M inutes of the annual meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City,
on April 2, 1951.
President Fryer called the -meeting to -order at 2:00 o'clock P. M., the
following members being -present:.' President Fryer, Aldermen George J. Anderson,
Leo C. Anderson, George B. Brumm, Wayne Davis, William K. Helmkay and Raymond F.

McPherson. Absent: None.
Upon motion by Helmkay, second by Leo C. Anderson, the minutes of the
meeting of March 269 1951 were approved.
President Fryer address.ed the Mayor,.the Members of the Council and
those present, stating that he was.ve.ry much .interested in seeing a complete stu
of zoning of the City and adjoining areas made by the Planning Commission, the
members of the Council and the Board of Zoning. President Fryer then requested
that all Committee reports be made in writing so that a record will be on file
if the question arises later on and he also stated that when a matter is referred
to a Committee no individual should take action until he has met with the said
Committee and then no definite action unless the matter has been referred to the
Committee with power to act. He further requested that no -member of the Council
leave his seat during an.open meeting unless he has permission to leave from the
chair. He then requested the City Clerk to read the following appointments of
members of the Council to serve on Council Committees:
STREET & ALLEY COMMITTEE: Leo C. Anderson, George J. Anderson and
.George B. Brumm
SEWER COMMITTEE: Raymond F. McPherson, Wayne Davis and
William K. Helmkay.
FINANCE COMMITTEE: William K. Helmkay, George J. Anderson and Leo C.

POLICE COMMITTEE: George J. Anderson, George B. Brumm and Wayne Davis
PUBLIC GROUNDS COMMITTEE: Wayne Davis, William K. Helmkay and George B. Brumm

President Fryer then introduced Mayor Glenn 0. Amundsen, who in a brief
address to the Council and those present thanked the citizens for the support he
had received at the recent charter election and also stated his appreciation for
the cooperation he had had from the outgoing Mayor and Council m'smbers. Among
other remarks he reminded the Council -that it was their duty to represent the
entire City. Mayor Amundsen then announced that he was appointing a Public Affaire
Committee, consisting of twelve men and women, to assist in studying various

'!matters which come to the Mayor and members of the Council. He then announced it

!the following appointments to various boards and offices:
To the Public Utility Board: Mr. William K. Helmkay for thr.ee years,
his term to expire the second'Monday in April, 1954
To the Board of Park Commissioners: Mr. Ben F. Dunn as Commissioner
at Large for one year, his term to expire the second
Monday in April, 1952 and Mr. Paul A. Grassle, Sr. as.• i
Commissioner of the Second Ward for three years, his
term .to expire the second Monday in April, 1954 I,
To the Zoning Board: Mr. Harold Gerths for five years, his term to
expire the second Monday in April, 1956 +
To the Board of Public Health & Welfare: Dr. R. J. Jackman for two
years, his term to expire the second Monday in April,1953;
Dr. L. A. Weed for two years, his term to expire the
second Monday in April, 1953; Mrs. Nelson W. Barker for

three years, her term to expire the second Monday in
April, 1954 and Mrs. Erwin S. Burrington for three years,

To the Music and Band Committee: Mr. E. B. Ballou.for three years, his

To the Planning Commission: Mr. John R. Morrison, Mr. Oscar J. Allerton Il
and Mr. W. W. Hendricks, each for three years, their terms
to expire the second Monday in April, 1954
To the Police Civil Service Commission: Mr. James F. Faber for three
years, his term to expire the second Monday in April, 1954
and Mr. Phillip W. Kern for two years, his term to expire

Mayor's Secretary: Mr. Bill Smollett.
A motion was made by Alderman Helmkay, second by Alderman Davis, approving the
', Mayor's appointments. All voted in favor of the motion.
The recommendation of the Board of Zoning that the petition of I'
'Catherine H. Lawler, Fabian F. Lawyer and Helen G. Lawler to have Lots 6, j, S,

9 and 10,. in Block 16, Head & McMahon' s Addition changed from a residential
to a multiple dwelling zone be granted was again considered by the Council. Mr.
James T. Spillane, Attorney for the petitioners and Mr. Allen J. Furlow, Attorney j

for Mrs. J. H. Kahler and Dr. and Mrs. Phillip Rench, were again heard on the
matter. Alderman McPherson stated that he would like to see the recommendations
for the applications now under consideration, studied by the Planning Commission j
before final action was taken. Alderman Davis inquired.as to whether or not the
petitions had been heard by the Poard of Zoning. Mr. Spillane stated that the

petitions had.beea heard by both the members of the Board of Zoning and the
members of the'Common Council. Upon motion by Alderman George J. Anderson, second I'I
by Alderman Brumm, the r.ecommendatiom of the Zoning Board -was approved and the �I

City Attorney. was* instructed to prepare an amendment to the Zoning Ordinance II

classifying the above described property as multiple dwelling. All voted in
I
favor of the motion. I .
The recommendation of the Board of Zoning that the petition of Mr.
George A. Henke to have Lot 1, Blo-ck 29, Northern Addition changed from a res-
idential to a commercial zone be denied was again considered by the Council.
Upon motion by Alderman�Prumm, second by Alderman George J. Anderson, the.

recommendation of the Board of Zoning that the petition be denied, was approved.
All voted is favor of the motion.

President Fryer inquired as t'o whether or not anyone wished to be heard
on any other matter at this time.
Mr. George Davis, from the Rochester Fire Department,,intr.oduced Mr.
James Beach, from the St. Paul Fire Department and representing,the International
Association of Fire Fighters, who represented the employees of the Fire Department
regarding requested increase in salaries. He stated that the employees of the
Rochester Fire Department -were a low paid group and recommended that the Council
give favorable consideration to the requested increase in salaries.
Mr. S. A. Loomis was again before the Council and stated that Mr. Darrel
Sanford, Scavenger and Dog Catcher for the City,, had gone outside of the City
limits•to handle scavenger work during the hours of the day when he is supposed,
to be acting as dog catcher and that he considered, it, unfair competition. P.residen,
Fryer requested that he present his complaint to the Council -in writing.
Mr. Clarence Berg, representing the A. F. L'. Drivers Union, protested
the City .purchasing crushed rock and gravel from the Quarve & Anderson Company,
stating that the employees of the said company are not residents in the City of
Rochester. Mr. Robert Petersdorf, A. F. L. Official, stated further.that the
employees of the said company were paid sub -standard wages and were unfair compet
tion for other firms handling the. same products. After bearing 'Mr. Berg and Mr.
Petersdorf, it was called to their attention that the charter required the
Council to purchase from the low bidder.
Alderman Leo C. Anderson introduced the following resolution which was
read:
"WHEREAS, It is deemed expedient and necessary that the
Common Council of the City of Rochester, Minnesota, adopt rules
of order for the. conduct of its business, and.
WHEREAS, A copy of Robert's Rules of Order (revised) of the
1915 Copyright, is before this Common Council:.
SO THEREFORE, Be it resolved by the Common Council of the
City of Rochester, Minnesota:
That the said Robert's Rules of Order be adopted by this
Common Council as rules of order for the conduct of* - its business."
Upon motion by George J. Anderson, second by Brumm, that the said
resolution be adopted as read, and all voting in favor thereof, Prea.ident'Fryer
declared the said resolution duly passed and adopted.

Alderman Leo C. Anderson introduced the following resolution which was
"Befit resolved by the . Common Council of the City of
Rochester, Minnesota:
That the said Common Council_of the City of Rochester,
Minnesota, hereby adopts the following rules and regulations
for the order of business of said Common Council:
1. Roll Call. The roll ,call of the Common Council shall
be had and taken in its alphabetical order according to the
names of the members, except that the name of the President of
the Common Council shall be called only at the first roll call
of each meeting -and then after that, at that meeting, only in
case of a tie vote when his name shall be called and vote taken
after the expression of each of the other members of the said
Common Council, or when a 5/7 vote is required.

2. Reading and approval of the minutes of the proceeding meeting.

Upon motion by Davis, second by McPherson, that the said resolution
be adopted as read, and all voting in favor thereof, President Fryer declared
the said resolution duly passed and adopted.
The application of F. R. Finch for reappointment to the office of
the City Clerk of the City of Rochester was read and upon motion by Helmkay,
hsecorid by. Leo C. Anderson, F. R. Finch was reappointed as City Clerk for the
,ensuing official year.
The application of Ralph E. Monson for reappointment as City Engineer
for the City of Rochester was read and upon motion by George Anderson, seconcl. by
Helmkay, Ralph E. Monson was reappointed as City Engineer for'the ensuing
official year.
The application of Desmond B. Hunt for reappointment and the
applications of.Raymond N. Wieland and William S. LaPlante for appointment as

'City Attorney of the City of Rochester were each read and upon motion by Leo C.
'Anderson, second by Helmkay, Desmond B. Hunt was reappointed as City Attorney for
,the ensuing official year. All voted in favor of the motion except Alderman
McPherson who voted "no".
The applications of Garnet Spring for reappointment to the.office
'of Building Inspector, Paul Plantz for reappointment to the office of Electrical
Inspector, Caralita Tingley for reappointment as secretary to the Building,
iElectrical and Plumbing Inspectors, J. M. Hartman for appointment as City Heating
"Inspector and T. J. Daly and Charles H. Dornack for appointment as City Plumbing-
Inspector, were each read and upon motion by Leo C. Anderson, second by Brumm,
action on the said applications was deferred at this time due to the fact that
organizational changes in the department were now being considered.
The application of C. A. Cottingham for reappointment as City
Weighmaster was read and upon motion by Helmkay, second by McPherson, C. A.
Cottingham was reappointed as City Weighmaster for the ensuing official year.
The applications of Darrell Sanford for reappointment as* City
Scavenger and Dog Catcher and Fredric W. Berg and Robert E. Finn for appointment
'as City Scavenger and Dog Catcher were each read and upon motion by McPherson,
second by Brumm, action on the same was deferred until a later meeting.

The application of•Louis Bennett for appointment to the position of
Weed Inspector was read and President Fryer ordered that the same be placed on
file f.or the reason that Ambrose Campion had been appointed as Weed Inspector last
January as required by State Statutes.
The application of Flora C. Anderson for.reappointment to the position of)
General Stenographer was read and upon motion by Helmkay, second by McPherson,
Flora C. Anderson.was reappointed as General Stenographer.
The application of W. J. Barden for reappointment as Assistant to the
City Treasurer was read and upon motion by Helmkay, s econd by George Anderson, W. J.
Barden was reappointed as assistant to the City Treasurer.
The application of Frank S. Halloran for reappointment to the position of
Meter Maintenance Man was read and upon motion by Davis, second by McPherson, Frank
S. Halloran was reappointed as Meter Maintenance Man.
The applications of Paul Dornack as First Assistant at :the City Dumping
Grounds, Erwin Standke and Harley B. O'C.onnor as assistants°at the dumping grounds

and Norbert Huiting as machine operato.r at the Dumping Grounds were each read and
upon motion.by Helmkay, second.by Davis, Paul Dornack was reappointed as First
Assistant at the Dumping Grounds, Erwin Standke and Harley B. O'C'onnor were
reappointed as assistants at the dumping grounds and Norbert Huiting was reappoint
as machine operator at the dumping grounds for the ensuing official year.
The applications for reappointment of Paul Sandberg, Ivan Boyd and Harry
Loucks as assistant custodians of the City Hall were each read and upon motion by
Davis, second by Helmkay, Paul Sandberg, Ivan Boyd and Harry Loucks were aeappointec
as assistant custodians of the City Hall for the ensuing official year.
The application of Mark E. Blanchard for reappointment as City Painter
was read and upon motion by Davis, second by Helmkay, Mark E. Blanchard was
reappointed as City Painter for the ensuing official year.
The application of C. E. Ginther for reappointment to the office of Fire
Warden of the City of Rochester was read- and upon motion by Helmkay, second by
McPherson, C. E. Ginther was reappointed as Fire Warden of the City of Rochester
for the. ensuing official year.
The proposal of the Rochester Post Bulletin for publishing the official
printing and advertising of the City of Rochester for the ensuing official year
was read and.President Fryer referred the.same to the Purchasing Committee.
A resolution adopted by Local 997, A. F. of L. of which,the employees at
the City Farm, the Street & Alley maintenance department and the Park maintenance
employees are members, requesting an increase in wages in the -amount of $50.00 per
month for each employee was read and President Fryer ordered that`the same be
placed on file. ,

A -communication from Robert Petersdorf, Sec. of Rochester Building
and Construction Trades Council, requesting an adjustment in wages for the City
Painter was read and President Fryer ordered that the same be placed on file.
The recommendation of the Chief of :Police that the salary of Frank S.
Halloran, Meter Maintenance Man, be adjusted from $235.00 per month to $250.00'
per month in addition to any general raise which might be allowed by the Council,
was read and President Fryer referred -the same to the Police Committee.
A communication from Irving L. Eckholdt, Judge of Municipal Court,
.requesting that in the event a general raise is given other employees of the City
the employees of his department receive the same consideration, was read and
(President Fryer ordered that the same be placed on file.

The following recommendation was read and President Fryer ordered that
the same be held until the meeting of April 9, 1951:
"Honorable Mayor & Common Council
.Of the City of Rochester, Minnesota
Gentlemen:
.Subject to your approval, I recommend that 36 men
be regulary employed in the City Engineers Department
(Maintenance Division) in the following classifications:
1 - Assistant Superintendent
1 - Mechanic
3 - Foreman
1 - Assistant Mechanic
1 - Stockkeeper
8 - Machine Operators
21 - Laborers -Truck Drivers
I. further recommend that these men work 40 hours per
week and that they be given such increase in salary as the
Council deems possible.

The following recommendation was read and upon motion by Helmkay,
second by Davis, the said recommendation was approved:
"To the Honorable Mayor and Common Council
Rochester, Minnesota
Gentlemen:
In accordance with Section #42, of the Charter, of the City of
Rochester,_ I should like th-e privilege of appointing a First
Deputy City..Assessor; a Second Deputy City Assessor and five
Part-time Deputy Assessors, to be named at a later date, and
subject to the approval of the Council. The Part-time Deputies,
of course, are for the purplse of Personal Property assessments.
I believe this action imperative and the above request should be
subject to revision. as I shall appreciate an opportunity to
become somewhat oriented in the office of City Assessor, before
determining just what is necessary to carry out my duties
efficiently and expeditiously.

A communication from the Yellow Cab Company transmitting a proposed
franchise for the operation of its cabs on the streets of the City, and calling
the attention of the Council -to Section 5, which provides for -a -change -in rates,
was read and upon motion by McPherson, second by. Helmkay, the,communica-tion and
franchise were referred to the City Attorney.``
The Mayor's emergency order given .to•the City Clerk for the purchase of
approximately 12,000 gallons of gasoline was read and upon motion -by Helmkay,
second by McPherson, the same was approved.
The request of the H & H Electric Company for a further extension of
time from April 1 to April 21, to c•ompl•ete the installation of traffic signals was
read and upon motion by Brumm, second by,Davis, the requested extension was grantee
The report of the Clerk of Municipal Court f•or the :week ended March 31,
1951 showing total criminal fines and costs collected $1,OO4.10 and civil fees
received $.70 was read and having been approved by .the City Attorney, President
Fryer ordered that the same be placed on file.
The City Engineer's annual report was presented to the Council and upon
motion by Davis, second by Helmkay, the same was accepted and ordered placed on
f ile. .

The recommendation of the Street & Alley Committee that the bid - of
Quap ve and Anderson for furnishing 500 cu. yde of crushed rock 0 1.75 delivered
and 1.25 stockpile and the bid of Rochester Sand and Gravel Company for furnishing
500 cu. yds. crushed gravel@ 1.65 delivered and 1.15® pit and 500 cu. yds of pea
gravel 0 1.75 delivered and 1.35 ® pit, each be accepted was read and upon motion
by Leo C. Anderson, second by George, J. Anderson, the bids were rejected and the
City Clerk was instructed to prepare a resolution calling for bids on April 16,
1951,
The recommendation of the Street & Alley Committee -that the bid of
Botsford.Lumber Company for furnishing 5400 bags of Standard Portland Cement
0,3.85 bbl.-$5197.50 and 600-bags Air-entraining•Portland Cement ® 3.95 bbl.-
$577.50, making a total of $5775.00, be accepted was -read and•upon motion by
Helmkay, second by McPherson, the recommendation was appro ved: The bid of The
Kruse Company for cement was rejected as same did not fionform to specifications.
The recommendation of.the Street & Alley Committee that the bid of
Rochester Ready Mix Concrete Company in the amount of $2,137. 50 be accepted for
furnishing the season's supply of ready mix concrete for use in the City Engineer's

The recommendation of the Street & Alley Committee that the bid of

l of $10, 265.00 and the bid of L. N. Sickels Company be accepted for furnishing

$99.00 a drum making a total of $2228.00 was read and upon motion by Helmkay,
'second by Davis, the recommendation was approved.
The recommendation of the Street & Alley Committee that the bid of
Wm. H. Ziegler be accepted for furnishing one Motor Grader for use. in the City
Engineer's Department in the amount of $12,752,00 and checks re.turned to the
!unsuccessful bidders was read and upon motion by Davis, second by McPherson, the

The recommendation of the Street & Alley Committee that bids be taken
,for the purchase of a iton 4 x 4 track complete with hydraulic snow plow and
;winch for use in the Street & Alley Department was read and upon motion by
'Davis, second by McPherson, the recommendation was approved.
The recommendation of the Lighting Committee that lights be installed
at let Avenue and 101 Street Southeast, 12th Street and 12th Avenue Southeast and
12th Street and 9th Avenue Southeast, was read and upon motion by George J.
Anderson, second by Brumm, the recommendation was approved..
The applications of Emil Nietz. Fred A. Roepke, Squires Electric Co.,,
Edwin H. Brown, William Hines, Roster Electric Company and Arthur A. Brown for
ii Electrical Contractors License were each read and upon motion by Helmkay, second

"WHEREAS, Section 7 of Ordinance No. 415 provides that the
Common Council of the City of Rochester, Minnesota, on the first
Monday in -April, in each year,.shall establish a minimum wage
scale for all publ-ic works' for the ensuing official year;
SO THEREFORE, Be it resolved by the Common Council of the
City of Rochester, -Minnesota:
That for and during the official year following the passage
and adoption of this resolution all contracts hereinafter entered
Into for the purpose of performing any work for the City of
Rochester, involving either new construction work or repair work
on any roads, bridges, sewers, alleys, parkways, buildings, streets
or any other public work involving the improvement of public
property shall be made upon the basis that the wages. paid skilled
and unskilled labor shall conform to the prevailing wages established
by the unions, representing such labor and various contractors
for skilled and unskilled labor."
