City -on April 23, 1951. I President Fryer called the meeting to order'at 7:30 o'clock P. M., the ill r following members being present: President Fryer, Aldermen Leo Anderson, George Anderson, Brumm, Davis, Helmkay and McPherson. Absent: None. Mr. Darrell Sanford, Dog Catcher, was -before the Council and stated that he had received many calls about dogs molesting the ducks in Silver Lake Park. After hearing Mr. Sanford, a motion was made by Helmkay, second by Brumm, instructing the City Attorney to prepare an amendment to the dog ordinance which would prohibit dogs in public parks"unless they are on a leash. All voted in favor of the motion. ij The recommendation of the Police Committee that a full time employee ;be added to the -Meter Maintenance Division for the summer months for the purpose of assisting in the cleaning and maintenance work of the meters was read and upon motion by McPherson, second by Brumm, the recommendation was approved. President Fryer referred the matter to the Chairman.o.f:.the,1police Committee, the Chairman of the Public Grounds Committee and the Chief of Police. The recommendation of the Police Committee that Ordinance No. 501, regulating the operating of bicycles and other similar conveyances upon tite public streets of the City of Rochester, be amended so that the bicycles will be registered every two years or at the discretion of the Police Department and i that a fee of twenty-five cents (250) be charged for such 'registration and license plate, was read and upon motion by Helmkay, second by George Anderson, the recommendation was approved and the City Attorney was instructed to draw an amendment to the bicycle ordinance requiring a fee of 25¢ when a license is issued. A communication from Wayne Davis, Alderman of the First Ward, i i ,recommending to the Council that the'City Attorney be instructed to immediately institute action.to prepare an index of all city ordinances and amendments 'thereto and that he further prepare a plan for special action at the earliest ,possible time and present to the Council his recommendation on the legal, clerical and stenographic assistance necessary to make this information available to all attorneys and other.persons interested was read and upon motion by Helmkay, second by Brumm, his recommendation was approved. A letter from Mr. N. D.-Cory, Superintendent of the Rochester Public Schools, containing the following quotations from the public examiner's report was read: "The previous report of examination on the financial affairs of this District contained the -following comment: " 'Children residing in Veterans' Housing,Project are attending schools,of the District without charge. This housing project is not located within the boundaries of School District No. 9, but adjoins such District. Neither is it within the City limits of Rochester. It is located on tax exempt property belonging to the County Fair Association. " 'As these children reside in another school,.district, such district should bear the cost of educating them. " 'The examiners were adiised that there are thirty-nine children from this -housing project attending District No. g schools. Based on the present per pupil maintenance cost, the expense of educating these children would be upwards of $10,000,00, exclusive of transportation.' "General Fund "Operations (continued) "The situation remains_unchanged except that this Federal Housing Project became the project of the City of Rochester on April 1, 1950. The budget of the Board of Education of School District No. 8 is subject to the approval of the City'Council. The City Council is attempting to find ways of financing the cost of educating these children.. "Attendance statistics show that during the year ended July 13, 1950 thirteen children from this housing project area attended kindergarten classes and that thirty such children attended elementary -classes, a total of 43 pupils. Neither State aid nor Reimbursement from School District No. 132, covering these pupils, was shown by the records during the year'examined. "Based on the present cost per pupil unit in average daily attendance, the. expense of educating these children would be approximately $11,000.00, without cost of transportation. "The District'is receiving nonresident secondary tuition payments for eight junior high school and ten senior high sehoolipupils residing in the housing project area and attending the high school of the District.='• It was further stated in the communication that it was the understanding of the Board of Education that the City Council would assume responsibility fmr payment of elementary children to the school district and in addition to educating the children, bus service had been furnished for kindergarten youngsters. Upon motion by George Anderson, second by Davis, the matter of educating the children attending kindergarten and those attending elementary classes in the Rochester Public Schools was referred to the City.Attorney and he was instructed to take the matter up with the public examiner. Kirmis, Herbert Horn and i " Sigvald Arneson for the position as assistant custodian of .the City Hall - to be ',vacated by Harry Loucks, were each read and President Fryer -referred the same to '�the Public Grounds Committee and the Chief of Police. A letter from Mr. Matt Mulvihill requesting further time to prepare a. statement of sales including non -intoxicating malt liquors was read and upon motion by Helmkay, second by George Anderson, the tim& for submitting the said statement As set as of May 1, 1951. The request of Whitlock Sonnenberg Auxiliary and William T. McCoy ;Auxiliary for permission to sell poppies on the streets of Rochester on Saturday, '-May 26th, was read and upon motion by Leo Anderson, second by George Anderson, their request was granted. The application of William L. Burrows for appointement to the position of Heating Inspector for the City of Rochester was read and President Fryer ordered that the same be placed on file. ti President Fryer announced the appointment of -Mr. Walter Vitzke and Mr. i, Russell Sanders to - serve as members of a committee• .to •study the matter of appointing a Heating Inspector for the City of Rochester. Alderman McPherson stated that it was not his understanding that two members of the committee should be citizens not connected with the City. A motion was made. by McPherson, second by Davis, rescinding the action of the prior meeting in regard to appointment of members to the Committee to study the appointment of the Heating Inspector and ,:appointing the Public Grounds Committee to study the matter, they to consult with the Building Inspector, the Electrical Inspector and the City Attorney. The report of the Clerk -of Municipal Court - for the week ended April 21, 1951 showing total criminal fines and costs collected•$610.00 and civil foes received $12.28 was read and having been approved by.the City Attorney, -President Fryer ordered that the same be placed on file. The application of Rochester Yellow Cab:Company for transfer of a taxicab license from a 5 passenger Chevrolet to a 5 passenger Pontiac was read and upon motion by, George Anderson,. second by Brumm, the transfer was granted, The applications of .George Sv,endsen.and L. Upon motion by Davis, second by Helmkay, that the said resolution be I adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. A motion was made by Davis, second by McPherson, that 'the chair appoint a committee to check all cab stands in the City. President Fryer appointed the Police Committee and the Chief of Police to.make an inspection of cab stands. President Fryer stated that ordinances granting franchises to the Yellow Cab Company and the Service Cab Company would be considered at this time and asked if any one present wished to be heard on the mqLtter. Mr. Peterson of the Nets Cab Company and Mr. J. Kramer of the Yellow,Cab Company were both heard on the matter of rates. Mr. Peterson stated that he was not opposed to an increa in taxicab rates at this time, provided the other companies had agreed on same. Alderman McPherson made a motion that no change be made in -the present rates charged by cab companies in the City of Rochester. The motion was seconded by Alderman George Anderson. All present' voted in favor of the motion. An Ordinance granting a franchise to the hereinafter named grantee for the privilege of operating motor vehicles on the streets, alleys and highways, of the City of Rochester, for the purpose .of transporting passengers,for 41re for a period beginning thirty (30) days after the official adoption and publication of this ordinance and terminating five (5). years thereafter, upon the terms and conditions.hereinafter mentioned, providing for a regulation of said service; providing the amounts to be charged grantee. per ,unit for the- c operation of said motor vehicles; providing fo,r the termination of grant; providing for public liability security; providing four the supervision by the Common Council,of the City of Rochester (Rochester Yellow Cab Zorpoxation), was given i t s s eco rd reading. Upon motion by Davis, second by Brumm, and upon roll call and all voting in favor thereof, the rules were suspended and the Ordinance was given its third and final reading. Upon motion by McPherson, second bg-George Anderson, that the said Ordinance be adopted as.read, and all voting in favor thereof, President Fryer declared the said Ordinance duly passed and adopted. The matter of payment for time worked in addition to time covered by regular monthly salaries was again brought to the 'attentibn of the Council. A motion was made by Leo Anderson, second by Brufnm, that prior to the payment of claims for time worked over and above that covered .by regular monthly salaries, the Head of the Department in -which the said claim originates shall confer with the Mayor and recommend as to whether or not the claim .is for an emergency and if.claim covers compensation for an emergency,payment be made subject to approval of the Common Council. President Fryer announced the appointment of Aldermen Wayne Davis, Raymond McPherson and, William Helmkay to 'the Board of Equalization for the fiscal year ending March 31, 1952. Alderman Leo Anderson stated that he had received several complaints in regard to the Rock Island Bus stopping at the south entrance of the 8ahler Hotel which caused considerable traffic congestion at the intersection. President Fryer referred the same to the Police Committee and the Chief.of Police. Upon motion by George Anderson, second by Brumm, the,meeting was adjourned. City'Clerk
