President Fryer called the meeting to order at 7:30 o'clock P. M., the following members being present: President Fryer, Aldermen Leo C. Anderson, George J. Anderson, George B. Brumm, Wayne'tavis, William X. Helmkay and Raymond P.) McPherson. Absent: None. Upon motion by Helmkay,, second by Davis, the.minut.es of the meeting of April 2, 1951 were approved. Th-a following recommendation was read: "Honorable Mayor & Common Council Of the City of Rochester, Minnesota Gentlemen: The matter of licensing of popcorn wagons or stands.on the public streets was referred to the Street and Alley Committee. We the undersigned, recommend that in accordance with Ordinance\ #5 no license or -permit be issued to conduct any business on the City streets, sidewalks or boulevards. We further.recommend that no such business be permitted with or without a license or permit. Respectfully, LEO C. ANDERSON Street & Alley ( GEORGE J. ANDERSON And ( GEORGE B. Monson, City,Engineer" Mr. Ray Stevens was present and spoke in favor of granting the popcorn vending licenses as petitioned for. Also John A. Yaeger, Jr. was present and urged that the license held by his brother, for the past year, be renewed. After the other Petitioners and others present interested in the granting of the 'said licenses were heard, President fryer suggested that the petitioners be allowed to operate 90 days and during that time to find new•locations if possible. He further suggested that the Public Grounds Committee assist them in looking for new locationE Upon motion by George Anderson, second by Brumm, the petitioners were granted a 90 day period in which to find new locations with the assistance of ,the Public Grounds Committee. All voted in favor of the motion except Alderman Helmkay,•who voted "no". The following' communication was read and upon motion by Leo Anderson, second by Helmkay, the appointment of Miss Elf reda Reiter and Mrs. Geraldine Bielenberg was approved: "To the Honorable Mayor and Members of the Common Council City of Rochester, Minnesota Gentlemen:' Subject to your approval I hereby appoint Miss Elf reda Reiter, as f -tst assistant and clerk of registration and Mrs. Geraldine 1 Record of Official Proceedings of the Common Council of the City,of Rochester, Minn., Apr4l 9, 19 51 • Bielenberg as second assistant and clerk of registration in the office of the City Clerk. Monson City Engineer" The following communication was read and upon motion by Davis, second by McPherson, the City Engineer was authorized to employ two men as operators of the City Parking Lot: "Honorable Mayor & Common Council Of the City of Rochester, Minnesota Gentlemen: I hereby request your permission and authorization to employ two men as operators of the City Parking.Lot at the salary determined by the Common Council. Respectfully, Ralph E. Monson City Engineer" The recommendation of the Street & Alley Committee and.the City •'Engineer that the following streets be widened and paved, such pavement to consist of concrete paving with integral curbs, was read and upon motion by McPherson, second by Helmkay, the recommendation was approved: 2nd S t. S. E, from lot Ave. to 2nd Ave. 2nd Ave. S. E. from East Center St, to the Mayo Park Bridge 3rd Ave. S. E. from the Mayo Park Bridge to 4th Street The recommendation of the Street & Alley Committee that the date of i 'accepting bids for construction of a new East Center Street bridge be delayed ,from May 7 until June 4, 1951 was read and upon motion by Davis, second by 1 1 U 1 C� 1 1 Helmkay, the recommendation was approved. 0 31 . B. from Silver Lake Park to loth Street and on loth Street N. D. from 7th to 9th Avenue was read and upon motion by Helmkay, second by George Anderson, the recommendation was approved. Mr. Russ4§11 Sanders was present at the meeting and requested that the Council appropriate the sum of .$199.00 for the purpose of furnishing music at the 4nnual gypsy frolic and upon motion by Helmkay, second by. George Anderson, the amount of $199.00 was appropriated from the Band Fund. A letter from August A. Andresen addressed to Mr. Desmonfi B. Hunt, City Attorney, stating that'he would advise the members of. the Ways & Means Committee of the opposition of the Council to the taxing of municipal securities by the Federal Government was read and President Fryer ordered that the same be placed on file. A notice from the State of Minnesota, Department of Weights•and Measures, that one of their inspectors in charge of vehicle scale testing would be working on a route on which Rochester is located and that an inspection of the truck scale could be made at that time if so desired, was read and since the scales had very recently been checked President Fryer ordered that the notice be placed on file. The following letters addressed to the Common Council and also a lett.er addressed to Mayor Glenn 0. Amundsen,substantiating the same as his letter to the Common Council, from -Mr. S. J. McComb, were each read and President Fryer ordered that the same be placed on file: "City Council " .Rochester, Minnesota Gentlemen: I protest most strongly recent Council action in the matter of bids for street surfacing materials. Certainly in such instances the Council, as representatives of all the peoples of Rochester, is obligated to accept the low bid. 4f ith all due regard for the right of Mr. Petersdorf to defend the rights jof unionism, I firmly believe that it is time to call a halt to his " bulldozing„ tactics in regard to municipal affairs. Let's pay attention the best interests of all the citizens, not just his particular group. Very truly yours, S. J. McComb" "The Rochester City Council Rochester, Minnesota Honorable Sirs: If the news story on page 9 of the -Rochester Post Bulletin for .April-3, 1951 is substantially correct it would appear that Mr. R. J. Petersdorf" is controlling the affairs of the city$. council by the force of implied threat. I protest his pre - Bumptiousness in doing this and I hope you will not 'allow him to push you around. " 354 Record of Official Proceedings of the Common Council of the City of Rochester, Minn.: Ur3m 9, 1951 A petition to have the South one half of Lots 7 and S in Block 94, of t 'Moe & Old's Addition changed from a. residential zone to a commercial zone was read and upon motion by Davis, second by George Anderson, the same was referred to the Board of Zoning. i Extra Order No. 2 issuea by Toltz, King and Day, Inc. to Paller and i 'Pagenhart, Contractors on the new Sewage'Disposal Plant for furnishing the !,following was read and upon motion by McPherson, second by Helmkay, the same II was approved and ordered placed on file For furnishing gravel coarse aggregate in place of crushed rock for all' exgerior walls, roof beams and roof slabs above elevation 989.25 in the Screen House Building. The gravel coarse aggregate mentioned above to comply with the specifi- cations for coarse aggregate except that it shall show an absorption of not over 2% and a lose of not more than 5% in 15 cycles of the sodium sulphate soundness test . . . $300,00 A communication advising that the Vets Cab Company of Rophester, a corporation, is now being dissolved and that a trustee, Raymond Hennessey, has been appointed and that the said trustee has entered into a contract for deed providing for the sale of the assets of the said corporation to Carl F. Petersen, the transfer to be effective on May 1, 1951 was read. Also Mr. Petersen' s application for a franchise to operate a cab service for a.period of 5 years beginning May 1, 1951 was read.- Upon motion by George Anderson, second by. McPherson, the notice of transfer was referred to the City Attorney for i report sand to notify all Cab Companies that a hearing on taxicab rates would be held next Monday. The application of North States.Enterprises, Inc. operators of the 'Rochester Outdoor Theater to use fireworks at the location of their theater durRng the summer was read and President Pryer referred the same to the License Committee, the City Attorney, the Chief of Police and the Fire Chief. A letter from Mr. S. A. Loomis listing dates when Mr. Darrell Sanford ,had been out of town on scavenger work was read. Also Mr. Loomis was present Wand again stated that he felt that scavenger services handled by Mr. Darrell Sanford was unfair competition. Mr. Darrell Sanford's application for City Scavenger and Dog Catcher was again considered by the Council and upon motion by Helmkay, second by McPherson, Mr. Darrell Sanford was appointed as City Scavenger and Dog Catcher for the ensuing official year. , The following list of employees in the Public Health & Welfare Department and wage schedule and also a communication asking f:or certain adjustments over and above the $300.00 general raise given employees of the City of Rochester, together with a letter requesting that the Health Officer's salary be increased in an amount equal to 10% of his present salary, were each read and ordered placed on file. 1 1 n LJ 1 • 1 1 11 Record of Official Proceedings of the Common! Mayor Glenn 0. Amundsen stated that he had noted an error in the appointment of members of the Board of Park Commissioners for a period of 3 years instead of 2 years as required by charter and advised that he was amending his appointments to the said Board to agree with the terms of the City charter. Mayor Glenn 0. Amundsen appointed Mr. Carl Hooper to the position of Civil Defense Director for a period of.one month, his present salary to be increased $25.00 for the month. Mayor Glenn 0. Amundsen also suggested to the Council that all City offices in the City Hall be kept open during the noon hour and upon motion by Helmkay, second by Davis, the Mayor's recommendation was approved.
