newspaper items and photographs descriptive of street.

Alderman McPherson brought up the matter of appointing a committee to consider
the matter of presenting the GrIffenhagen report to the Citizens of Rochester. It was
;determined that the members of the Council and 'the Mayor would submit names from the
three City. wards as members of the proposed committee. Upon motion by Helmkay, second
by Miner, the report of Gr.iffenhagen & Associates was accepted and ordered placed on fill
The matter of sewer service in 2nd Street Northwest to the house recently
moved by Arthur Bourassa was considered and upon.motion by Amundsen, second by Helmkay,
the City Engineer was instructed to' furnish the manhole cover and ring and 77 feet of
S inch sewer pipe, the balance of the cost of the project to be paid by Mr. Boura.ssa,
Alderman Morris suggested that traffic signals be installed at.the intersectiox
lof let Street and let Avenue Southwest and 4th Street and 1st Avenue Southwest and
lAlderman'Helmkay recommended that -stop and go signals be installed at llth Avenue and
(2nd Street Southwest. The matter of installing the said signals was referred to.the
(Police Committee and the Chief of Police.
The City Engineer stated that they did not have enough fill to complete the
approach to the bridge in Mayo Park and recommended that the isli.nds at the rear of the
Norton Hotel be used for the required fill. Upon motion by Amundsen, second by McPhersot
the City Engineer was authorized to spend an amount not to exceed $499..00 for the
purchase of more fill for the bridge.
The City Engineer requested permission to employ Mr. Zane Chaffee to inspect
(sidewalks in ,the City of Rochester and upon motion by Miner, second by Helmkay, he was
lauthorized to employ Mr. Chaffee, he to be paid on claim for his services.
The City Engineer asked permission to employ someone to measure the flow of
lsewage where it can not be based on the water meter reading. President Fryer referred
(the matter to the Sewer Committee.
Upon motion by Miner, second by Morris, the meeting was adjourned until 11:00
