The following.reeommendation of the Public Grounds Committee was read and upon motion by Helmkay, second by George Anderson,.the same was accepted and ordered placed on file: "To•the Honorable Mayor and Members of the Common. Council City of Rochester, Minnesota - Gentlemen: The Public Grounds Committee have now been informed that Ordinance No. 309,.which was passed on April 19, 1922, permits the licensing of popcorn wagons and their use on the City streets of Rochester. We, the Committee, feel that the purpose of the prse'nt con- troversy would be served if the Council either issued a new ordinance or amended the one referred to above, to include the' following restrictions: 1. That each applicant for a license shall secure a written letter from the adjacent property owner,, indi•cating•said property owners willingness that the wagon be so located. 2. That all,licenses shall be issued for a specific location and that they not permit wagons to be moved under any condition. 3. That the licenses be issued only to the present. owners of said wagons with the understanding that they can not be transferred to a new owner if the physical property is disposed of or removed if the present owner discontinued business for a period of six months or more. 4. That it be specificatlly understood that no additional licenses for popcorn wagons or similar enterprises shall be issued to anyone whatsoever. 5. That the ordinance restrict the location of the 'wagon relative to the street intersection in accordance with local and -state traffic regulations, which require that no object sahll be closer than 40.ft. to any main intersection. 6. That the licenses be issued with the understanding that if three or more bona.fide complaints are received by the Police Department from motorists or pedestrians protesting that such wagons are obstructing the free flow of foot or vehicle traffic in that area, then the license will have to.be revoked. This work to be do.ne under supervision of the City Engineer, was read and upon motion by Davis, second by Helmkay, the recommendation was approved, The request of Edison P.T.A. for permission to operate a bingo game on April 24, 1951 was read and President Fryer ordered that the same be placed on The recommendation of the Rochester Sheet Metal Contractors Association 0 that the names of William Burrows and Frank Mengedoth be considered by the Council ins 0 o _ Record of Official Proceedings of the Common Council of the City ,of Rochester, Minn.,,., April 16, 19 51 • P I r when appointing a Warm Air Heating and Air Conditioning Inspector was read.- It was suggested by Alderman McPherson that a committee to study the matter of ,',appointing a Heating and Plumbing Inspector, be appointed. Upon motion by McPherson, second by Davis,.the chair was authorized tQ appoint a committee consisting of two members, who are neither city officials or employed by the City, the City Attorney, the Building Inspector and the Electrical Inspector.. The following,findings of the Fire Commission of the City of Rochester in the matter of the complaint against 'C. E. Ginther, Fire Chief,' was. read and ,President Fryer ordered that the same be placed on file;. 1. That on or about the 15th day of January, 1951, the City of Rochester owned a certain light truck which was used primarily to combat grass fires. 2. That on or about the aforementioned date a certain generator hadbeen left with the City Fire Department for inspection and trial purposes and at that time was not the property of the City of Rochester. 3. That on or about.the 15th day of January,. 1951, C. E. Ginther placed this generator together with one of the lights in this truck and used, or pernittea it to be used, at a certain site in the City of Rochester providing light for workers who were then demolishing a certain building. That the use of this equipment was for one night only and demolition of the building continued for several nights thereafter. 4. This Commission finds that the said C. E. Ginther received no personal gain in consideration of the use of the equipment provided.. 5. The Commission further finds that the complaint of Robert J. . Petersdorf, is -based upon hearsay and he has refused to divulge the source of his information. However, the fact that the equipment was used was not denied by C. E. Ginther. 6. The Commission further finds that the testing of the generator was actual and that at a later date said generator was purchased by the City of Rochester. 7. The Commission further finds that upon the evidence presented there is not sufficient grounds to warrant this Commission ordering a suspension of .C. E. Ginther, Fire Chief. Alderman George Anderson moved that a letter be -sent to all department heads admonishing them not to permit any city equipment or property to be used for personal gain. His motion was'seconded by Alderman Brumm. Alderman George A nderson and Brumm voted in favor of the motion and Aldermen Leo Anderson, ,Davis, Helmkay and McPherson voted unou. i A protest against any action which might be taken by the Council in not granting licenses for the popcorn vending stands, which were in operation last year, -was read and.President Fryer ordered that the same be placed on file. The request of the Military Order of the Purple Heart to display their exhibits housed in 28 foot mobile trailer units on the public streets was read and upon motion by Davis, second by Helmkay, their request was granted, they placing of the said mobile units to be supervised by the Chief of Police. The City Engineer's preliminary estimate for the widening of 3rd Avenue Southeast between 4th and 5th Street Southeast in the amount of $11,946.10 was. 'read and President Fryer ordered that the same be placed on file. 'All voted in favor of the motion. °WHEREAS, the subcommittees of the Planning and Zoning Commission and of the Parking Committee of the Rochester Chamber of Commerce have met -and discussed the parking problem which is, and for some time has been a troublesome matter for the City of Rochester, Minnesota, and. after considering the -various phases of such problem do hereby make the following recommendations to be submitted to the Common Council of the City of Rochester, Minnesota; 1. That a commission known as the Parking Commission be appointed by the Mayor with the approval of the Common Council, to consist of not less than three (3) nor more than five (5)' citizens of the City of Rochester. That the terms of office.1or such commission members shall be three (3) years. That the expiration of the terms shall be as follows: The first commission shall be appointed with terms expiring in one, two. and three years and, thereafter, a new member Qr members shall be named each year. 2. That such a commission make a thorough study of the problems and needs of sai4 city for the parking of automobiles; that it be authorized to consult, with anyone who is trained in the study of such matters; that it be empowered to conduct hearings and'to coordinate its' plans with those of other civic groups, more particularly with plans of the Planning and Zoning Commission of the City of Rochester. 3. That it be authorized to submit any recommendations toward a solution of,the-problem of parking motor vehicles within the city to the Common Council of tie City of Rochester, Minnesota. WHEREAS, the Planning and Zoning Commission accepted these recommendations, by unanimous action, on February 2,,1951= NOW THEREFORE, BE IT RESOLVED that the Commission does petition the Common Council to, appoint a -Parking Commission to advise it on all matters pertaining to parking of automobiles within the City of Rochester, Minnesota. a A petition which would limit Darrell Sanford to cleaning septic tanks located within the City limits only was read and upon motion by Davis, second by McPherson, the same was ordered placed on file. The following communication from Mr. James J. Macken, Jr., Chief of , Police was read and President Fryer ordered that the same be referred to the License Committee and the City Attorney: "Honorable Mayor and Common Council City of Rochester, Minnesota Gentiemen:` ` I submit the following for your information. I, On March 6, 1951, a complaint was filed under the City Ordinance charging Samuel R. DeFosse, the holder of a non -intoxicating malt liquor license for the Belt Line Tavern, with .selling 3.2 beer to minor presons on February 27, 1951. )fr. DeFosse was arraigned on March 9,.1951, at which time he entered a plea of not guilty. After several adjournments the case was heard by Judge.Eckholdt In Municipal Court, Rochester, Minnesota, on April 12, 1951. The Defendant was found guilty and a penalty of $100,00 fine or 90 days at hard labor was imposed. The fine was paid. Respectfully submitted, James J. Alderman Brumm introduced a resolution appropriating $22,289.43 from the Park Improvement Fund and ordering payment made to Mayo Civic Auditorium) Revolving Fund, which was read. Be it and it is hereby further resolved by the said Board that hourly labor, full or part time, necessary for utility operation bepaid at such a rate not to exceed that adopted.by the Common Council, but said labor not to participate in Employee's Retirement Plan.9 , After.some discussion, a motion was 'made by Drumm,-secoAd by Davis, that the City Clerk be instructed -to return the said resolution with the request of the Common Council that adjustments of salaries for the positions do not exceed those amounts by:$300.00 per year or $25.00 per month paid for the same positions as were approved and paid prior to salaries effective August 1, 1950 and approved by Council resolution on August 21, 1950. It was stated by the Council that if a salary adjustment was approved on A ugust lit in excess of $-300.00 per year, nothing further could be done in such instances at this.time. All voted in favor of the motion. The matter. of repairing railroad eTossi•ngs• within the' City limits was ,,again discusse& by the members of the Council and upon motion by Helmkay, second by McPherson, ,it, was, ordered that a resolution be prepared.requesting that said crossings be repaired at once and that certified copies of the resolution be presented to the.RaiXroad Companies. 1 1 • 11 1 1 • Record of Official Proceedings of the .Common- Council of the City of Rochester; Minn:; -April 16, 19.51 1 1 Co rr� 1 • 1 Alderman George Anderson introduced the following resolution which was read; "WHEREAS, the Common Council of the City of Rochester, Minnesota; are definitely dissatisfied with the condition of railway grade crossings in the City. Most of these crossings are constantly in need. of -repair and are presently in such- a deplorable condition that they unquestionably constitute a hazard to the- free flow of traffic and, health and . safety of the citizens of this community. NOW-THEREFORE.BE•IT RESOLVED: That the Mayor and City , Attorney contact the railways involved and request immediate action on the permanent improvement of these crossings.- - BE IT FURTHER RESOLVED: That if the railways do_not take immediate action -that other means be explored to legally require the correction of this hazardous condition.11 Upon motion by Helmkay, second by McPherson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted, Chief of Police,.James J: Macken, Jr., stated that the police car that had recently been damaged was beyond repair and should be replaced by a new car. Upon motion by George Anderson, second by Davis, the matter was referred to the Police Committee and the Chief of Police to look up insurance carried by the other party involved in the accident and the City Clerk was instructed to prepare a resolution ordering bids for a new car and present same at the next Council meeting. President Fryer announced the appointment of the following committees to study the salary schedules of the various departments of the.City: City Clerk's. Department Finance Committee Public Utility Department Finance Committee Building Inspectorts Dept. - Finance Committee Assessor's Department - Finance Committee Treasurer's Department - Finance Committee. Park Department - Public Grounds` Committee Health & Welfare Department - Public Grounds Committee Fire Department_ - Fire Committee Police Department - Police Committee City,Engineer's Department - Street & Alley .Committee Upon motion by Davis, second by Helmkay, the meeting w6Ls adjourned until 7:30 o1clock P.
