Minutes of an adjourned regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on
March 14, 1951.
President Fryer called the meeting to order at 7:30 o'clock P. M., the
following members being present: President Fryer, Al-dermen Amundsen, Anderson, Helmkay,
McPherson, and Miner. Absent: Alderman Morris.
President Fryer stated that a canvass of the returns from the Charter- Election
held on March 13, 1951 would be made at this time.
Alderman Anderson introduced the following resolution which was read:
"Be it resolved by the Common Council'of the City of Rochester, Minnesota:
That the following is a tabulated statement and list of the number of votes
cast for each person at -the- -Charter Election held March 13, 1951, in the City of
Rochester, Minnesota, as -determined by said Common Council, on the canvass of the
returns of said election made the 14th day of March, 1951, the said statement is
hereby declared to show the result of said election.

SO THEREFORE, Be it resolved by the Common Council of the City of Rochester,
Minnesota:

That Glenn 0. Amundsen is hereby declared to be elected to the office of Mayor of
said City, at the Charter Election held March 13, 1951, to hold office for two years and
until his successor is elected and qualified;
That Marvin W. Price is hereby declared to be elected to the office of City Assessor
of said City, at the Charter Election held March 13, 1951, to hold office for 'two years and
until his successor is elected and qualified;
That Karl H. Postier is hereby declared to be elected to the office of 'City Treasurer
of said City, at the Charter Election held March 13, 1951, to hold office for one year and
until his successor is elected and qualified;
That William S. LaPlante is hereby declared to be elected to the office of Justice
of Peace, styled "City Justice" of said City, at the Charter Election held March 13, 1951,-to
hold office for two years and until his successor is elected and qualified;
That Wayne Davis is hereby declared to be elected to the office of Alderman of the
First Ward of said City, at the Charter Election held March 13, 1951, to hold office for two
years and until his successor is elected and qualified;
That Arthur G. Steinberg is hereby declared to be elected to the office of Justice
of Peace of the First Ward of said City, at the Charter Election held March 13, 1951, to hold
office for two years and until his successor is elected and qualified;
That there is hereby declared to:be a tie vote for the office of Constable of the
First Ward of said City;
That George J. Anderson is hereby declared to be elected to the office of Alderman of
the Second Ward of -said City, at the Charter Election held March 13, 1951, to hold office for two
years and until his successor is elected and qualified;
That there is hereby declared to be a tie vote for the office of Justice of Peace of
the Second Ward of said City;
. That there is hereby declared to be a tie vote for the office of Constable of the
Second Ward of said City;
That George B-. Brumm is hereby declared to be elected to the office of Alderman of the
Third Ward of said -City, at the Charter Election held March 13, 1951 to hold office for two years
and until his successor is elected and qualified;
That there is hereby declared to be a tie'vote for the office of Justice of Peace of
the Third Ward of said City.n

Upon motion by Miner, second by Helmkay, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted. '
The recommendation of the Public Grounds.Committee that the following
schedu le of charges for weighing on the new truck -scale be adopted was read and
upon motion by Miner, second by Helmkay, the recommendation was approved:
Up to 7000 lbs. gross weight - 15¢ per weighing
On trucks from 000 lbs. g 7 gross weight and not a semi Ij
trailer truck - 25¢ per weighing
Semi trailer truck up to 60,000 lbs. gross
weight - 50¢ per weighing
All gross loads over 60,000 lbs. - $1.00 per weighing
The recommendation of the Street & Alley Committee and the City Engineer
that the following paving and resurfacing projects be undertaken as a first step
toward an extensive paving program was read and upon motion by Anderson, second
by Miner, the recommendation was approved:
"Concrete paving -
on 2 Ave. S. E. from Center to 2nd
on 2nd St. S. E. from 1st to 2 Ave.
on 3rd Ave. S. E. from 3rd to 4th .St,
and the approaches to the Mayo Park Bridge.
Bituminous resurfacing -
on 4th St. S. W. from Broadway to 1st
on 1st Ave. S. W. from 2nd to 3rd St.
on East Center from Broadway to 2nd
on 3rd St. S. E. from Broadway to Alley.
The recommendation of the Street & Alley Committee that the petition
for grading of 15th Avenue Northeast north of Center Street be not considered
,since it was not signed by a majority of the property owners, was read and upon
motion by Anderson, second by Miner, the recommendation was approved.
A recommendation by James J. Macken, Jr., Chief of Police and William
,Van Hook, Superintendent of Parks,.that additional lighting be -made on Center
Street at the end of 3rd Avenue for the following -reasons was read and President
Fryer ordered that the same be placed on file:
1. A heavy discharge of Auditorium patrons onto Center Street
at this point following performances in the building.
2. This is a much used bus stop, particularly before and after
Auditorium performances.
3. A police officer stands in the center of the street to direct
traffic and he should be -easily seen, both for his own safety
and for the safety of pedestrians and other traffic.
4. This is normally a popular pedestrian crossing without the extra
traffic which the Auditorium brings.
Mayor McQuillan again brought up the question of extending rent control
,beyond the date set by statutes and asked that an ordinance be adopted by the
Council which would extend rent control if a bill is not passed which would
(continue rent control beyond the date as now set by law. Upon motion 'by
;Amundsen, second by Miner, the City Attorney was ins tructed' to prepare an
ordinance which would extend rent control if same is not taken care of by an

act of Congress. All voted in favor of the motion.

The request of Feller &•Pagenrart for permission to use the barn at the
Sewage Disposal Plant site for storage of materials was read and ;upon motion by
Miner, second by Amundsen,. permission to use the said barn was authorized, the
rent for. same to be at the rate.of $5.00 per month.
A communication from the Conference of State Defense urging that the.
Council further protest the. taxing of interest on Municipal Bonds and recommendin
that a protest be sent to the United States Senator from this district was read
and upon motion by Miner,'second b.y Anderson, the City Attorney and City Clerk
were instructed to send a telegram stating that the Common Council had again gone
on record as..not being in favor of the proposed taxation.
The request of the Junior Chamber of Commerce for permission to operate
a bingo game at their annual gypsy frolic to be held on April 21, 1951 at the
Mayo Civic Auditorium, was read and President Fryer ordered the same placed onfile.
The Certificate of County Board of Classification of Forfeited Lands as
provided by Chapter 386, Laws 1935 as amended was read and upon motion by Amundsen,
second by Anderson, the Mayor and the City Clerk were authorized to -sign the
certificate approving the. classification as, set by the Board of County Commissioners.
A communication from the Chief of Police stating that Chris Margellos
had pleaded guilty to.a charge of selling intoxicating liquor to a minor and which
had been previously referred to the License Committee was again considered and
upon motion by Amundsen, second by Helmkay, the said letter was ordered placed on
file.
A statement of receipts and disbursements in the Park Improvement Fund
for the month of February, 1951 was read and the same was ordered placed on file.
The report of the Clerk of Municipal -Court for the week ended March 10,
1951 showing total criminal fines and costs collected $1;106.00 and civil fees 1
received $11.50 was read and having been approved by the City Attorney, President
Fryer ordered that the same be placed on file.
The City Engineer's trial balance for the month of February, 1951 was
read and the same was ordered placed on file.
Alderman Amundsen introduced a res.olution granting three public dance
permits to Archie Dieter, which was read.
Upon motion by Anderson, -second by Helmkay, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the said
reso lut ion .duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $250.00 from the
General Fund and ordering payment made to Raymond Kruger, which was read.
Upon motion by Helmkay, second by Miner, that the.said resolution be

payment made to the Street-& Alley Fund, which was -read.
Upon motion by Miner, second by Anderson, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman Andersop introduced a resolution.appropriating $450.00 from

'the Bridge Fund and ordering payment made to Lysne Construction Company, $371.13
from the Sewer Fund and ordering payment made to Red Ming Sewer Pipe Corp. and
$672.74 from the S & A Fund -and ordering payment made to Firestone Stores, which
was read*
Upon motion by Helmkay, second by Miner, that the said resolution be
adopted as read, and all voting in favor thereof,.President Fryer declared the
said resolution duly passed and adopted,
Alderman Anderson introduced a resolution appropriating $709.54 from the.
',Sewa,,e Disposal Plant Fund and ordering payment made to Toltz, King and Day, Inc.,

Upon motion by.Anderson, second by Miner, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the.
said resolution duly passed.and adopted.
Alderman Anderson introduced a resolution appropriating $206.95 from the
General Fund and ordering payment made to Schmidt Printing Company, which was read.
Upon motion by Miner, second by Anderson, that the said resolution be
adopted as read, and all voting in favor thereof, -President Fryer declared the
said resolution duly passed and adopted.
Alderman Helmkay introduced.a resolution,appropriating $2,614.23 from the
Park Improvement Fund and ordering payment made to Mayo Civic -Auditorium Revolving
,Fund, which was read.
Upon notion by Anderson, second by Helmkay, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman Helmkay introduced a resolution appropriating $60,000,00 from

Alderman Miner introduced a, resolution appropriating $90,000.00 frofn
the Gen'erai Fund and ordering payment made to the Park* Improvement Fund, which wasl
read.
Upon motion by Amundsen, second by Anderson, that the said•resolution
be adpted as .read, ' and all - voting in favor -thereof, President Fryer- declared the
said resolution duly passed and -adopted.

adopted as read, and all voting in favor thereof , President Fryer declared the
said resolution duly passed and adopted.

read.
Upon motion by Helmkay,-second by Amundsen, that the said resolution be
adopted as read, and all voting ,in favor thereof.' President Fryer declared the
