Minutes of a special meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in'said City,
on January 31, 1951.
President Fryer called the meeting to order at 5:00 o''clock P.M., the
following members being present: President Fryer, Aldermen Amundsen, Anderson,
Helmkay, McPherson and Miner. Absent: Alderman Morris.
The call of the special meeting was read'andPPresident Fryer ordered
that' the same be placed on file, the said meeting being called for the purpose of
considering the question of appealing the decision of the District Court to the
State Supreme Court in the case of pending police appointments and any other
business the said Common -Council may deem proper.
President Fryer asked at this time if the Mayor wished to talk on the
matter for which the meeting had been called. Mayor McQuillan again stated his
views in the matter and that he thought an effort should be made to appeal the
decision of the District Court to the Minnesota State Supreme Court and test the
legality of Civil Service in-the.City.of Rochester. He then asked that the
Council authorize the payment, from city funds, of the expense .of carrying the
case to the Supreme Court. After hearing further discussion by the Mayor, the
Members of the Council and the City Attorney the matter.was left standing without
action being taken by the Common Council.
The Mayor's appointment of Lynn D. Peeler as Records Clerk in the Police
Department and also the appointment of Harold Fitzpatrick as Captain of Detectives,
of the Police Department, effective as of January 30, 1951, was read and upon
motion by Anderson, I second by Miner, the appointments were approved.
Alderman Amundsen introduced a resolution appropriating $420.00 from the
General Fund and ordering payment made to Henry M. Oeffler for 171 weeks permanent
partial disability, which was read.
Upon motion by Amundsen, second by Miner, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the sa
resolution duly passed and adopted.
Upon motion by Amundsen,'second by Miner, the meeting .was adjourned.
