Minutes of a regular meeting of the Common Council, of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said .
City on November 5, 1951.
President.Fryer called the meeting to order at 2:00 o'clock P. M., the
following members being present: President Fryer, Aldermen Leo Anderson, George

Anderson, Brumm, Davis, Helmkay and McPherson. Absent: None.
Upon motion b Helmka P y y, second by Leo Anderson, the minutes of the
meeting of October 22,_ 1951 were, approved.
President Fryer stated this as being the time and place set for a
hearing on the levying of special assessments for the, construction of a §anitary
sewer and watermain in Peck's Second Addition. There was no one -present wishing
to be heard.
President Fryer stated this as being the time and place set for a
hearing on the levying of special assessments for the construction.of a sanitary
sewer and watermain in 7th Avenue Northwest from 16th Street Northwest to 100 -Lot:
North. There was no one present wishing to be heard.
President Fryer stated this.as being the time and place set for a
hearing on the levying of special assessments for the construction of a sanitary
sewer and watermain in 9th Street Northeast from the present sewer to 19th Avenue
Northeast and on lgth Avenue Northeast in Miner's Heights. There was no one
present. wishing 'to be heard.
President Fryer stated this as being the time and place set for a
hearing on the levying of special assessments for the construction of a sanitary
sewer and watermain in 18th Avenue Northeast from 9th Street Northeast to the
south line of Ifestlund ,Sub -Division. There was no dn,e present wishing to be heard,
President Fryer .stated this as being the time and place set for a
hearing on the levying of special assessments for the construction of a curb and
gutter on 9th Avenue Northwest from 14th Street Northwest, north in Pahama Court.
There was no one present wishing to be heard.
President Fryer stated this as being the time and place set for.a
hearing on the levying of special assessments for the construction of a curb and
gutter on 5th Avenue Northwest from lst to 4th Street Northwest. There was no.one
present wishing to be heard.
President Fryer stated this as being the time and place set for .a
hearing on the levying of special assessments for the construction -of the widening
of 3rd Avenue Southeast from 4th'to 5th Street Southeast. There was no one
present wishing to be heard.
President Fryer stated this 'as 'b,eing the time and, place set for ree-
eiving and opening bids for the furnishing and installing of a public address

system in the Council Chambers in the City Hall. The bids of Kirkwood Ra-Tel,
Inc. in the amount of $1, 434.00 and Orville B. Cooper in the amount of $1, 552.00

were each received and opened. President Fryer referred same to the Council as a
Committee of the whole. ofthe Council's
A lderman Davis, Chairman of the Purchasing Committee, made a verbal report/
recommendation that the public address system be purchased from Kirkwood Ra-Tel,
Inc., the said Kirkwood Ra-Tel, Inc. being the lowest responsible bidder and if
necessary two additional.speakers be purchased im addition to those covered by
contract. Upon motion by Davis, second.by Brumm, the recommendation was approved.
A group of citizens from the Jefferson P.T.A. were present at the meeting
and inquired as to why traffic signs had not been installed as requested at a
jj previous meeting. It was explained.to the group that signs to be used in that
locality were not carried in stock by the City and had to be ordered,•however, an
order had been placed for the signs and they would be installed as soon as they
were available. A motion was made by Leo Anderson, second by Brumm, that the Chief
of Police be instructed to delegate two officers from the Police Department to
work extra on their off duty time, to patrol the streets at the Jefferson School
building. All voted in favor of. the motion.
The recommendation of the Sewer Committee and the City Engineer that bid;
be taken for the construction of a building for a gas metering station, to be
located at 132 Street and Second Avenue Northwest was read and upon motion by
Helmkay, second by Brumm, the recommendation was approved.
The recommendation of the Public Grounds Committee and the City Engineer
that bids be taken for installing a 11 inch Gas Line from the Sewage Treatment Plart
Line to the Street & Alley Warehouse was read and upon motion by Leo Anderson,
second by George Anderson, the recommendation.was approved.
The recommendation of the Street & Alley Committee that the request of

the Highway Department that angle parking between �Fth and 6th Streets on South

Broadway be changed to parallel parking be granted was read and upon motion by
McPherson, second by Helmkay, the recommendation was approved.
The recommendation of the Board of Zoning that the petition of
Elizabeth quammen, Gladys Pager and Raechel Hendricks to have Lotsll and 12,
in Block 34, of the Original Plat changed from a multiple dwelling zone to a
commercial zone be granted was read and upon motion by -Leo Anderson, mecond by
Helmkay, the recommendation was approved and the City Clerk was instructed to
advertise a public hearing to be held at 7:30 o'clock P. M. on November 26, 1951.
The recommendation of the Lighting Committee that a street light be
installed in the middle of the 1200 block on 6th Avenue Southeast was read and
upon motion by Helmkay, second by Brumm, the recommendation was approved.

A communication from Mr. C. F. Olson, of 215 Fifth Street' Southeast,
protesting an assessment;f•or the widening of 3rd Avenue Southeast between 4th
and 5th Streets was read and President Fryer ordered the same placed on file.
A fetter from the Bach Music Company recommending other equipment for
that
a public address system'in the Council Chambers other than listed in the
specifications and that the. work be let on a cost plus basis was read and the
same was ordered placed on file.
The request of Mr. Zd. E. Just for permission to install a special
meter to meter the water from his air'conditioning system and two water cooled
refrigerating machines was read and upon motion by Brumm, second by Helmkay, the
same was referred to the Sewer Committee and the City Engineer.
A communication from Mr. M. L. Priebe requesting a connection with the
City sewer system to serve the Vilest Side 11661, Cafe' at the junction of Highways
14 and 52 and stating that he is willing to pay double the regular rate'as set
by ordinance was read and President_ Fryer ordered the same placed on file for
future reference. -
A claim by.'Dr.-and Mrs. Casimir A. Domzalski for damage claimed in the
amount of $57.00 to their 1951 Studebaker two door sedan was read. The said
claim had been previously reported to the insurance company carrying the
insurance on the truck.bearing license No. 7043 and operated by the Park
Department, which Dr. Domzalski claimed was involved in the accident to their cax
The request of the Board' of Public Health & Vielfare for permission to
employ Miss Nancy Donaldson as a records clerk at a salary of $150.00 per month,
effective November 1, 1951,' to replace Mrs. .Kathleen Barry, was read and upon
motion by Davis, second by Brumm, the request was granted.
A quit claim deed given by the City of Rochester to Amos W. Seymour. and
Anna'W. Seymour was read and upon motion by Leo Anderson, second by McPherson,
the same was approved and the Mayor and City Clerk were, instructed to execute
the same. -
The following resolution adopted by the Public Utility Board was read
read -and the same was ordered placed on file:
"Bb it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota, that the Common
Council of the said City be and is hereby requested to
authorize the said Board to enter into a_ contract with the
Prat -Daniel Corporation for the furnishing of ONE DUST
COLLECTOR, the total amount of the said contract to be
THIRTEEN THOUSAND FIFTY-ONE DOLLARS ($13,051.00)".
A petition for the installation of street lights in Peck's First
Addition was read and upon motion by Davis, second by Leo Anderson, the matter
was referred to the Lighting Committee with power to act.- +
The following petition signed. by 117 residents in Southeast Rochester

was read and President Fryer referred th.e matter to the Police Committee to meet

with a representative of the Rochester Bus Lines, Inc.:
"We, the undersigned, all being residents of Rochester,
Minnesota do petition the Rochester Bus Line, Inc. to extend
your route on 4th Street S. E. Rochester from lltr Avenue
so as to include a schedule giving service to those living
South of 4th Street and in Homestead Addition. And, we
'I further agree to patronize the same, if this route is
established. u .
A letter from Mr. Fred Zimmerman requesting that he be transferred from
the Street & Alley Maintenance Department to the Dumping Grounds was read and
upon motion by Davis, second by McPherson, the same was referred to the Street &

Alley Committee,and the City Engineer. II
The request of the City Engineer for permission to employ Fred Lidtke
as rodman at a aDlary of $250.00 per month, effective November 1, 1951 was read
it
and upon motion by McPherson, second by Leo Anderson, the said request was
approved.
The report of the City Weighmaster for the month of October, 1951
showing fees collected for loads weighed in the amount of $107.60 was read and
President Fryer referred the same to the Finance Committee. �I
The reports for the month of October, 1951 of the Building Inspector
showing fees collected for building permits issued in the amount of $617.00; of
the Electrical Inspector showing fees collected for electrical permits issued
in the amount of $63.25; of the Plumbing Inspector showing fees .col,lected for
plumbing permits issued in the amount of $314.50'; of the Heating Inspector
showing fees collected for heating permits issued in the amount of $239.25 and

fees collected for sign permits in the amount of $24.70, were each read and
President Fryer referred the same to the Finance Committee.
The Health Officer's Lockup Inspection Report was,read and the same
was ordered placed on file.
The reports of the Clerk of the Municipal Court for the week ended
October 27, 1951 showing total criminal fines and costs collected $635.53 and
civil fees received $7.70 and for the week ended November 3, 1951 whowing
total criminal fines and costs collected $595• 90 and civil fees received $8.00,,
were each read and having been approved by the City Attorney, President Fryer
!i ordered that the same be placed on file'.
The report of revenue and expenditures in the Park Improvement Fund

for the month of October, 1951 was read and the same was ordered placed on file.
The applications of John Arthur McGrath and Charles-Vt. Pappas for a
license to sell cigarettes ware each read and upon motion by Brumm, second by
Leo Anderson, the licenses were granted.

The applications of Art Iverson, Halvor K. Fodness, Frank E. Ryan, Paul)
Klipsie and Gustave F. Kuhn for a Journeyman Warm Aii Heating, Ventilating and
Air -Conditioning Worker's License were :each read and upon motion by Brumm,
second by Helmkay, the licenses were granted.
The application of Spencer Ait ,Conditioning, for a Hot'. Air Heating, Air
Conditioning and Ventilating Contractors License was read and upon motion by
Leo Anderson, second by George Anderson, the license wqs granted.
A letter from Air. Louis S. Bozikowski stating that he wished to apply
for an "Off Sale" Liquor License was read and President Fryer ordered the same

placed on file as the xxtuml, number of "Off Sale" liquor licenses in the City of
Rochester has -already been. granted.
The surety bond of H 8& H Electric Company in the amount of $2,400.00
with the Western Surety Company as surety was read and the same'was referred to
the Mayor for his approval.
Alderman George Anderson introduced a resolution accepting the bid of
Kirkwood Ra-Tel, Inc. for installation_ of a Public,Address System in the Council
Chambers in the City Hall, which was read.
Upon motion by Leo Anderson, second by George Anderson, that the said
resolution be adopted as read, and all voting in favor thereof ,'President Fryer
declared the said resolution duly passed and adopted.
Alderman George Anderson introduced a resolution levying special
assessments for the construction of a sanitary sewer on 7th Avenue Northwest from
16th Street Northwest. to 100 feet North, which was read.
Upon motion by George Anderson, second by Brumm,.that 'the said resolutio
be adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman George Anderson introduced a resolution levying special'assess-
ments for the construction of a curb and gutter in Pahama Court, which was read.
Upon motion by Brumm, second by Davis, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman George Anderson introduced a resolution levying special assess-
ments for the construction of a sanitary -sewer and watermain in 9th Street N. E_
from the present sewer to 19th Avenue N. E. and on isth Avenue N E. in Block 4,
Miner's Heights, which was read.
Upon motion by Davis, second by Helmkay, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.

Alderman Brumm introduced a resolution levying special assessments for
the construction of a sanitary sewer and x!atermain in lgth Avenue Northeast from
9th Street Northeast to the South line of Westlund's Sub -Division, which was read.
Upon•motion by Leo Anderson, second by George Anderson,.that the said
resolution be adopted as read, and all voting in favor thereof, President Fryer
declared the said resolution duly passed and adopted.
Alderman Brumm introduced a resolution levying special assessments for

Second Addition, which was read.

Alderman Davis introduced a.resolution ordering bids for construction

Alderman Davis introduced a resolution ordering bids for installation
of a. 1.1 inch gas line from the Sewage Treatment Plant to the St°reet & Alley
Warehouse, which was read.
Upon motion by,McPherson, second by Leo Anderson, that the said
resolution be adopted as read, and all voting in favor thereof, President Fryer
declared the said,resolution duly passed and adopted.
Alderman Davis introduced a resolution appropriating $57,696.97 from
the General Fund and $14, 731.97 from the Sewer Fund and orddring payment made
to S.treet & Alley Fund - $23, 799- 97; Park Improvement Fund - $9„ 900.,00.; Street &
Alley Fund, $9,900.00; Sewer Fund - $19200.00; Fire Protection Fund - $12,900.00

Alderman McPherson introduced a resolution appropriating $12,611.94
fromthe Sewer Fund and ordering payment made to Carlisle G. Fraser, which was

from the S.D.P. Fund and ordering payment made to Carlisle G. • Fraser, • which was

Upon motion by Brumm, second by Davis, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman McPherson introduced a resolution appropriating $67,607.71
from the S.D.P. Fund and ordering payment made to Feller.and Pagenhart, which
was read.
Upon motion by Davis, second by Helmkay, that the said resolution be
(!adopted as read, and all voting in favor thereof, President Fryer declared the
said resolution duly passed and adopted.
Alderman McPherson introduced a resolution appropriating $6,039.99
from the S.D.P. Fund and ordering payment made to Carlisle G. Fraser, which
was read.

Upon motion by McPherson, second.by Leo Anderson, that the said resolu-

Alderman Leo Anderson introduced a resolution appropriating $919.95 from
the General Fund, $10.75 from the Sewer Fund, $3.45 from the Parking Meter Fund
and $520.66 from -the Street & Alley Fund and ordering payment made to N. W. Bell
Telephone Co. - $273.67; Whiting Press, Inc. - $200'.90; Rochester Sand & Gravel -
$540.24 and Olmsted County Highway Department - $434.o0, which was read.
Upon motion by George Anderson, second by Brumm, that the said resolu-
tion be adopted as read, and all voting in favor thereof, President Fryer declared
the said resolution duly passed and adopted.
Alderman Leo Anderson introduced a resolution appropriating $363.55 froml,
the General Fund and: ordering payment made to Minnesota Box & Lumber Company, whicl
was read.
Upon motion by Brumm, second by Davis, that the said resolution be
adopted as read, and all voting in favor thereof, President Fryer declared the
said.resolution duly passed and adopted.

The matter of closing on November 12, the day following Armistice Day,
which had been previously referred to the City Attorney was again discussed. City
Attorney Hunt stated that the 12th was not a legal holiday and that all City
business could be conducted on the said -date. A mot.ibn was made by Alderman
Brumm, second by Alderman McPherson, that City offices and departments be not
closed on Monday, November 12, 1951.
The unpaid claims of the janitors for services'in the community room in
the City Hall for the month of August was discussed further and upon motion by
George Anderson, second by McPherson, the said bills were ordered paid.
A letter from Mr. George Pallister stating that.there was a hole in the
alley at -the rear of his residence at 112 - 16th Avenue Southwest and also that
there was a low spot in 16th Avenue Southwest in front of his place which should
be filled to prevent mud and water from splashing on his house as cars and trucks
pass was read and Pres.ident Fryer referred the matter to the S &'A Committee and
the City Engineer.
