M., the j ii following members being present: President Fryer, Aldermen Leo Anderson, George Anderson, Davis, Helmkay and McPherson. Absent: Alderman Brumm. Upon motion by George-Anderson,.second by Davis, the minutes of the meeting J ' I I of August 20', 1951 were approved. President Fryer stated this as being -the time and place set for the i second hearing on the grading of 5th Avenue Southeast from 4th to 6th Street Southeast. Three -property owners were present at the hearing and opposed the project. President Fryer stated this as being the time and place set for the ,I first hearing on the grading and surfacing of 5th Street Northeast from 15th Avenue Northeast to the east side of Lot 10, Jane's Addition. There was no one present wishing to be heard. President Fryer stated this as being the time and place set for receiving and opening bids for regrading and surfacing of 14th Street Northeast from 3rd I to 13th Avenue Northeast. -The bid of Leon Joyce in the amount of $30,435.00 was received and opened. No action was taken at this time. I The bids of H &'H Electric Company in the amount of $8,500.00, Lehn Electric i Company in the amount of $9,615.00 and Kehne Electric Company in the amount • ,I of $10,997.00 were each received and opened. .The recommendation of the Police Committee, Street and Alley Committee, �i City and Engineer and Assistant Chief of Police that the bid of H & H Electric i Company in the amount of $9,500.00 for furnishing traffic signals be accepted, was read and upon motion by Helmkay, second by McPherson, the recommendation was approved. President Fryer stated this as being the time and place set for receiving and opening bids for the purchase of a building, or buildings, located on the North 57 feet of the South 122 feet of the Southwest Quarter of Block g0, CI 1 • 1 • 1 1 Original Plat. Sept ember . 4, 1951 1 C E CS) Q0 d 1 • 1 1 0 President Fryer stated this as being the time and place set for rec- eiving and opening bids for the purchase of a building, or buildings, located on the south 30 feet Of the Northwest quarter and the north 10 feet of the Southwest quarter of Block 90, Original Plat. No•bids were received. Upon motion by McPherson, second by Helmkay, the -City Clerk was instructed to re -advertise for bids for.the sale of the said buildings, bids to be received at 7:30 o'clock P. M. on September 17, 1951. The recommendation of the Lighting Committee that street lights be installed on 5th Avenue Southeast between 12th and 13th Streets Southeast, on 1st Avenue Southwest across from the Dale Burnham Motor Service and one behind the Cocd,Cola Plant was read and upon motion by Davis, second by Helmkay, the recommendation was approved. The recommendation of the Street & Alley Committee that sidewalks be ordered constructed in front of 1207, 1211, 1221, 1225 and 1229on Tenth Avenue Southeast was read and upon motion by Helmkay, second by George Anderson, the recommendation was approved. The recommendation of. the Board of Zoning that the petition to have lots 7 and 9, in Block 22, Northern Addition changed from a residential to a commercial zone be granted was read and upon motion by Davis, second by McPherson, the same was approved and the City Clerk was instructed to. publish a notice of hearing to be held on September 17, 1951 at 7:30 o'clock P. M., A communication from the.City Engineer stating that he,had taken up the matter of improving the North Broadway Railroad crossing in the City with Mr. E.R. Boyce of the Minnesota Highway Department, and that since it was necessary to secure further information as to serviceability and cost, the matter was being studied further by representatives of the Highway Department and the Railroad was read. Companys% President Fryer ordered the same placed on file. A letter transmitting five copies of agreement forms to cover maintenanc4' of T. H. 296 on 4th Street Southeast was read and.President Fryer ordered the same placed on file. Copies of the three following resolutions adopted by the Public Utility Board were each read and President Fryer ordered that the same be placed on file: "WHEREAS, funds in Cash in Banks - Water Department are not sufficient to finance refunds for WATERMAIN ASSESSMENTS currently being applied for, THEREFORE, be it and it is. hereby resolved by the Public Utility Board of the City of Rochester, Minnesota, that the Sinking Fund Commission of the said City bre and is hereby requested to transfer the amount of FIFTEEN THOUSAND DOLLARS ($15,000.00) from the Sinking Fund for Water Department Depreciaition Reserve - Not Invested to the Public Utility Fund - Cash in Banks for the purpose herein stipulated.;' "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the 530 Record of Official Proceedings of the Common Council of the City of Rochester,. Minn., September . 4; " 1s51 • said City be and is hereby requested to authorize the said Board to enter into a contract with the WESTINGHOUSE ELECTRIC CORPORATION for.the furnishing of a TURBINE NOZZLE BLOCK in accordance with specifications on file, the total amount of the said contract to be THREE THOUSAND ONE HUNDRED FIFTY FIVE DOLLARS ($3,155.00) and the said Westinghouse Electric Corporation being the only qualified bidder." "WHEREAS, on January 26th,1951 the Public Utility Board accepted proposals for the sale of the South 22 feet of Lot S, all of Lot 9 and the North 22 feet of Lot 10, Block 50, Original Plat of the City of Rochester, Minnesota, and WHEREAS, the proposal of the Smith -Sonnenberg Motors in the amount of TWENTY ONE" THOUSAND THREE HUNDRED DOLLARS ($21,300.00) was the highest received, the Public Utility Board, on Feburuary 13th 1951, accepted said proposal by resolution and asked the Common Council for authority to make said sale and to direct the City Attorney to execute a deed conveying said property to the Smith - Sonnenberg Motors, and WHEREAS, the Common Council on February 19th 1951, approved the sale of the said property and directed the execution of a deed, and WHEREAS, said deed was prepared and the Smith -Sonnenberg Motors were notified to that effect, and WHEREAS, payment for said property has not been received as of this date, THEREFORE, be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council be and is hereby requested to direct the City Attorney to start proceed- ings for the evicition of..the said Smith -Sonnenberg Motors from the said property, and BE IT AND IT IS HEREBY FURTHER RESOLVED by the Public Utility Board that the check in the amount of $2,200,00 be forfeited to the Public Utility Department for sustained damages." The request of the Rochester Fire Department Relief Association for approval of a loan to Frank Book in the amount of $2,300.00 on his property located at 18 - llth Street Northwest was read and upon motion by Leo Anderson, second by McPherson,• th.e same was approved, subject to favorable report of the Finance Committee. A notice from the League of Minnesota Municipalities of regional meetings to be held during the fall season was read and those interested in attending were requested to make reservations through the City Clerk. The following communication from the Department of Public Utilities was read and President*Fryer ordered that the same be placed on file: "The Honorable Mayor and Common Council, City of Rochester, Minnesota Gentlemen: The Public Utility Board has received a letter from the City Planning and Zoning Commission containing an inquiry as to whether or not funds are available to finance watermain extensions in the four lots and fifteen acres in Highland Addition in the event said properties are annexed to the City of Rochester. The Public Utility Board has direcred me to make the following reply concerning this and any other future proposed annexations to the City. During the past five years there have been watermain installations under the assessment plan, not including the'recent ones, in the amount of $217,989.27. In the same period of'time the Water Department has refunded the amount -of $147,457.23. There remains as a liability the amount of $100,709.35 which the Water Department is obliged to pay. The Water'Department is faced with a further expansion program in the matter of additional well supply and pumping equipment. The Public Utility Board, therefore,.wishes to inform you that no funds will be available for watermain installations on properties not now a part of the City of Rochester. Mayor Glenn Amundson Pres. Smith Fryer Members of the City Council Dear Sirs: It is'the purpose of this letter to advise you that in planning the city budget for 1952 that you set aside an allowgnce for a cost of living raise for each city employee, should the cost of living continue to raise, also any adjustments due to any changes in classifications in our respective departments. Street & Alley Dept. Health Dept. Park Dept. and Rochester City School employees. Thank you for your cooperation. Very truly yours, Members of City Employees Local #997 Robert Barclay, Pres. J. Kreps, Sec." A communication from the Mayo Memorial Association announcing the appointment of Mr. E. H. Schlitgus to represent their Board in all of its dealings with,all persons, concerns,!and organizations that are now engaged in any of the work of preparing the Mayo Memorial was read and President Fryer ordered the s%ame placed on file. A letter addressed to Mayor Glenn Amundsen from the Automatic Voting Machine'Corporation asking as to whether or not the Council is interested in $c kx8x=k t-r.ying out voting machines during 1952 and outlining their proposal for the installation of same on a trial basis was read and upon motion by Davis, second by Helmkay, the Mayor was instructed to notify Mr. Arvid Johnson, representative of the Automatic Voting Machine Corporation, that the Council would meet with him at a meeting of the Council to be held on September 17,.1951. The City Engineer's estimate of cost for the construction of a foot bridge over Bear Creek from llth Avenue Southeast to $latterly Park in the amount of $6,071.25 was read and President Fryer ordered that the same be placed on file. The request of the.Trinity Lutheran Church that a sidewalk be constructed on the east side of 6th Avenue Southwest between 4th•and 2n& Streets was read and upon motion by McPherson, second by Helmkay, the same was referred to the Street & Alley Committee. A petition for the construction of a curb and gutterion both sides of 4th Street Southeast f-x,om 11th to.16th Avenue Southeast was read and the same was ordered placed on file to be considered with -next years projects. The following communication fromthe Board of Park Commissioners was read: "Honorable Mayor and Members of the Common Council City of Rochester, Minnesota Gentlemen: At our Board meeting last evening me considered, and 532 Record of- Official Proceedings of the Common Council of the City of Rochester, Minn., September 4, 1951 • tabled, the request made by Mr. Newton Holland and referred to us by you that he be permitted to plant and maintain a tree in front of his location at 216 Firot Avenue S. W. If and when a tree ordinance is adopted by the city and we can base any decision we might make on its provisions, we shall be glad j to again consider Mr. Holland's request. Very truly yours, L. Benson, Secretary Board of Park Commissioners City of Rochester, Minnesota" President Fryer ordered the letter placed on file and the City Clerk'was Instructed to send a copy of the said letter td Mr. Holland. A communication from Mr. L. C. Horton requesting permission to operate a sound truck from 10:00 A. M. ` to 2:00 P. M. on Friday, September 7, 1951, for the purpose of notifying the people of Rochester about the Crusade for Freedom. i - - A motion was made by Davis, second by McPherson, approving the request and the City Clerk was instructed to nofity Mr. P', H. Gentling of the action taken by bhe Council. All voted in favor of the motion. G. Berens was present at the meeting and requested that parking of cars on 2nd Avenue Southwest between 1st and 2nd-Streets be banned. The matter was referred to the Chief of Police. The report of the City Weighmaster for the month of .August, 1951 showing fees collected for weights in the amount of $84-05 was read and President Fryer referred the -same to the Finance Committee. The reports of the Clerk of Municipal Court for the week ended August 25, 1951 showing total criminal fines and costs collected $831.21 and civil fees received $3.90 and for the week ended showing total criminal fines and costs collected $555.00 and civil fees received $6.Q0; were each read and • 1 • 1 • Record of Official Proceedings of the Common Council of.the.City of Rochester; Minn. Guinn and Campbell Hotel for license to sell cigarettes were each read and upon motion by George Anderson,, second by. Davis, the licenses were granted. The application of Harold F. Beilke for a Journeyman Electirician's License was read and upon motion by Davis, second by George Anderson, the license was granted. The applications of Campbell Hotel and. A. P. Barry for license to sell soft drinks were each read and upon motion by Davis, second by George Anderson, the licenses were granted. The application of Charles E. Nelson for a real estate brokers license was read and upon motion by Davis, second by Helmkay,.the license was granted subject to the approval of the Real Estate Committee. The application of A. Freeman for a Junk Dealers License was read and upon motion by George. Anderson, second by Helmkay, the license was granted. The license bond of A. -Freeman in the amount of $1,000.00 with the London & Lancashire Indemnity Company of America as surety was read and upon motion by.Davis, second by Helmkay, the.bond was approved, the surety trereon accepted and it was ordered that the same/be placed on file. The contract bonds of Blacktop Maintenance Company in'the amount of $3,555.00 with the Western Surety Company as surety and Leon Joyce in the amount of $9,391.50 with the Indemnity Insurance Company of North -America as surety were each read and the same were referred --to the Mayor for his approval. Mayor Glenn 0. Amundsen presented three letters addressed to him from the Rochester Automobile Club, the Rochester Chamber of Commerce and the Rochester and Olmsted County Safety Council recommending to the Common Council that a member of the Police Department of the City of Rochester attend a school for traffic control to be held at Northwestern University. Upon_ motion by Davis, second by Helmkay, the matter was referred to the Police Committee. Alderman Davis introduced a resolution accepting the bid of H & H Electric Company for furnishing traffic signals at the intersection of 1st Avenue S. W. and 4th Street; 1st Avenue S. W. and 1st Street; 2nd Avenue S. W. and 2nd Street and 2nd Avenue--S:. W. and lst Street, which was read. Upon motion -by George Anderson, second by Davis, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Davis introduced a resolution appropriating $1,878.99 from the P..I.R. Fund and ordering payment made to Carlisle G. Fraser, -which was read. Fund and ordering payment made to Carlisle G. Fraser, which was read. Upon motion by Davis, second by'Helmkay, that the said resolution be. adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Davis introduced a resolution appropriating $1,986.75 from the S & A Fund and $310.20 from the Sewer Fund and ordering payment made to Rochester Ready Mix - $41._1.40; Blacktop Maintenance Co.-"$338.72; Clarence J. McDonald - $251.57; United Steel Co. $444.94; Gopher Stamp & Die Co. - $611.02 and Fullerton Lumber Co. - $239.40, which was read. Upon motion by Helmkay, second by McPherson, that the said resolution be adopted as read,, and all voting in favor thereof, President Fryr declared the said resolution duly passed and adopted. Alderman McPherson introduced a. resolution appropriating $14, 776.61 from the Park Improvement Fund and $337.83 from the Lighting Fund and ordering payment made to City of Rochester, public Utilities - $2,391.56; Mumford Service - $449.00; auarve & Anderson - $225.00; Elk's Club -. .$270.00; Kruse Company - $725.39; Veter J. Brown $404,49; Olson Equipment Company - -$8,655.00 and Squires Elecbric Company - $1,995.00, which was read. Upon motion by McPherson, second -by George Anderson, that the said resolution be adopted as read,.and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman McPherson introduced a resolution appropriating $29,328.80 from the Sewer Fund and ordering payment made to the Sinking Fund of the City -of Rochester, which was read. Williams Estate Fund: Thiem Signs, $4.50, Upon motion by Davis, second by McPherson, the City Clerk was instructed to present a resolution at the meeting of September 17, 1951 authorizing the Chief of Police to change the plates on parking meters designating Monday night instead of Friday night as the evening when stores will be open and the meters in operatiox The matter of the Attorney General's ruling wherein it was stated that the President of the Council could only vote in case of a tie and could not vote when matters where a 5/7 vote is designated by the City Charter wasagain discussed. This ruling does not permit the President of th.e Council to vote on a motion to override a veto by the Mayor. A committee of members of the Common Council recently called at the Attorney General's office. The conference the Committee had had with the Attorney General was reported by Alderman Davis, who stated that it was his impression that the Attorney General did not intend to reverse his ruling which was based on a previous ruling from that office issued in 1929. It was agreed by the members of the Council that the matter should be cleared up one way or the other. Any interested Rochester tax payer could take the matter into the District Court for that purpose.
