President Fryer called the meeting to order at. 2:00 olclock P. M., the following members being present: President Fryer, Aldermen Leo Anderson, George Anderson, Brumm, Davis, Helmkay and McPherson. Absent: None. Upon motion by McPherson, second,by Brumm, the minutes of the meetings of February lSth, 20th, 27th and 29th, 1952 were approved. President Fryer stated this as being -the time and Glace set for the first hearing on the construction.of a sanitary sewer and watermadn and grading and surfacing of 5th Street Southeast from 4th to 5bh Avenue Southeast and on. 5th Avenue Southeast from 5th to 6th Street Southeast. A communication from Mr. & Mrs. Walter Hess objoctirg to the improvement was read and Predid_ent Fryer ordered the same placed on file. - President Fryer stated this as being the time and place, set for- the first hearing on the construction of a curb and gutter in Peck's 2nd Addition. Emerson.of 916 - 12th Avenue N. I. was present at the meeting and stated that he, did not object to the installation of a curb and gutter, but he did ;,rish to, enter a complaint on the condition of the streets during the winter, due to the fact that the snow had not been plowed from the streets. President Fryer requested him to make an appointment with the Chairman of the Street & Alley Committee and to take up'the complaint with the sai� Committee. The bid of H & H Eleettic Co. i in the amount of $1,745.00 was received and opened. i, The recommendation of the Police Committee that the bid of H & H I, Electric Company for installation of used traffic signals at North Broadway and 7th Street in the amount of $1,745.00 be accepted was read and the same was ordered placed on file. President Pryer stated this as being the time and place set for rec- eiving and opening bids for furnishing one 55 foot taro -piece aluminum Alloy junior Aerial Ladder for use in the Rochester Fire Department. No bids were received. The recommendation of the License Committee that a license be granted to Kris Nielson to connect to sever and drains was read and upon motion by Brumm, second by George Anderson, the recommendation was approved. The following recommendation of the Sewer Committee was read and upon motion by George Anderson, second by Davis, the recommendation was approved: "Hon. Mayor & Common Council City of Rochester, Minnesota Gentlemen: We, the undersigned members of the Sewer Committee, recommend that permission be granted for a reduction in sewer service charges for clear eater which is metered and returned to the sanitary sewer only when the case meets the following conditions: 1. The applicant requesting such permit shall submit estimates by two reputable contractors ordinarily engaged in sewage work indicating the cost of a connection to the storm sewer system for disposal of the water. 2. If the estimated cost of construction of the connection to the storm sewer exceeds the anticipated savings in the 5 year period, a permit will be granted. Helmkay " The following recommendation of the Street & Alley Committee was read and upon motion by Davis, second by.Brumm, the 'recommendation was approvedt "Hon. Mayor & Common Council City of Rochester, Minnesota Gentlemen: A suggestion has been offered by the Minnesota Department of Highways that Broadway from Fourth Street Worth to Sixth Street South should be resurfaced.. This would involve a co- operative project and the City would be expected to stand a, share of the exp"ense. A rough preliminary estimate indicates that this share might range between $15,000 and $25,000. We, the undersigned, recognize the desirability of such a project improving the appearance and riding qualities of Broadway. However, since no funds are presently availalbe for the City's share of such work, we recommend that no immediate request be made for such an agreement; but that funds for such a project be budgeted assoon as possible. We, further recommend, that all possible steps be taken immediately to correct the conditions now existing at the - railroad crossings and the several "sags" in the present pavement so these areas will be suitable for resurfacing when the time comes. Monson, City Engineer" The recommendation.of the Street & Alley Committee that a request be made to the Minnesota Department of Highways for a Co-operative Agreement for the construction of a curb and gutter and paving of Fourth Street Southeast from Sixth Avenue to the Rochester State Hospital (2nd Street S.E.) was read and upon motion by Leo Anderson, second by George Anderson, the recommendation was approved. The request of E. J. Armit to have Lots 4 and 1 of Block 1, and Lots 1, 2, 3 and. 4 of Block 2, DresbPch's Addition annexed to the City of Ro cheater ,v:as read together with the recommendation of the City Engineer that the plat be aeepted:and the lots annexed to the City. A motion was made by Brumm, second by McPherson, instructing the City Attorney to. prepare an ordinance for the annexation of the above described lands. A letter from the State of Minnesota., Water Pollution Control Commissio: transmitting a copy of the report of the Division of Water Pollution Control and also one set of plans and specificatidns for the project covering 0 Record of Official Proceedings of the Common Council of the City of Rochester, Minn. March '3. 19 52- • approximately 5,560 feet of eight -inch diameter sewer pipe was read and upon motion by Brumm, second by Davis, the report and plans were ordered. placed on file. Utility A communication from the Public/Department of the City of Rochester advising that provisions had been made on the plat of Betcherls Sub -Division for all necessary utilities and that their Board approved the plat as sub- mitted was read and ordered placed on file. A resolution adopted by the governing body of the City of St. Paul urging that bills S.2437 and H.R.6390 or bills containing similar provisions for urban aid on highway construction be approved was read and_upon motion by Leo Anderson, second by McPherson, the Mayor, the City Attorny and the City Clerk were instructed to prepare a resolution urging the adoption of the above mentioned legislation. A notice by the League of Minnesota Municipalities of the short courses to be -conducted at the Continuation Center of the University of Minnesota during March and�the first part of April was read and President Pryer ordered .that the same be placed on file. The Mayors certification of the appointment of Lawrence W. McKee, Byron W. Brueske and Clark A. Tuttle, Jr. to the eligibility list for the Rochester Police Department and a notice from the Police Civil Service Commission cortifying.to the Mayor the above names from the eligibility roster were each read and President Fryer ordered that the same be placed on file. A communication from the Public Health & Welfa.re.Department stating that a review of the status of its income and expense for the current fiscal year ending March 31, 1952 indicating that sufficient funds would be available to pay all obligations including the salaries and raises allowed for the employees in the Public Health and Welfare Department and that their Board would not request any of the funds held available by the Common Council to pay salary increas.es during the current year was read and President Pryer ordered that the same be placed on file. A letter was received from the Board of Pari Commissioners regarding the area on the East side of 2nd Street Southeast just Worth of the Mayo Civic Auditorium which reads in part as follows; "We assume that the portion of the property not'required for street and public siddwalk purposes will be designated as a part of Mayo Memorial Park. If this is your intention, we should very much appreciate early action on your part. We Mould then be in a position to make plans to develop the area and to fit the work into cur spring schedule." A notice by the Federal. Power Commission of the date of a hearing to be held in Washington, D. C. on March 17, 1952 on rates for the Northern Natural Gas CompaAy was read and the same was ordered placed on file. A contract for furnishing natural gas at the City warehouse on North Broadway was read and upon motion by Brumm,,second by Helmkay, the Mayor and the City Clerk were authorized to execute same. The recommendation of the Building -Inspector and the Acting Chief of the Fire Department on necessary repairs vrhich should be made at the Central Fire Station was read and upon motion by Davis, second by George Ander'son, the same was approved and ordered placed on file. A communication from Mayor Glenn 0. Amundsen, notifying the Council of .the resignation of Mr..Ben F. Dunn as Member at Large of the Board of Park Commissioners effective as of March 4, 1952 was read together with his appointment of Mr. -Paul A. Grassle, Sr. as Fark Commissioner at Large and Mr. Ciaude J. Bremer of 124 - llth Avenue Southeast to fill the unexpired term of Mr. Paul A. Grassle, Sr. as Park Commissioner of the Second -Ward. Upon -motion by George Anderson, second by Helmkay, the Mayors appointments were approved. A petition signed by Jpseph C. Zazubek, Wilma M. Zazubek and Mrs. J. E. Reid to have Lots 9 and 10, block 5, of. Wm. McCullough's Addition to the City of Rochester changed from a multiple dwelling zone to a commercial zone was read and upon motion by Davis, second by Brumm, the•saae was referred to'the Board of Zoning. A petition.for the grading of 18th Avenue Northeast from 9th Street Northeast to the south line of Westlund's Subdivision was read and the same was referred to the Street & Alley Committee. A petition for the construction,of a curb'and gutter on Sth Street Northeast from lot Avenue to 2nd Avenue was read and the same was referred to the Street & Alley Committee. The petition of Mr. & Airs. Robert C. Neill to have Lot 3, Block 1, Cookla Sub -Division changed from.a residential zone to a multiple dwelling zone was read and upon motior. by Davis, second by Brumm, the same was referred to the. Board of Zoning. The reports for the month of February, 1352 showing fees collected for building permits issued in the amount of $194.0o; of the Electrical Inspector showing fees collected for electrical permits issued in the amount of $53.55; of the Plumbing Inspector showing fees collected for plumbing permits issued in the amount of $565.,75; of the Heating Inspector showing fees collected for heating permits issued in the amount .of $214-50; and fees collected for !sign permits issued 696 Record of Official Proceedings of the Common Council of the City of Rochester, Minn.. March 3, - 1952 in the amount of $25.39, were each read and President Fryer referred the same to the Finance Committee. The reports of the Clerk of th.erunicipal Court. for the week ending February 23, 1952 showing total criminal fines and costs collected $365.00 and I civil fees received $1.30 and for the week ending March 1, 1952 showing total criminal fines and costs collected $1,028.15 and civil fees received $7.90, were each read and having been approved by the City Attorney, President Fryer ordered i that the sane be placed on file. • The report of the City Weighmaster for the month of February, 1952 showing fees, collected for loads weighed in the amount, of $105.30 was read and ! i President Fryer referred the same to the Finance Committee. The application of Marti Motors for license to sell cigarettes was f! read and upon motion by Davis, second by George Anderson, the license was granted. � The applications of the Knights of Columbus for license to sell cigarettes, for license to sell soft d.rinks and for license to sell• non- i intoxicating malt•liquors "on sale", were each read and upon motion by Brumm, second by Davis, the licenses were granted. The application of the Sanitary Company for license to connect with 3ewers:,and drains was read and upon motion Davis, second by Brumm, the license was granted. t II The application of the Service Cab Company for transfer of a taxicab license from a Plymough Sedan to.a 1950 Nash Statesman was read and upon motion by Leo Anderson, second by Brumm, the transfer was granted. The license bond of The Sanitary Company in the amount of $1,000,00 i with the Aetna Casualty and Surety Company as surety was read and upon motion by Brumm, second by Davis, the bond was approved, the surety thereon accepted, I' and it was ordered that the same be placed on file. Alderman Leo Anderson introduced a resolution ordering 2nd hearing on constructions of a sanitary sewer and watermain' and the grading and surfacing of II �I 5th Street Southeast from 4th to 5th Avenue Southeast and on 5th Avenue Southeast from 5th to 6th Street Southeast, which was read. Alderman _Helmkay introduced a resolution appropriating $544,65 from the S.D.P. Fund and ordering payment made to Toltz, Bing and Day, Inc., which was read Upon motion by Helmkay, second by McPherson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Helmkay introduced a resolution appropriating $371.20 from the General Fund, $4- 32 from the ,S, & A Fund, $11.70 from the Fire Protection Fund, $1,232.70 from the.Park Improvement Fund and $4,936.76 from the'Lighting Fund and ordering payment made to, City of Rochester, Pub. Utilities; which was read. Upon motion by Leo Anderson, second by George Anderson, that'the said resolution be adopted as read, and all voting in favor thereof, President.Fryer declared the said resolution duly passed and adopted. Alderman McPherson introduced a resolution appropriating $11,779.37 from the Park Improvement Fund and ordering payment made to R. C. Drips - $576.62; Marigold Dairies, $215.81; Reynolds Wholesale, $470.43; Sullivan Brothers-$345.00;• Davids Surplus Outlet, $205.00; Old Dutch Foods, $590.50; Naegele Poster Service, $599.20; Cyclone Fence Division, $347.64; American.Paint Corp. - $237.40 and Collector of Internal Revenue,- $9, 201.77, which was road. Upon motion by George Anderson, second by Brumm, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. .Alderman McPherson introdaced a resolution appropriating $3,52;50 from the F.E.Williams Estate Fund and ordering payment made to Olmsted County Treasurer, which was read. ''March 3. 1952 II Alderman McPherson introduced a resolution providing for the sale of 4150,000.00 Permanent Improvement Revolving Fund Bonds, which was read.' Upon motion by Davis,,second by Helmkay,, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the. said resolution duly passed and adopted. A•mooion was*made by McPherson, second by Helmkay, that the City Attorney have an opinion prepared on the legality of the bonds. Alderman McPherson introduced a resolution requesting the City of Rochester to provide for improvements on Trunk Highway No. 296•, ,rich was read. Upon motion by Helmkay, second by McPherson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Leo"Anderson introduced a resolution appropriating $309.75 from the Street & Alley Fund and ordering payment made to Quarve & Anderson, which was read. Upon motion by McPherson, second by Leo Anderson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. An Ordinance annexing to the City of Rochester, Minnesota, the ' folllwing described real estate, situated in Olmsted County, Minnesota, to -wit: Westlawn Addition and other areas abutting thereon",;was given its second reading. Upon motion by Brumm, second by George Anderson,and upon roll call and.all voting in favor thereof, the rules were suspended and the ordinance was given its third and final reading. Upon motion by Leo Anderson, second by Brumm, that the,said ordinance be not adopted as read, and .all voting in f avor thereof, President Fryer declared the said Ordinance not adopted. Upon motion by Brumm, second by McPherson, the City Attorney was instructed to prepare an Ordinance annexing to the City of Rochester a part of Westlawn Addition,- Thurberls 3rd Addition and a parcel of land abutting on Highway 52 and 54 on which the Standard Oil Station is now located. Alderman McPherson introduced an Ordinance entitled, "An Ordinance annexing to the City of Rochester, Minnesota, the following described real* estate, situated in Olmsted County, Minnesota, to -wit: Westlawn Addition and other areas abutting thereon", which was given its first reading.
