President Fryer called the meeting to order at 2:00 o'clock P. M., the following members being present: President Fryer, Aldermen Leo Anderson, George Anderson, Brumm, Davio, Helmkay and McPherson] Absent: None. Upon motion by Helmkay., second by Davis, the minutes of the meeting of July 23, 1951 were approved. President Fryer stated this as being the time and place set for the first hearing on the grading and resurfacing of 14th Street Northeast from 3rd to 13th Avenue Northeast, Mr. T. R. Lundquist was present and asked that they consider the grading and.surf acing'of 14th Street from the Silver Lake Drive East,to 13th Avenue Northeast. President Fryer stated this as being the -time and place.set for the first hearing on the grading and surfacing of llth Street Northwest from 4th Avenue Northwest to Cascade Creek. There was no one present wishing to be heard. President Pryer stated this as being the time and place set for the second hearing on the construction of a sanitary sewer and watermain on 9th-Street Northeast from the present sewer and watermain to 19th Avenue Northeast and on lgth Avenue Northeast into Miners Heights, Block 4. There.was no one present wishing to be heard. President Fryer stated this as being the time and place set for the second hearing on the construction of a curb and gutter on the north side of 16th Street Yortheast from Broadway to 1st Avenue Northeast. There was no one present wishing to be heard. President Fryer stated this as being the time and place set for the hearing on the petition for the vacation of the alley lying immediately east of - Lots one and eleven in Block 1 and Lots one -and eleven in Block 2, Parkins Addition to the City of Rochester. There was no one present wishing to be heard. President Fryer stated this as being the time and place set for the receiving of bids for the construction of a sewer and watermain in 9th Street Northeast from the end of the present sewer and watermain to 19th Avenue Northeast and on lSth Avenue Northeast in M inerl's Heights, Block and for the construction of a sanitary sewer and watermain and grading and surfacing in lgth Avenue Northeast from 9th Street Northeast to the South line of Westlund Sub -Division. No bids were received for grading and surfacing. The bids of Carlisle G. Fraser in the amount of 3,556.00 for sanitary sewer and 7,991.75 for watermain in 9th Street Northeast from the end of the present sewer and watermain'to 19th Avenue Northeast and on l9th Avenue Northeast in Minerls Heights, Block 4 and in the 96 Record of Official Proceedings of the Common Council of the City of Rochester, Minn.. The recommendation of the Sewer and Water Committees that the bid of Carlisle G. Fraser for construction of a sanitary sewer and watermain in 18th 'Avenue Northeast from 9th Street Northeast to the south line of Westlund Sub- division be accepted at unit prices was read -and upon motion by George Anderson, lsecond by Helmkay, the recommendation was approved. The recommendation of the Sewer and Water Committees that the bid of ;Carlisle G. Fraser for construction of a sanitary sewer and watermain in 9th Street Northeast from the end of the present sewer and watermain to 19th Avenue INortheast and on l8th Avenue Northeast in Miner's Heights, Block 4, be accepted .at the unit prices bid was read and upon motion by Davis, second by McPherson, the recommendation was approved. President Fryer stated this as being the time and place set for receiving and opening bids for the construction of a sanitary sewer and watermain and grading and surfacing in Peck's Second Addition. No bids were received for grading and surfacing. The bid of Carlisle G. Fraser in the amount of $9, 269,40 'for sanitary sewer. and $20,241,90 for watermain was received and opened. The recommendation of the Sewer and Water Committees that the bid of Carlisle G. Fraser for construction of a sanitary sewer and watermain in Peck's Second Addition be accepted at the unit prices bid was read and upon motion by Helmkay, second by Davis, the recommendation was approved. President Fryer st.at.ed this as being the time and place set for (furnishing 500 tons of plant mixed bituminous mix. The bid of .Blacktop Maintenance Company in the amount of $3,555.00 (500 tons bituminous mixture- 0 5.55 - $2,775•00 and 6500 gals, bituminous material, cutback asphalt Mc-4 ;$.12 - $790.00) was received and opened. The recommendation of the Street & Alley Committee that the bid of Blacktop Maintenance Company be accepted for furnishing 500 tons of Hot Mix 'Bituminous surfacing material in the amount of $3,555.00 was read and upon motion by Brumm, second by Helmkay, the recommendation was approved. President Fryer stated this as being the time and place set for receiving bids for the construction of a curb and gatter on 13th Avenue Northeast from 9th to 14th Street Northeast. The bids of Gordon Winslow Company in the amount of $5,273•95 and H. T. Earle & Son in the amount of $5.322.62 were each received and opened. Written protests. were received from the following organizations: Veterans of Foreign Wars, A. F. of L. General Drivers Union, Local #874, Rochester Building and Construction Trades Council, Central Labor Union and Construction Laborers' Union Local No. 405. A petition signed by 210 residents of the City of Rochester protesting the decontrol of rents in.the City of Rochester was read together with the above protests. Mr. Max Roffman, Business A gent for the U. P. W. Local 515, presented a petition in protest of decontrol of rents in the.City, the said petition was signed by 142 individuals.' Mr. Roffman also spoke at length in opposition to decontrol of rents. Your landlords were present -at the meeting and spoke in favor of decontrol of rents. Mayor Amundsen stated that he had prepared an honor roll and had requested landlords' to sign same,"up to the present date only one had appeared in his office and signed the roll. Alderman Brumm introduced the following resolution which was read: "WHEREAS, a public hearing was'held at the City Hall, Rochester, Minnesota on A ugust 6th, 1951 before the City Council, of said City, notice of which hearing -was given by publication in the official newspaper of said City more than ten days prior to the date of said hearing, and WHEREAS, the purpose of said hearing was the determination of whether or not there exists within the City of Rochester, Minnesota such a shortage in rental housing accomodations as to require rent control in such City, and WHEREAS, at said public hearing -an opportunity was given to the public to introduce evidence bearing on the question of the availability of rental housing accomodations in said City. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Rochester, Minnesota, on the basis of the facts presented at said . hearing that- there no longer exists such a shortage in'rental housing accomodations within said City of Rochester, Minnesota,, as to require rent control in said City of Rochester, Minnesota. BE IT FURTHER RESOLVED: That the City Clerk shall notify the Housing Expediter that it is the request of the City Council- of the City of, Rochester, that the City of Rochester, Minnesota, be decontrolled pursuant to the provisions of Section 204 (j) (3) of the Housing and Rent Act of 1947 as amended; and further that a certified copy of this resolution shall be, in accordance -with the provisions of said'Act, transmitted to the Housing Expediter." A motion was made by Davis, second by Brumm, that the said resolution be adopted as read; and upon roll call, Alderman Leo Anderson voted "no", Alderman George Anderson voted "present" and Aldermen Brumm, Davis, Helmkay and McPherson voted ."aye". Alderman George Anderson's vote was. cast with the majority. Presider Fryer declared the said resolution duly passed and adopted. Mr. Newton Holland was present at the meeting and asked permission to plant a tree in front of his restaurant on let Avenue Southwest. August 6, 1951 _ • The following resolution adopted by the Rochester Building and i ,Construction Trades Council of the American Federation of Labor, and the following !1communication from the same organization were each read and ordered placed on II • "WHEREAS, the City Council of Rochester, Minnesota has consistantly tried to break down working conditions and wages built•up here in Rochester by the American Federation of Labor, and WHEREAS, the City Engineer has deliberately purchased services and materials which are NON -UNION, when the city has a contract to buy said materials and services with a fair union concern,'and WHEREAS, the City Engineer, on his own, has refused to pay the going union sclae for laborers he has hired to do'extra work thereb • y tearing down conditions and trying -to break our unions, and WHEREAS, the Park Department, in violation of existing agreements, insists on having men not belonging to the A F of L construction unions, doing all kinds of construction work within the park system, and WHEREAS, the Fire Chief of the City of Rochester deliverately violates the agreement made by the city council in regard to any painting done in the fire hall, which definitely states that the firemen shall not do any painting within the building, yet this year, evidently with the permission of the council, the Fire Chief has his firemen paint a good portion of the building, and WHEREAS, the only conclusion that the Rochester Building and Constr- uction Trades Council can draw from the above named acts, is that the various department heads named, with the support and permission of the City Council, are doing everything in their power to destroy unionism and to lower the standards of wages and working conditions in the City of Rochester, SO THEREFORE, BE IT RESOLVED, that the Rochester Building and Construction Trades Council, affiliated with the American Federation of Labor, go on record to inform the city council that if the above named acts are not stopped and a satisfactory solution worked out between the Common Council of the City of Rochester and the Rochester Building and Construction Trades Council, this Trades Council will proceed to "advertize" to the public and to our membership as to just what the city council and their employees are doing to destroy and dissolve our member unions, and BE IT FURTHER RESOLVED, that a copy of this resolution be sent to the City Clerk, to the Mayor and a copy to each alderman and department head concerned. Trades Council" "To the Common Council of the City of Rochester, Minnesota Gentlemen: It has been brought to our attention that the City, or ibs representative has advised the tenants at the Vetls Housing Project that they must paint the fronts of the buildings that they live in. Action such as this is just another move -by city administration to exclude our tradesmen from as much work done by the city as possible. We object very strongly to such actions. I believe the city council realizes that every time something like this is done, it deprives our members of much work. Please take some action on this matter, and we urge you to let this work out on a contract to some painting contractor, whose men should do this type of work. Sincerely, ROBERT PETERSDORF, Sec. Rep. He was informed that the matter,had been referred to the Planning Commission and upon motion.by Davis, second by Helmkay, the Planning Commission was requested to make a report on the matter at the meeting.of the Council to beheld on A ugust 20, 1951. The recommendation of the Board of Zoning that the petition of Wm. L.- and Anne A. Ear to have Lot 23, Block 1 in Ireland's Addition to the City of. Rochester, changed from a residential to a multiple dwelling zone be granted was read and upon motion by Davis, second by Brumm, the City Clerk was instructed to publish notice of hearing on August 20, 1951 at 7: 30 o'clock P. Id. and the Building Inspector was instructed to post notice on the premise',s. The recommendation of the Board of Zoning that the petition of Mr. Arthur L. Ball to have the following described property changed from a residential to a commercial zone be denied was read and upon motion by Davis, second by George Anderson, the.same was approved: "Commencing at a point 463 ft. East and 336 ft. North of 'the quarter corner between Sec. 26 and 35, Township 107 North and Range 14 West, for place of beginning, th on a line bearing South 66 degrees East for a distance of 65 feet,' thence on a line bearing North 21 degrees 39 minutes East for a distance of 97.7 feet, thence on a line bearing North 81 degrees 41 minutes West to the Center line of 3rd Ave. N.W. as platted and used prior to August 5, 1935 and thence in a Southerly direction along said Center line to a point made by the intersection of said Center line and extension of the South boundary of this tract, and thence on a line bearing South 66 degrees. East to the place of beginning.'" The recommendation of the Street & Alley Committee that bids be taken for the installation of traffic signals at the intersections.of'First Avenue Southwest and Fourth Street; First Avenue Southwest and First S''treet; Second Avenue Southwest and Second Street and Second Avenue Southwest and First Street, was read and a motion was made by Davis, second by Helmkay, that the recommendatic be approved, all voted in favor of the motion except Alderman Brumm, who voted"nol The recommendation of the -Street & Alley Committee that the City Engineer be instructed to order widewalks constructed in the following locations was read and upon motion by Davis, second by Helmkay, the same -was approved: On the south side of 10 St. N.P. from 11 to 12 Avenue;. On the west side of g Ave. S.E. along side of Lots 7 and 10, Block 37, Morse and Sargent's Addition. On the .south hnd west sides of 6 St. N.W. from the end of the present sidewalk to 5th Street. On the north side of 9 St. N.E. from 13 Avenue, $ block east. .On the east side of 13 Ave. N.E. between 9 and 10 Streets where sidewalks are not now in.place. On both sides of 3rd Avenue N.E. from 14 to 15 Street. The recommendation of the Police Committee that one 1950 Deluxe Fordor Ford Sedan and one 1947 79A Fordor Fprd Sedan, now in service in the Police Department, be replaced .and that the City Advertise for bids was read and upon motion by Davis, second by Helmkay, the recommendation was approved. The recommendations of the Police Committee that Merlin Mewhorter, (Patrolman on the Police Department, who has been d6signated as temporary Desk Sargeant until such time as the vacancy can be filled, be compensated $15.00 per month.above Patrolman's pay, or the same rate presently, paid to regular Desk !Sargeants, and that the claim of Hyatt Frost, patrolman in the Rochester Police ,Department, in the amount of $150.00 for extraordinary services (while serving as Desk Sargeant for ten months) be paid, were''each read and upon motion by McPherson, second by Helmkay, the same were approved. The recommendation of the Police Committee that Joe L. McDermott, ,Juvenile Office of the Rochester Police Department, be allowed a monthly claim of $15.00 in payment for the -use of his car while engaged in his work, was read ,and upon motion by Leo Anderson,'second by McPherson, the same was approved, effective August 1, 1951. The recommendation of the Street & Alley Committee that bids be taken for the purchase of a new or used asphalt spreading and leveling machine for use in the Street Department was read and upon motion by Davis, second by Helmkay, the recommendation was approved. The following resolution adopted by the Public Utility Board was read and the same was ordered placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the Wm. H. Ziegler Company for the furnishing of a 60 cu.-ft. Air Compressor, in accordance with specifications; the -total amount of the said contract to be TWO THOUSAND ONE HUNDRED SEVENTY FIVE DOLLARS ($2175.00)and the said Wm. H. Ziegler Company being the lowest responsible bidder meeting specifications." The request of the Board of Park Commissioners for the installation of a light on the pole inside the entrance to Mayo Field was read and President Fryer referred the same to the Lighting Committee. The request of the •Board of Park Commissioners that the retaining wall on the north side of the river in Mayo Park be extended and that sidewalk be constructed to run the full length of the wall was read and the -same was -ordered 'iplaced pn file. Hunt City Attorney of City of Rochester Roghester, Minnesota Dear Mr. Hunt: This is to acknowledge receipt of your letter dated July 209 1951, concerning. the resolution for the decontrol of the City of Rochester, Minnesota, adopted by the Common Council. of the City on June lgth and vetoed by the Mayor on June 20th. You stated in your letter that the resolution is without legal effect inasmuch as the veto of the Mayor still stands. Your statement was based on an opinion by the -Attorney General fo the State of Minnesota. Since Section 204 (j) (3) of the Housing and Rent Act of 1947, as amended, requires that the decontrol resolution of the governing body of a community must be passed "in accordance with applicable local law", I shall not take any action, based on the resolution mentioned above, to remove rent control in the City of Rochester, Minnesota. A communication from the League of Minnesota Municipalities notifying the City of a 25% increase in dues for the -year beginning September 1, 1952 was read and President Fryer ordered that the same be placed on file'. A claim .in the amount of $15.65 for damages to a:. -car owned by Charles Hammond was read and upon motion by Davis, second by Brumm, the same was referred to the City Attorney. The Mayor's emergency order designating July 21, 22 and 23, 1951 as an emergency period and authorizing payment of overtime worked during those days was read and upon motion by Davis, second by Helmkay, the same was approved. The requestofthe Dia,bled American Veterans for permission to display a mobile exhibit in Rochester on August 23rd through August 26th'was read and upon motion by Davis, second by George Anderson, the request was granted, subject to supervision. of the location by the Chief of Police. The City Ingineer's preliminary estimates for the construction of a curb and gutter -on 13th Avenue Northeast from 9th to 14th Street Northeast -in the amount of $5,762.90; construction of a sanitary sewer and watermain in 9th Street N. E. from the end of the present sewer and watermain to 19th Avenue Northeast and on lgt$ Avenue Northeast in Miner's Heights in the amount of watermain - $4,2411.50 and sanitary sewer - $3,603.00; construction of a sanitary sewer and watermain in lgth Avenue Northeast from 9th Street N. A protest against the amending of the City Ordinance•regulat.ing the sale of liquor, which would permit dancing in "On Sale" establishments was read and President Fryer ordered same placed on file. A petition for the construction of a curb and gutter on both sides of i 31 Street Southeast between 14th and 15th Avenues Southeast was read and the j same was ordered placed on file until next year. A petition for the construction of a sidewalk on the south side of loth Street Northeast from llth to 12th Avenue Northeast was read. No action was taken on the petition. A petition for the construction of a sanitary sewer on llth Avenue Southeast from 12th to 13th Street Southeast was read and the same was referred to the Sewer Committee. A petition for the grading and surfacing of 5th Street Northeast from. 15th Avenue Northeast -to the east edge of Lot 10 in Janes Addition was read and the same was ordered placed on file until next year. A petition for the construction of a sanitary sewer on loth Avenue Southeast from 12th to lath Street Southeast was read and the same was referred I� to the Sewer Committee. 1 The following resolution adopted by the Commissioners of the Sinking Fund was read and upon motion by George Anderson, second by Helmkay, the same was approved and ordered placed on file: "Be it resolved by the Commissioners of the Sinking Fund of the City of Rochester, Minnesota: That the sum of $100,171.37 be and the said sum is hereby appropriated from the Sinking Fund of the City of Rochester, Minnesota, and ordered paid to the First National Bank of Rochester, Minnesota, for the purchase of $100,000.00 United States of America 1 7/8% Treasury Certificates of Indebtedness of Series B-1952, due July 1, 1952, together with premium in the amount of $140.63 and accrued interest in the amount of $30.74. The reports of the Clerk of Municipal Court for the week ended July 29, 1951 showing total criminal fines and costs collected $600.40 and civil fees received $1.65 and for the week ended August 4, 1951 showing total criminal fines and costs collected $1,109.00 and civil fees received $3.65, were each read and having•been approved by the City Attorney, President Fryer ordered that the same be plated on file. The application of Wesley Schoepf for license to sell cigarettes was read and upon motion by Amundsen, second by Helmkay, the license was granted. The application of Fuel Economy Engineering Company for a Hot Water and Steam Heating Contractors License was read.and upon`motion by Brumm, second by McPherson, the license was granted. The application of Thomas F. McGrand for a real estate,brokers license was read and upon motion by Davis, second by Brumm, the license ;was granted subject to the approval of the Real Estate Committee. The application of Wesley Schoepf for a license to sell soft drinks was read and upon motion by McPherson, second by Helmkay, the license was granted. The application of Carl`F. Peterson d/b/a/ Vets Cab Company for a taxi Cab License was read and upon motion by Brv:mm, second by Davis, the license was granted,, The license bond of Squires Electric Company in'the amount of $1,000.00 with the American Surety Company of New York as surety was read and upon motion by George Anderson, second by Helmkay, the bond was approved, the surety thereon accepted and it was ordered that the same be placed on file. .The two bonds of Carlisle G. Fras•er in the amounts of $5,749,95 and $15,034.45 with the United States Guarantee Company as surety were each read and the -same were referred to the Mayor for his approval. Upon motion by Davis, second by Leo Anderson, the City Assessor was authorized to spend an amount not to exceed $300.00 to make a survey of flood damage in the City. Alderman George Brumm again brought up the matter of adopting an ordinance which would regulate the maximumwe-ight of loads on thei streets of the City of Rochester. The matter had been previously referred to the Street & Alley Committee and the City Engineer but no ordinance had been prepared up to this date. Alderman Brumm al.so stated that numerous complaints in the,area of 7th Street Northwest about dust from the roadways and loading grounds of the Gamble Robinson and Chevrolet warehouses. The matter was.left in the hands of - the Aldermen from the 3rd Ward and the City Engineer to consult with the above companies in regard to dust prevention on tj.eir grounds. Alderman Davis referred to a copy of an ordinance regulating auction sales in the business district of the City which does not permit! the holding of a sale after 6:00 P. M. He also brought to the attention of the Council that the Chief of Police was not authorized by Ordinance to inspect pawn 'shops. Upon motion by Davis, second by McPherson, the City Attorney was instructed to amend the above mentioned ordinances so as to extend the hours for holding an auction sale and authorizing the Chief of Police to inspect pawn shops. Alderman Davis stated that their was a firm in Chicago- qualified to furnish.a schedule of salaries applicable to employees in the City offices.
