Minutes of an adjourned regular meeting of the Common !Council of the
City of Rochester, Minnesota, held in the Council .Chambers, in the City Hall in 'I
said City, on June 19, 1951.
President Fryer called the meeting to order at 2:00 o'clock P.M., the
following members being present,: President Fryer,.Aldermen Leo Anderson, George
Anderson, Brumm, Davis, Helmkay, and McPherson. Absent;. None.
Upon motion by Helmkay, second by Brumm, the minutes.of the meeting
of June 4, 1951 were approved.
President Fryer stated this as.being the time and place set f c the
first hearing on the construction of a sanitary sewer,. watermain and street.
grading and surfacing and construction of.a curb and gutter in;araham Court from
Durand Court to-15th Avenue Southeast.- There was no one presentwishing to be
heard.
President Fryer.stated this as. -being the time and place set for the
first hearing on the construction of a sanitary sewer and watermain and grading
and surfacing in Peck's Second Addition. There was no one -present wishing to be
heard.
President Fryer stated this as being the time and place set for the

President Fryer stated this as,being the time and place set for the
second hearing on the construction of a sanitary..sewer and watermain and grading
on 2nd Avenue Northeast from 16th Street Northeast. to 165 feet North. There was
no one present wishing to be heard.
President Fryer stated this -as being the time -and place set for the
second hearing on the construction of a sanitary sewer in 11i'Street Southeast
between let and 3rd Avenues Southeast to serve Lots 22, 23, 24,25 and 26, in
Block S and Lots 3, 4, 5, 6 and 7 in Block 11, Sunnyside Addition. There was no
one present wishing to be heard.
President Fryer stated this as being the time and place set for- the
second hearing on the construction of a.curb and gutter on both sides of 9th
Avenue Northeast from 9th to loth Street Northeast and on 9th Street Northeast
from 9th Avenue to loth Avenue Northeast. There was no one present wishing to
be heard.

President Fryer stated this as being the time and place set for the
first hearing on the widening on the west side of 14th Avenue Southwest in front
of Lots 2,3,6 and 7 in Block 1, Dresbach's Addition. There was no one present
wishing to be heard.
President Fryer stated this as being the time and place set for the
first hearing on the construction of a curb and gutter on 10$ Street Southeast
in front of No. 1019,1020 and 1024. There was no one present wishing to be
heard.

first hearing on the construction of a sanitary sewer and watermain in lath

Addition. There was no one present wishing to be heard.
President Fryer stated this as being the time and place set for
receiving bids for resurfacing lot Avenue•Southwest from 2nd to 3rd Street and
4th Street Southwest from Broadway to lot Avenue Southwest. The following bids
were received and opened and President Fryer referred the same -to the Street &
Alley Committee and the City Engineer for tabulation and report:

President Fryer stated this as being the time and place set for
receiving bids for the sale and removal of the sheet metal building north of
the brick building'on the City Parking Lot. No bids were received.
President Fryer stated this as being the time and place set for
receiving and opening bids for paving 3rd Avenue Southeast from Mayo Park Bridge
to 4th Street Southeast. No bids were received.
President Pryer stated this as being the time and place set.for a

public hearing under the provisions of the Housing and Rental Act of 1949 and
any amendments thereto, as to whether or not there no longer exists such a
shortage in rental housing accomodations in the City of Rochester, Minnesota, -as
to require rent control in the said City of Rochester, Minnesota, Mr. Claude H.
McQuillan was before the Council and - stated that he represented a number of
tenants who did not wish to appear before the Council and recommended that rent
!control be continued in the City of Rochester. Several landlords were present
at the meeting and requested that a resolution be adopted decontrolling rent in
the
City, Mayor
Amandsen recommended that
the City be not
decontrolled,
but
that

an increase
from 10 to 15% in rentals
be permitted.

present and reading'a letter from the United Packinghouse Workers in America
Local 199 urging that the.City be not decontrolled, a motion was made by Davis,
second by Leo Anderson, that action on the matter be deferred until the meeting
Of July 2, 1951 at 2:00` o l clock P.M. and upon roll call Aldermen Leo Anderson,
Davis and McPherson voted in favor of the motion and Aldermen 'George Anderson,
Brumm, Helmkay and*Pryer voted "no".
Alderman Brumm introduced the following resolution which was read:
"WHEREAS, a public hearing was held at the City Hall, Rochester
Minnesota on June lgth, 1951, before the City Council of said City,
notice of which hearing was given by publication in the official
newspaper of said City more than ten days prior to the date of
said hearing; and
WHEREAS, the -purpose of said hearing was the.determination of
whether or not there exists within the City of Rochester, Minnesota,
such.a shortage in rental housing aecomodations as.to require rent
control in such city; and
WHEREAS, at said public hearing an opportunity was given to
the public to introduce -evidence bearing on the -question of the
availability of rental housing accomodations•in said City.
HOW THEREFORE, BE IT RESOLVED by the City Council of the City
of Rochester, Minnesota, on the basis of the facts presented at
said hearing that there no longer exists such a shortage in rental
housing accomodations within said City of Rochester, Minnesotq as
to require rent control in said" City of Rochester, Minnesota.
BE IT FURTHER RESOLVED that the City Clerk shall notify the
Housing Expediter that it is the request of the City Council of the
City of Rochester, that 'the City of Rochester, Minnesota, be
decontrolled pursuant to the provisions of Section 204 (j) (3)
of the Housing and Rent Act of 1947, as amended; and further
that.a certified copy of this.resolution shall be, in'accordance
-with the provisions of said Act, transmitted to the Housing,
Expediter."
Upon motion by George Anderson, second by Brumm, that the said resoles Lion be
adopted as read, and upon roll call maxibr Aldermen George Anderson, Brumm, Helmkay
and Pryer voting in favor of the motion and Aldermen Leo Anderson, Davis and
McPherson voting "no", President Fryer declared the said resolution duly passed
and adopted.
Alderman Davis made a verbal report that his Committee recommended
Charles H. Do.rnack to the appointment of Plumbing Inspector for ,the City of
Rochester, his appointment to be effective on June 20, 1951, and upon motion by
Davis, second by Brumm, and all'voting in'favor"thereof, the said appointment was
approved.
The matter of drafting an ordinance governing the office'of the
Building,.Electrical, Plumbing and Heating Inspector's was discussed and President
Fryer appointed Aldermen Davis, Helmkay and McPherson as a committee to work with
the City Attorney in preparing the said ordinance.
A remonstrance signed by 132 residents on 3rd and 4th Avenues Southeast
stating four reasons why they did not wish to have 3rd and 4th Avenues made one
way streets was read and ordered placed on file. Attorney George Delaney,
representing certain business men on 3rd Avenue Southeast, spoke against the
proposed traffic change on the said avenues. After hearing others .present on the

matter a motion was made by Leo Anderson, second by McPherson, that the proposed
traffic regulation making 3rd Avenue one way going South and hth Avenue one way
going North be abandoned and upon roll call Aldermen Leo Anderson and McPherson
voted in favor of the motion and Aldermen George Anderson, Brumm, Davis and
Helmkay voted "no".
A motion was then made by Davis, second by McPherson, that the prolast

by residents on 3rd and 4th Avenue be placed on file and that the matter be
again referred to the Street & Alley Committee. All present voted in favor of
the motion.
A notice by the Police Civil Service Commission that the final
extension of the leave of absence of Patrolman Lee Graham for a period of 30

days, this leave being granted without pay, had been granted was read and
President Fryer ordered the same placed on .file.
The Mayor's appointment of Mr. Lester Goetting as a member of the
Zoning Board to fill the unexpired term of Mr. Arleigh Disney, his term to
expire the second Monday in April, 1952, was read and upon motion by Brumm,
second by Helmkay, the Mayorls appointemeut was approved.
The request of the Peoples Natural Gas Company for permission to
construct a metal building 6+ X 81 to be used as a district regulator near the
iI junction of llth Avenue and 7th Street Northeast was read and upon motion by
Davis, second by Helmkay, the same was referred to the Street & Alley
Committee with power to act. '
The request of the Chief of Police that the Common Council authorize
expenses for two pistol teams, consisting of four men each, one team captain,
two convention delegates and himself to attend the Police Convention at
Mankato on June 25 and 26 .was read and upon motion by George Anderson, second
by Davis, his request was granted.
The appointment by Garnet Spring, Building Inspector, of Mr. Walter
Swenberg, Heating Engineer and Mr. H. W. Thompson, Heating Contracting as
j members of,the Heating Investigating Committee and Mr. Herman Dornack, Master
Plumber and Mr. Harold Gerths, Journeyman Plumber as members of the Plumbing
Investigating Board, was read and upon motion by Davis, second by Helmkay, the
appointments were approved.
The request of the Board of Park Commissioners for permission to
award a contract to the Squires Electric Company in the amount of $1,995.00 for
flood lights at Soldiers Field was read and President Fryer ordered the same
!, placed on file.
The recommendation of the Board of Public Health & Welfare that
Ordinance No.
508 be amended to provide six members on the Public Health .&

Welfare Board.instead of five, the Board to be made up of two doctors of medicine
practicing in the community, one doctor -of dental surgery, one member a
representative of the Civic League and two members to be appointed from the
citizenry at large with reference to theit fitness for office, was read and upon
motion by Davis, second by McPherson, the City At'tom ey was instructed to prepare
an amendment to Ordinance No. SOS making the requested change.
Two letters, one opposed to amending the dog ordinance and one in
favor'of the'dog ordinance being amended,.together with a remonstrance signed by
173 residents'of the City were each read and upon motion by Davis, second by
Brumm, the City Clerk was instructed to present same at the meeting to be held
on July 2, 1951,
The City Engineerts preliminary estimate of cost for construction of
a sanitary sewer and watermain in 15th Avenue Southeast from Durand Court to
o
Graham Court and in Graham Court from 15th Avenue Southeast to Durand Court
was read and President Fryer ordered the same placed on file.
A communication from the City Engineer stating that the Street & Alley
Committee and the Board of County Commissioners were unable to meet on June 12th
at a meeting scheduled for 4¢00 o'clock in the afternoon relative to the regrading
and surfacing of 14th Avenue Northeast. However, the City Engineer did state
the conclusions of previous discussions on the matter which areas listed belowt
1. The County Board are willing to pay the entire cost, of grading,
6" base and 20 surfacing on the center 24 feet (traveled roadway)
of this street.
2. The County would co-operate with the City, on this basis only
where a-44 foot wide roadway could be obtained. (Further dis-
cussion indicated this might be reduced to 421 if conditions
warranted).
3. The City would pay,for the balance of the grading, base and
surfacing as well as'curb and gutter, sidewalks, and drainage
facilities. Some of this could be financed by assessment if
the City so desires.
4. The City could prepare plans, award contracts and supervise the
construction. The County would reimburse the City for .its share
based on the computed quantities and unit prices bid plus a pro-
portionate share of engineering and other costs.
5. This street or others similarly constructed would continue. to be
maintained u#fter agreement between the City Council and is
County Board as is now the case wherein the County reimburses
the City a fixed cost per mile for maintenance of State Aid
Roads within the. City limits.
One complication on this particular project is the large drainage
ditch on the north side of 14th Street N.E: fro.m the City limits to the
West edge of the Carroll Addition. The County Board expressed the
opinion that any drainage construction more costly than,ordinary rural
ditch construction would have to be the responsibility of the City.
It would probably cost in the -neighborhood of $40,000 to construct a
storm sewer large enought to take the drainage now carried by this
ditch. Since this amount is not.immediately available for this
purpose, I recommend.,
1. That 14th Street N. E. from 3rd Avenue to 12th Avenue be regraded
leaving the ditch on the north side, but filling the south ditch-,
2. That this street be graded in such a way that when the storm sewer
can be constructed and the north ditch filled, the roadway will be
a minimum of 44 feet in width. il
3. That this work be done this year and that hearings be ordered

Upon motion by Leo Anderson, second by McPherson, the City Engineer was instructed
to complete the plans for the proposed project and give his estimate of the cost
of the entire project.
it The City Engineerts request for permission to take one week of his

vacation beginning June 18 through June 23 was read and President Fryer ordered
same placed on file.
A petition for the_ grading and surfacing of llth Street Northwest from
4th Avenue Northwest to the Creek was read and upon motion by Leo Anderson,

second by Davis, the -same was ordered placed on file until January, 1952 at
which time the first hearing would be advertised.

j The petition of the Rochester Dry Cleaners to have the property owned
i
b Dr. W. B. Thurber on Highway No. 2, the y 5 property:oaned by the Rochester Dry
Cleaners abutting on Highway No. 52, a strip of land 16 feet wide and 200 feet
long belonging to Mr. M. L. Priebe and a parcel of land 15 acres in area
I,
belonging to the Rochester Dry Cleaners annexed to the City of Rochester was
read together with a petition signed by 43 owners of property in the area west
of the present city limits requesting that their property also be annexedto
the City of Rochester. Upon motion by Leo Anderson, second by Helmkay, the
petitions were referred to the City Engineer and the Planning Commission for
Investigation and report.
A petition for the vacation of an alley between Parkins Addition and I'
Belmont Addition south of 7th Street Southwest was read and upon motion by
George Anderson, second by Leo:Anderson, the City.Clerk was instructed to j
prepare a resolution ordering the required legal notices and present same at Ij
the Council meeting to be held on July 2, 1951.
A contract between the City of Rochester and K: M. McGhie as Engineer
on the apron project to be constructed at•the Rochester Airport was read and the

Mayor and City Clerk -were instructed to execute the said contract.
The following request by Laura.J. Russell was read and upon•motion by
Brumm, second by Davis, she 'was authorized to construct the said sanitary sewer
in 11i Street Southeast under the supervision of the City Engineer, she to pay I.
the full cost of the project:
"To the Common Council of -the City of Rochester
I
Gentlemen:
Due to the fact that houses are being constructed on 11* St. S.E.
between 3rd Ave. S.E. and lot Ave. S.E. it is necessary that the
sewer be extended at once. I therefor request permission to extend i!
the sewer to serve Lots 3,4,5, and 6, Block 11 and Lots 23,25 and
26 in Block 8, Sunnyside Addition.

and ordered placed on file:
"Be it resolved by the Commissioners of the Sinking Fund of
the City of Rochester, Minnesota:
That the snm.of•$23,900..00 be and the said sum is hereby
appropriated from the Sinking Fund and ordered paid to the First
National Bank of Chicago, Illinois for the July lot, 1951
maturity of interest on 1.70% General Obligation Sewage Dispaal
Plant Bonds, Nos. 1 to 2800, Inclusive.0
The recommendation of the Lighting Committee that the Public Utility
Department install post bracket lights at 1132 - 10th Street Southwest and one
on the post in front of the Tillisch and the Logan residences; and increase the
wattage of the present Plummer Circle lights was read and upon motion by Leo
Anderson, second by,Davis, the recommendation was approved and:ref erred to the
Public Utility Department.
The recommendation of the Street & Alley Committee and the City Enginee
that the bids of Gordon Winslow Company Ve accepted for concrete resurfacing -of
lot Avenue Southwest from 2nd to 3rd Street Southwest in the amount of $15,364.1715
and 4th Street Southwest from Broadway to lot Avenue Southwest in the amount of
$17.,923.10 was read and upon motion by Brumm, second by Davis, ,the recommendedon
was approved subject to funds being available for the project on 4th Street
Southwest between Broadway and lot Avenue Southwest.
The following recommendation by the Street & Alley Committee was -read
and upon motion by Helmkay, second by Davis, the same was approved:

We, the undersigned members of the Street & Alley.
Committee, recommend that the recommendation of the Street &
Alley Committee approved by,the Common Council on May 4,
1942, authorizing the City Engineer to make charges for
repairing street -openings be amended as follows:
That the City Engineer be permitted to not collect
money at the time the permit is issued, but that the bharge
be billed to the person receiving the permit after 13:e
opening has been made. This 'is to make it possible to
determine the exact Size of opening made.

The reports of the Clerk of Municipal Court for the week ended June 9,
1951 showing total criminal fines and costs collected.$1,203.00 and civil fees
received $4.45 and for the week ended June 16, 1951 showing total criminal fines
and costs collected $619*00 and civil fees received $5.90, were each read and
having been approved by the City Attomey, President. Fryer ordered that the same
be placed on file.

for Journeyman Plumbers License were each read and upon motion by McPherson,

The application of F. C. Butterfass for license to construct sidewalks
was read and upon motion by Brumm, second by Helmkay, the license was granted.
The applications of Elwyn Means, Ed Kriehn and A. C. Burgan for license
to sell soft drinks were each read and upon motion by Leo Anderson, second by
Brumm, the licenses were granted.
The application of the Rochester Shrine Club for permission to play
;bingo in the North Hall of the Mayo Civic Auditorium was read and upon motion
by Davis, second by Helmkay, the same was ordered placed on file.
The application of Joseph Leif erman for a Real Estate Brokers License
was read and upon motion by Davis, second by Helmkay, the license was granted
subject to the approval of the Real Estate Committee.
The application of the Rochester Yellow Cab Corporation for transfer
,'of two taxicab licenses was read and upon motion by Davis, second by Leo Anderson,
the transfers were granted.
The application of the Service Cab Company for transfer of one taxicab
license was read and upon motion by Davis, second. by Brumm, the transfer was
granted.
The application of the Elks Lodge No. 1091 for a permit to display

The application of H. J. Hanson for a.Journeyman,Warm Air Heating,
Ventilating and Air Conditioning Worker s License was read and upon motion by

Helmkay, second by George Anderson, the license was granted.
The application for transfer of "On Sale" 3.2 Beer License No. 718 and
"Off Sale" 3.2 Beer License No, 1341 from Carl Person to Elegn Means was again
read and upon motion by.Davis, second by McPherson, the transfer was granted.
The surety bonds of Paul Plants in the amount of $19000.00 and Joseph
Leif erman, Edgar E. Jensen and Elmer•B. Hagen each in the amount d $2,500.00 Ath
the Western Surety Company were each read and upon motion by Davis, second by
Leo Anderson, the bonds were approved, the surety thereon accepted and they were
ordered placed on -file.
The contract bond of Universal Motors, Inc. in the amount of $550,00
with the Western Surety Company as surety was read and the'same was referred to
the Mayor for his approval.
Alderman Brumm introduced a resolution accepting the bid of Gordon
Winslow Company for resurfacing 1st Avenue Southwest from 2nd to .3rd Street and
4th Street Southwest from Broadway to let, Avenue Southwest, which was read.
Upon motion by Leo And-erson, second,by George Anderson, that the said
resolution be adopted.ae read, and all voting in favor thereof, 'President Pryer
declared the said resolution duly passed and adopted.
Alderman Brumm introduced a resolution ordering plans, specifications
and estimate of cost and 2nd hearing on construction of a curb and gutter in
Peck's First Addition, which was read.
Upon motion by George Anderson, second by Brumm, that the said resolutioi
be adopted as read, and all voting in favor thereof, President Fryer declared
the said resolution duly passed and adopted.
Alderman Brumm introduced a resolution ordering plans, specifications
and estimate of cost and 2nd hearing on construction of acurb and,gutter in
Peck ' s. Second Addition which was read.
Upon motion by Brumm, second by Davis, that the said resolution be
adopted as read, and all voting .in favor thereof,. President Fryer declared the
said resolution duly passed and adopted._

Alderman Davis introduced a resolution ordering plans, specifications

Upon motion.by Leo Anderson, second by George Anderson, that the

-The matter of attending the National Convention of -Councilmen and
Aldermen to be held at Cleveland, Ohio on July 18 to 21, 1951 was again dis-
cussed.at the Council meeting and upon motion by Davis, second by, Bru=, two
members of the Council were authorized.to attend the said convention at City
expense.-
The matter. of members of the Council going to Albert Lea for the
purpose of studying their'salary schedules was discussed and the City Clerk
was requested to call the City Manager at Albert Lea for an.appoiatment on
Wednesday, June 2T, 1951 if possible.
The claim of J. B. Ellis for damage to a tire which he claims was
torn.on a broken curb was read and President Fryer referred same to the City
Attorney,
