President Bach called. the. meeting to order at 7: 30 al clock P.tii., the following members being present: President Bach, Aldermen Anderson, Brumm, Davis,;; Morris,, Schroeder and Thiem.. Absent: None. I Upon motion by Davis, second by Morris, the minutes of the .meeting of April 7, 1952 were approved. President Bach stated this,as being the time and place set for .the first hearing on the construction of a curb and gutter on 9th Street Northeast from lst to 2nd Avenue Northeast. There was no one present wishing to be heard. President Bach stated this as being the time and place set for the first hearing on the construction of a sanitary sewer and watermain in Botcher's Sub-. Division. There was no one present wishing, to be heard. President Bach stated this:as being the time and place set for the second hearing on the grading and surfacing of 112 Street Southeast from 1st to 3rd Avenue' Southeast. President Bach stated this as being the time and place set for the second hearing on the grading and surfacing of 15th Avenue Northeast from East Center Street north to the north line of hot 16, Block 3, Stebbins Addition. There was no one present wishing to be heard, President Bach stated this as being the time.and place set for receiving bids for the construction of a curb and gutter on 9th Avenue Southeast from loth I -to llth Street Southeast. The bids of Gordon Winslow Company in the amount of $3, 530. $0; H. T. Earle in the amount of $3, 625.00 and C. M. •Boutelle in the amount of $3,737.10 were each reo.eived and opened. President Bach stated this as being the time and place set for receiving_ and opening bids for furnishing manhole and catch basin castings. The bids of Neenah Foundry Company in the amount of $5,802.50 and Adler Steel Products Company in the amount of $6,530.00 were each.received and opened. There was no one present, wishing to be heard and upon motion by Brumm, second by Thiem, the City Attorney was instructed to prepare an amendment to the zoning ordinance making the requested change. President Bach stated this as being the time and place set for receiving bids.for being designated as a City Depository for the official year commencing April 1, 1952. The bids of The First National Bank in the amount of $600,000.00, the Union National°Bank in the amount of $300,000.00 and the Olmsted County Bank & Trust Company in the amount of $300,000.00 were each received and opened. Mr. Peterson, of the Vet's Cab Company, was present at the meeting and recommended that the amounts of insurance liability be'inereased. Under the present franchises the amount of insurance required is $25,000.00 for injury to any one individual, $-90,000.00 for any one accident and $5,000.00 for property damage. A motion was made by Anderson, second by Brumm, that the matter be referred to the City Attorney and the License Committee. Judge Irving L. Eckholdt was before the Council and stated that he was very much in need of additional help in his office and asked permission to employ a third assistant and upon motion by Davis, second by Schroeder, he was authorized to employ an additional assistant in his office. He also requested permission to purchase another desk and upon motion by Schroeder, second by Thiem, his request was referred to the Purchasing -Committee, A recommendation by the Street & Alley Committee stating that the Committee and the City Engineer had met with the property owners on 5th Street Southeast between 3rd and 4th Avenues Southeast in regard to improvement of same and that the matter was left for the property owners to decide what improvement was wanted was read and upon motion by Davis, second by Schroeder, the recommend - at ion, was ordered placed on file. The recommendation of the Street & Alley Committee that angle parking on the south side of 3rd Street Southeast and Southwest from the alley east of Broadway to 1st Avenue Southwest be eliminated and parallel parking substituted therefor was read and upon motion by Davis, second by Schroeder, the same was approved. The recommendation of the Street & Alley Committee that bids be taken for the grading and surfacing of 5th Street Northeast from 15th'Avenue Northeast to the East line of -Lot 10,.Jane's Addition was read and upon motion by Brumm; second by Anderson, the recommendation was approved. The recommendation of the Street & Alley Committee that a curb and gutter be constructed on loth Street Southeast from 1st to 3rd Avenue Southeast was read and upon motion by Anderson, -second by Thiem, the recommendation -was approved. The recommendation of the Street & Alley Committee that the alley iri Block 4, Riess 2nd Addition be graded and oiled was read and upon motion by Davis, second by Brumm,, the recommendation was approved. The appointment by the City Clerk of Miss Elfreda Reiteras first assistant and clerk of registration and Mrs. Geraldine Bielenberg as second assist2 ant and clerk of registration for the ensuing year was read and upon motion by - i Schroeder, second by Thiem, the appointments were approved. The appointment of the following employees in the City Engineer's Department were read and upon motion by Brumm, second by Thiem, the appointments were approved: C. A. Cook, Chief Operator and Edward Ranfranz, Floyd Wussow and William Haugen as assistant operators at the old Disposal Plant, these appointments to expire as soon as the Old Sewage Disposal Plant is abandoned, and the appointment of Walter C. Hogenson as Superintendent of the new Sewage Treatment Plant, was read and upon motion by Davis, second by Morris, the appointments were approved. All voted in favok of the motion. The following recommendation of the Rochester Real Estate Commission was read together with their recommendation that the 52 applications received at the meeting of April 7th be granted "To the Mayor And Common Council City of Rochester Gentlemen: The Rochester Real Estate Commission was created by ordinance Yo. 702. The present board can see no real reason to have this board, the way the ordinance is set up. The applications come to the Common Council and are then sent to the board. As long as there are no charges against any of the applicants, we have to recommend they be granted. in our opinion, this ordinance should be amended so that the Common Council will pass on the applications, and if any changes are brought against any licensed realtor then your Real Estate Commission can investigate and recommend what charges to prefer. J. P. Huyber, a member of our Board, passed away some time ago, and it leaves as one member short. As the ordinance cells for a five man board, and it is your Irish to continue this board, may we suggest that you appoint another member. Sincerely, ROCHESTER REAL ESTATE COMMISSION H. J. Hogenson for the position of Superintendent; of the new Sewage -Treatment Plant was read together with his request for a'ledve' , of absence until the plant is completed and in operation. President Bach ordered i, that the same be placed on file. The request of Russell L. Sanders, General Chairman of the Gypsy Frolic, for an appropriation of $199.00 for the prupcse of furnishing music on the public streets and in public buildings during the date of the Gypsy Frolic was read and upon motion by Anderson, second by Thiem, the requested appropriation was ordered. A letter from Mrs. Kathleen Fitzgerald granting permission to the City of Rochester for the dumping of fill on property owned by her just South of and li adjoining the property of Burnham Motor Sales was read and President Bach ordered i the same placed on file. �! i r The request of LeRoy Shane, Inc. for street lights on 16th Street N. E. was read together with a recommendation by the Lighting Committee of the Common Council that the said lights be installed and the Public Utility Board be notifiedl, thereof. Upon motion by Thiem, second by Schroeder, the recommendation of the Lighting Committee wasapproved. A letter from the First National Bank of Minneapolis addressed to the ' First National Bank of Rochester requesting that authorization of city officials jl to,enter the safe deposit box in the First National Bank of Minneapolis be approve& by resolution of the Common Council and that signatures of those approved by forwarded to the said First National Bank of Minneapolis -was read'and ordered i placed on file. The preliminary estimates of the City Engineer for grading and surfacing 15th Avenue Northeast from East Center Street north to the north line of Lot 16 in Block 3, Stebbins Addition in the amount of $1681.o0•-for , grading and surfacing � 114 Street Southeast from 1st to 3rd Avenue Southeast in the amount of $2490.00 and grading and surf acing lSth Avenue Northeast from 9th Street Northeast to the south line of Westlundis Subdivision, were each read and the same were ordered i placed on file. i' A letter from the State of Minnesota, Department of Highways, transmitting Cooperative Agreement 0-976 in connection with Project S.P.5513-02, T. H. No. 296, was read and President Bach ordered the said agreement placed on file. A communication from the State of Minnesota, Department of Highways, requesting a revised resolution by the Common Council which would,authorize an i agreement between the State of Minnesota and the City of Rochester for the installation of traffic signals at the East and West*Junction of Hight•;ay 52 and 14 I and Highway 63 and 14 t.•as- read and the sane was ordered placed on file. resolution being presented later in the meeting. Reid to have the West 45 feet of Lots 9 and 9, Block 9, Wm. McCullough's Addition and the East 54 feet of the West 99 feet of Lots S and 9, Block 9, Wm. McCullough's Addition changed from a multiple dwelling zone to a commercial zone was read and upon motion by Anderson, second by Brumm, the petition was again referred to the Board of Zoning. The petition of Freda Sorenson and John and Cecilia E. Weis to have the West z of Lots 1 and 2, Block 32 and Lot 14, Block 32 in Northern Addition changed from a residential zone to a commercial zone was read and upon motion by Anderson, second by Davis, the petition was referred to the Board of Zoning. The petition of Bernard Leitzen to have Lots 1, 2 and 3 in Block 2, Cook's Sub -Division changed from a residential zone to a commercial zone was read and upon motion by Davis, second by Brumm, the petition was referred to the Board of Zoning. A petition for the grading and construction of a curb and gutter on 15th Avenue Southwest from 7th Street Southwest to the south line of Dresbach's Addition was read and upon motion by Davis, second by Brumm, the petition was referred to the Street & Alley Committee and the City Engineer. A petition for the construction of a curb and gutter on 14th Avenue Northeast from 9th to loth Street Northeast was read and upon motion by Anderson, second by Davis, the petition was referred to the Street & Alley Committee and the City Engineer. A petition for the extension and completion of let Avenue Southwest continuing into Soldiers Field was read and upon motion by Anderson, second by Davis, the same was referred to the Street & Alley Committee and the City Engineer. The matter of taking care of a hazardous condition at the lots from which the Fawcett and Pougiales houses were removed was brought to the attention of the Council and upon motion by Anderson, second by Schroeder, the City Engineer was instructed to take care of the condtions causing a hazard at the said area. A letter from Arthur R. Swan, Attorney representing Dr. I.E. Michael, who purchased a home from Jack Batdorf at 1700 Ninth Street Northeast, the legal description being Lot 1, Meredith's Subdivision, and further stating that the house on the said described property had been built to close to the property lines was read and upon motion by Davis, second by Schroeder, the matter was referred to the Board of Zoning. Mr. John Fisher, of the Exchange Club, was present at the meeting and inquired as to whether or not the Council had made any decision on the matter of placing benches on the boulevards of streets and upon motion by Brumm, second by Davis, the same was referred to the City Attorney and the Public Grounds Committee. to meet with the Board of Park Commissioners on the matter. Mr. Paul A. Grassle, Sr. President of the Board of Park Commissioners, was present at the meeting and presented the annual report of the Board of Park Commissioners which was read and ordered placed on file. The annual report of the Public Utility Board was presented and ordered . i; placed on file. The annual report of the City Engineer was read and the same was crdered placed on file. The reports of the City Treasurer for the months of February and March , 1952 were each read and ordered placed on file. The reports of the Clerk of Municipal Court for .the week ended April 12, 1952 showing total criminal fines and costs collected $2,143.-00 and civil fees received $.25 and for the weer ended April 19, 1952 showing total criminal,fines and costs collected $2,413.00 and civil fees received $1.65 aere, each read and having been approved by the City Attorney, President Bach ordered that the sane be! placed on file. The application of William E. Just for license to sell non -intoxicating malt liquors "Off Sale" was read and upon notion by Davis, second by Morris, the' I license was granted. The applications of Coca Cola Bottling Company and 7-Up Bottling Company] for a Wholesale Beer License were each read and upon motion by Davis, second by Schroeder, the licenses were granted. The .applications of Donald W. Metcalf, W. E. Just, Campbell Hotel, Thrifty Drug Store, Gregory G. Pappas, C. W. Dwight and John F. quinn for license i to sell cigarettes were each read and upon motion by Davis, second by Schroeder, the licenses were granted. 0 The applications of C. N. Boutelle and Donald A. Ramthum for license to construct sidewalks were each read and upon motion by Brumm, second by Anderson, the licenses were granted. The application of A. D. Fairley for a Journeyman Hot Water and Steam Fitters License was read and upon motion by Davis, second by Thiem, the licdnse was granted subject to the approval of the Plumbing Inspector. Hodge for Real Estate Brokers license were each read and upon motion by Thiem, second by Anderson, the licenses"were granted subject to the approval of the Real Estate Commission.
