Minutes of a regular meeting of the Common Council of the City of Rochester,
Minnesota, held in the Council Chambers in the City Hall, in said City, on July 3, 1950.
President Fryer called the meeting to order at 2:00*01clock P. M. the following
members being present: President P3y'er, Aldermen Amundsen, Anderson, Helmkay,McPherson,
Miner and Morris. Absent: None.
Upon motion by Morris, second by Miner, the minutes of the meetings of
June'l9th and June 29th, 1950 were approved.
President Fryer stated this as being the time and place set for the first
earing on the regrading of 3rd Street Southeast from 1st Avenue to 2nd Avenue Southeast
and 1st Avenue Southeast from 3rd Street Southeast, south to the alley,in Block $3, Moe
and Old's Addition. There was no one present -wishing to be heard.
President Fryer stated this as being the time and place set for the first
hearing on the construction of a sanitary sewer on 15th Avenue Northeast from East Cent
Street to serve Lots.13, 14, 15 and 16 in Block 3, Stebbins Addition. There was no one
present wishing to be heard.
President Fryer stated this as being the time and place set for receiving and
opening bids for the construction of a sanitary sewer and watermain and grading on 13th
Avenue Sou-theast between 6th and 7th Streets Southeast. The bids of Carlisle G. Fraser
in the amount of $1,O89.95 for sanitary sewer and $1,907.10 for watermain and H.T.Guische
in the amount of $1,436.00 for sanitary sewer: and $2,113.00 for watermain were each
received and opened. No bids -were received for grading.
The recommendations of the Sewer Committee and. Water. Committee: that the -bids'. -,-
in the amount of $1, Osg.85 for the construction of a sanitary sewer and $1, 907.10 for the
construction of a watermain on 13th Avenue Southeast between 6th and 7th Streets
Southeast as submitted by Carlisle G. Fraser be accepted were each read -and upon motion
by Amundsen, second by Anderson, the recommendations were approved.
President Fryer stated this as being the time and place set for receiving and
opening bids for the construction of a storm sewer on 14th Avenue Northeast from 9th
Street Northeast to Silver Lake. The bids of Carlisle G. Fraser in the amount of
$21, 239- 75 and H. T. Guischer in the amount of $23,112. 50 were each received.
The recommendation of the Sewer Committee that the bid of Carlisle G. Fraser
in the amount of $21,239.75 for the construction of a storm sewer in 14th Avenue
Northeast from 9th Street Northeast to Silver Creek be accepted was read and upon motion
by Anderson, second by Helmkay, the recommendation was approved.
President Fryer stated this as being the time and place set for receiving and
opening bids for the furnishing of two carloads of Portland Cement. No bids were recei

unopened, as the location for a new truck scale had not been definitely determined at

President Fryer stated this as being the time and place set for receiving and
opening bids for the furnishing of 200 parking meters. The bids of Magee -Hale Park-0-
Meter Company in the amount of $48.90 each; M. H. Rhodes, Inc. in the amount.of $58.00

each; International Meters, Inc. in the amount of $48.73 each; and Duncan Rueter
(Corporation in the amount of $56.95 each, were received.

Mr. Plunkett, representing Paul Helgesen, was before the Council and requestedjl
that a permit be issued for the moving of a house from 207 Third Avenue Southwest to
229 Sixteenth Avenue Southwest. Mr. Robert Cross, a resident on 16th Avenue Southwest,
was present at the meeting and opposed the locating of the said house'at 229 Sixteenth
Avenue Southwest and also presented a petition signed by 22 residents on 16th Avenue
Southwest opposing same. Mr. Cross further stated that there had been a provision in
deeds of property on 16th Avenue Southwest setting a minimum value of houses located on
said real estate. The City Attorney informed Mr. Cross and others present that in that
case it became a personal matter between the present residents on 16th Avenue and Mr.

'Paul.Helgesen. Upon motion by Helmkay, second by Morris, the. Lysne Construction Companyi
!'was granted permission to move the said building from 207 Third Avenue Southwest to
,!229 Sixteenth Avenue Southwest.
Mr. Richard Manahan, attorney representing Holland Furnace Company, was again
before the Council and requested'that a permit be issued to Holland Furnace Company to

operate in the City of Rochester. Upon motion by Morris, second by McPherson, the matte,'

was referred to the License Committee.

The recommendation of the Street & Alley Committee that since no bid was

received for furnishing two car loads of Portland Cement for use in the Street Department,
the Street & Alley Committee be empowered to purchase this material on the open market,
was read and upon motion by Miner, second by Helmkay, the recommendation was approved.
The recommendation of the Purchasing Committee signed by Alderman Amundsen, I.
Chairman and Alderman Anderson,'Member, that one Burroughs Adding Machine be purchased
for use in the office of the Munidipal Court at a price of $190.00; one'Burroughs Adding',
.Machine be purchased for use in the City Treasurerts office at a price of $261.00; and
that six #1452 Walnut Comfront Chairs be purchased for use in the City Clerks office atill

a price of $197.20 was read. A motion was made by Amundsen, second by Helmkay, that the;
,recommendation be approved, all voted in favor of the motion except Alderman McPherson,
who voted "nof'.
The recommendation of the Street & Alley Committee that a curb and gutter be
'constructed on 5th Street Southwest between 15th and 16th Avenue Southwest was read and
;upon motion by Miner, second by Helmkay, the recommendation.was approved.

The recommendations of the Street & Alley Committee, the Water Committee and the
Sewer Committee that 9th Avenue 1�orthwest in Pahama Court be graded and -sewer and
watermain be installed in same were each read and upon motion by Miner, second by Helm
the recommendations were approved.
The recommendation of the Purchasing Committee that 750 government booklets be
purchased from the quality Printing Company at a price of; $95.00 was read and upon motiox
by .Miner, second by Helmkay, the same was approved.
The City Engineer's estimate of cost for the construction of"a sanitary sewer

,and watermain in 13th Avenue Southeast from 6th Street to 7th Street Southeast in the
amounts of $1,161.4o and $1,927.70 respectively was read and President Fryer ordered that
the same be placed on file.
The City Engineer's estimate of cost for the grading and surfacing of 13th
Avenue Southeast from 6th-Street to 7th Street Southeast in the amount of $907.50 was
(read and President Fryer ordered that the same be placed on file.
A notice from the State of Minnesota that plans covering sanitary sewer
extensions totaling 4,977 feet of eight and twelve inch diameter pipe ',have been approved
by the Water Pollution Control Commission on condition that no connections be made until
a contract is let for a sewage treatment plant was read and President Fryer ordered that
Ithe same be placed on file.
A communication from Western Airlines, Inc. stating that they are now filing
application with the Civil Aeronautics Board for additional service between the City of
ochester and Los Angeles, California was 'read and President Fryer ordered that the same
e 'placed on file.
A letter from the Mayo Association transmitting a quit claim deed to.Lots 20,
21 and 22 in Block 20, Moe & Olds Addition was read and the City Clerk was requested to
ave the said deed filed with the County Register of Deeds.
The request of the Public Health & Welfare. Department for permission to purch
miscellaneous kitchen equipment from the F. W. Woolworth Co. in the amount of $6.10 and
towels, holders, etc. from the C. F. Massey Company in the amount of $11.52 for the
Public Health Center Building was read and President Fryer ordered that the same be
placed on file.
The requests from the Board of Public Health & Welfare for permission to emplo3
re. Alice R. Mackinnon,to replace Mrs. Iva Leiferman as a public health nurse, effectiv(
ane 21, 1950 at a salary of $224.00 per month and Miss Marie Hassett,to replace Mrs.
aura Donney as a public health nurse, effective June 19, 1950 at a salary of $224.00 pei
oath, were each read and upon motion.by Anderson, second by McPherson, the same were
pproved.
The recommendation of the Board of Zoning that the petition'of Mr. Paul J.

The recommendations of the Board of Zoning that the petition of.Charles Blake,
,John Fitzgerald, Frank Mamasis, James Johnson and Andrew gulas to have the property in
Block 1,2, Wm. McCullough's Addition abutting on 7th Avenue Northwest changed from a
,multiple dwelling zone to a residential zone be granted and also the petition of Cliff
Igo to have a part of Outlot 22 in Northern Addition changed from a residential to a

;commercial zone be granted, were each read and upon motion by Anderson, second by Miner,l
the recommendations were approved and the City Clerk was instructed to publish a notice
of hearing to be held on July 17, 1950 on the said zoning changes. j
A letter from the State of Minnesota, Department of Highways, notifying the
City that if street lighting is installed on that part of.12th Street Southeast on which,
pavement and surfacing was completed last year the entire cost of the project would have'
to be borne by the City of Rochester was read. No action was taken on thematter at this)
meeting.
A communication from the Minnesota League of Municipalities transmitting a
bulletin of legislative resolutions which were adopted at the League's Legislative j

Conference in Willmar on June 9, 1950 was read and President Fryer ordered that the samell
be placed on file.
An opinion by J.A.A. Bur-nquist, Attorney General, on the question "Does the
state law or the city charter control as to the date of meeting.of the board of
equalization or review?" was read and the same was ordered placed on file.
A petition for the construction of a sidewalk on 9th Avenue Southeast on the
west side of the street between 9th and 9th Streets Southeast was read and upon motion
by Anderson, second by Amundsen, the same was referred to the Street & Alley Committee

-and the City. Engineer.
The petition of Paul J. greter for a special permit to construct, maintain ands,
operate a real estate office on the property described as follows was read:
"Commencing at a point in the West line of Lot 25, Re -Sub -Div of
Lot 105, Auditor's Plat "A" of the SWa`, Section 1-106-14, Rochester
Olmsted County, Minnesota, a distance of 48 feet South of the
Northwest corner of said Lot 25, running thence South a distance
of 52.5 feet to the Southwest corner of said Lot, running thence
Northeasterly to the Southeast corner of Lot -27 of said Sub -Div.,

Upon motion by Amundsen, second by Miner, the same was referred to.the City Attorney fort'
report at the Council meeting to be held on July 17, 1950. All voted in favor of the II
motion except Alderman McPherson, who voted "no".

A petition for the construction of a sanitary sewer and watermain and the
grading and surfacing_ in West's Sub -Division was read and the same was' ordered placed
on file.
A petition to have 16th and 17th Avenues Northeast in Meredith's Second Sub -
Division graded and sewer line and water main installed was read and the same was ordere
placed on file.
A communication from the Board of Public Health and Welfare stating that a
(gift in the amount of $501.75 had been made to the said department by the Olmsted County
Christmas Seal organization to defray the cost of X-Ray developing dark room equipment
at the Public Health Center Building. A motion was made by Miner, second by McPherson,
Ithat the said gift be accepted and deposited in the Permanent Improvement Fund to the
(credit of the Public Health Center Building. All voted in favor of the motion.
A communication from the Board of Park Commissioners re -submitting their salary
list of April 14th with the request that the Council formally approve salaries as set up
Iby them or else take some action which will definitely set salaries of park department
(employees for the current fiscal year was read. A_ motion was made by -Amundsen, second
by Helmkay, that the rates listed under "Extra golf course help" and l',ifeguards and
Bathhouse: Attendants" be set at a rate not to exceed 900 per hour. No other changes in
Ithe salary list as submitted were authorized. All voted in favor of the motion and the
City. Clerk was instructed to notify the Board of Park Commissioners .of the action taken
by the 8ommon Council.
After discussing the matter of rates for skilled and unskilled labor, which
and not included in any pay oll classification',
may be employed by City departments on a temporary basis a motion was made VY McPherson,
ssecond by Amundsen, that skilled and unskilled labor be paid the same rates as are paid
!by contractors in accordance with the local union scale.
The following petition for vacation of an alley was read:
"Honorable Mayor and Members
Of .The Common Council
City of Rochester
Rochester, Minnesota
Gentlemen:
The undersigned owners of the abutting property respectfully
request that that portion of the alley running north and south and
west of Lot 17, Block 2 of Replat-of Outlot 1 and'Block 14, Manley's
Sub -Division and described as follows be vacated:
'Beginning at the northwest corner of Lot 17,-
Block 2 of Lampmgn's Replat of Outlot 1 and
Block 14,,Manley s Sub -Division, thence -south
to the southwest corner o� said lot 17, thence
southwesterly to the intersection of the south
and west line of said alley, thence north along,
the west line of said -alley to thenorth line of
Lot 19, Block 2 of Lampman's Replat of Outlot 1
and Block 14, Manleyls Sub -Division, thence east
10 feet to place of beginning."
The reason for asking said vacation is that Lot 7.in Block 1 of
Lampman's Replat of Outlot 1 and Block 14, Manley�a Sub -Division is
no longer served by said alley.

The applications of Roger S. Lillo and Harry L. Peterson, Rochester Chamber ofl'
Commerce and John Princiotta for license to sell cigarettes were each read and upon
',motion by Anderson, second by Helmkay, the licenses were granted.
The applications of Milly's Beauty Shop, Evjen Grocery, Murphy's Lunch, Alex'sl
,Food Market, Rochester Chamber of Commerce (2) and the Brechwald Hotel for a permit to.

'place and maintain a sign were each read and upon motion by Anderson, second by McPherson,
the permits were granted.
The applications of John Princiotta, Roger S. Lilla and Harry Peterson, Rochester
'Chamber of Commerce and Rochester Produce Market for license to sell soft drinks were
each read and upon motion by Helmkay, second by Anderson, the licenses were granted.
The application of Adrian J. Ronnenberg for a journeyman warm air heating,
ventilating and air conditioning worker's license was read and upon motion by Miner,
second by Morris, the License was granted.
The surety -bond.- of Ace Sign Company in the amount of $1,000,00 with the Glens!
1'Falls Indemnity Company as surety and the indemnity bonds for lost check of Maass & 1,
McAndrew Company in the amount of $45.
35 and Mrs. Sam Rueb in the amount of $20.00 were
each read and upon motion by Miner, second by Amundsen, the bonds were approved, the
,surety thereon accepted and it was ordered that the same be placed on file.
The contract bonds of Carlisle G. Fraser in the amount of $632.10 with the
United States Guarantee Company as surety and Gordon Winslow Company (6) in the amounts
of $2, 8o6. 25; $9.597- 80; $5, 555.10; $1, 617.25; $3,156.80 and. $3, 020.4o with the western
Surety Company as'surety, were each read and the same were referred to the Mayor for his!,
approval.
A statement of receipts and disbursements in the Park Improvement Fund for the

The reports for the month of June, 1950 of the Building Inspector showing feed
,in the amount of $180.11 for building permits issued; of the Electrical Inspector showing

Alderman Amundsen introduced a resolution accepting the bid of Carlisle G.
(Fraser for the construction of a sanitary sewer and watermain on 13th Avenue Southeast
between 6th and 7th Streets Southeast, which was read.
Upon motion by Amundsen, second by Anderson, that the said resolution be adopte
as read, and all voting in favor thereof,. President Fryer declared the said resolution
duly passed and adopted.
Alderman Amundsen introduced a resolution accepting the bid of Carlisle G.

Alderman Helmkay introduced a resolution appropriating $5,951.09 from the
P.I.R. Fund and ordering payment made to Carlisle G. Fraser for estimate No. 1 for

was read.

Upon motion by McPherson, second by Miner, that the said resolution be 'adopted;'
as read, and all voting in favor thereof, President Fryer declared the said resolution

Alderman Helmkay introduced a resolution appropriating $600.49 from the P.I.R.;,
Fund and ordering payment made to Carlisle G. Fraser for estimate No.. 1 for construction',
of a sanitary sewer in Block 3, Crown's Sub -Division, which was read.

Upon motion by Miner, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President Fryer declared the said resolution

Alderman McPherson introduced a resolution appropriating $19,063.93 from the
Bridge Fund and ordering payment made to L. M. Feller 'Company for construction of bridge'('
No. 6599, which was read.
Upon motion by Anderson, second by elmkay, that the said resolution be adopted
as read, and all voting in favor thereof, President Fryer .declared the said resolution
duly passed and adopted.
Alderman ePherson introduced a resolution appropriating $407.78 from the Sewer
Fund and ordering payment made to Red Wing Sewer Pipe for sewer pipe and $250. 00 from the
Sewer Fund and ordering payment made to Carlisle G. Fraser for rental of equipment .for
storm sewer work, which was read.

Upon motion by Helmkay, second by McPherson, that the said resolution be adopted
as read, and all voting in favor thereof, President Fryer declared the said resolution

Alderman McPherson introduced a resolution appropriating $252.00 from the
Permanent Improvement Fund and ordering, payment made to Briese Steel & Building Materials
Company for general plans and engineering services for addition to warehouse, which was

as read, and all voting in favor thereof, President Fryer declared the said resolution
duly passed and adopted.
Alderman Miner introduced a resolution appropriating $360.97 from the
Permanent Improvement Fund and ordering payment made to Hanson Hardware Company for
janitor supplies and kitchen ware for health center building, which was read.
Upon motion by Amundsen, second by Anderson, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the said
resolution duly passed and adopted.
Alderman Miner introduced a resolution appropriating $416.66 from the Band
Fund and ordering payment made to Harold Cooke for salary for June, 1950, which was read.
Upon motion by Anderson, second by Helmkay, that the said resolution be adopted
as read, and all voting in favor thereof, President Fryer declared the said revolution
duly passed and adopted.
Alderman Miner introduced a resolution appropriating $308.34 from the Parking
Meter Fund and ordering payment made to Miller Meters, Inc., which was read.
Upon motion by Helmkay, second by McPherson, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the said
resolution duly passed and adopted.
Alderman Miner introduced a resolution ordering the first hearing on the
construction of a sanitary sewer and watermain and -grading and surfacing of 9th Avenue
Northwest in Pahama Court, which was read.
Upon motion by McPherson, second by Miner, that the said resolution be adopted
as read, and all voting in favor thereof, President Fryer declared the said resolution
duly passed and adopted.
Alderman Miner introduced a resolution ordering the first hearing on the
construction of a curb and gutter on 5th Street Southwest between 15th and 16th Avenues
Southwest, which was read.
Upon motion by Miner, second by Morris, that the said resolution be adopted
as read, and all voting in favor thereof, President Fryer declared the said resolution
duly passed and adopted.

the same were approved and the Mayor and City Clerk were authorized and directed to

Common Council. Upon motion. by Miner, second by -Morris, the City Clerk was instructed
to request the assistance Af a representative from the office of the Public Examiner to
assist in setting up the above mentioned records.
