President Fryer called the meeting to order at 7:30 o'clock P. M., the following members being present: President Fryer, Aldermen Leo Anderson, George Anderson, Brumm, Davis, Helmkay and McPherson. Absent: None. Upon motion by Davis, second by George Anderson, the minutes of the meetings of March 3rd and March 12th, 1952 were approved* President Fryer stated this as being the time and place set for the second hearing on the construction of a curb and gutter on 13th Avenue Southeast from 4th to 5th Street Southeast. There was no one present wishing to be heard. President Fryer stated this as being the time and place set for the second hearing on construction of a curb and gutter on 31 Street Southeast from 14th to 15th Avenue Southeast. There was no one present wishing to.be heard. President Fryer stated this as being the time and place set for the second hearing on the construction of a curb and gutter on 6th Street Southeast from Sth to 9th Avenue Southeast. There was no one present wishing to be heard. President Pryer stated -this as being the time and place set for the second hearing on the construction of a curb and gutter on Sth Avenue Southeast from loth to llth Street Southeast. A petition signed by 13 interested parties protesting the above project was read. Also those present.in favor of the project and objecting to it were heard. President Fryer stated this as being the time and place set for the second hearing on the construction of a curb and gutter on loth Street Southeast from 3rd to 4th Avenue Southeast. There was no one present wishing to be heard. President Fryer stated this as being the time and place set for the second hearing on the construction of a curb and gutter on 12th Avenue Northeast from 9th to loth Street Northeast. Mr. R. E. Emerson was present and opposed the installation of curb and gutter as petitioned for. President Fryer stated this as being thettime and place set for the 2nd hearing /construction of a curb and gutter on 4th Street Southeast from llth.Avenue Southeast to 2nd Street Southeast. There was no one present wishing to be heard. President Fryer stated this as being the time and place set for the second hearing on the construction of a curb and gutter in Peck's First Addition. There was no one present wishing to be heard. President Fryefj stated this as being the time and place set for the second hearing on the construction of a curb and gutter.in Peck's Second Addition. A letter from Mr. Gust Rabine 1 E P I L urging that the project be completed was read together with a communication from the Board of Education, School District No. S stating that the Board concurs in the petition for the curb and gutter on loth Avenue Southeast. The communications, were ordered placed on file. President -Fryer stated this as being the time and place set for the second hearing on the construction of a sanitary sewer and watermain and the grading and surfacing of 5th Street Southeast from 4th to 5th Avenue Southeast and on 5th Avenue Southeast from 5th to 6th Street Southeast. A communication from Margaret Davies requesting that her name be withdrawn froml,the petition for the grading and a letter from Mr. Christy Spibzack requesting that the project be completed were read together with a protest signed by 9 interested parties and the same were ordered placed on file. President Fryer stated this as being the time and place set for the second hearing on the grading and surfacing of 5th Avenue Southeast from 4th to 6.th Street Southeast; 6th Avenue Southeast from 5th_to.6th Street Southeast and 5th Street Southeast from 4th to 6th Avenue Southeast. A protest signed by 6 interested parties was read and ordered placed on file. Mr. 1. Coppe was present and spoke in opposition to the project and Mr. A. L. Blackburn was present and urged that the'project.be completed. Upon motion by Davis, second by Helmkay, the' matter was referred back to the City Engineer to.determine the number of parties. in favor of the project and the number opposed to the project. President Fryer stated this as being the time and place set for receiv- ing and opening bids for furnishing one 55 foot two piece aluminum alloy Junior Aerial for use in the Rochester Fire Department. The bid of Peter Pirsch & Sons Company in the amount of $1,025.60 was received and opened and President Fryer referred the same to the Fire Committee and Fire Chief for report. The recommendation of the Fire Committee that the bid of Peter Pirsch & Sons, Co. for furnishing one 55 ft. two piece aluminum alloy Junior Aerial be accepted in the amount of $1,025.60 was read and a motion was made by George Anderson, second by Brumm, that the recommendation be approved, all voted in favor of the motion, except Alderman Davis who voted "no". President Fryer stated this as being the time and place set for receiving and opening bids for repairs to the Rochester Central Fire Station. One bid was received but was'not opened. President Fryer stated this as being the time and place set for receiving and opening bids for the purchase of $150,000.00 City of Rochester, • c 0 Record of Official Proceedings of the Common Council 40 of the City of Rochester, Minn., March 17, 1952 T Minnesota Permanent Improvement Revolving Fund Bonds. The bids of the Sinking Fund Commission of the City of Rochester in the amount of $150,000.00 plus accrued interest and Juran & Moody in the amount of $150.000.00 plus accrued interest and a premium of $1,050.00, were each received and opened. A motion was made by McPherson, second by Helmkay, that the bid of Juran & Moody in the amount of $150,000.-00 plus accrued interest and a premium of $1,050.00 be accepted. All voted in favor of the motion. A request for Council approval of a loan by the Fire Department • Relief Association to George Davis in the amount of $1,500.00 was read. Alderman Helmkay, Chairman of the Finance Committee, reported verbally on the matter and recommended that the loan be approved. Upon motion by George Anderson, second by Brumm, the loan was approved. A letter from the Fire Underwriters Inspection Bureau requesting detailed description of the property annexed by the City of Rochester lying south of Highway No. 14 and west of Highway go. 52 was read and the City Engineer was instructed to prepare a plat of the said lands for use of the Fire Underwriters Inspection Bureau. A letter from Mr. H. G. Halvorson, President of the Rochester Exchange Club asking permission to discuss the matter of putting in beaches at various bus stops throughout the City of Rochester was read. Dr. P. H. Gentling and other members of the club -were present and explained the project in detail. President Fryer referred the same to the Chairman of the Street & Alley Committee, Chairman of the Police Committee, the Chief of Police, the City Attorney, the City Engineer and the Building Inspector. A letter from the State of Minnesota, Department of Conservation, requesting cancellation of an $8.00 fee for rental of the City Hall community room was read. The matter of charges for rental of the community room was discussed and upon motion by George Anderson, second by Brumm, the charge in questioii-was ordered cancelled. All voted in favor of the motion except Aldermen Davis and Helmkay, who voted Unon. After discussing the matter further a motion was made by McPherson, second by George Anderson, authorizing the City Clerk to determine which public organizations might use the community room without charge. The following -communication from Rev. R. J. Jansen, Pastor of St. Francis Church, was read and President Fryer ordered that the same be' -referred to the Street & Alley Committee and the City Engineer: 'The City Council City of Rochester Gentlemen: Permit me.to bring to your attendtion for consideration the following matters: • Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 17., 1952 1 F_I L M 1 1 1) My favorable approval of the proposed widening of 4th Street S.E. about which I read in the Post -Bulletin. Apart from the advantages that will accrue to the Church location -- and thare are some -- the heavy traffic on this street certainly demands that something be done soon. You might consider traffic signals too, at the corner of llth ave and 4th St. S.E., similar to that on the corresponding avenue and 2nd St. S. W. 2) My concern about the storm sewer on 31 St. S.E. When notice of this appeared in the paper about a year ago, I contacted the City Engineer's office about it. Naturally, no definitile answer was given, but. being proposed, it was.hoped and planned to., construct same. With this in mind, we planned also to drain school play -ground into this storm sewer. At the present time, I am told it is still in the hands of the Council to decide concering this. I would appreciate it, therefore, if some information about this would be forthcoming so that we can plan our grading plot accordingly. Jansen Pastore . .The following letter from the State of Minnesota, 'Department of Highways, addressed to the City Engineer was read and President Fryer ordered same placed on file: "Mr. Ralph E. Monson City Engineer Room 107, City Hall Rochester, Minnesota Re: Traffic Control Signals T.H. No. 63 - Rochester Dear Mr. Monson: I have your letter of March 5th in which on behalf of the City of Rochester you request permission to install fixed -time traffic control signals at the intersection of North Broadway (T.H. No. 63) and 7th Street North in Rochester, with the understanding that the State is not to share in any way in the expense of the installation of in the maintenance of the equipment. If the city wishes to proceed on its own with the installation we will have no objection. In a way I am sorry to see this action on the part of the city for I believe sincerely that the day is not far distant when the state will have to insist upon a change -over from angle parking to parallel to eliminate the serious and unnecessary congestion and confusion which now exists on Trunk Highway No. 63 in the central business district. I would like to call your attention to the fact that when this day comes there is no way that the state will be able to reimburse the city for any installations of signal equipment made by the city merely to avoid changing over to a proper method of, parking, which would -do so much to better traffic conditions. in Rochester. Darrell Traffic Engineer" The Mayor's emergency order issued for overtime work for members of the Street & Alley*Department on February 1:0, 11, 12, 21 and 24 was read and upon motion by Leo'Anderson, second by George Anderson, the same was approved. 0 A notice from the Minnesota Railroad and Warehouse Commission that one • Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 179 1952 of their inspection trucks would be in the City in the near future and would inspect the 100,000 Howe Motor Truck Scale if so desired. No request was made for inspection and the communication was ordered placed on file. A petition for the construction of a sanitary, sewer and grading and surfacing of 2nd Avenue.Northwest from 13th Street Northwest to Cascade Creek was read and the same was referred to the Street & Alley Committee, the Sewer Committee and the City Engineer. A petition for the construction of a sanitary sewer and watermain in 5th Street Northeast from 15th Avenue Northeast approximately 550 feet East was read and the same was referred to the Sewer Committee, the Water Committee and the City Engineer. The following communication from Don Swenson, Manager of the Rochester Airport was read and the same was ordered placed on filet "Honorable Mayor .and, Common Council City of Rochester, Minnesota Rochester, Minnesota Gentlemen: We wish to inform you that inasmuch as State Aid Project No. 5501.04 has been deferred in order that urgently needed elevated runway lights may be installed at the ROchester Airport during 1952• According to an agreement between the City of Rochester' and State Department of Aeronautics, the State will issue funds sufficient to pay one half of the engineering costs incurred on this project. In order,that the City, of Rochester be not burdened with any expense relative to this project,'the Rochester Airport Company will make payment to the City of Rochester covering the other one half of the above mentioned engineering costs. The report of the Trustees of the Walter Hurlbut Book Fund for the calendar year of 1951 was read and the same was ordered placed on file. The reports of the Clerk of Municipal Court for the week ended March 8, 1952 showing total criminal fines and costs collected $993.00 and civil fees received $6.05 and for the seek ended March 14', 1952 showing total criminal fines and costs collected $921.00 and civil fees received $6.35, were each read and having been-approv-ed by the City Attorney, President Fryer ordered that the same be placed on file. The application of Ray Bowers for a Reel Estate Brokers license was read and upon motion by McPherson, second by Helmkay, the license was granted. The application of S. E. The surety bonds of H & H Electric Company in the amount of $1,745.00 and Ray Bowers in the amount of $2,500.00 with the Western Surety Company as surety, were each read and upon motion by George Anderson, second by-Brumm, the bonds were' approved, the surety thereon accepted and it was ordered that the'same be placed on file. Alderman Leo Anderson introduced a resolution accepting the bid of Peter Pirsch & Sons Company for furnishing one 55 ft. two-piece aluminum alloy Junior Aerial ladder for th& Fire Department, which was read.' Upon motion by Leo Anderson, second by George Anderson, that the said I resolution be adopted a9 read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman McPherson'introduced a resolution accepting the bid of Juran & Moody for purchase of $150,000,00 P.I.R. Fund Bonds, which was read. Upon motion by McPherson, second by Brumm, that the said resolution be adopted as read, and all voting in favor thereof,'President Fryer declared the said resolution duly passed and adopted. Alderman Leo Anderson introduced a resolution declaring'grant agreement entered into with the Civil Aeronautics Administration on January 21, 1952 void, which was read. Upon motion by George Anderson, second by Brumm, that the said resolutian be adopted as read, and all voting in favor thereof, Pres"ident Fryer declared the said resolution duly passed and adopted. Alderman Leo Anderson introduced a resolution requesting Federal Aid for, installation of runway lights at the Rochester Airport, which was read. Upon motion by Brumm, second by Davis, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman George Anderson introduced a`re.solution requesting Minnesota Department of Aeronautics to pay part of engineering services on Project Dio. 5501-04 which was read. Upon motion by Davis, second by McPherson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the ' said resolution duly passed and adopted. Upon motion by George Anderson, second by Brumm, that the said resol- ution be adopted as read, and all voting in favor thereof, President Fryer, declared the said resolution duly passed and adopted. Alderman Brumm introduced a resolution accepting plans and specifi- cations and ordering bids for construction of a curb and gutter on 10th Street Southeast from 3rd to 14th Avenue Southeast,,which was read. Upon motion by George Anderson, second by Brumm, that the said resolution be adopted as re8d, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Brumm introduced a resolution accepting plans and specifi- cations and ordering bids for construction of a curb and gutter on 12th Avenue N. E. from 9th to loth Street N. E., which was read. Upon motion by Brumm, second by Davis, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Davis introduced a resolution accepting plans and specifi- cations and ordering bids for construction of a curb and gutter in Peck's First Addition, which was read. Upon motion by Davis, second by McPherson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared th4l- said resolution duly passed and adopted. Alderman Davis introduced a resolution accepting plans and specifi- cations and ordering bids for construction of a curb and gutter in Peck's Second • Addition, which was read. Upon motion by McPherson, second by Leo Anderson, that the said resol- ution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. Alderman Davis introduced a resolution aocepting plans and specifi- cations and ordering bids for construction of a curb and gutter in loth Avenue Southeast from East Center Street to 14th Street Southeast, which was read. Alderman Helmkay introduced a resolution appropriating $583.80 from i the General Fund, $24.66 from the S & A Fund, $86.22 from the Sewer Fund, $953.W from the Lighting Fund and $1,242.28 from the Park Improvement Fund and ordering payment made to the City of Rochester, Public Utilities, which was read. Upon motion by Brumm, second by Davis, that the said resolution be 1 adopted as read, and all voting in favor thereof, president Fryer declared the said resolution duly passed and adopted. Alderman Helmkay introduced a resolution appropriating .$565.85 from the S.D. P. Fund and.order.ing payment made to Toltz, King & Day, Inc., which was read. Upon motion by Davis, second by McPherson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the r said,,resolution duly passed and adopted. Alderman McPherson introduced a resolution appropriating $9 52.16 from the General Find, $1,107.63 from the S & A Fund, $219.97 from the Sewer Fund and ordering payment made to Municipal Equipment Co.- 21 ' P$ 9.97: Schmidt Printing Co.2 $463.40; Firestone Stores-$650.79; Rochester Post Bulletin-$484.80; Olmsted Co. Highway Dept.; $200.00 and Wm. H. Ziegler Co.- $256.84, which was read. Upon motion by McPherson, second by Leo Anderson, that the said resolution be adopted as read, and all voting in favor thereof, ,President Fryer declared the said resolution duly passed and adopted. Alderman McPherson introduced a resolution appropriating $1,434,00 from!, the General Fund and ordering payment made to Kirkwood Ra-Tel, Inc., which was 1 read. Alderman McPherson introduced a resolution appropriating $269290.37 from the Sewer Fund and ordering payment made to Sinking Fund of the City of Rochester, which was .read. Upon motion by Brumm, second by Davis, that the said resolution be adopted as read, and all voting in favor thereof, President. Fryer declared the said resolution duly passed and adopted. Alderman McPherson introduced a resolution appropriating $385.25 from the General Fund and $12.3.0 from the Sewer Fund and ordering payment made to the N. W. Bell Telephone Company, which was read. Upon motion by Davis, second by McPherson, that the said resolution be adopted as read, and all voting in favor.thereof, President Fryer declared the said resolution duly passed and adopted. Alderman McPherson introduced a resolution regarding legislation of highways through the City, which was read. Upon motion by Leo Anderson, -second -by George Anderson, that the said resolution be adopted as read, and all voting in favor thereof, President Fryer declared the said resolution duly passed and adopted. An Ordinance amending an Ordinance entitled, uAn Ordinance to provide for registration of dogs and for the destruction of dogs not registered", was given its first reading. The following claims were read and upon motion by Brumm, second by McPherson, the same were approved and the Mayor and City Clerk were directed and authorized to draw warrants upon the City Treasurer and make payments accordingly: From the General Fund: Richard E. Some discussion was held on as to whether -or not it would be feasible to allow Mr. A. L. Blackburn to make the improvements which he had petitioned for on 5th Street Southeast from.4th.to 5th Avenue and on-5th-Avenue Southeast from 5th to 6th Street Southeast and President Fryer referred the matter to the Sewer Committee, the Street & Alley Committee and the City Engineer with power to act. Alderman McPherson reported that the Committee -appointed to meet with the Chicago North Western Ry. Company regarding signals on llth Avenue Northwest had met with the Railroad representative on this date and had stated that the Railrodd Company would be willing to pay i of the cost of installing the•signals.
