Minutes of an adjourned regular meeting of the Common'Council of the
City of Rochester, Minnesota, held in -the Council Chambers in the City Hall, in
said. City on March 26, 1951.
President. Fryer called the meeting to order at 7:30 o1clock P. M., the
following members being present: President -Fryer, Aldermen Amundsen, Anderson,
Helmkay and Miner. Absent: Aldermen McPherson and Morris.
Upon motion by Amundsen, second by Miner, the minutes of -the meetings o
March 5th- and 14th, 1951 were approved.
President Fryer stated this as being the time and place set for receiv-
ing and opening,bids for furnishing the season's supply of sand, gravel and crushe
rock for use in the City Engineer.'s Department. The following bids were received
and opened:

President_Fryer stated this as being the time and place set for receiv-
ing and opening bids for furnishing cement for use in the City Engineer's Depart-
ment. The following bids were received and opened:

President Fryer stated this as being the time and place set for receiv@
ing and opening bids for furnishing of one motor grader for use ,in the City
Engineer's.Department. The bids of Wm. H. Ziegler Company in the amount of
$12,752.00.; Rosholt Equipment Company in the amount of $13, 573.00 and A-W
Company Inc. ,in the amount of $12.931.00 were each recieved and opened.
Action on the above bids received was postponed until .the next
Council meeting.
President Fryer stated this as being the time and place set for a
hearing on the proposed change of zoning of Lots 6,7,9,9 and 10, in Block 16,
Head & McMahon's Addition from a residential zone to a multiple dwelling zone.
Mr. James T. Spillane, Attorney representing Mrs. Catherine Lawler, Fabian F.
Lawler and Helen G. Lawler, again requested that the Council approve the
(petition as submitted for change of zoning', stating the following reasons:
that the Board of Zoning had recommended that the petition be granted, that
a mortuary,business deserves a decent location in the City and .that it is not
practical to operato that type of business in the business district. He stated
further that areas in the nearby vicinity are now zoned as multiple dwelling and
commercial and many of those who were protesting the change now lived over 500 ft.
�from.the location in question. Mr. Allen J. Furlow, Attorney representing Mrs.
�J. H. Kahler and Dr. and.Mrs. Phillip Hench; opposed the change at the hearing,
stating that a,mortuary would not add to the value of property- in that locality
and that the area is now generally residential and that oeners of homes should
be entitled to the protection of the Zoning Ordinance. He also stated that the
proposed change would constitute "spot" zoning. Mr. A. C. Gooding also opposed
the proposed zonechange and. stated that he felt it would definitely decrease the
value of residential property in the neighborhood. Mrs. D. M. Masson presented a
plat of the surrounding area and suggested that the City consider a site for
If uneral homes outside of thq city.limi�s which would avoid traffic problems and
bother objections which might be made to a mortuary business. Mr. John Lawler
'and Mr. Fabian Lawler urged that the proposed change be approved by the Council.
�,k communication from Kinsey M. Simonton, M. D. of 622 Third Street Southwest,
,(dated March 9, 1951 stating three specific reasons why he was opposed -to the
,proposed zoning change was read and President Fryer ordered that the same be
I 'placed on file.
President Fryer stated -this as being the time and place set for a
hearing or_ the proposed change of zoning of Lot 1, Block 29, Northern Addition
from a residential zone .to a commercial -zone. • Mr. George Henke was present and
stated that his Attorney, Mr. Spillane, had to -leave for another appointment. He

again urged that the Council act favorably on his petition for the requested zoning

change. He stated further that the description of the propertylin question was a
triangular piece of land and was not suitable for a residential location. He
stated further that the property at one time had been used for coma' cial purposes
and that other areas in that location are now commercial., Mr. Emil Heintz was
present at the meeting and acted as spokesman for a number of residents in that
locality who were opposing the requested zoning change. Also Mr. Floyd Gate.wood
of 111�F' North Broadway, 'stated that Mr. Henke had not improved the lot and that
he was opposed to the change.
After hearing those present on both petitions a motion was made by , ,
Helmkay', second by Miner, that action be deferred on the matter until the meeting
of April 2, 1951.. All .voted .in favor of the motion.
The matter of extending rent control was again discussed and the Mayor
stated that a bill had been adopted which extended rent control until June 30th.
Mr. George Leiferman, Mr. Harold Patterson, Mr. Emil Reiter and Mr. Edw. Capelle
stated 'their reas'oris for being 'opposed 'to rent co"ntrol and furtherstated that
from information they had, they felt the City could decontrol rent. Mr. Robert
Petersdorf and Mr. Ross Bosshard stated that they were in favor of rent control.
It was determined that before any action could be taken on the matter a hearing
would have to be held, at which time those interested in either side of the
matter could be heard. No action ordering a hearing was taken at this meeting.
A request from Mr. Arnold E. Teske, Contractor, that permission be
granted to grade llth Avenue Southeast between loth and 102 Street, so that
dwelling units might be constructed on that section of llth Avenue was read
together with the City Engineer's recommendation that Arnold E.'Teske be granted
permission to grade llth Avenue Southeast between loth and 102 Street at his own
expense and under the supervision of the City Engineer's Department. Upon motion
by Helmkay, second by Amundsen, the City Engineer's recommendation was approved.
A communication from General Mills, Inc. dated March 21, 1951 and
addressed to the Honorable Smith Fryer, President of the Council, asking that the
City grant permission for their firm to occupy the old mill property until their
new warehouse could be completed or enclosed so that they could move into it,
which they thought would be approximately 30 days, was read and„upon motion by
Amundsen,/second by Helmkay, President Fryer was authorized to aotif y General
Mills, Inc. that they could use the.old mill .building until their new building
was in condition to be occupied.
The claim of Mr. H. J. Kruse in the amount of $47. S5 for alleged damage
to his automobile on March 3, i951 by City equipment was read and upon motion by
Amundsen, second by Miner, the same -was referred to -the City Engineer and the Cityl
Attorney.

jmultiple dwelling zone was read and upon motion by Amundsen, second by Helmkay,
!!the. same was referred to the Board of Zoning.
A petition to have the north and south alley from the North line of
,Lot 7, Block 1, Nielson's Subdivision North to llth Street Northwest vacated
was read and upon motion by Amundsen, second by Helmkay, the City Clerk was
'instructed to prepare a resolution ordering the required hearings on the said
petition'and present same at the next Council meeting.
The following resolution adopted by the Public Utility Board was
read and President Fryer ordered that the same be placed on file:
"Be it and it is hereby resolved by the Public Utility Board
II of the City of Rochester, Minnesota, that the Common Council of
the said City be and is hereby requested to authorize the said
Board to enter into a contract with CHAS. OLSON & SONS, INC. for
the furnishing in accordance with specifications and with their
proposals, of-
1. One (1) double drum switch
2. One (1) forward and reverse transmission
3. One (1) drive line to operate digger
4. One (1) pole hole digger, complete with auger,
the total amount of the said contract to_ be TWO THOUSAND TWENTY
NINE DOLLARS AND FIFTY CENTS ($2, 029. 50) and the said Chas. Olson
and Sons being the lowest responsible bidder."
An agreement b wtween the County of Olmsted andthe City of Rochester
lfor maintenance of a portion of State Aid Roads Nos. 11011. "I" and 11211 within the
,City of Rochester was read and President Fryer ordered that the same be placed

The report of the Board of Trustees of, the Walter Hurlbut Book Fund
for the calendar year 1950 was read and President Fryer ordered that the same be
placed on file.
The City Treasurer's report for the month of February, 1951 was read
and the -same -was ordered placed on file.
The reports of the Clerk of Municipal Court for the e:eek ended March 17,
1951 showing total criminal fines and -costs collected $4.20.00 and civil fees
received $.95 and for the week ended March 24, 1951 showing total criminal fines
and costs collected $172.00 and civil fees received $12.70, were each read and
having been approved by the' City Attorney, - President Fryer ordered that the same
be placed on file.
Alderman Miner introduced a resolution authorizing the Public Utility
Board to enter into contract with Chas. Olson & Sons, Inc., which was read.
Upon motion by Amundsen, second by Helmkay, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said.resoluticn duly.pessed and adopted.
Alderman Miner introduced a resolutionv.accepting the agreement with
the County of Olmsted for 1951 maintenance of State Aid Roads trit'_i:: she corporate
limits of the City of Rochester and authorizing the Mayor and City Clerk to
comalet a the said -agreement, which was read.
Upon motion by Helmkay, second by Miner, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman Miner introduced a resolution appropriating' $8;188.00 from the
General Fund and ordering payment made to-C. C. Pagenhart, which was read. /
.Upon motion by Miner, second by Amundsen, that the said resolution be
adopted as read, and• all voting in favor thereof, 'President Fryer declared the
said resolution duly passed and adopted.
Alderman Helmkay introduced a resolution appropriating $2500.00 from
the General Fund and ordering payment made to the -Library Fund., ,which was read.
Upon motion by Amundsen, second by Helmkay, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed e.ud adopted.
Alderman Helmkay introduced a resolution appropriating. $423.83 from the
General Fund, $755; 79 from the Street & Alley Fund, $4. 78 from the Fire Fund and
$.95 from the Sewer Fund,and ordering payment made to the City of Rochester, which
was read.
Upon motion by Helmkay; second by Miner; that the said, resolution be

Alderman Helmkay introduced a resolution appropriating $1195.00 from
the Street& Alley Fund and. ordering payment made to the Frawley Equipment Co.,
which was read.
Upon motion by Miner, second by, Amundson, that the said resolution be

said resolution duly passed and adopted.
Alderman Helmkay introduced a resolution appropriating $514.Q0 from
the Street & Alley Fu nd.and ordering payment made to A. Fi. Byholt $270.75 and
M.-L. McIntire $243.25, which was read.
Upon motion by Amundsen, second by Helmkay, that the said resolution be

adopted as read, and all voting in favor th.ereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman Helmkay introduced a resolution appropriating $198.40 from
the S & A Fund, $94.20 from the Fire Protection. Fund and $.20 from the Sewer
Fund and ordering payment made to Hayes Lucas Lumber Company, which was read.
Upon motion by Helmkay, second by Miner, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
'` said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $200.00 from'
the Fire Protection Fund and ordering payment made to Gate City Foundry, which
was read.
Upon motion by Miner, second by.Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declwed the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $1429.02 from
the Park Improvement Fund, $952.49 from the General Fund, $17- 55 from the S & A
'Fund, $22.59 from the Fire Protection Fund, $78.66 from the'Sewer Fund and
$4309.61 from the Lighting Fund and ordering payment made to City of Rochester,
Public Utilities, which was read.
Upon motion by Amundsen, second by Helmkay, that the said resolution
be adopted as -read, and all voting in favor thereof, President Fryer declared the
,said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $7,441.54 from

the Park Improvement Fund and ordering payment made to Collector of Internal
Revenue $3424.29; Mayo Civic Auditorium Revolving Fund $2903.69 and Alvin E.

Alderman Anderson introduced a resolution appropriating $16,500.00
from the General Fund and ordering .payment made to the Street & Alley Fund, which
was read.
Upon motion by Amundsen, second by Miner, that the said resolution be
adopted as read, and all voting in favor thereof; President Fryer declared the
said resolution duly passed and -adopted.

to write the various boards and departments..of the City, requesting that they
submit their .salary schedules not later than April 6, 1951 and.that if such
schedules were not received on that date bhe Council would take no action on their

President Fryer stated•that•the Olmsted County Safety Council was
'holding a dinner meeting at the high school cafeteria on March 29, 1951 for

!'the benefit of drivers employed in private business and by the City.- Upon
;'motion by Helmkay,.second by Miner,•attendance of the drivers -in the Engineer's
Department, Park Department and Public Health & Welfare Department was
'authorized at city expense.
Upon motion by Amundsen, second by Helmkay, the meeting was adjourned.
