'19 50 1 • 1 • 1 1 Minutes of .a special, meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City' or. September 25, 1950. President Fryer called the meeting to order at 5:00 o'clock P. ai. , the follow' ' members being present: President Fryer, Aldermen Amundsen, Anderson, Helmkay,McPhersonj Miner and. Morris. Absent: None. The call.of the special meeting was read and President Fryer ordered that same be placed on file, the said meeting having been called for the purpose of considering charges which have been submitted to the Mayor in the matter of the alleged violation of Section 25 of,the Charter of the City of Rochester, Minnesota by C. E. Ginther, Chief of the Rochester Fire Department and any other business the said Common Council may deem proper. Mayor McQuillan stated that evidence in the matter for which,the special r. meeting had been called as submitted to him consisted of a photostatic copy of a warrant3 deed showing that C. E. Ginther was owner of a farm on which a bituminous plant was located, and a photostatic copy of conditional sale of bituminous equipment between C.E. Ginther and the Wm. H. Ziegler Company. He further stated that he had signed checks payable to R. E. Ginther for bituminous material, in the amount of $18.9.29 from the Park Improvement Fund and to the Bituminous Construction Company for bituminous material from the Street & Alley Fund in the amount of $250.56. Mr. C. E. Ginther, Chief of the Rochester Fire Department, was present at the meeting and stated that he did not think that he was guilty of the charge as stated by the Mayor, as he had no interest in the bituminous plant in question. Mr. Ginther then presented a copy of a bill of sale which he stated was drawn last spring when he sold th ,bituminous plant to his brother R. E. Ginther. He further stated that his brother also (held a cop"y of the said 'Dill of sale for the bituminous plant equipment. Mr. Ginther th presented a copy of the said bill of sale which was read by the Mayor and the members lof the Common Council. After hearing further discussion on the matter by Mr. Robert Petersdorf and Mr Paul A. Grassle, a motion was made by McPherson, second by Helmkay, that no charge be preferred against C. E. Ginther in connection with the alleged violation of -Section 25 0 the Charter of the City of Rochester, Minnesota. Upon roll call all voted in favor of t motion. The application for transfer. of °on sale' intoxicating liquor license No. 266 rom Jerry Reichert to Joseph E. Paulsen was read and upon motion by Amundsen, second by nderson, the same was referred to the License Committee. The request of the Public Health & Welfare Department to employ Miss Dorothy E. Upon motion by. Amundsen, second by Miner, the request was approved. and the salary for Miss Anderson was approved !! at $3960.00 per year, which is the salary now being paid to Miss Mildred Mouw. l Mayor Mcquillan stated that he had received notice from the U. S. Conference (I of Mayors of a civil defense conference to be held in Washington D. C. on October 5 and . II 6, 1950. Upon motion by Miner, second by Amundsen, the -Mayor was authorized to attend the said conference at City expense. J Mr. Laton Smith was present at the meeting and asked permission to place two campai n ':, in the business district the City.
