President Fryer called the meeting to order at 2:00 o'clock P. M. the j following m6mbers being present: President Fryer, Aldermen Amundsen, Anderson, i! 'Helmkay, McPherson and Miner. Absent: Alderman Morris. !� Upon motion by Miner, second by Helmkay, the minutes of the meetings of February 19th, 23rd and 28th,. 1951 were approved. President Fryer stated this as being the time and place set for the • second hearing on the construction of a sanitary sewer and watermain on 2nd j Avenue Northeast from 14th to 16th Street Northeast. There was no one present j wishing to be heard. President Fryer stated this as being the time and place set for the second hearing on the construction of the grading and surfacing of 2nd Avenue Northeast from 14th to 16th Street and 15th Street Northeast from 2nd Avenue, one half block east. There was no one present wishing to be heard.. I� President Fryer stated this as being the time and place set for the second hearing on the grading and surfacing of 5th Avenue Southeast from 4th to 6th Street; 6th Avenue Southeast from 5th to 6th Street and 5th Street Southeast II from 4th to 6th Avenue Southeast. There was no one present wishing to be heard. President Fryer stated this as. being the time and place set for the li second hearing on the grading and surfacing of loth Street Northeast from 13th Avenue.to the west line of Miner's Heights. There was no one present wishing I� to be heard. President Fryer stated this as being the time and place set for the second hearing on the construction of a curb and gutter .on 5th Avenue Northwest �i from lot Street to the Chicago Northwestern Railway tracks. Two residents in i' the 400 block on 5th Avenue Northwest were before the Council and protested the construction of a curb and gutter in the said 4oO block. A motion was made by I' 'Anderson, second by Miner, that the curb and gutter, in the 400 block, be deleted from the project. All voted in favor of the motion. President Fryer stated this as being the time and place set for the second hearing on the construction of a curb and gutter on Sth Avenue Southeast from llth to 12th Street Southeast. There was no one present wishing to be heard. President Fryer stated this as being the time and place set for the second Jxearing on the construction of a curb and gutter on 9th Street Northeast from llt h to lath Avenue Northeast. President Fryer stated this as being the time and place set for the second hearing on the construction of a curb and gutter on 92 Street Northeast from 8th to 9th Avenue Northeast. There was no one present wishing to be heard.• President Fryer stated this as being the time and place set for the second hearing on the construction of a curb and gutter on 6t� Street Southeast from 4th to 5th Avenue Southeast. There was no one present wishing to be,heard'. Three merchants operating stores on 4th Street Southeast and East -Center Street were present and objected to the proposed limiting of parking of cars on 0 one side of the said streets. Also a protest, signed by 66 customers of "Carl's Place", requesting that parking be not limited to one side of 4th Street Southeast was read. Upon motion by Miner, second by Helmkay, the matter was tabled at this time and the protest was ordered placed on file. Firs. L. A. Ranfranz, proprietor of the llth Avenue Northeast grocery store;.asked that 10 minute parking on the East -side of llth Avenue directly across.the street from the store be permitted, -which would accomodate customers on -the.ir .way home. Upon motion -by Helmkay, second by Amundsen, the matter was refe.rr.ed .to the Chief of Police -for investigation. Mr. Paul A. Grassle was before the Council and stated that he thought his bill for sewer rental charges was. exces's-iv-e. He stated that the bill he had received for one month an& in the amount of'.$1.62.00 and recommended that the rates for sewage treatment be studied and investigated further as it appeared to him the schedule set up in the ordinance was unjust and would work a hardship on many assessed for sewage treatment service. Air. F. A. Loomis, proprietor of the Gopher Sanitary Service, was present at the meeting and stated that he felt that the City Scavenger was unfair competition, due to the fact that he received a monthly salary and had his telephon furnished. Upon motion by Amundsen, second by Anderson, the matter was referred to the Public Grounds Committee. The recommendation of the Street & Alley Committee.,that,a neon sign, approximately three feet by ten feet, be installed at the northeast corner of the old City Warehouse advertising the parking lot, at a cost of approximately.$400.00, was read and upon motion by Helmkay, second by Miner, -the recommendation was approved. The recommendation of the Street & Alley Committee that bids be taken for the season's supply of sand, gravel and crushed rock; cutback asphalt, road oil, etc.; Portland cement and ready mixed concrete was read -and upon motion by Helmkay, second by M iner, the recommendation was approved. March 5, . 1951 E The recommendation of the Street.& Alley Committee that bids be taken i' Ifor furnishing one motor grader was read and upon motion by Helmkay, second by Amundsen, the said recommendation was approved. The recommendations of the Zoning Board that the petition of Catherine H..Lawler, Fabian F. Lawler and Helen G. Lawler to have Lots 6,7,5,9 and 10, in !Block 16, Head & McMahon's Addition changed from a residential zone'to a multiple dwelling zone be granted and that.the petition of George A. Henke to have Lot 1, Block 29, Northern Addition changed from a residential zone to a commercial zone be denied, were each read and upon motion by.Helmkay, second by Amundsen, the Citya Clerk was instructed to publish a notice of a hearing to be held on March 26, 1951 at 7:30 o'clock P. M. in the Council Chambers and the.Building Inspector was instructed to post a notice of the said hearing on the.property affected. The recommendation of the Lighting Committee that the following -street lights be installed was read and upon motion by Amundsen, second by Anderson, the recommendation was approved: 12th Avenue a4d 81 Street N.E.; 14th Avenue and 7th Street N.E. ; 14th Avenue and Sth Street N.E.; 17th Avenue and loth Street N.E.; 18th Avenue and 9th Street N. The report of the Chief of Police that on March 5, 1951, Christ Margellos of the Kentucky Liquor Store, 20 South Broadway, was arraigned in Municipal Court for a violation of Ordinance *No. 645, selling intoxicating beverages to a person under the age of 21 years, and that Mr. Ma'rgellos pleaded ;guilty and was given the option of $100.00 fine or 90 days in jail (he.paid the fine) was read and President Fryer referred the'same to the License Committee. A copy of the resignation of Frank G.-Newhouse as Special Municipal Judge of the City of Rochester was read and President Fryer ordered that the same be placed on file. Upon motion by McPherson, second by Helmkay, the City Attorney was instructed to write the Governor requesting him to make an appointment to fill 'lithe vacancy in the Special Municipal Judge's office. A communication from the Conference on State Defense urging that'the 'I 'Council communicate with the members of the Ways -and Means Committee and our ;;Congressmen and Senators opposing the taxing of Municipal Bonds, which action is linow under under consideration at Washington, was read and upon motion by McPherson, second by Helmkay, the City Attorney was instructed to telegraph the Record of Official Proceedings of the°Common Council of the City of Rochester, Minn.. 11-ar'6h -5 i. 1951', proper officials that the Council was very much opposed to the proposed legislation. A request by the Board of Park Commissioners that the Council reimburse -the Park Improvement Fund for improvements in the park system was read and upon motion by Anderson, second by Helmkay, the same was ordered placed on file. An acknowledgement by the State Public Examiner of request for an audit of the City of -Rochester to cover the period from April 1, 1951 to•April 1, 1952. was read and President Fryer ordered that the same be placed on file. An.extra order issued by Toltz, King & Day, Inc., Engineers and • Architects, to Feller and Pagenhart, Contractors for the new•Sewage Disposal Plant, for change in breeching in accordance with Revision 1, Drawing No. 909 and in the amount of $43.30 was read and upon motion by Amundsen, second by Miner, the change orderwas approved. Cp3 petition for �-� A _ p grading and surfacing on 15th Avenue Northeast from East Center Street to the North line of L'ot 16, Block 3, Stebbins Addition was read and the same was referred to the Street & Alley Committee and the City Engineer. The request of the Board of Public Health & Welfare for'permission to employ Miss Neola Henson as health educator in the Health Department, effective April 1, 1951 at a salary of $4200.00 per year, said salary to be paid from the W. K. Kellogg Foundation funds, was read and upon motion by Amundsen, second by Miner, their . request was approved. The application of, Lysne Construction Company for a permit -to move a i' steel bridge 7ft. by 100 ft. from Mayo Park to loth Street Northwest was read I. and upon motion by Amundsen, second by Helmkay, the permit was granted. The applications of Hickey Brothers, -Inc. for license to sell i, cigarettes at the Kahler Hotel and the Zumbro Hotel were each read and upon it motion by Amundsen, second by Helmkay, the licenses were granted. The'application of Service Cabs Inc. for transfer of City taxicab i licenses No. 9 and No. 10 was read and upon motion by Miner, second by Helmkay, i� the transfer was granted. I The application of Clifford W. Zirkler,for a Journeyman Electrician's 'I License was read and upon motion by Amundsen, second by McPherson, the license was granted. Alderman Amundsen introduced a resolution.appropriating $232.63 from, the Parking Meter Fund and ordering payment made to Gopher Stamp & Die Company, which was read. Upon motion by Helmkay, second by McPherson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. i Alderman Amundsen introduced a resolution appropriating $4,165.59 from the Park Improvement_Fund and ordering payment made.to Mayo Civic Auditorium Revolving Fund, which was read. Alderman Amundsen introduced a resolution appropriating $200.00 from the Fire Protection Fund and ordering payment made to Gate City Foundry, which was read.
