II Minutes of an adjourned regular meeting of -the Common Council of -the City I ' ,iof Rochester, Minnesota, held in the Council Chambers, in the City Hall•in said I% City, on November 20, 1950. �I President Fnyor called the meeting to.order at 7:30 o'clock P. M., the following members being present: President Fryer, Aldermen Amundsen, Anderson, Helmkay, McPherson, Miner, and Morris. Absent: None. Upon motion by Morris, second by Amundsen, the minutes of the meetings of November ,6th and November 13th, 1950 were approved. President Fryer stated this as being the time and place set for a ,,hearing on the levying of special assessments for the construction of a sanitary 'Iisewer and watermain in 8th Avenue Northeast, in Peck's First Addition. There was no one present wishing to be heard. I President Fryer stated this as being the time.and place set for receiving a ,'and opening bids for furnishing a transit for use in the City Engineer's Department. The bid of H. A. Rogers Company in the amount of $615.00 was received and opened. The recommendation of the .Street & Alley Committee that the bid of H. A. Rogers Company for the furnishing of a transit for use in the City Engineer's Department be rejected and check returned to the bidder, and that the Street and I (Alley Committee be authorized to make the purchase on the open market, was read ; and upon motion by Morris, second by Miner, the recommendation was approved. President Fryer stated this as being the time and place set for receiving and opening bids for the furnishing of labor and material for installaing Christmas Street Lighting. No. bids were received. Mr. Paul A. Grassle, who was appointed to represent the Chamber of Commerce at a hearing in Washington, D. C. on the North Central Case which would permit the Mid -Continent Airlines to make certain stops in addition to their present schedules, reported that no final decision was made at the .two conferences which he I� !attended. H.e did, however, state that the decision of the Civil Aeronautics !; Commission would probably be made known within the next.10 days. Mayor McQuillan stated that he had contacted Mr. Hove in regard to �I i . submitting testimony to the Council as to the time employed at the Hot Mix Plant on the C. E. Ginther farm and also as to payments received for his services. The Mayor stated that Mr. Hove had refused to testify ox give a certified statement in regard to the above mentioned employment. After further discussion, a motion was i 'made by Miner, second by Helmkay, that the matter of the alleged violation of the City Charter by C. E. Ginther, Fire Chief, be,referred to the Fire Civil Service Commission for their consideration. All present voted in favor of the motion. The first course would be to take the case to. -the State Supreme Court and -the second course would° be ' to abolish Civil Service in the Police Department in the City of Rochester.. The -Mayor then recommended that the Common Council by resolution abolish -Police Civil Service in the City of Rochester, Minnesota. The Council decided to study the - matter at an informal meeting to be held on Monday, evening, November 27th. The recommendation of the Sewer Committee that no change be made in the sewer assessments for Ninth Avenue Northwest -in Pahama Court, and for 15th Avenue Northeast in Block 3, Stebbins Addition, was read:: Action on the same was deferred until the next meeting: The recommendation of the -Sewer Committee and the City' Engineer that the bid of Carlisle G. Fraser -in -the amount of $19, 500.00 for construction of a c two—inch high pressure gas main from Second Avenue N. W. and, 13th Street N. W. to -the now Sewage Disposal Plant be accepted and checks returned to the unsuccess— ful bidders, was read and upon motion by•McPherson, second by Morris, the recommendation was approved. The matter of the claim of Bert Hayes for damage to his 1949 Hudson car in the amount of $73.00 was brought to the attention of the Council. A motion was made by Miner, second by McPherson, that the City Attorney be instructed to contact Postier & Eggers and determine, if possible,'who would be responsible for the damage claimed. All voted in favor of the -motion, The application of Trim. T. McCoy Post No. 92 to conduct a bingo game at the post club rooms on each Sunday afternoon was read. No action which would prohibit the operation of 'a bingo game at the post club rooms was taken. After some discussion on the hours of holding the bingo game it was moved by McPherson, second by Helmkay, that the City Clerk write a letter requesting that the Legion hold their bingo game on some other day than Sunday. • The request of the Rochester Fire Department Relief Association for, approval on a loan to Edward J. Dillon in the amount of $1250.00 on his property at 103 Fifth Street Southeast and also a loan to Gordon Benson in the amount of $1900.00 on his property at 942 Seventh Avenue Southeast, was read. Alderman .Morris, Chairman of the Finance Committee, reported verbally that the said Committee was in favor of approving the loans and upon i3otion by Morris, second by Amundsen, the said loans were ap�oroved. The request of the Board of Public Health Welfare for permission to employ Miss Mildred Lewis as secretary in the sanitation division of the Health Department, effective November 27, 1950 at a salary of $175.00 per month to replace Mrs. -Cora Thompson, who has resigned, was read and upon motion ,by Morris, second by Miner, their request was approved. A letter from John F. Bonner, City Attorney for the City of Minneapolis, ! I1 '� enclosing a copy of the action taken 3y said City regarding a petition filed by the Northern Natural Gas Company requesting an increase in rates in the State of it Minnesota was read and upon motion by Morris, second by McPherson, the Mayor, City Attorney Y and City Clerk were instructed to prepare a resolution requesting the II Attorney General to intervene as Chief Law Officer of the State of Minnesota wt a hearing to be held on February 19,.1951 in Washington, D. C. I The resignation of Emrold Thiem from the Board of Zoning of the City of IRochester and also the Mayor's appointment of Mr. L. A. Fellows to fill the vacancy on the said Board of -Zoning were each read and upon motion by Morris, second by • !i _Anderson, Mr. Thiem's resignation was accepted and the appointment of Mr. L. A. Fellows to fill the unexpired term of Mr. Emrold Thiem, which expires on the second Monday. in April, 1955, was approved. The resignation of Mr. M. J. Fairley as Plumbing and Heating Inspector for the City of Rochester was'read and upon motion by Miner, second by Anderson, the same was accepted. The City Treasurers report for the month of October, 1950 was read and the same was ordered placedon file. The City Engineer's trial balance for the month of October, 1950 was read and the same was ordered placed on file. A statment of receipts and disbursements in the Park Improvement Fund for the month of October, 1950 was read and the same was ordered placed on file. The reports of the Clerk of Municipal Court for the week ended November 11, 1950 showing total criminal fines and costs collected $909.00 and civil fees received $1.90 and for the week ended November 19, 1950 showing total criminal fines and costs collected $969.00 and civil fees received $13.95,4were each read and having been approved by the City Attorney, President Fryer ordered that the same be placed on file. The applications of Steve Gromek for license to sell cigarettes and license to sell soft drinks were each read and upon motion by Morris, second by Anderson, the licenses were granted. The application for transfer of "On Sale" and "Off Sale" 3.2 Beer license from Clarence Sather to Fergus Brackbnbury was read together with the applications of Fergus Brackenbury.for license to sell cigarettes and soft drinks. The surety bonds of Wm. H. Ziegler Company in the amount of $535.00 with the St. Paul Mercury Indemnity Company as surety and Radio Corporation of America...in the amount of $4,321.00 with the Indemnity Insurance Company of North America as surety were each read and the same were referred to the Mayor for his approval. Alderman Helmkay introduced a resolution accepting the bid .of Carlisle G. Fraser for construction of a two-inch high pressure gas main from 2nd Avenue and 13th •Street Northwest to the new Sewage Disposal Plant site, which was read. Upon motion by Miner, second by. Morris, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution ordering bids for furnishing a 1000 gallon per minute pumper for use in the Rochester Fire Department, which was read. Upon motion by Anderson, second by Helmkay, that the said resolution be adopted as.read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution ordering bids for fire hose for use in.the Rochester Fire Department, which was read. Upon motion by Helmkay, second by McPherson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution levying special assessments for the construction of sidewalks for the year 1950, which was read. Upon motion by McPherson, second by Miner, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution levying special assessments for the construction of a sanitary sewer and watermain in Sth Avenue Northeast from loth Street Northeast, north 1300 feet in Peak's First Addition, which was read. Upon motion by Miner, second by Morris, that the said 'resolution- be .adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Miner introduced a resolution ordering a hearing on the levyi ng of special assessments for the grading of 5th Avenue Northwest from llth to 14th Street Northwest, which wqs read. Upon motion by Helmkay, second by McPherson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Miner introduced a resolution ordering a hearing on the levying of special assessments for the -grading of 12th Avenue Northeast in Westls'Sub- Division, which was read. Upon motion by McPherson, second by Miner, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Miner *intaoduced a resolution ordering a hearing on the levying of special assessments for the grading of loth Avenue Northeast and 15th Avenue Northeast from 7th. to 9th Street Northeast and 7th Street Northeast from 13th to 15th Avenue Northeast, which was read. Upon motion by Miner, second by Morris, that the said resolution be adopted as react, and all -voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Miner introduced a resolution ordering a hearing on the levying of special assessments for the grading of 16th and 17th Avenue Northeast from 9th Street Northeast.to the south line of Meredith's 2nd Sub -Division, which was read. Upon motion by Morris, second by Anderson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman McPherson introduced a resolution ordering a hearing on the levying of special assessments fo'r the grading of 9th Avenue Northwest in Pahama Court, which was read. Alderman McPherson introduced a resolution appropriating $206.80 from the General Fund and ordering payment made to the quality Printing Company, which was read. Upon motion by Helmkay, second by McPherson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman McPherson introduced, a resolution appropriating $4,893.95 from the General Fund and ordering payment made to Motorola, Inc., which was read. Upon motion by McPherson, second by Miner, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the I said resolution duly passed and adopted. Alderman McPherson introduced a resolution appropriating $2,590.05 from the General Fund and ordering payment made to the Big Four Oil Company, - which was read. Upon motion by Miner, second by. -Morris, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman McPherson introduced a resolution appropriating $99.36 from the General Fund, $2. 70 from the S & A Fund, $6.30 from, the Fire Protection Fund, $90. 54 from the Sewer Fund and $5, 497.77 from the Lighting Fund and orderi payment made to City of Rochester, Public Utilities, which was read. Upon motion by Morris, second by Anderson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Helmkay introduced a resolution appropriating $328046 from the Fire Protection Fund and ordering payment made to Highway Safety Appliances, Inc.,+ which was read., Upon motion by Anderson, second by Helmkay, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Helmkay introduced a resolution appropriating6 $ .590.00 from the Fire. Alderman Helmkay introduced a resolution ap propriating $2,921.73 from the Park Improvement Fund and ordering payment made. to Globe T,ickete Co.-$201.36'; I. E. B. Ballou - $274.70; Kris Nielson - $229- 51; and Mayo Civic Auditorium Revolving Fund - $2217.16, which was read. Upon motion by Miner, second by Morris,•that,the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the. said resolution duly passed and adopted. Alderman Helmkay introduced a resolution appropriating •$414.75 from the Lighting Fund and ordering payment made to the Public Health & Welfare Fund, which was read. The -credit memorandum issued by Toltz,, King & Day, Inc_. making,the following change in the contract price was again considered by the Council and upon motion by Morris,•second by,McPherson, the change order wag -approved: "Substitution of 5 H.P. motor for the 71 H. P. motor for the sludge recirculation pump, a credit of . . . . . . . . . $35.00V The City Attorney stated.that he had now come to an agreement with Mr. &- Mrs. W. 0. Geselle for an easement across their farms, for the construction of a trunk line sewer to the new Sewage Disposal Plant and upon motion by Miner, second by Morris, the City Attorney was authorized to make the settlement as stated. Alderman McPherson suggested that signs be installed on Broadway indicating the three parking lots which are now in use, which would include the ;I , parking area at the Mayo Civic Auditorium, the old Mill Property and the area at the City Warehouse. He further stated that four neon flashing signs could be installed at a cost of approximately $1,000.00. Upon motion by McPherson, second by Helmkay, it was ordered that plans and specifications be prepared for the said i signs and that'a resolution be presented at the next Council meeting ordering bids. Ulrich was before the Council and asked permission to locate a trailer temporarily on the.lot where he expects to sell Xmas trees. Upon motion by Helmkay,.second by Anderson, his request was granted. The matter of the Christmas Street Decorations was discussed and it was noted that most of the work.on this project had been .completed before the date on which bids were to. be. opened. Upon motion by McPherson, second by Miner, the City Clerk was instructed to write the Chamber of Commerce calling their attention to the procedure which was necessary for the City to follow and request that plans and specifications be prepared at an earlier date for the.coming year...
