Anderson, Geo, J# Anderson, Brumm, Davis, Helmkay and McPherson. Absent-- None. Upon motion by George Anderson, second by Helmkay, the minutes of the meeting of --December 17, 1951 were approved. Mrs. Walter Fuchs of Douglas,. Minnesota,was before the Council -and 1 ! Istated that she had been injured from a fall while crossing lst Street S.E. from iiFenney's Store to Montgomery Ward, the accident happened on October-1, 19510 ,iShe further stated that she had reported the accident -to -the manager of Montgomery, Ward Company and when the crossing was investigated a piece of steel was -found. which she claimed -had tripped her while crossing the -'street. Upon motion by Leo Anderson, second by McPherson, her verbal claim was referred to the Street & Alley Committee, the City Engineer and the City Attorney for investi-gation. Those. interested in the matter of.parking automobiles on South Broadway between 4t.h and .6th. Streets were again heard. Mr. Robert Woodhouse spoke first '!on the matter and urged that angle parking be.continued. Others present who were in business I.n that locality also asked that parking be.not changed to parall'el, After hearing those pr-ese,nt and before action was taken on the matter �Alderman Davis asked that he be, permitted to.abstain-from voting because he operate.9 a. busin,ess on Broadway between 4th and 3rd Streets. A motion was made * by Helmkay, second bv Leo, Anderson, that action be deferred at this time on the i agreement and the City Engineer and, City. Clerk were instructed to writ,e the 'Minnesota State Highway Department requesting-permissAon to install traffic* �signals at the Intersection of Broadway Street North and 7th-Street, the entire cost to be paid by the City, and to also ask.for an agreement for the ,installation of signals as were previously listed in the first agreement with- �'the exception of traffic signals at 9th Street and Broadway Southeast, 6th .Street and Broadway South and 7th.Street and Broadway North. All present voting on the matter voted In favor of.the motion, Mr. Basil Thompson was again before the Council and asked what action had been taken in regard to setting asidea parking place for his store :'located in the Carlton Hotel. No action was taken granting his request. Representatives of the various Sign Construction Companies in the City of Rochester Inquired abou� placing signs on the sidewalks similar to ��the one which had been erected in front of the Light House Cafe. " We further recommend that when any of this equip-, ment-or any City labor be used on private work a sur charge of 10 per cent be added to the regular rates to cover the cost of overhead. City Engineer" The recommendation of the Bower Committee that bids be taken on January 21, 1952 for the construction of a storm sewer on 15th Avenue Northeast from Silver Creek to the SOuth,l*ight-of-way line of the Chicago & . North Western Railway was -read and upon motion,by Davis, second by Helmkay. the same 'was approved, The following recommendation of the Sewer Committee was read and Apon motion by Brumm, second by Helmkay, the recommendation was approved: December 28, 1951 "Honorable Mayor & Common Council Of the City of Rochester, Minn. Gentlemen: 'The Just Rite Market has made application for permission to dispose of clear water into the sanitary sewer. It appear' to be unreisonable for the said property to make a' connections to the storm sewer. Therefore we, the undersigned members of the Sewer Committee, recommend.that the J ' not Rite Market at 2 - 11 - 6th Avenue S.W. be granted permission to discharge clear water into the sanitary sewer with the following stipul - ations: 1. A, meter shall be installed at the owner's expense tomeasure the volume of such clear water. 2. The sewer service charge for this clear water, as measured by the above mentioned meter, shall be at the rate-offive (5) cents per 100 cubic feet. 3. The regular sewer service charge shall apply to all other waters contributed to the -sanitary sewer In accordance with Ordinance #T25- Respectfully, SEWER COMMITTEE Raymond F. M. The.recommendation of the Board of the Zoning that the petition of Poster Blectric*Company to have Lots 1,:2 and 3, Block 3, Cook's Sub -Division changed from a residential to an industrial zone be granted was read and upon motion by Davis, second by McPherson, the recommendation was accepted and a hearing was ordered for January 21, 1952 at 7:30 o'clock P. M. An authorization by Toltz, King & Day, Inc. issued to Feller & Pagenhart, Contractors, for labor and material for furnishing and installing four 90 Burt Standard Galvanized Roof Ventilators. two ventilators to be installed on each digester 0 $24o.00 was read and upon motion by Leo Anderson, second by Brumm, the extra order was approved. A letter from the League.of Minnesota Municipalities transmitting � material and program for certification of water and -sewage works operators was read and President Pryor referred thecommunication to the Sewer Committee and the City Engineer. The request of T. E, Dieter to be considered an applicant for' an "off sale" intoxicating liquor license when and if they become available was read. President Fryer explained that the present ordinance did not provide for the issuance of any more noff saleu intoxicating liquor licenses. A motion was made by Davis, second by Helmkay, that the Council go on record of not being presently in favor of issuing additional "off sale" intoxicating liquor licenses. All voted In favor of the motion except Alderman Brumm, who voted "no". The following opinion by the Attorney General was read and President Fryer ordered same placed on file: December.18, 1951 "Mr. Desmond B. Hunt City Attotney Rochester, Minnesota Dear Mr. Hunt: In your letter of December 10, addressed to the Attorney Gendral, you state as FACTS "On June 7th, 195"G. one Wme, D. Lowery and Ridhd B. Smith caused the said town (Rochester) to be.surveyed and platted, and I quote, 'Rochester, Olmsted Co. M.T. June 7th, 1956. We the undersigned Proprietors of the Town of Rochester situated on the South East * of See. 35 Township 107 Range 14 do hereby certify that -we caused the said Town to be surveyed and platted; and that Streets Alleys &a are set apart for public use, .as specified u-pon the within Plat. Wm. D. Lowery. Richd.B, Smith by Geo. S. Harris, his Atty..in fact.' "This plat-oonsisted of approximately si.* blocks one block being set aside as a 'public equaret.,Today It is known as 'Central Park'. Q,UESTIONS "Can the City of Rochester use any part of the public square for the parking of automobilool, either with or without charge? . . nOan the City of Rochester make use of this public square as a place to park�automobiles, either with or'without charge? An appeal from the application of the provisions of Ordinance No.. 621 of the'City of Rochester by the Building Inspector in refusing to permit the -use of Lot 25, Block 25. Northern Additibn to the City of Roch-ester'for business purposes Othek;.than the restaurant, tavern, second hand, automobile repairing or manufacturing businesst under the.authority of Section lo(k) of said Ordinance was read together with a petition asking that the Common Council' give favorable consideration to the appeal of Carl Ro Gray, Jr., Administrator of Veterans Affairs, and upon motion by Brummo second by Helmkay, the matter was re'fe . rred to the Board of Zoning and the City Attorney, After considering the matter further a motion was made by McPherson second by Helmkay, that if the recommendation'of'the Board of Zoning on the above petition was favorable, the Building Inspector be authoriied to issue a permit as requested In the appeal and petition, All voted in favor -.of the motion. The reports of the Clerk of the -Mu-nicipal Court for the week ended December 22, 1951 showing total criminal fines and costs collected $772.00 and civil fees received $3.40; for the week ended December 29, 1951 showing total criminal fines and costs collected $510-37 and civil fees rec,eived $4-70; and for the week ended January 5. 1952 showing total criminal fines and costs collected $916.00 and civil fees received $2.60, were each read and having been approved by the City Attorney, President Fryer ordered that the same be placed on file. The application of Ray H, Nordby for license to sell non -intoxicating malt liquors was read and upon motion by Brumm, second by Davis, the license was granted. The applications for license to sell cigarettes of Roy H. Nordby and William Penske and Patricia quandt were each read and upon motion by Davis, second by Helmkay, the licenses were granted. The applications for license to sell soft drinks of Roy H. Nordby and William Penske and Patricia Quandt were each read and upon motion by Davis, second by Helmkay, the licenses were granted* The application of Service Cab Company for transfer of taxicab license No. 12 to a 1940 Cadillac Town Sedan was read and upon motion by Leo Anderson, second by Brumm, the transfer was granted subject to the approval of the Chief of Police. The license bonds of T. H. Johansen (1) and Elmer 0. Johnson (3) each :in the amount of $1,000,00 with the Aetna Casualty and Surety Company as surety ,were each read and upon -motion by Brumm, second by Helmkay, the bonds were ,approved, the surety thereon accepted and the same were ordered placed on file, The contract bonds of Alvin E. Ben Ike in the amount of $10.736.00 and Dodge Lumber & Fuel Company in the amount of $1,200.00 each with the Continental Casualty Company as surety were each read and the same were referred to the Mayor for his approval.
