Proceedings of the Common Council of the City of Rochester, Minn., , February 20,_1952 1 U Co W 1 1 Minutes of a special meeting of the Common Council of the City of Rochester, Minnesota held in the Council Chambers in the City Hall in said City on February 20, 1952. President Fryer called the meeting to order at 4:00 o'clock P. M., the following members.being present: President Fryer, Aldermen Leo Anderson, George Anderson, Brumm, Davis, Helmkay and McPherson, Absent: None. The call of the special meeting was read, the said meeting having been called for the purpose of considering the adoption of'a resolution.authorizing the purchase of certain equipment for use in the Department of Civil Defense in the City of Rochester, Minnesota and any other business the said. Common Coumil may deem proper. Alderman Helmkay introduced the following resolution which was read: "WHEREAS, The City of Rochester, Minnesota, by Ordinance duly adopted by the governing body of said city, did establish a civil defense organization, and WHEREAS, a Director of such civil defense organization was duly appointed, qualified, and is now acting as the Director of said program, and WHEREAS, it is deemed advisable that certain equipment, listed on attached form ,#103 and made a part of this resolution, be purchased by the said City of Rochester, Minnesota, upon the terms likewise set forth in said form #103, for the furtherance of civil defense, NOW THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: That in consideration of a contribution from the State Government toward the cost of organizational equipment for divil defense purposes, and in consideration of the procurement.of such organizational equipment by the Federal Government and the State of Minnesota, the City of Rochester hereby agrees that it is firmly obligated to the State Government for one-half of the cost to the State Government of the equipment listed on the attached Form 103 and one-half of any procurement or transportation charges which may be incurred by the State Government in connection therewith, that funds to meet such obligations are currently available, and that it will, immediately upon delivery'of said equipment to it and receipt of a bill from the State Government remit to the State Government one-half of the cost of such equipment and one-half of any procurement and transportation charges which may be incurred by the State Government. That the City of Rochester further agrees, `that if for any reason it should revoke or cancel the request for organizational equipment contained on the attached form 103, it will promptly reimburse the -State Government for any loss, as determined by the Director oacasioned to the State Government thereby. The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the. City Treasurer in accordance herewith, and cause said payment to be made.11 Upon motion by Davis, second by Helmkay, that the said resolution be except Alderman Burmm,'who voted "no" Adopted as read, and all present voting in favor thereof,/President Fryer declared', the said resolution duly passed and adopted. The following claim was read and upon motion by Helmkay, second by Davis, the same was approved and the Mayor and City Clerk were directed and authorized to draw warrants upon the City Treasurer and make payments accordingly: From the General Fund: F. R. Finch, City Clerk - $95090. • From the Park Improvement Fund:. F. R. Finch, City Clerk - $15.53• From the Public Health & Welfare Fund: F.R. Finch, City Clerk - $46.06. Council of the City of Rochester, Minn., February 20, 1952 The City Attorney explained to the Council that claims under the Workmen's Compensation Act had been made against the City for professional services, hospitalization and compensation in connection with hernia cases which.may or may not be accidents, and recommended that no action be taken on ,such claims until thoroughly i4vestigated by the City Attorney. A motion was made by George Anderson, second by.Brumm, approving the recommendation of the City Attorney and that all hernia cases be referred by the various department:, .heads to the City Attorney for investigation before settlement of claim.
