Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambersin the City Hall, in said City
on December 4, 1950.
President Fryer called the meeting to order at 2:00 o'clock P. M., the
following members being present: President Fryer, Aldermen Amundsen, Anderson,
Helmkay, McPherson, Miner and Morris. Absent: None.
Upon motion by Amundsen, second by Miner, the minutes of the meeting.of
.November 20, 1950 were approved.
President Fryer stated this as being the time and place set for a'hearing
on the levying of special assessments for the grading of loth andy 15th Avenues
Northeast from 7th to 9th Street and 7th Street Northeast from 13th to 15th.
Avenue Northeast. There was no one present wishing to be heard.
President Fryer stated this as being the time and place set for a hearing
on the levying, of special' assessments for the grading of 16th_ and" 17th Avenues
Northeast from 9th Street Northeast to' the south line of Meredith) s" Second Sub -
Division. There was no one present wishing to be heard.'
President Fryer stated'this as being the time and place set for a hearing
on the levying of special assessments for the grading of 12th Avenue Northeast in �-
West's Sub -Division. There was no one present wishing to be heard.
President Fryer stated this as, being the time and_ place' set for a hearing
on the levying of special assessments for the grading of 9th Avenue Northwest in
Pahama Court. There was no one present wishing to be'heard.
President Fryer stated this as being the time and place set for a. hearing
on the levying of special assessments for the grading of 5th Avenue Northwest from

ll.th to 14th Street Northwest. There was no one present wishing to be heard.
President Fryer stated this as being the time and place set for a heari ne
on the levying of'special assessments for the grading of 6th Avenue Northwest from
7th Street Northwest to the Chicago Northwestern Railroad tracks. There was no
one present wishing to be heard'.
President Fryer stated this as being the time and place'set for a hearing
on the levying of special assessments for the grading of 13th Avenue Southeast from
6th to Sth Street Southeast. There was no one present wishing to be heard.
President Fryer asked Mayor McQuillan if he had anything to bring before
the meeting at this time. The Mayor then read a,statement giving,his reasons why
he thought Civil Service in the Rochester Police Department should be abolished
and recommended to the Council that they adopt a resolution which'would abolish
the said Civil Service. He further recommended that a plan be worked out by the
Council, the Mayor and Attorneys_,*setting up a merit system in'the Police Department
after necessary amendments to th,e City Charter had been approved.'

Mr. A. C. Hagen and Mr. Ralph M. Graen were present at the meeting and
I'
each recommended that the Police Civil Service be not abolished, stating that the y
felt it would be a step backwardp and a return to the old spoils system.

Alderman Anderson moved that no action be taken on the Mayor's recommend- I;
!ration that Civil Service for the Police Department be abolished. Alderman Amundsen
seconded the motion and upon roll call all voted in favor of the motion.
Mr. Robert Petersdorf was present at the meeting and asked for an informal
meeting with the members of the Common Council to study the present building,
heating, plumbing and electrical codes and that no appointment be made,to fill the
vacancy in the Heating and Plumbing Inspector's office until this meeting had been
held.
Mr. Naegele, of the Nae.gele Poster Service, was before. the Council and
eked for permission to complete the sign project which they had started on the Soutr
of the new bridge from 2nd Avenue to 3rd Avenue Southeast. After some ,discussion
a motion was made,by Morris, second by Miner, that the Naegele Poster Service be
granted permission to complete their sign project with the understanding that the
Common Council would have the right to censor advertising posted on the billboards.
The following resolution adopted by the Public Utility Board was read
and President Fryer ordered that the same be placed on file:
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota that the Common Council of
the said City be and is hereby requested to authorize the said
Board to enter into a contract with Wallace and Tiernan Company
for the furnishing of seven (7) chlorinators and seven (7)
hypochlorinatbrs in accordance with specifications and with
their proposal,. the total amount of the said contract to be
TEN THOUSAND FOUR HUNDRED DOLLARS (410,400.00)"
The requests of the Board of Park Commissioners to enter into contract
with the Botsford Lumber Company for furnishing glazed tile wall facing material
to complete the inside wall facing of the sanitary building at the John R. Cook
IPark and the Universal Motors, Inc. for the furnishing of a dump truck, were each
read and President Fryer ordered that the same be placed on file.
A letter addressed to Mayor McQuillan from Mrs. James A. Gee of Akron,
Ohio requesting payment of damages to clothes and for personal injury was read
and the matter was again referred to the City Attorney.
The request of the Minnesota State Gideons for permission to hold
street services during their convention to be held in Rochester on the 18th, 19th
and 20th of P-lay, 1951, at the location of the First National Bank corner, was
read and upon motion by McPherson, second by Helmkay, their request was granted.
An extra order issued to Carlisle G. Fraser by Toltz, King and Day, Inc.
authorizing an increase in price in his contract for the following items was read:

Upon motion by Anderson, second by Amundsen, the Extra Order No. 1 was approved.
The City Engineer's appointment of Donald Valsvik to the position of
draftsman in the City Engineer's Department at a salary of $260.,00 per month
was read and upon motion by Miner, second by McPherson, the appointment was
approved.
The appointment by the Judge of Municipal -Court of Cleo Paullin as
Clerk of Municipal Court and Dor-othy Lawson as Deptty Clerk of Municipal Court,
effective December 1, 1950, was read and upon motion by Miner, second 'by
Amundsen, the appointments were approved.
The request of Clara M. Yeager for .a parking space for her personal car
at the Cooperative Building at the corner of Broadway and 4th Stroet was read.
No action was talien on the matter. -
The petition of Catherine H. Lawler, Fabian T. Lawler and Helen G. Lawler
that Lots'?, 7, 9, 9 and 10, Block 16, Head & McMahon's Addition be changed from
a residential zone to a multi-ole dwelling zone tnras read and upon motion by
Anderson, second by Amundsen, the same was referred to the Board of Zoning.
The recommendation of the Sewer and Purchasing Committees that bids be
taken for the furnishing of one carload of prepared stoker coal for use in the
.Sewage -Treatment Plant was read and upon motion by McPherson,- second by Morris,
the recommendation was approved.
The recommendation of the Street & Alley Committee that bids be taken for
the purchase of a 16,000 lb. G. V.W. truck for u-se in the Street & Alley Department
was read and upon motion by'Helmkay, second by Amundsen, the recommendation was
approved.
The recommendation'of the Street & Alley Committee that bids be taken
for the Rurchase of a light panel truck for the City Engineer's Department,
trading in the department's 1941 Dodge Sedan, was read and upon notion by Anderso
second by McPherson, the recommendation was approved.
The reports for the month of November, `1950 of the Building Inspector
showing fees collected for building permits issued in the amount 'of $303.00; of
the.Electrical Inspector showing fees collected for electrical permits issued in
the amount of $53.00; of t-he Heating Inspector snowing fees collected for heating
permits issued in the amount of $329.50; and of the Plumbing Inspector showing
fees collected for plumbing permits issued in the amount of $932.25 were each
read and President Fryer referred the same to the Finance Committee.
The reports of the Clerk of the Municipal Court .for the week ended
November 25, 1950 showing total criminal fines and costs collected $923.00 and
civil fees received $.85 and for the week ended December 2, 1950 showing total

criminal fines and costs collected $729.00 and civil fees received $1.05, were
each read and having been approved by the City Attorney, President Fryer ordered
that the same be placed on file.
The applications of Vernon D. Wendland for licenses to sell.soft drinks
and cigarettes were each read and upon motion by Amundsen,_ second by Helmkay, the
licenses were granted.
The application of Rochester Bus Line, Inc.. for transfer of City Bus

License No. 1 from Bus No. 14 to Bus No. 37, 1950 GMC 27 passenger Bus, was read
and upon motion by Anderson, second by Miner, the transfer was granted.
The application of Leslie R. Lance for a Master Plumber's license was
read and upon motion by Anderson, second by Amundsen, the license was granted.
The surety bond of L. R. Lance in the amount of $1,000.00 with the Western
Surety Company as surety and the Indemnity bonds for Lost Warrant or Order of the
International Association of Auditorium Managers in the amount of $130.00 and the
Gibbons Printing Company.in the amount of $67.30 were each read and upon notion
by Anderson, second by Miner, the bonds were.approved, the surety thereon accepted
and the bonds were ordered placed on file.
The contract bond of Carlisle G. Fraser in the amount of $19, 500.00 wit h
the United States Guarantee Company as surety was read and the same was referred
to the Mayor for his approval.
..Alderman Anderson introduced a resolution levying special assessments
for grading in Mohn & Hodge Sub -Division, which was read.
Upon motion by Amundsen, second by Anderson, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution levying special assessments
for the grading of 16th and 17th Avenues Northeast from 9th Street Northeast to
the South line of Meredith's 2nd Sub -Division, which was read.
Upon motion by Anderson, second by Helmkay, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the.
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution levying special assessments
for the grading of 9th Avenue Northwest in Pahama Court, which wes read.
Upon motion by Helmkay,-second by McPherson, that the said resolution be

Alderman Anderson introduced a resolution levying special assessments
for the grading of 5th Avenue Northwest from llth Street Northwest to 14th Street
Northwest, which was read..
Upon motion by Morris, second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof,. President Fryer declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution levying special assessments
for the grading of 6th Avenue Northwest from 7th Street Northwest to the Railroad
tracks, which was read.
Upon motion by Amundsen, second by Anderson, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution -duly passed and adopted.
Alderman Anderson introduced a resolution levying special assessments
for the grading of 13th Avenue Southeast, from 6th to Sth Street Southeast, which
was read.
Upon motion by Anderson,, second by Helmkay, that the said, resolution be
adopted as read, and all voting in favor th,ereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman Helmkay introduced a resolution authorizing the Public Utility
Board to enter into contract with Wallace.& Tiernan Company, which was read.
Upon motion by Helmkay, second by McPherson, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman Helmkay introduced a resolution ordering a hearing on the
levying of special assessments for the widening of East Center Street from Broadway
to 2nd Avenue, which was read.
Upon motion by McPherson, second by Morris, that the said resolution be
adopted as read, and all voting in favor thereof, President -Fryer declared the
said resolution duly passed and adopted.
Alderman Helmkay introduced a resolution ordering a hearing on the
levying of -special assessments for widening of 3rd Avenue Southwest,f rom 3rd to 5th
Street Southwest, which wqs read.
Upon motion by Morris, second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman Helmkay introduced a resolution appropriating $200.00 from the
General Fund and ordering payment made to Robert A. Bennighof, which was read.

,Street & Alley Fund and ordering payment made to the Wm.-H. Ziegler Company, which

Alderman Helmkay introduced a.resolution appropriating $1,416.50 from the
'Sewer Fund and ordering payment made to the Neenah Foundry Company, which was read.
Upon motion by McPherson, second by Morris, that the said resolution be
adopted as read, and all_noting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman Helmkay introduced a resolution appropriating $499.95 from the
Bridge Fund and ordering payment made to L. M. Feller Company, which was read.
Upon motion by Morris, second by Amundsen, that the said resolution be
;adopted as read, and all voting in favor thereof, President Fryer declared the

Alderman McPherson introduced a resolution appropriating $52,945.00 from
I, the P. I.. R. Fund and ordering payment made to the First National Bank of Rochester,
Minnesota, which was read.
Upon motion by Amundsen,9second by Anderson, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman McPherson introduced.a resolution appropriating $7,399.00 from

Alderman McPherson introduced' a resolution appropriating $294.41 from t
Lighting Fund and $1,166.49 from the Park Improvement Fund and ordering payment
made to the City of Rochester, Public Utilities, which was read. ,

Alderman.Miner introduced a resolution appropriating $27,977.31 from
the Sewage Disposal Plant Fund and,ordering payment made to Feller and Pagenhart,
which was read.

enter into contract with the Universal Motors for.the purchase of a dumping•
truck, which was read.

said resolution duly passed and adopted.
Alderman Miner introduced a resolution authorizing the Park Board to

adopted as read, and all voting in favor thereof, President•Fryw-, declared the
,said resolution duly passed and adopted. ;
Alderman Morris introduced a resolution ,ordering bids -for furnishing a
light panel truck -for use in the City Engineer's•Department, which was -read.

•Alderman Morris introduced a resolution ordering bids for furnishing a•

Alderman Morris introduced a resolution appropriating $265.05 from the
General Fund and ordering payment made to•the City of Rochester, Public Utilities
ifor steam heat for the City Hall, which was read.
Upon motion by Amundsen, second by Anderson, that the said resolution be
,adopted as read, and all voting in favorthereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman Morris introduced a resolution appropriating $40.00 from•the
,Street & Alley Fund, $323.50 from the Sewer Fund and $1.45 from the Bridge Fund and

ordering payment made to the Dodge Lumber & Fuel Company; which was read.
Upon motion by Helmkay, second -by McPherson, that the said resolution be
adopted as read, and -all -voting in favor t-hereof,-President Fryer declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a reso-lution appropriating $1,124.59 from
the Fire Protection Fund and ordering 'payment made to Mine Safety Appliance Co. -
$254.6,2; Harold's Auto Electric - $477.02 and Alexander Auto Electric - $392.95,
which was read.
Upon motion by.McPherson,.second by Morris, that the said resolution be
adopted.as read, and all, voting in favor thereof, President Fryer declared the
said resolution duly passe3d and_adopted.
Alderman Amundsen introduced a. reso,l.ution appropriating $35.•732.64 from
the ,Bridge Fund and or-derIng payment made to L. M. Feller Company,, which was read.
Upon motion by Morris, -second by Amundsen, that the said resolution br
adopted as. read, and all voting i•n favor thereof, President Fryer' declared the
said, resolutio.n duly passed and adopted.
Alderman Morris .introduced a resolution or deri,ng bids for furnishing
four signs directing traffic to the Public Parking Lots, which wa's read.
Upon motion by McPherson, second by Helmkay, that'the said resolution be
adopted as read, and all voting in favor thereof,' President Fryer declared the
said resolution duly passed and adopted.
