Common Council of the City of Rochester, Minnesota, held in the Council. Chambers, in the City Hall in said City, on February 4, 1952. President Fryer called the meeting to order at 2:00 o'clock P.M., the following members being present: President Fryer, Aldermen Leo C',Anderson, Brumm, Davis, Helmkay and McPherson. A bsent: Alderman George Anderson, due to illness. Upon motion by Helmkay., second by Davis, the minutes of the meeting of January 21, 1952 were approved. Mr. Wm. Buss was resent at the meeting and P. g presented a bill for watermain assessments °and interest, in the amount of $142.29, on iota 16 and 17, Block 13, of Manley's Addition. Upon motion by Davis, second by Leo Anderson, the matter was referred to the.Public Utility Board. Mr. Stanley F. Drips, Civil Defense Director,.was present at the meeting and stated that Federal funds were available to match state and local funds for the purchase of equipment in. connection with civil defense. He requested that the City approve the purchase of a projector, 1000 pamphlets entitled "This is Civil Defense" and amateur mobile equipment for communication training and that action be taken to, obligate the City for their share. A motion was made by McPherson, second by Helmkay, that the purchase of the said equipment be approved and that the City appropriate its share of tha-cost. All voted in favor of the motion, except Alderman Brumm who voted ".no". The following recommendation of the Sewer Committee was read and upon motion by Brumm, seco nd.by Leo Anderson, the recommendation was; approved: "Honorable Mayor and Common -Council Of the City of Rochester, Minn. Gentlement The request of Robert Gill fora reduction in the sewer assessment for Lot 39, Peck's Second Addition was referred to the Sewer Committee. Because of the unusual shape and other peculiar conditions affecting this lot, we, the undersigned membersofthe Sewer Committee, recommend that the assessment. be reduced from $257.39 to $202.50. Since the assessment has already been made, we suggest that the assessment be left as is on the books and the sum of $54. sg be paid Mr. Gill out of the Sewer Fund.' Mayor & Common Council City of Rochester, Minnesota Gentlemen: The request of Mr. A.L. Blackburn to construct a sanitary sewer in Fifth Street Southeast between Fourth and Fifth 664 Record of Official Proceedings of the Common Council of the City of Rochester, Minn. February 4, 19,52 Avenues and to grade a portion of Fifth Street and of Fifth Avenue " has been referred to the Sewer Committee, Street and Alley Committee and City E ngineer. II A meeting was held Monday morning, January 28, 1952, in the City Clerk's Conference Room, of the above -named committees and li the parties interested in the improvements. At the conclusion of the meeting, it was decided to circulate a petition for the construction of sewer and water and the surfacing and grading in Fifth Street Southeast from Fourth Avenue to Fifth Avenue and in Fifth Avenue from Fifth Street to Sixth Street Southeast. j! Monson, City Engineer" I� I The recommendation of the Police Committee and the Chief of Police that the cab stand arrangement on First Avenue North West near the Chicago and Northwestern tracks be as follows, was read: "Starting on the East side of First Avenue nearest the tracks as follows: Yellow, Vets, Service, Yellow, Yellow, Yellow, Yellow. On the West side of First Avenue starting nearest the tracks: McGoon, Yellow, Vets, Service and Yellow. The question of granting a stand to the Vets' Cab Company on First Street Southwest near Hargeaheimer's restaurant is being studied and no recommendation will be made at this time." Upon motion by Helmkay, second by McPherson, the recommendation of the Police i l Committee and the Chief of Police was approved. Mr. Carl F. Peterson, of the Vets Cab Company, again requested that j a taxicab stand be authorized on lst Street Southwest, west of Broadway and east of the alley. Upon motion by Leo Anderson, second by Helmkay, his request was referred to the Police Committee and the Chief of Police, with power to act. However, they were requested to contact Dr. C. Holland before authorizing the I taxi stand. �I The three following resolutions adopted by the Public Utility Board were each read and President Fryer ordered that the same be placed on file: ! • "Be it and it,is hereby resolved by the Public Utility Board of the,City of Rochester, Minnesota that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the MINNEAPOLIS HONEYWELL REGULATOR COMPANY for the furnishing, in accordance with specifications, of ONE EIGHT POINT STRIP CHART POTENTIOMETER, the total amount of the said contract to be ELEVEN HUNDRED SIXTY e said FOUR DOLLARS AND TWENTY-FIVE CENTS ($1,16 .25) and the Minneapolis Honeywell Regulator being the lowest responsible bidder." The application of Mr. A. L. Campion for appointment to the office of Weed Inspector for the City of Rochester was read and President.Fryer referred his application to the Mayor. A copy of an order suspending changes in rates and services issued by the Federal Power Commission in the matter of the Northern Natural Gas Company was read. and President Fryer ordered the same placed on file. A communication from the Rochester Public Schools stating that a locatio: in each building had been worked out for the storage of voting machines was read and the same was ordered placed on file. A communication from the,Automatic Voting Machine Company calling the City's attention to Section 209.15 relative to the appointment of a custodian of voting, machines was read. The appointment of Mr. Ivan Boyd to act as custodian of the machines was considered bpt action on the matter -of his appointment and salary in connection with same.was postponed until the next meeting.' The request of the Lincoln School P. T.A. to hold a bingo game at their carnival to be held in the school building on February 29, 1952 was read and the same was ordered placed .on file. The following letter from the State of Minnesota. Department of Highways, was read: "The Common Council City of Rochester, Minnesota Attn. Mr. F. R. Finch, Clerk Re: Traffic Control Signals on Gentlemen; Broadway - Rochester Since receipt of a letter of January 21 from Mr. Monson, City Engineer, I had an opportunity to discuss with him the matter of the proposed traffic signal installations in Rochester and in particular the questions which were asked in his letter relative to possible changes in the originally proposed plan for signal- ieation. The matter was discussed at length with_Mr. Monson and I believe he has full information as to our recommendations in the matter. We might repeat,'however, the information included in my letter of December loth, that I do not feel that further signalization is warranted at locations on Broadway unless steps are taken to at least make a start in the change -over from angle to parallel parking on this important and already congested street. Monson, City Engineer, was read: "Honorable Mayor & Common Council Of the City of Rochester, Minn. Gentlemen: Mr. J. D. F. February 4, 1952 • Department of Highways, paid a personal visit to my office on Thursday. January 24, 1952, in response to my letter to him relative to traffic signals. In this letter I had asked him two questions:. 1. Would the State participate in the installation of signals on the Beltline, as outlined in our agreement, if signals on Broadway at 7th Street North, 6th Street South, and 91 Street South were omitted from consideration? 2. Would the State participate•in the installation of signals on the Beltline and at North Broadway and 7th Street if the other two intersections were omitted? Mr. Darrell pointed out that his opinidn as stated in a previous letter would still apply, and that he would not recommend to the Commissioner the approval of any more.signals on Broadway until steps were taken to begin the elimination of angle parking on Broadway. His answer to the questions is that the state will undoubtedly enter into a new agreement for signals on the Beltline and leave out those on Broadway (except the South junction) but will not consider any more signals on Broadway as long as angle parking is permitted. Respectfully submitted, RALPH E. MONSON" A motion was made by Brumm, second by McPherson,instructing the City Clerk to prepare a resolution ordering bids for the installation of used traffic signals at the intersection of North Broadway and 7th Street. All present voted in favor of the motion. A motion we,s made by McPherson, second by Brumm, instructiong the City 'Engineer to request the State, o,f Minnesota. Department of Highways to proceed with the installation of the traffic signals at the intersection of Highway No. 52 and 14 at 2nd Street Southwest; Highway No. 63 and 14 on South Broadway; and the Junction of 14 and 52 Southeast as proposed in the original agreement submitted to the City. Fifteen of the following requests signed by property owners in that area were read and ordered placed on file: "TO THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINNESOTA The undersigned, having heretofore signed a petition in favor of the annexation of Highland Addition by the City of Ro,cheater, hereby respectfully requests that my name be withdrawn from the petition in favor of said annexation, and you are respectfully notified that I hereby protest said annexation by the City off Rochester and signify my opposition to the taking into the City of Rochester of said Highland Addition. Dated this 29th day of January, 1952. 1', The following petition signed by 30 residents in the area of Highland Addition was read and ordered placed on file: "TO THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINNESOTA: The undersigned, having signed no petition for or against the annexation`of Highland Addition to the City of Rochester, hereby respectfully protest ouch annexation and request that said Highland Addition be not taken into the City of Rochester. Dated this 29th day of January, 1952." The undersigned, having signed no petition for or against the annexation of Hillcrest Addition to the City of Rochester, hereby respectfully protest such annexation and request that said Hillcrest !Addition be not taken into the City of Rochester. Dated this 29th day of January, 1952.4 Communications from John H. Campbell requesting that his name be taken off the petition for the annexation of the West Zumbro Addition; from Alice Jensen requesting that her name be retracted from the petition against going into the City; from Mrs. Bertha Yates requesting that her name be withdrawn from the Hillcrest Petition for annexation to the city; from George Dingfelder requesting that his name be added to the petition as being opposed to the annexation of West Sumbro Addition; and from Robert E. and Martha L. Johnson stating that they did not wish to have their 5 acres, which are on the extreme west border line in Hill - crest Addition, taken into the City, were each read and ordered placed on file. A petition signed by five property owners, requesting that their names be withdrawn from the petition for the annexation of West.Zumbro Addition to the City'of Rochester was read and ordered placed on file. The petition of Mr. E. W. Judd to have the real estate known as Rose - Bowl Addition annexed to the City of Rochester and also a petition by the owners of Lots 3, h, 7, 8 and 9, in the Terryville Subdivision of Highl-and Addition to have the said lots annexed to the City of Rochester, were each read and ordered placed on file. After hearing the petitions and communications read President Fryer announced that an ordinance entitled, "An Ordinance annexing to the City of Rochester, Minnesota, the following described real estate, situated in Olmsted County, Minnesota, to -wit: Westlawn Addition and other areas abutting thereon", would be given its first reading at this time. M. on Wednesday, February 13, 1952 was read and the same lwas ordered placed on file. The request of the Mayo Association to constructa new 12 inch sanitary 'sewer, running due west from the exsiting sanitary sewer manhole at the inter- section of 2nd Avenue S. W. and lot Street S. W. to a new manhole approximately 95 feet west, which will serve. one of the trunk sewer lines from our new Diagnostic Building, the cost of the said construction to be paid by the Mayo Association and the sewer to become the property of the City of Rochester after. completion, was read and upon.motion by.Brumm, second by McPherson, their request was approved, subject to the approval of the Sewer Committee and the City Engineer. A letter from the Olmsted County Department of Highways transmitting ,'four copies•of a maintenance agreement for covering the maintenance of State Aid Road 2 and "I" in the City of Rochester for the_year 1952 was read and upon motion by Davis, second by Leo Anderson, the Mayor and the City Clerk were instructed to complete the agreements. The request,of Mr. Stanley F. Drips, Civil Defense Director, to attend the Staff College for Civil Defense Administrators and Executives for a one -week ,course at Olney, Maryland was read. A motion was made by Davis, second by Helmkay, Mr. Drips was authorized to attend the said conference at city expense. All present voted in favor of the motion except, Aldermen.Brumm and McPherson, who voted "no". A petition for the construction of a sanitary sewer and watermain and grading of streets on 5th Street -Southeast from 4th to 5th Avenue Southeast and on 5th Avenue Southeast from 5th to 6th Street Southeast was read and the. -.City Clerk was instructed to prepare a resolution for the next meeting ordering the ,first hearing. Statements of expenditures from the City Engineer's payroll for the m6nths of December, 1951 and January, 1952 were each read and President Fryer ordered that the same be placed on file. The reports for the month of January, 1952 of the Building Inspector showing fees collected for building per issued in the amount of $2,622.00; of the Electrical Inspector showing fees collected for electrical permits issued in the amount of $33.00; of the Plumbing Inspector showing plumbing permits ,issued, fees collected in the amount of $392.50; of the Heating Inspector showing fees collected for heating permits issued in the amount of $229.25, and fees collected for sign permits in the amount of $9.13, were each read and Record of-Officia-1 Proceedings of the Common Council of.the City of Rochester, :Minn., February .4, 1952 1 1 11 ro Chi C� 1 IJ 1 1 President Fryer•referred,the�same to the Finance Committee. The financial report of the Fire -Department Relief Association for the year ended December 31' 1951 wastread and -the same was ordered -placed -on file. The report of the City Weighmaster for the• month of January, 1952 showing fees collected for loads weighed in the amount of ' $93.35• was read and President Fryer referred the same to the Finance Committee. The keport of the Clerk of Municipal Court for the week ended January 26, 1952 showing total criminal fines and costs collect ed•$624,00 and civil fees received $6.35 and for the week ended -February 2, 1952 showing total criminal fines and costs collected $717.00 and civil fees received $9.70, were each read and having been approved by the -City Attorney,•President Fryer ordered that the same be placed on file, The.application of Donald Pillar for a license to -sell cigarettes at retail -was read and upon motion by Brumm, second by Davis* the license was granted The application of E. J. Armit for a Real Estate Broker's license was read and upon motion by Brumm,'seeond•by Leo Anderson, the license was granted subject to the approval of the Real Estate Commission. The contract bond of Carlisle G. P.. Fund, and ordering payment made to Alvin E. Benike, which was read. Upon motion by Helmkay, second by McPherson, that the said resolution be adopted as read, and -all present -voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman McPherson introduced a resolution appropriating $1,907,97 from the Bridge Fund and ordering payment made to L. N. T. Earle, $2,903,25 and Mayo Civic Auditorium Revolving Fund, $3, 379.63, which was read. Upon motion by Leo Anderson, second by Brumm, that the said resolution be adopted a,s read, and all present voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Helmkay introduced a resolution appropriating $564.59 from the General Fund, $695. 59 from the Street & Alley Fund, $296.20 from. the Sewer Fund, $30.86 from the Bridge Fund and $17.61 from the Parking Meter Fund and ordering payment made to the Street & Alley Fund, which was read. Upon motion by Brumm, second by Davis, that the said resolution be adopted. as read, and all present voting- in. favor. thereof, President. Fryer' declared the,said resolution duly passed and adopted. Alderman Helmkay introduced a resolution appropriating $2,724.00 from the Permanent Improvement Fund and ordering payment made to Alvin E. Jones (2) 0 $666.00 each Glenn-:R., Keller-.(1) ® $460.00; Kenneth Raymond (1) ® $450.00; Donald Cunningham(3) $425.00 each; Albert Isaacson (1) ® $410.00; and Philip Lake (11) fob $4o6.00 each The matter of construction of a new sub -station for the Rochester Fire Department north of the tracks, at either the intersection of 7th Street and Broadway North or 13th Street and Broadway North was discussed. The Acting Fire Chief stated that it would require from 2 to 3 minutes to drive from the Central Fire Station to those. locations on North Broadway and there• was still a possibility of being hold up by trains on either of the Railroad tracks. Alderman McPherson called to the attention of the Council a recommendation made by the National Fire Underwriters in 1949 that -a sub -station should be constructed north of the railroad tracks. Upon motion by Helmkay, second by McPherson, the matter was .referred to the Fire Committee for study. The Assistant City Engineer, C. A. Armstrong, stated that the.Engineer had recommended that the plowing of snow on sidewalks• be discontinued, which would leave the members of the Engineer's maintenance crew -:.employed on -this work free for other snow removal. A motion was made by Leo Anderson, second by Brumm, that snow be not plowed from .the walks after this date. All present voted in favor of the motion.
