February 5, 19.51 Minutes of a regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on February 5, 1951. President Fryer called the meeting to order at 2:00 o"clock P.I., the '',following members being present: President Fryer, Aldermen Amundsen, Anderson, Helmkay, McPherson and Miner. Absent: Alderman Morris. Upon motion by Miner, sejcond by Helmkay, the minutes of the meetings of January 15th, 29th and 31st, 1951 were approved. President Fryer stated this as being the time and place set for the first hearing on the construction of a.watermain in Parkside Addition. There was no one present wishing to be heard. President Fryer stated this as being the time and place set for receiving and opening bids for the sale of surplus police radio equipment. The bids of Dr. Murray %. Parent in the amount of $450.00; M. C. Campbell in the amount of $60.00 and the Rochester Radio Club in the amount of $25.00, were each received and opened. The recommendation of the Police Committee and the Chief of Police that L CJ the bid of Dr. Murray %. Parent be accepted for the purchase of surplus used radio I equipment in the Police Dep ar.tment, in the amount of $450.00, was read and upon X motion by Amundsen, second by McPherson, the recommendation was approved. it A letter from the International Publishing Corporation with -sample !� y . copy of "Manual for Civilian Atomic Defense" enclosed and quoting price of 7*¢ i each for orders of 5000 or more was read and the same was ordered placed on it file. i A letter from Wayne Hopkins, Scout Executive, expressing appreciation to the Council for the use of the Mayo Civic Auditorium was read and the same was ordered placed on file. �I A communication from Robert Petersdorf, Secretary and Business representative of the Rochester Building and Construction Trades Council, was •read 'I which called to the attention of the Council that C. E. Ginther was engaged in • � wrecking the old coal sheds just north of -the Northwestern Depot on North l I iBroadway and that the Fire Chief had used one of the fire trucks at the location to furnish lights for the wrecking work, which is being done after dark. Mr. II Petersdorf expressed his objection to a' City Official engaging in such practices G and possibly depriving construction labor of the employment, and the use of City it ,owned fire equipment on other than city projects'. A motion was made by Helmkay, .I second by Amundsen, that the matter be referred to the Fire Civil Service j ,Commission. All voted in favor of the motion. The application of Peter J. February , 51 1951 Plumbing Inspector was read and President Fryer ordered that the, same be placed on file. Special Legislative Bulletin -No, 1 from the League of Minnesota Munici- palities calling to the attention of the Council bills now pending in the State Legislature was read and the same was ordered placed on file. A claim for damages to a car owned by Lansford N. Haggerty -in the amount of $225.10 was read and upon motion by Miner, 'second by Helmkay, the same was referred to the Globe Indemnity Company for their consideration. The request of the Lincoln School P.T.A. to operate a bingo game on February 2, 1951 was read and the same was ordered placed on file. The resignation of Mr. August Dornack as member of the.Board of Zoning, to be effective immediately, and'the Mayor's appointment of Mr. John J. Fitzgerald to serve the balance of Mr. Dornack's term ending April 1, 1951,' were each read and upon motion by Miner, second by McPherson,•Mr. Dornack's resignation was accepted and the appointment of Mr. Fitzgerald was approved. The City. Engineer's estimate of cost of constructing a bridge on East Center Street over the Zumbro River in the amount of $178.966.10 was read and upon motion by Miner, second by Helmkay, the City Clerk was instructed to prepare a resolution and present same at the next meeting of the Common Council -ordering bids for the said bridge. The recommendation of the Board of. Zoning that the petition of Mr. Wm. Preston to have the West 46 feet of Lot 2 and the, West 46 feet of the South 24- T feet of Lot 3, in Block 41, Morse and Sargent's Addition changed from a residenti to a multiple dwelling zone be granted was read and the same wasi ordered hvld�unti; the next meeting of the Council so the matter could betinvestigated further. - o _ The recommendation of the City Engineer that the contract of Carlisle G. Fraser for construction of the Southeast storm and sanitary sewer system be increased in the amount of $759.40, to substitute reinforced concrete culvert pipe for reinforced concrete sewer pipe in the depths exceeding 14-fe'et, was read and upon motion by Helmkay, second by Miner. t;he.:same..was- referred t'o!'t w Sewer`. C`ommi The recommendation of the Street & Alley Committee that the City Engine be instructed to contact the Minnesota Department of Highways relative to the proposed program of traffic control devices to determine.whether their permission can be obtained for installation of these devices on trunk highways, and to - determine to what extent the Highway Department would participate inthe cost. thereof, was read and upon motion by Miner, second by Helmkay, the recommendation was approved. The recommendations of the Sewer and dater.Committees that a sanitary sewer and watermain be constructed on 2nd Avenue Northeast from 14th to 16th .,Street Northeast, were each read and upon motion by Helmkay, second by Anderson, ithe recommendations were approved. I The recommendation of the Street & Alley Committee that $5,000.00 be transferred from the General Fund to the Street & Alley, Fund for snow removal was read and upon motion by Helmkay,-second by Miner, action on the recommendation was deferred. The annual report of the Rochester Police Relief Association and statement of receipts and-disbursements,for the year ended January 31, 1951 was read and the same was ordered placed on file. The financial report of the Fire Department Relief Association for the calendar year ended December 31,, 1950 was read and the same was ordered placed on file. The statement of receipts and disbursements in the Park Improvement Fund for the month of December, 1950 was read and the same was ordered placed on file. The City Engineer's trial balance for January, 1951 was read and the same was ordered placed on file*, The reports for the month of January, 1951 of the Building Inspector ,j showing fees collected for building permits issued.in the amount of $2,139.00; li of the Electrical Inspector showing fees collected for electrical permits ;issued in the amount of $363.50; of the Heating Inspector showing fees collected .for heating permits issued in the amount of $351.25; and of the Plumbing Inspector showing fees•collected for plumbing permits issued in the amount of $39,75 and fees collected for sign permits issued in the amount of �$19.14, were each read and President Fryer referred the same to the Finance Committee. The reports of the Clerk of Municipal Court for the week ended "January 20, 1951 showing total criminal fines and costs collected $64;L.00, civil fees received $5.42, and conciliation court fees $646,42; for the week Record of Official Proceedings, of the Common Council 277 ; of the City of Rochester, Minn., February -:g i951 1 I. • Q;. 1 ended January 27, 1951 showing total criminal fines and costs collected $529.00 and civil fees received $2.95; and for the week ended February 3, 1951 showing total criminal fines and costs collected $591.00 and civil fees received $2.00, were each read and having been approved.by the City Attorney, President Fryer ordered that the same be placed on file. The application of George Greenwaldt for a license to sell cigarettes was read and upon motion by Amundsen, second by Helmkay, the license was granted. The application of Loren A. Woodhouse bor a Journeyman Warm Air Heating Ventilating and Air Conditioning Worker's License was read and upon motion by McPherson, second by Anderson, the license was granted. The application of Harold A. Hoffman for a real estate broker's license was\read and upon motion by Amundsen, second by Anderson, the license was granted; The license bonds of Elmer C. Johnson (3) each in the, amount of $1000.00 with the Aetna Casualty and Surety Company as surety and the Indemnity Bond for Lost Order or Warrant of Mrs. Effie Parkin in the amount of $48.00, were each read and upon motion by Miner, second by McPherson, the bonds were approved, the surety thereon accepted and it was ordered that the same be placed on file. The contract bonds of Ward LaFrance Truck Corporation in the amount of $14,,, 195.75 with the Standard Accident. Insurance Company as surety.; Neenah Foundry Company in the amount of $3,825,00 with the Travelers Indemnity Company as surety; Carlisle G. Fraser in the amount of $21 4,327.10 with the United States Guarantee Company as surety and Hewitt Rubber Division in the amount of $2,980.50 with the American Surety'Company as surety, were each read and the same were referred to the Mayor for his approval. Alderman Helmkay introduced a resolution accepting the bid of Dr.Murray R. Parent for the purchase of surplus police radio equipment, which was read. Upon.mot.ion by Amundsen, second by Anderson, that the said resolution b adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Helmkay introduced a resolution ordering bids for furnishing radio equipment for the City Engineer's Department, which was read. upon motion by Anderson, second by Helmkay, that the said vesolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Hel*kay introduced a resolution ordering bids for furnishing a spray bar for use in the Street & Alley Department, which was read. Upon motion by Miner, second by Amundsen, that the said resolution be adopted as read, and -all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. ' Alderman Helmkay introduced a resolution ordering plans,specifications profile and estimate of cost and 2nd hearing on the construction of a watermain �in Parkside Addition, which was read. Upon motion by Miner, second by Amundsen, that the said resolution be. adopted as read, and all voting in favor thereof, President. Fryer declared the_ .,said resolution duly passed and adopted. w Alderman Helmkay introduced a resolution ordering the first hearing on construction.of a curb and gutter on Sth Avenue Southeast from llth to 12th Street Southeast, which was read. Upon notion by Amundsen, second by Anderson, that the said resolution be ,adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution ardering the first hearing on construction of a curb and gutter on 5th Avenue Northwest from 1st Street'to the 'Northwestern tracks, which was read. Upon motion by Anderson, second by Helmkay, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said.resolution duly passed and adopted. Alderman Anderson introduced a resolution ordering the first hearing on construction of a curb and gutter on 9th Street Northeast from 1lth to 13th Avenue Northeast, which was read. Upon motion by Hflmkay, second by McPherson, that the said resolution ,be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution ordering the first hearing on ,construction of.a curb and gutter on Sth Avenue Northeast from 9a Street to 14th Street Northeast, which was read. Alderman Amundsen introduced a resolution ordering the first hearing on grading and surfacing of 2nd Avenue Northeast from 14th to 16th Street and 15th Street Northeast .from 2nd Avenue Northeast, one half block east, which was -read. Upon motion by McPherson,.second by Miner, that the said resolution be adopted as read,.and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution ordering.the first hearing on grading and .surfacing of. loth Street Northeast from lath Avenue 'to the east line o: Minerls Heights, which was read. Upon motion by Miner, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution ordering the first,hearing on grading and surfacing of 5th Avenue Southeast from 4th to 6th Street, 6th Avenue Southeast from 5th to 6th Street and 5th-Street Southeast from 4t.h to 6th Avenue Southeast, which was read. Upon motion by Amundsen, second by Helmkay, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Amundsen introduced' a- resolution ordering examination of books and records for the fiscal year of April 1, 1951 to April 1, 1952, which was read. Alderman Amundsen introduced a resolution appropriating $513,64 from the Street & Alley Fund, $5.00 from the General Fund and $1,80 from the Bridge Fund and ordering payment made to Rochester Sand & Gravel Company, which was read. Upon motion by Miner, second by Amundsen, that the said resolution be !adopted as read, and all voting in favor thereof, President Fryer declared the ,said resolution duly passed and adopted. Alderman McPherson introduced a resolution appropriating $296.00 from the General Fund,_ $1647.16 from the Strneet & Alley Fund, $502.50 from the Sewer ,Fund and $54,50 from the Bridge Fund and ordering payment made to the Street & Alley Fund, which was read. Upon motion by Amundsen, second by Helmkay, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman McPherson introduced a resolution appropriating $206.96�from ,the Street & Alley Fund and ordering payment made to the Home Gas Company, which was read. Upon motion by Helmkay, second by McPherson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the ,said resolution duly passed and adopted. Alderman McPherson introduced a resolution appropriating $8,061.84 from the Park Imrprovement Fund and ordering payment made to the Mayo Civic Auditorium (Revolving Fund, $3, 638. 89 and Collector of Internal Revenue, $4. 422.95, which was read. Alderman Miner introduced a resolution appropriating $791.13 from the General Fund, $2,296.93 .from the Street & Alley Fund, $68.71 from the Fire Protection Fund and $14.52 from the Sewer Fund and ordering payment made to the City of Rochester, Minneeota,•which was read. Upon motion by McPherson, second by Miner, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution appropriating $416.66 from the Band Fund and ordering payment made to Harold Cooke, which was read. Upon motion by'Miner, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Rochester,: Minn:,_ February 5, 1951 1 1 0 Ll 1 1 A communication from the.Cooperative 0il Company requesting that the Council provide a private parking space for Miss Clara Yeager, an employee of their firm, the said parking space to be located near the Cooperative building on the co.r.ner of 14th Street and Broadway, was read and upon motion by Amundsen, second by Helmkay, the City Clerk was instructed to notify the Cooperative Oil Company that space for private parking was.not availgble. The matter of parking automobiles on Center Street east of the center street bridge and on 4th Street east of 6th Avenue was again discussed and upon motion by Amundsen, second by Miner, the Police Committee and the Chief of Police were requested to present a recommendation at th,e next meeting of the Council, providing for the parking of cars on one side only of that part,of Center.Street East and 4th Street Southeast as mentioned above. Mr. Paul Plantz, Electrical Inspector, requested permission to attend the 14th Annual Electrical Industry Convention tobe held .at the !Nicollet Hotel in Minneapolis on February 25 to 28 and upon motion by McPherson, second by Helmkay, Mr. Plantz was authorized to attend at city expense.
