. Minutes of an adjourned regular meeting of the Common,Council of the City
of Rochester, Minnesota, held in the Council Chambers in the City Hall in said City
I; on December 19, 195Q-
I; President Fryer called the meeting.to order at 7:30•o'elock P. M., the
i following meLlbexs being present: President .Fryer, Aldermen Amundsen, Anderson,,
Helmkay, McPherson, and ,.finer. _ . ,. Absent: Alderman Morris.
Upon motion by Amundsen, second by Miner, the minutes of the meeting of�
December 4, 1950 were approved. -
President Fryer stated this as being.the time and place set for a nearing
on the levying of special assessments fcr the widening of 3rd Avenue Sou+Ehwest from
!,3rd Street to 5th Street Southwest. There was no one present wishing to be heard.

President Fryer stated this as being the time and place set for a hearing
on the levying of assessments for the widening of East Center Street from Broadway
to 2nd Avenue Southeast. There was ,nc one present wishing, ta be heard.
President Fryer stated this as being the time and place set for
receiving and opening bids for furnishing fire hose for the Rochester Fire
Department. The following bids :.ere received and opened:

President Fryer stated this as being the time and place set for opening
and receiving bids for furnishing a 1000 gallon per minute pumper for the Rochester
Fire Department. The following bids were received and opened:

were referred to the Fire Committee and the Chief of the Fire Department for .
recommendation ,on January 2, 19.51. It was further agreed to„meet with the
representative -of the companies.bidding on the said fire hose and pumper at.4:00
o'clock P. M. on December 29, 1950.
President Fryer stated this as being the time and place set_•for receivin
and opening bids for furnishing signs for directing traffic to the public parking
lots. The bids of . Ace Sign Company in the amount -of $364.00; Lehnertz . Sign Co.,
in the amount of $499.00; Thiem -Signs in the amount of $749.00 and alternate• in'
the amount of $600.00, were each received and opened.
The recommendation of the Purchasing Committee that the bid of Ace Sign
Company in the amount of $364.00 for furnishing four (4) signs directing traffic
to the Public Parking Lots be accepted and checks returned to the,unsuccessful
bidders, was read and upon motion by Miner, second by Amundsen, the recommendation
was approved. ' _
President Fryer stated this as being the time and place'set for receiving
and opening bids for furnishing a light panel truck for use- in the City Engineer) s
Department. The bids of Rocket Auto & 'Implement Company in the amount of $1295.33
and Universal Motors, Inc. in the amount of 1102. 83 were each received and opened.
The recommendation of the Street & Alley Committee that the bid of
Universal Motors, Inc. be rejected for non-conformance with specifications and the
bid df Rocket Auto & 'Implement Company be accepted for furnishing one light panel
truck for use.in the City Engineer's Department and checks returned to the
unsuccessful bidders was read and upon motion by Miner, second by McPherson, the
recommendation was approved.
President Fryer stated this as being the time and place,set for receiving)
and opening bids for furnishing a 16;000 lb. Gross Vehicle Weight' Truck for .use in
the Street & Alley Department. The bids of Universal Motors, Inc. (2) in the
amounts of $2125.57 and $2275.00 and Smith Sonner_berg Company in the amount of
$1925.00 and Truck Service Company in the amount of $2400.00 were each received
and opened.
The recommendation of the Street & Alley Committee that the bid of Smith
Sonnfnberg Motors, Inc. for furnishing one 16,000 lb. G. V.W. Truck for us.e...in' the
Street & Alley Department be accepted and checks returned to the unsuccessful
bidders was read and upon motion by Amundsen, second by Miner, the recommendation
was approved.
President Fryer stated this as being the time and place,set for receiving,
and opening bids for furnishing one carload of prepared stoker coal far use at
the Sewage Treatment Plant. The bid of Dodge Lumber & Fuel Company in the amount
of $12.00 per ton was received and opened.

The recommendation of the Sewer and Purchasing Committees that the bid
of Dodge Lumber & Fuel Company in the amount of $12.00 per ton for the furnishing
of one carload of prepared stoker coal for use at the Sewage Treatment Plant be
accepted was read and upon motion by Anderson, second ,by Miner, the recommendation
eras approved.
The recommendation of the Sewer Committee that bids be taken for manhole
and catch basin castings for the 1051 season was read and upon motion by Anderson,
,second by Eelmkay, the.recommendation was approved.
The recommendation of the City Engineer that a plat of, Dashow's Sub -
Division annexing to the City of Rochester the following described lands be
accepted -was read and upon motion by -Miner, second by. Amundsen, the report was
approved and the City Clerk was instructed to complete the certificate on the
plat and have the same filed with the Register of Deeds:
"Commencing at the Southeast corner of Outlot 23, Northern Addition
situated in the Southeast " of Section 26, 107- 14 West, for a
place of beginning, thence west along the north line of 16th Street
N.E. 496.25 feet to the west line of 1st Avenue Northeast, if
extended in a straight line, thence north along the west line of
1st Avenue N. E. extended in a straight line 165 feet, thence
East parallel with 16th Street N.E. 486.25 feet to the east line
of said Outlot 23, thence south along the east line of said
Outlot 2 165 feet to beginning,also the north feet ofthat

part of 16th Street N.E. now vacated which lies East of the East
line of 2nd Avenue Northeast."
The following recommendation of the Sewer Committee was read and upon
motion by Anderson, second by Amundsen, the same was approved:
"Honorable Mayor and Common Council
Of the City of Rochester, Minnesota
Gentlemen:
We, the undersigned, recommend that bids be taken on
January 15, 1951, for the construction of a Southeast storm
and sanitaryrelief sewer consisting of the following:
Storm sewer on 112 Street S.E. from First Avenue
2 block east; and -on -First Avenue S.E. from lla
Street to 92 Street.
Storm sewer on loth Street S.E. from'First Avenue
to Fif th Avenue S. E.
Storm sewer on 92 Street from First Avenue to the'
west side of Broadway and thence north and west to
the Zumbto River.
Sanitary Relief sewer on loth Street S.E. from
Fifth Avenue to First Avenue; and on First Avenue
from 10th to 92 Street; and on 92 Street fr.om
First Avenue to Broadway.

The City Attorney presented rulings from the Attorney General's office
in regard to the abolition of civil service in the Rochester Police Department
and President Fryer ordered that the same be placed on file.
The following communication was read and Presiden't Fryer ordered that
the same be placed on file:

Attention: City Clerk finch
By motion duly passed on December 12th 1950 tl:e Public
Utility Board provided that the property north of Well
Houses #3 and 44, or. the North side of the reservoir
at the City Water Works site be released to the Common
Council for a parking lot with the provision that no
toilets be constructed or se,•iers of any kind installed
on the said property.
Map indicating property is attached.

A letter from the Minnesota Department of Health transmitting a copy
of a report by their Division of Municipal Water Supply covering',an examination
of plans and specifications on ,,rater main extensions in the' City of Rochester was
read and the same was ordered placed on file.
A petition for the grading and surfacing of 2nd .Avenue Northeast from
i4th to 16th Street Northeast and 15th Street Northeast from 2nd Avenge Northea-st
to the Nast line of Passe and Far_nings I Addition was rend and the same was
referred to the Street & Alley Committee and the City Engineer.
A petition for the construction of a sanitary sewer and watermain in
2nd Avenue Northeast from loth to 16th Street Northeast was read' and the same was
referred to the Sewer and Water Committees.
A communication from the Izaak Talton League of America, Inc. stating
that at its annual convention held in Duluth a resolution was adopted congratulat-
ing the City of.Rochester on the construction of a new outfall sewer and se,.rage
treatment plant, was read and President Fryer ordered that the same be placed on
file.
The following resolution adopted by the Commissioners of the Sinking
Fund was read and upon motion by Amundsen, second by Miner, the same was approved
and ordered placed on file:
"Be it resolved by the,Commissioners of the Sinking Fund
of the City of Rochester, Minnesota:
That the sum of $23, 900.00 be and the said sum.is hereby
appropriated from the Sinking Fund and ordered paid to the
Fir$t National Bank of Chicago, Illinois, for the January 1st,
1951 maturity of interest on 1.70% General Obligation Sewage
Disposal Plant Bonds, Nos. 1 to 2900, inclusive." .

The Chief of Police stated that a study had been in gogress on the
location of bus and taxicab stands in the business part of -the City. Mr. Howard
.McGoon .,yas present at .the meeting and stated that if the location he now has for
a taxicab stand was to be used for a bus stop, he wished to have another location
in the business part of the City. Upon motion by Helmkay, second b;r Miner, the
matter was referred to the Police Committee, License Committee and the Chief of
j!Police.for further study and a report at the next meeting to be held on January 5,
1951.
j Mr. Raymond Wieland was present at the meeting and read the following

;copy of a letter addressed to the Board of County Commissioners:

fGentlemen:
Your representatives came to us with this request that we
extent from this present and for two or three years the
non -execution of the reverial clause that appears in the
original deed formerly given a former board -- reason for
request -- to have ample time., to settle justly, the business
affairs that arise due to the veterans housing project. --
When the discussion as to the location quieted, the outcome
was to locate the cottages on the fairgrounds.
Your board, the fair board, the City of Rochester, ourselves,
had a tacit undcrstar_din that the cottages were to be so

placed. Your request seems reasonable -- we comply.

IMr. Wieland -requested that the Council authorize the American Legion to form a
committee for the purpose of investigating, applications for housing at the
!fairgrounds housing project and to investigate maintenance of housing units and
complaints received from tenants. Upon motion by McPherson, second by Amundsen,
his request was approved.

The appointment of Mr. C. A. Armstrong as Assistant City .Engineer by
Ii Ra.lph E. Monson, City Engineer, at the present salary of $5000.00 per year was
read and upon motion by Amundsen, second by Anderson, the appointment was approved.
The City Engineers trial balance for the month of November, 1950 was

each read and having been approved by the City Attorney, President Fryer ordered
that the same be placed, en file.
The application for transfer of "on sale" intoxicating liquor license
No. 266 from Jerry Reichert to Joseph W. Hamm i,:as, read and upon motion by Amundsen
second by Helmkay, the transfer was granted.
The application for t-ran.sfer. of "On Sale" Intoxicatin;; Liquor License
No. 264 from Joe Daly to Ward Walker was read and upon motion_ 'ay, Amundsen, second
by Miner,.the transfer was granted.
The applications of Ward Walker for license to sell cigarettes and soft
drinks were each read and upon motion by Helmkay, second by McPherson, the license
were granted.
The applications of Byers V. Nel.son and Otto H. Schmidt for a real
estate brokers license and Arthur G. Schmidt for a real estate salesman's license
were each read. Mr. Edward Capelle, member of the Real Estate Committee, was
present at the meeting and verbally recommended that the applications which may
be received between this date and April 1st be granted without investigation by
the said Committee. Upon motion by Amundsen, second by Miner, the licenses were
granted.
The application of the National Outdoor Display Co., Inc. for a license

to erect and maintain signs eas read and upon motion by Amundsen, second by Miner,
the license was granted.
The license bonds of Otto H. Schmidt in the amount of $2500.00; National'
Outdoor Display Company, Inc. in the amount of $1,000-.00; Ward 1-a.lker in the
amount of $3,000.00 and Joseph W. Hamm,in the amount of $1,000.00, each with the
Western Surety Company as surety, were each read and upon motion by Miner, second.
by Amundsen, the bonds were approved, the surety thereon accevte'd and it was
ordered that the same be placed on file.
Alderman McPherson introduced a resolution accepting the bid of Ace
Sign Company for furnishing four signs directing traffic to public.parking lots,
which was read.
Upon motion by Amundsen, second by Anderson, that the said resolution
be adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted..
Alderman McPherson introduced a resolution accepting the bid of Rocket

Engineer's Department, which. was read.

Alderman McPherson introduced a resolution accepting the bid of Smith
Sonnenberg Motors, Inc. for furnishing of a-16,00& lb. G.V.W. truck for use in
the Street & Alley Department, which was read.
Upon motion by Helmkay, second by McPherson, that the said resolution•
be adopted as read, and all voting in -favor-thereof, President Fryer declared
the said resolution duly passed and adopted.

Alderman 14iner introduced a resolution appropriating $1,O90.45 from - the
General Fund and ordering payment made' to J. P. McCarthy Company - ,$351.45,
Rochester Post Bulletin $517.80 and Schmidt Printing Company - $211.20, which
was- read.
Upbn motion by Miner, second* by Amundsen, that the said resolution be
adopted as `read, and all voting in favor thereof, President Fryer declared the
said re'solu"tion duly passed and, adopted.
Alderman Helmkay introduced a resolution appropriating, $235.08 from'
the General Fund and ordering payment made to City of Rochester, Public Utilities
which was read.
Upon motion by Amundsen, second by Anderson, that the said resolution
be adopted as read, and all voting in•f avor thereof, President 'Fryer declared the
said resolution duly passed and adoptezl.
Alderman Helmkay introduced a resolution appropriating, $11.73 from the
General Fund, $7-40.00 from the Street & Alley Fund and $2.96 from the Fire
Protection Fund and ordering payment made to Woodhouse Bros. , rrh'lich was read.
Upon motion by Anderson, second by"Helmkay, that the.said resolution
be adopted as read, and.all voting in favor thereof, President Fryer declared'the
said resolution duly passed and adopted.
Alderman Helmkay introduced a resolution appropriating $4.20 from the
General Fund and $259.12 from the Fire Protection Fund and ordering payment made
to the Botsford Lumber Company, which -was read.
Upon motion by Helmkay; second by McPhersoh, that the said resolution
be adopted as read, and all voting in favor. thereof, President -Fryer declared the
said resolution duly passed and adopted.
Alderman Helmkay introduced a resolution appropriating, $307.40 f,rom the
General Fund.and $53.45 from the Fire Protection Fund and ordering payment made
to Quality Printing Company, which was read.
Upon motion by McPherson, second by Miner, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.
Aldermar_'Helmkay introduced a resolution appropriating $193.75 from the
General Fund and $10.50 from the Sewer Fund and ordering payment made to the N.
Bell Telephone Company, which was read.
Upon motion by Miner, second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof,. President Fryer declared the
said resolution duly passed and adopted.
Alderman Helmkay introduced a resolution appropriating $55.62 from the

Upon motion by Amundsen, second by Anderson, that the said resolution
-be adopted as read, and all voting in favor thereof, President Fryer declared
the said resolution duly passed and adopted.
Alderman Anderson introduced a resolution'appropriating $549.25 from the
General Fund, $964.99 from the Street & Alley Fund, $623.25 from the P.I.R. Fund,
$319.00 from the Sewer Fund, $415-.75 from the Bridge Fund and $61.50 from the
Parking Meter Fund and.ordering payment made to the Street & Alley Fund, which
l was read.
Upon motion by Anderson, second by Helmkay, that the said resolution
be adopted as read, and all voting in favor thereof, President Fryer declared
the said resolution duly passed and adopted.

Alderman Andersan introduced a resolution.appropriating $1391.25 from -the
'',Street & Alley Fund and $1146..25 from the P. .I.. R. Fund and ordering payment. made
to the Rochester Sand & Gravel Company, which was read.
Upon motion by McPherson, second .by Miner, that the said -resolution be
,'adopted as read, and all voting in.favor thereof, President Fryer declared ,the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $2,959.04 from the -
Bridge Fund and ordering payment made t.o L.-M. Feller. Company., which was read.
Upon motion by Miner, second by Amundsen, that the said resolution be

adopted -as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $1,439.44 from the
'Bridge Fund and ordering payment made to L. M. Feller Company, .which was read.
Upon motion by Amundsen, second by Anderson, that the said resolution be
,adopted as read, and all voting in favor thereof, President Fryer decla-red the
'said resohution.duly passed and ado-ted.

Alderman Anderson introduced a resolution appropriating $69gg.4o from
the Park. Improvement Fund andordering' payment made to Hugh Vincent Feehan -
$300.00; Mayo Civic Auditorium Revolving Fund - $1567.69 and Collector of Internal)
Revenue - $5120.71, which was read.
Upon motion by Helmkay, second by cPherson, that the said resolution

Upon motion by •4cPherson, second by Miner, that th'e said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adapted.

Alderman Anderson brought to the attention of the Council that the
office of the Plumbing and Heating Inspector was still vacant and recommended
that steps be taken to fill the vacancy. Alderman Helmhay suggested t$at the
I, Building Inspector be appointed as acting Plumbing and Heating Inspector until.
April 1, 1951. After further discussion a motion was made by Amundsen, second
by Anderson, that the.City Clerk request the Plumbers, Steamfitters and Heating
men to submit two or three names from the membership of their unions,cra
who they considered qualified to f ill t h.e
office of Plumbing and Heating Inspector. All present voted in favor of the
motion.
Upon motion by Amundsen, second by Miner, the meeting was adjourned.
