M.,the following ;'members being present: President Fryer, Aldermen Amundsen, Anderson, Helmkay, McPherson', Miner and Morris. Absent: None. Upon motion by Miner, second by Amundsen, the minutes of the meetings of August 21 and August 25, 1950 were approved. President Fryer stated this as being the time and place set for the second �I ;.hearing on the grading and resurfacing of the north and south alley between Block 3, W. There was no one present wishing to be ,heard. it President Fryer stated this as being the time and place set for receiving and opening bids for the construction of a sanitary sewer and watermain and grading of 16th and 17th Avenues Northeast from 9th Street Northeast to the South line of Meredith's Second Sub -Division. The bid of Carlisle G. Fraser in the amount of $2,791.60 for I' sanitary sewer and $4,095.00 for watermain was received and opened. No bids were received for grading. r The recommendation of the Sewer and Water Committees that the bid of Carlisle G. L Fraser for the construction of a sanitary sewer and watermain in 16th and 17th Avenues ;Northeast from 9th Street northeast to the south lire of Meredith's,2nd Sub -Division be ,accepted was read and upon motion by Miner, second by Morris, the recommendation was approved. 1 The recommendation. of the Street & Alley Committee that since no bids were ,received for the grading of 16th and 17th Avenues Northeast from 9th Street Northeast to l', the south line of Meredith's Second Sub -Division the City Engineer be authorized to do I the work was read and upon motion by Miner, second by Morris, the recommendation was i approved. No bids were received: The recommendation of the Street &•Alley Committee that since no bids were received for grading the Easterly North and South Alley,in Block 23, Northern Addition Ithe City Engineer be authorized to do the work was read and upon motion by Amundsen, (second by Helmkay, the recommendation was approved. President Fryer stated this as being the time and place set for receiving and (opening bids for the re -roofing of the old City Warehouse Building. The bids of Alpek Sheet Metal Works in the amount of $964.00.and Woodhouse Brothers in the amount of.$740.� lwere each received and opened. The recommendation of the Street & Alley Committee that the bid of Woodhouse Brothers for the re-roofing.of the old city warehouse building in the amount of $740.00 Ibe accepted and checks be returned to the unsuccessful bidders was read and upon motion by Anderson, second by Helmkay, the recommendation was approved. President Fryer stated this as being the time and place 'set for receiving and opening bids for the furnishing and installing traffic signals on Broadway at Center Street, Second and Fourth Streets and 3rd Avenue and 4th' Avenue Southeast. No bids were received. The -recommendation of the Police Committee, the City Engineer and the Chief of olice that since no bid was received for furnishing and installing new traffic signals on Braodway at Center, Second and Fourth Streets, and 3rd Avenu.e and 4th Street Southeastl, the project be re -advertised with bids returnable on September 19, 1950 was read and upol motion by Anderson, second by Helmkay, the recommendation was approved. President Fryer stated this as being the time and place set for receiving and opening ,bids for the sale of one used truck scale. The bid of Bemel Auto Parts in the amount of $325.00 was received and opened. • The recommendation of the Public Grounds Committee that the bid of Bemel Auto Parts for the purchase of one used truck scale in the amount of $325.00 be accepted was read and upon motion by Miner, second by kelmkay, the recommendation was approved. The recommendation of the Street & Alley Committee that 14th and' 15th Avenues Northeast from 7th -to 9th Street Northeast and 7th Street Northeast from 13th to 15th Avenue Northeast, in Mohn & Hodge Subdivision, be graded was read and upon motion by lAmundsen, second -by Morris, the recommendation was. accept ed. S e'.pt emb er 5, -. 19 50 it I, �I I' The recommendations of the Street & Alley Committee that a sidewalk be constr- II ucted on the east side of 6th Avenue Southwest from 2nd Street south to the present I,,Ilsidewalk and also on the east side of 6th Avenue Southwest from 3rd to 4th Street Southwest, were each read and upon motion by Amundsen, second by Helmkay, the recommendations I' were approved. The recommendations of the Street & Alley Committee that 3rd Avenue Southeast between 4th and 5th Streets Southeast -be widened and 3rd Avenue Southeast between 3rd anld i 4th Streets Southeast be widened and regraded and a curb and gutter constructed to meet I; the approach of the Mayo Park Bridge, were each read and upon motion by Amundsen, second;j i1 by Helmkay, the recommendations were approved. The recommendation of the Street& Alley Committeethat 5th Avenue Northwest from llth Street to 14th Street be graded and surfaced was read and upon motion by Amundsen, second by Helmkay, the recommendation was approved. The recommendation of the Water Committee that a watermain be constructed on 15th Avenue Northeast from East Center Street to serve Lots 13, 14, 15 and 16 in Block 3; l ,Stebbins Addition was read and upon motion by Miner, second by Amundsen, the recommendation was approved. 'I The recommendation of the Realtor's Committee that. the applications of j ,Howard L. Narveson and Clarence L. Gibbs for realestate salesman's license be granted 'I ',was read and President Fryer ordered that the same be placed on file. i The recommendation of the Street & Alley Committee that the City Engineer be authorized to contact the owners of property necessary for &.right-of-way on loth Street!, Ncw theast between lath Avenue and Miner's Heights was read and upon motion by Amundsen, second by Miner, the recommendation was approved. The following communication from the Chief of Police was read and President II • I, Fryer referred the same to the Street & Alley Committee and the Police Committee: "Hon. Mayor and Common Council City of Rochester, Minne sot*a l Gentlemen: For your consideration and approval: Installation of Tw&Twelve minute meters in several blocks faces in the business district fora trial period. Study of the unfavorable conditions for students attending Thomas Jefferson and coming from the west. From a safety standpoint I believe it necessary that sidewalk be ordered in on one side of the street to provide a place for the Students to walk. Also in j adverse weather because of the narrow width of the street splashing from snow and rain will be unavoidable. +; Very truly yours, I JAMES J. MACKEN, JR. Mayor and Common Council City of Rochester, Minnesota Gentlemen: On the 30th of August, 1950, Carl Nichols and Cora- Clarke, employed at the Joachim Food Market, were found guilty in Municipal Court in Rochester, Minnesota, of selling non - intoxicating malt beverages to a minor person. . Said conviction under the provision of Section 7, Ordinance, No. 5o4, constitute grounds for the revocation of the license held by the Joachim Food Market for the sale of non -intoxicating malt beverages off -sale. The information contained herein -is for your consideration Very truly yours, JAMES J. MACKEN, JR. Chief of Police" (Upon motion by Amundsen, second by Miner, license No. 1255 for "off.sale" non-intoxicati (malt liquor issued to John Joachim was revoked. The recommendation of the Police Committee and the Chief of Police that a Police Signalling System be installed for the City of Rochester by the Northwest Bell Telephone Company was read and upon motion by Amundsen, second by Anderson, the same was; (referred to the Police Committee with power to act. The following resolution adopted by the Public Utility Board was read and IPresider_t Fryer ordered that the same be placed on file. - "Be it, and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota, that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into the following contracts for -the furnishing of coal screenings, according to specifications on file, with the following companies: (1) Pittsburg -Midway Coal Company for the furnishing of 5,000 tons of raw carbon coal screenings at a mine price of $2.65 per ton,making a total contract price of Thirteen Thousand Two Hundred Fifty Dollars ($13,250.00). (2) Pittsburg -Midway Coal Company for the furnishing of 5,000 tons of 12" washed Kentucy coal ecreenings at a mine price of $3.50 per ton, making a total contract -price of Seventeen Thousand Five Hundred Dollars($17,500.00). (3) Walter Bledsoe and Company for the furnishing of 15,000 tons of I1" washed coal screenings at a mine price of $3.50 per ton, making a total contract price of Fifty -Two Thousand Five Hundred Dollars )($52,500.00). (4) Republic Coal and Coke Company for the furnishing of 5,000 tons of 12" washed coal screenings at a mine price of $4.45.per ton, making a total contract price of Twenty -Two Thousand Two Hundred Fifty Dollars $22,250.00). (5) Old Ben Coal Corporation for the furnishing of 5,000 tons 1" washed coal screenings at a mine price of $4.70 per ton, making a total contract price of Twenty -Three Thousand Five Hundred .Dollars ($23, 500.00). (6) Sahara Coal Company for the furnishing o.f 5,000 tons of i2« raw coal screenings at a mine price of $4.20 per ton, making a total contract price of Twenty -One Thousand Dollars( $21, 000. 00). the total amount of said contracts herein stipulated being ONE HUNDRED AND FIFTY THOUSAND DOLLARS .($1 50, 000..00) , and the said companies being the 16west responsible bidders when BTU content is considered and the coal is reduced to moisture -free, ash -free basis and considering plant requirements. The request of Knute Olson, City Assessor for permission to attend a conferene61 i i'of the National Assessing Officers Association to be held at Atlantic City, New Jersey, on October 9, 10, 11 and 12, 1•950 was read and upon motion by Morris, second by Amundsen; the request was not granted. The City Engineer's estimate of cost for the construction of a curb and gutter' in 912 Street Northeast from Sth to 9th Avenue Northeast in the amount of $2, 54 -15 was read and -the same was ordered placed on file. 'j The recommendation of the Board of Zoning that a special permit be issued by the Building Inspector for.the construction of a Greek Orthodox Church at 903 Second I. ,Street Southwest was read and upon motion by Amundsen, second by Anderson, the Building ,Inspector was authorized to issue the said special permit. ! A petition for the surfacing of 16th Street Northeast from Broadway to 3rd it ';Avenue Northeast and 3rd Avenue Northeast from 14th Street Northeast to the north line �I lof Barck and Merz Addition was read and President Fryer referred the same to the Street & iAlley Committee. it A petition for the construction of .a watermain on 15th Avenue Northeast from I' East Center Street to serve Lots 13, 14, 15 and 16, in Block 3, Stebbins Addition was read and President Fryer referred the same to the Water Committee. j! I i A notice from the League of Minnesota Municipalities of regional meetings and a schedule of the dates of meetings was read. Those wishing to attend were requested to notify the City Clerk so that reservations could be made. f A letter from the Federal Telephone and Radio Corporation advising that they would not submit a bid for a radio communication system for the Rochester Fire Department ,at this time was read and President Fryer ordered that the same be placed on file. The request of the Board of Public Health & Welfare for permission to sell 0.83 ,acres of the city farm property to School District No. 59 of Olmsted County at the rate of $100.00 per acre was read and upon motion by McPherson, second by Amundsen, the request was approved. '! The request of the Board of Public Health & Welfare for permission to employ I. Pougiales and Agnes Pougiales and 18 Second Avenue Southeast owned by Lester N. As is $17, 500.00 Land only (without house) 15,000.00 That the property at 18 Second Ave. S.E. As is I 16,000.00 Note: It is the appraisers opinion that no salvage other.than used lumber could be had from the Fawcett property'. In the instance of the Pougiales house the owner should in our opinion be given the option of moving the house to a different site at an agreed figure. It is not the appraisers intent at this time to make a formal report on basis.for the opinion arrived at; this being only in answer to a request for an opinion; however, we have in our records a complete inspection report of both properties as to size; condition, location, and adjacency, use and permit, a comparative value on market price.for properties in the adjacent area from which to prepare a formal appraisal report if needed. Lee from the Rochester Fire Department to be effective September 19, 1950 was read and upon motion by Anderson, second by Miner, his resignation was accepted. The application of Mr. Bennie Johnson for appointment as Justice of the Peace Of the Second Ward was read and upon motion by Amundsen, second by Morris, action on the tter was postponed until the next meeting. The matter of having Mr. W. J. Barden, assistant in the City Treasurer's office ssist in making collections from the parking meters was discussed by the Council. Upon otion by Amundsen, second by Helmkay, Mr. Barden was instructed to make collections fro the automatic meters and to furnish a bond in the amount of $2,000.00,,he to be under th upervision of the Chief of Police. The reports for the month of August, 1950 of the Building Inspector showing ees collected from building permits issued in the amount of $1,229.52; of the Electric nspector showing fees collected from electrical permits issued in the amount of $87.50; f the Heating Inspector showing fees collected from heating permits issued in the amount f $249.00; and of the Plumbing Inspector showing fees collected from plumbing permits ssued in the amount of $470.25 were each read and President Fryer ordered that the same ie placed on file. The report of the Clerk of the Municipal Court for the week ended August 26, 950 showing total criminal fines and costs collected $1,t010.00 and civil fees received 2.95 and for the week ended September 2, 1950 showing total criminal fines and costs ollected $1,077.00 and civil fees received $1.40 were each read and having been approve y the City Attorney, President Fryer ordered that the same be placed on file. The application of the Holloway Beverage Company for a wholesale beer license as read and upon motion by Amundsen.; second by Miner, the license was -granted. The application of Al M. Goodman for license to sell cigarettes at retail was *ead and upon motion by Miner, second by Amundsen, the license was granted. Narveson in' the amount of $1, 600.00 with. the I' Western Surety Company as surety; Standard Oil Company in the amount of $1,000,00 with the Seaboard Surety Company as surety; and Anne C. Jensen in the amount of $1,000.00 with the American Surety Company as surety were each read and upon motion by Amundsen, second';', by Morris, the bonds were approved, the surety thereon accepted'and it was ordered that the same be placed on file. I I The contract bonds of Farnham Stationery & School Supply Company in the amount of $4,631.25 with the American Automobile Insurance Company as surety;. C. M. Boutelle (2) in the amounts of $4,064.00 and $4,994.23 with the Western Surety Company as surety and Carlisle G. Fraser �2) in the amounts of $5,102.60 and $2,022.90 with the United States ''Guarantee Company as surety, were each read and the same were referred- to the Mayor for his approval. j Alderman Amundsen introduced a resolution accepting the bid of Carlisle G. Fraser for the construction of a sanitary sewer and watermain on 16th and 17th Avenues Northeast from 9th Street Northeast to the south line of Meredith's 2nd Subdivision, which was read. Upon motion by Anderson, second by Helmkay; that the said resolution be adopted i ,'as read, and all voting in favor thereof, President Fryer declared the said resolution i duly passed and adopted. Alderman Amundsen introduced a resolution accepting the bid of Woodhouse• Bros. 1, for the re -roofing of the old city warehouse, which was read. Alderman Amundsen introduced a resolution accepting the bid' of Bemel Auto 13artsi ,for sale of one used scale, which was read. Upon motion by Helmkay, second by McPherson, that the said resolution be adopte as read, and all voting in favor thereof, president Fryer declared thesaid resolution (duly passed and adopted. Alderman Anderson introduced a resolution accepting plans. and specifications and ordering bids for the grading and resurfacing of 6th Avenue Northwest from 7th Street Northnest to the Chicago N. W. Railway Tracks, which was read. Upon motion by McPherson, second by Miner, that the said resolution be adopted' s read, and all voting in favor thereof, President Fryer_ declared thei said resolution duly passed and adopted. Alderman Anderson introduced a resolution accepting plans and specifications nd ordering bids for the grading of the easterly North and South alley and the east and est alley from the East line of Lot 11, easterly to North and South alley in Block 23, orthern Addition, which was read. Upon motion by Miner, second by Morris, that the said resolut-ion be adopted s read, and all voting infavor thereof, President Fryer declared the said resolution my passed and adopted. Alderman Anderson introduced a resolution condemning land in the Northeast uarter of Section 26, Township.107 North Range 14 lying west of the Zumbro River' and appointing Commissioners, which was .read. Upon motion by Anderson, second by Helmkay, that the said resolution be adopteid as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. I. Alderman Helmkay introduced a resolution- ordering the first hearing on the • surfacing of 16th Street Northeast from Broadway to 3rd Avenue Northeast and 3rd Avenue Northeast from loth Street N. E. to the North line of Barak & Merz Addition, which was 1 read. Upon motion by Helmkay, second by McPherson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. 1 Alderman Helmkay introduced a resolution ordering the first hearing on the widening of 3rd Avenue Southeast between 4th and 5th Streets Southeast, which was read. I Alderman Helmkay introduced a resolution ordering the first hearing on the widening and regrading of 3rd Avenue Southeast between 3rd and 4th Street and construction of a curb and gutter to meet the approach of the Mayo Park Bridge, which was read. Upon motion by Miner, second by Morris, that the said resolution be adopted as read, -and all voting infavor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Helmkay introduced a resolution ordering the first hearing on the grading and surfacing ,of 6th Avenue Northwest from llth to 14th $treet Northwest, which was read. Alderman McPherson introduced a resolution ordering a hearing on the levying of special assessments for the construction of a curb and gutter on.7th Avenue Northwest from 7th to loth Street Northwest, which was read. • Upon motion by McPherson, second by Miner, that the said resoluti&n be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted.
