President Pryor called the meeting to order at 7:30 o'clock P. ., the followini'

members being present: President Fryer, Aldermen Amundsen, Anderson, Helmkay, McPherson,,;
Miner and Morris. Absent: None.
Upon motion by Morris, second by McPherson, the minutes of the meetings of
October 2nd and October 6th, 1950 were approved.
President Fryer stated this as being the time and place set for a hearing on
the levying of special assessments for the construction of a curb and gutter on loth .I
Avenue Northeast from 3rd to 5th Street Northeast. There was no one present wishing to

be heard.

President Fryer stated.this as being the time and place set for a hearing on l
the levying of special assessments for the: construction of a curb and gutter on 912 Avenue
Southeast from llth to 12th Street Southeast. There was no one present wishing to be
heard.
President Fryer stated this as being the time and place set for receiving and
opening bids for the grading and surfacing of 5th Avenue Northwest from llth to 12th
Street Northwest. No bids were received.
The recommendation of the Street & Alley Committee that since no bids were
received for the grading and surfacing of 5th. Avenue Northwest from llth to 14th Street
Northwest, the City Engineer be authorized to do the work using city forces, was read
and upon motion by Anderson, second by Helmkay, the recommendation was approved.
President Fryer stated this as being the time and place set for receiving and
opening bids for the grading and surfacing of Sth'Avenue Northeast from 14th Street

Northeast, north to the City limits. The bid of Leon Joyce in the amount of $3,467.4o li
was received.
The recommendation of the Street & Alley Committee that the bid of Leon Joyce
for the grading and surfacing of Sth Avenue.Northeast from 14th Street Northeast, north

and upon motion by Miner, second by Morris, the recommendation was approved..

President Fryer stated this as being the time and place set for receiving and
opening bids for the widening and regrading of 3rd Avenue Southeast between 3rd and 4th
Streets Southeast and a curb and gutter constructed to meet the approach of Mayo Park

,Bridge. NoIbids were received.
The recommendation of the Street & Alley Committee that since no bids were
received for widening and regrading of 3rd Avenue Southeast between 3rd and 4th Streets
Land a curb and gutter constructed to meet the approach of Mayo Park Bridge, the work be

deferred until the spring of 1951, was read and upon motion by Morris, second by Amundsen,

the recommendation was approved.
President Fryer stated this as being the time and place set for receiving and

opening bids -for the widening of 3rd Avenue Southeast from 4th to 5th Streets ,Southeast.
No bids were received.
The recommendation of the Street & Alley Committee that since no bids were
received for the widening of 3rd Avenue Southeast from 4th to 5,th Street Southeast, that
the work be deferred.until the spring of 1951 was read and upon motion by Morris, second)
by Miner, the recommendation was approved.
President Fryer stated this as being the time and° - place set for receiving and
opening bids for the surfacing of 16th Street Northeast f rom.Broadway to 3rd Avenue and
on 3rd, Avenue Northeast from 14th Street Northeast to the north line of Barck & Merz
ddition. No bids were received.
The recommendation of the Street & Alley Committee that since no bids were
ec'eived for the surfacing of 16th Street Northeast from Broadway to 3rd Avenue and on
3rd Avenue Northeast from loth Street Northeast to the north line of Barck and Merz
Addition,.the City Engineer be authorized to do the work using city forces was read and

President Fryer stated this as being the time and place set for receiving and

The recommendation of the Street & Alley Committee that since no bids were

he work using, city forces, was read and upon motion by Amu-ndsen, second by Helmkay, the

Machine Company in the amount of $4,049.10 for the furnishing of one accounting machine �
for use in the City Clerk's office be -accepted was read and upon motion by Miner, second
by Morris, the recommendation was approved.
I The recommendation of the Street & Alley Committee that bids be taken for the
purchase of one engineer's transit for use in the City Engineer's Department was read i
and upon motion by Miner, second by Helmkay, the recommendation was approved.
The recommendation of the Street &Alley Committee that bids be taken for,the
furnishing of a power steering attachment for the No. 100 motor patrol belonging to the
Street & Alley Department was read and upon motion,by Miner, second by Morris, the
recommendation.was approved.
The recommendation of the Street & Alley Committee that an assistant mechanic
be added to th4 Street and Alley Department at a salary -of $260.00 per month was read
and upon motion by Helmkay, second by Anderson, the recommendation was approved. !
The recommendation of the Chief of Police and the City Engineer that the
following named streets be designated as arterials, except where they intersect with
streets that are presently designated as Arterials, "West Center - Fourteenth Street
,Northwest -.Fourth Avenue Northwest and Southwest and.Eleventh Avenue Northeast and
,Southeast", and if these streets are approved as Arterials it will necessitate purchase
!iof approximately 100 Stop Signs and tubular posts, was read and upon motion by Amundsen,,
second by Miner, the recommendation was approved.
The recommendation of the Realtor's Committee that the application of 0.. P4_
Storlie for a Realtor's license be granted was read and President Fryer ordered that the!
same be placed on file. I,
The recommendation of the Fire Committee that the bid of Radio Corporation of
America for the furnishing of Fm Radio Communication System for the Rochester Fire
'Department in the amount of $4,321.00 be accepted and certified checks be returned to
,the unsuccessful bidders was read and upon motion by Amundsen, second by Morris, the
recommendation was approved.

Upon motion by Anderson, second by Helmkay, a vote of thanks was extended to
,Reuben A. Rieck, Richard H. Schacht and Robert W. Cross for their generous cooperation
in making a study of radio equipment for use in the Rochester Fire Department.
The recommendation of the Street & Alley Committee that the bid of Leon Joyce
,for the grading of streets_ in Parkside Addition in the amount of $41, 713.06 be accepted
was read and upon motion by M orris, second by Miner, the recommendation was approved.
The three following resolutions adopted by the Public Utility Board were each

read and upon motion by Miner, second by Helmkay, the same were approved and ordered
placed on file:
"Be it and it is hereby resolved by the Public Utility Board of the
City of Rochester, Minnesota, that the Sinking Fund Commission of said
City be and is hereby requested to invest.the amount of FIFTY THOUSAND
DOLLARS ( $50, 000.00.) from uninvested funds in the Sinking Fund for
Electric Department Depreciation Reserve."

"WHEREAS, insufficient funds are availalbe in "Cash in Banks -
Steam Department" to meet the current expansion program and to
stock -pile. coal for the coming heat'i-ng , season,
THEREFORE, ' Be it and it is hereby resolved by the Public'
Utility Board of the City of Rochester, Minnesota, that the
Sinking Fund Commission of the said City be and.is hereby
requested to appropriate TWENTY FIVE THOUSAND EIGHT HUNDRED TEN
DOLLARS ($25,810.00) from Sinking Fund for Steam Department'`
Depreciation Reserve -Not Invested to the Public Utility Fund -
Steam Department".
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota that the Common Council of
the said City.be and is hereby requested to authorize the said
Board to enter into a contract with the NATIONAL CONVEYOR AND
SUPPLY COMPANY for the furnishing of.a CAR SHARER, the amount of
the said contract to be TWELVE HUNDRED FORTY SIX DOLLARS AND
TWENTY CENTS ($1,246.20) and the said National Conveyor and
Supply Company being the lowest responsible bidder."
A communication from Leiferman- Koehnen, Inc. stating that they had now
ompleted the Castle Trailer Court Park at 20th Avenue and 2nd Street Southwest and about
5 spaces were now.available for parking of trailers was read and President Fryer ordered
hat the same be placed on file.
..The request of the Board of Public Health & Welfare for permission to employ
r. Ralph Resler of 303 Third Street Northwest as a garbage collector, effective
ctober 15, 1950 at a salary of $245.00 per month was read and upon motion by Morris,
econd by Helmkay, the request was approved.
The request of the City Engineer for permission to employ William H. Dunnette,
s Rodman II, effective October 5, 1950 was read and upon motion by Anderson,:second by
finer, the same was approved.
A petition by the owners of the property known as the Parkside Addition
equesting that the bid of Leon Joyce for grading of streets in'the said addition be
ccepted and the contract awarded to him was read and the same was ordered placed on file
A noti$e of claim for personal injury by Miss Margaret J. Voelker was read and
resident Fryer referred the same to the City Attorney.
I) A credit memorandum issued by Toltz, King and Day, Inc. to Carlisle G. Fraser
• reducing his contract on the sewer line to the new Sewage Disposal Plant by the amount of

$23,523.25 was read and upon motion by Helmkay, second by Miner, the same was approved.
Mr. David Fanning was present at the meeting and 'inquired as to why action had
not been taken on a plat which had been submitted for approval. The City Engineer. was

Instructed to make his investigations of the proposed plat \and submit a recommendation
it the next meeting, at which time approval of the plat would be considered.
The City Engineer's trial balance for.'the month of September, 1950 was read and
the same was ordered placed on file.
The reports of the Clerk of Municipal Court for -the week ended October 7, 1950
showing total criminal fines and costs collected $943.00 and civil fees received $5.40

Attorney, President Fryer ordered that the same be placed on file.
The application of John gubat for a license to sell cigarettes at retail was
j read and upon motion by Morris, second by Amundsen, the license was granted.
The application of John Kubat for a license to sell soft drinks was read and
upon motion by Amundsen, second by- Helmkay, the license was granted.
The applications of Lawrence Lysne for two permits to move buildings over ;i
it
certain streets in the City of Rochester mere each read and upon motion by Amundsen, l
second by Miner, the permits were granted.
The application of Harry Donald Prouty for "on sale!intoxicating liquor license
I1was read. No action was taken on the application.

The application of Russell Carlson for a license to operate a popcorn wagon
was read and upon motion by Amundsen, second by Miner, the license was not granted.
The application of 0. P. Storlie for a real estate broker's license was read
and upon motion by Miner, second by Amundsen, the license was granted.
The two contract bonds of Carlisle G. Fraser in the amounts of $2,445.90 and

$17,199.30 with the United States Guarantee Company as surety were each read and the
!i
same were referred to the Mayor for his approval.
Mr. Paul Grassle was present at the meeting and asked if the•bell which was
removed from the old fire hall at` the time the building was torn down could be loaned tol'
the Rooter's Club or the Chamber of Commerce. Upon motion by McPherson, second by
Helmkay, his request was granted.

Alderman Amundsen introduced a resolution accepting the bid' of Leon Joyce for ai!,

Upon motion by Amundsen, second by Anderson, that the- said resolution be adopted
as read, and all votiifg in favor thereof, President Fryer declared the said resolution

Alderman Amundsen introduced a resolution accepting the bid of Burroughs
Adding Machine Company for furnishing an accounting machine for use in the City Clerk's

which was read.
Upon motion by McPherson, second by Miner,
that the said resolution be adopted
as read, and all voting in favor thereof, President
Fryer declared the said resolution
duly passed and adopted.
Alderman Amundsen introduced a resolution
approving a resolution adopted by the
Public Utility Board, transferring. funds from Sinking Fund to Steam Department, which
was read.
Upon motion by Miner, second by Morris, that the said resolution be .adopted

Alderman Helmkay introduced a resolution appropriating $2,566.39 from the
Street & Alley Fund and ordering payment=made to L. N. Sickels Co., $1,179.50; Dresser
Trap Bock Company, $491.83; Bituminous Construction Company, $332.41; Firestone Stores,
$273.30 and Herbert G. Bnopp, $289.34, which was read.
Upon motion by Miner, second by Morris, that the said resolution be adopted
as read,'and all voting in favor thereof, President Fryer declared the said resolution
duly passed and adopted.
Alderman McPherson introduced a resolution appropriating $9,`580.24 from the
(Bridge Fund and ordering payment made to L. M. Feller Company for estimate No. 19 for
bridge No. 6599, which was read.
Upon motion by Morris, second by Amundsen, that the said resolution be adopted))

Alderman McPherson introduced a resolution appropriating $6,'937.99 from the
Permanent Improvement Fund and ordering payment made to Ellerbe & Company for professio
service in connection with the Health Center Building, which was read.

Alderman McPherson introduced a resolution appropriating $426.72 from the P.I.R.

in 16th Street Northeast from Broadway to 3rd Avenue and on 3rd Avenue Northeast from
14th to 16th Street Northeast, which was read.
Upon motion by Anderson, second by Helmkay, that the said resolution be -adopted)

Alderman Miner introduced a resolution appropriating $493.85from the Lighting
Fund, $306,19 from the Park Improvement Fund and $41.31 from the Sewer Fund and ordering
payment made to City of Rochester, Public Utilities, which was read.

The matter of erecting billboards in the'area around Mayo Memorial Park was
discussed and Mr. Raymond'DeVogel,'of Naegele Poster Service, was present at the meetiAgl

not know-thattthere would be objections to -outdoor advertising inrthe area in which the
Mayo -Memorial would be located. A motion was made by Amundsen, second- by McPherson, II
jthat the�Couneil go on record as not -being in favor of the construction of signs in the
area in which the Mayo Memorial is to be located. All voted in favor•of themotion:.

During the discussion it was recommended that a study•be made of the ordinance
'covering -the issuance of permits for the construction of billboard advertising. Upon
'motion by Helmkay, second by Amundsen, the chair was appointed to•select a committee of ii
,three from -the Council to make a study 6f the present ordinance. President Fryer
.appointed Aldermen•Amundsen, McPherson and Helmkay to act on the said committee to work
with the Building Inspector and the City Attorney in preparing an amendment to the said
ordinance. I.
Mayor McQuillan reported briefly on the Conference,of Mayors at Washington, D. C.
regarding civil defense and recommended that the sum of $10,000.00 be included in thd' j
,tax budget for the purpose of civil defense.
Alderman Anderson recommended that the area at the waterworks could be used for
,parking purposes but that -certain property would have to lle purchased for an entrance:
IHe stated further that the Utility Department would provide a sketch of the area proposed;

the Public Grounds Committee. -
The recommendation of the Street & Alley Committee approving the p-drehase of
v500 tons of hot mix bituminous surfacing from the Bituminous Construction Company 'wan "
reconsidered and the City Engineer recommemded that the.bid be rejected and the certified
check returned to the bidder.- Upon motion by Amundsen, second by'Helmkay, the City
Engineer's reco'mmendation was approved. -
Upon motion by Amundsen, second by Helmkay, the meeting was'adjourned.
