Record of Official Proceedings of the Common Council
of the City of Rochester, Minn., June 2. 1952
Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota held in the Council Chambers in the City Hall, in said
City on June 2, 1952.
President Bach called the meeting to order at 2:00 o'clock P. M., the
following members being present: President Bach, Aldermen Anderson, Brumm,
Davis, Morris, Schroeder and Thiem. Absent: Hone.
Upon motion by Morris, second by Thiem, the minutes of the meeting
of May 19, 1952 were approved.
President Bach stated this as being the time and place set for the
first hearing on the grading and paving of the alley in Block 5, gutzky's
Addition. A protest against the grading and paving of the said alley signed by
19 residents of that area was read, also those present protesting the project
were heard.
President Bach stated this as being the time and place set for
receiving and opening bids for the following projects:
Upon motion by Davis, second by Schroeder, the City Clerk was instr-
ucted to open bids received for construction of a curb and gutter on 12th Avenue
Northeast from 9th to loth Street Northeast. The bids of H. T. Earle & Son in
the amount of $5,246.18, C. M. Boutelle in the amount of $6,623.00 and Gordon
Winslow Company in the amount of $5,908.00 were received and upon motion by
Morris,, second by Thiem, the same were referred to the Street & Alley Committee
and City Engineer for recommendation.
Upon motion by Davis, second by Schroeder, the City Clerk was instr-
ucted to open bids received for construction of a sanitary sewer and grading of
2nd Avenue Northwest from 13th .Street to the trankline.sewer in 13* Street
Northwest. No bids were (received for grading. The bid of Carlisle G. Fraser
In the amount of $2,037.00 for sanitary sewer was received and upon motion by
Davis, second by Schroeder, the same was referred -to the Sewer Committee and
City Engineer for recommendation.
Upon motion by Davis., second by Morris, the City Clerk was instructed
to open bids for construction of a sanitary sewer and watermain in 5th Street
Northeast from 15th Avenue Northeast to the east line of Lot 10, Jane's
Addition. The bid of Carlisle G. Fraser in the amount of $5,090.95 was
received and upon motion by Davis, second by Schroeder, the same was referred
to the Sewer Committee, Water Committee and City Engineer for recommendation.
Upon motion by Thiem, second by Schroeder, the City Clerk was instr-
ucted to open bids for furnishing one patrol car for the Police Department.
The bid of Universal Motors, Inc. in the amount of $2,069.00 was received and
President.Bach referred same to the Police Committee and Acting Chief of

The recommendation of the Street & Alley Committee that the bid of H.T.:
Earle & Son be accepted at unit p prices bid'Por construction of'a curb and gutter
on 12th Avenue.Northeast from 9th to 14th Street Northeast and,checks returned
to unsuccessful bidders was read and upon motion by Morris, second by Schroeder,
the recommendation was approved.
The recommendation of the Sewer`Committee that the'bid of Carlisle G.

Fraser be accepted at the unit prices bid for construction_of a sanitary sewer in
2nd.Avenue Northwest from 13th Street to the trunk line in 1 A Street Northwest
was read and upon motion by Morris, second by Brumm, the recommendation was
approved.
The recommendation of the Sewer and Water Committees that the bid of
Carlisle G. Fraser for construction of a sanitary sewer and watermain in 5th St.
Northeast from 15th Avenue to the east line of Lot 10, Jane's Addition be accepted
at the unit prices bid was read and upon motion by Brumm, second by Schroeder, the
recommendation was approved.
The recommendation of the Street & Alley Committee that bids be taken
on June 16, 1952 for the improvement of sidewalk, driveway and parking area on
the north side of the Mayo Civic Auditorium was read and upon motion by Brumm,
second by Anderson, the recommendation was approved.
The recommendation of.the Street & Alley Committee that bids be taken
on June 169 1952 for one flat bed dump body and hoist and one two ton dump'truck
complete with dump box and hoist was read and upon motion by Schroeder, second by '
Thiem, the recommendation was approved.
The recommendation of the Street & Alley Committee and City Engineer
that the plat of Schleif's Addition -conformed with the requirements of the
ordinance and that the same be annexed was read and upon motion by Schroeder,
second by Morris, the recommendation was approved.
The recommendation of the Street & Alley Committee that the City
Engineer be delegated to represent the City of Rochester at the American Public
Works Congress on August 24 to 27, 1952 at Los Angeles, California, the City to
pay one half.of the expenses and the Minnes-ota Public Works Association the other '
Half was read and upon motion by Thiem, second'by Anderson, thei recommendation
was approved.
The recommendation of the Board of Zoning that the petition of Joe
Michele Endrizzi to have the west 49.7 feet of Lot I and the west 49.7 feet of
the south ja of Lot 2, Block 43, Original Plat changed from multiple dwellingto
commercial 'one be granted was read and -upon motion by Thiem, second by Brumm,
the recommendation was approved and the City Clerk was instructed to publish a
notice of hearing to be held on June 16, 1952 on the said zone change.

The recommendation of the Board of Zoning that the petition of Charles
and Emma Hatch to have Lot 5, Block 24, Northern Addition changed from a
residential to a commercial zone be not granted was read and upon motion by
Anderson, second by Thiem, the recommendation was approved.
The recommendation of the Sewer Committee recommending approval of
Credit Memorandum No. 6 issued by Toltz, King and Day, Inc. for acceptance of
filter media rock meeting the specifications in all respects except for
particle shape was read and upon motion by Davis, second by Morris, the
recommendation was approved. •
The recommendation of the Police Committee that the bid of Universal
Motors, Inc. be accepted for furnishing one patrol car was read and upon motion
by Morris, second by Davis, the recommendation was approved.
The following recommendation was read and upon motion by Schroeder,
second by Thiem, the same was referred to the City Attorney:
"Honorable Mayor & Common Council
City of Rochester, Minnesota
Gentlemen:
The Plat of Mohn and Hodge Second Subdivision has been
returned to me after being revised as suggested by the City•
Council.
I have examined the plat and find that it now conforms
to the requirements of Ordinance T04 and I recommend its
approval.
There is one possible point of question which I suggest
should be studied by the City Attorney, This Plat is a Replat
of Thurber's Third Subdivision. However, Thurber's Third
Subdivision has never been vacated. There is a possibility
of confusion in abstracts and property descriptions in the
.future.

A protest signed by C. S. Dorsey, M.D. against any assessment for
construction of a sewer on loth Street Southeast, for the reason that sewer
services are already installed in his property, was read and the same was
ordered placed on file for future reference. •
The following resolution adopted by the Public Utility Board was
read and ordered placed on file:
"WHEREAS, the City of Rochester, Minnesota, through its Public
Utility Board, has an agreement for the sale of electric current with
the People's Cooperative Power Association of Olmsted County, and
WHEREAS, Paragraph 2 of this agreement states, 'The City agrees
to sell and deliver to the Consumer, and the Consumer agrees to purchase
and receive from the City all of the electrical energy which the
Consumer may require during the term of this agreement subject to the
provisions hereinafter stated.............', and
WHEREAS, the People's Cooperative Power Association have esta-
blished that they have under -normal voltage at the extreme end of their
line, and that it is not economically feasible to increase the copper
sizes of transmission to serve this small area, therefore,
BE IT RESOLVED By the Public Utility Board that the Honorable
Common Council be and is hereby requested to authorize the said Board to
amend Paragraph 2 of the present Agreement to read as follows: 'The City
agrees to sell and deliver to the Consumer, and the Consumer agrees to
purchase and receive from the City, ninety per cent (90%) of all of the
electrical energy which the Consumer may require during the term of this
agreement, subject to the provisions hereinafter stated'."

A letter from the Board of Public Health & Welfare advising that the -
City Treasurer's office will continue as a designated place to receive payment of
garbage collection fees and that the Treasurer would be placed on the Public
Health & Welfare Department payroll at a fee of $25.00 per month was read and_
upon motion by Morris, second by Schroeder, the same was approved.
A request from the Board of Public Health & Welfare for permission tv
employ Miss Audrey 'Seaberg, R.N. as a public health nurse, effective July 1, 1952,1
at a salary of $305.00 per month was read and upon motion by Anderson, second by
Schroeder, the request was granted, -
Order No. 21997 from the State of Minnesota, Department of Highways,
designating a detour within the City of Rochester during the period of construction
work on trunk highway No. 296, between llth Avenue and 4th Street Southeast and
the Rochester State Hospital, was read and upon motion by Anderson, second by
Davis, the said detour was approved.
The following wage schedule submitted by the Board of Park Commissioners;
was read and President Bach ordered that the same be placed on file:

The Mayor's emergency order given to the Public Utility Board for the
purchase of Red Cedar Poles was read and upon motion by Schroeder, second by
Morris, the same was approved.
The request of Leonard Ekstrand that permission be granted the
Rochester and Olmsted County Community Council to use the City Council Chambers
for the evening of June 24th was read and upon motion by Davis, second by
Schroeder, the request was granted.
A letter from Wayne Clark withdrawing his application for a wholesale •
beer license was read and ordered placed on file.
A communication from the Board of Park Commissioners transmitting a set
of plans for a storage addition to the Mayo Civic Auditorium building and also a
copy of authorization of construction by the National Production Authority.was
read and upon motion by Morris, second by Schroeder, the communication was
referred to the Finance Committee.
The City Engineer's estimate of cost for construction of a sanitary
sewer in 2nd Avenue Northwest from 13th Street Northwest to the trunk line sewer
in 132 Street -Northwest in the amount of $1,953.00 was read and the same was
ordered placed on file.
A notice from the Town Board of Cascade Township that in accordance
with Section 145.17 of the Minnesota State Health Laws, permits for operating
the new Sewage Disposal Plant and the present dumping grounds must be applied
for through the Town -Board of Cascade Township was read and upon motion by
Anderson, second by Thiem, the applications were referred'to the City Engineer:
to be completed and forwarded to the said Town Board.
A petition for construction of a curb and gutter on loth Avenue
Southeast from 6th to 7th Street Southeast was read and upon motion by Morris,
second by Schroeder, the same was referred to the Street & Alley.Committee and
the City Engineer.

on an examination of the facilities and management of the Rochester City Jail
was read and President Bach ordered the`same placed on file.
A statement of receipts and disbursements in the Park'Improvement Fund
for April, 1952 was read and the same was ordered placed on file.
The reports•for the month of May, 19.52 of -the Building Inspector showing
fees collected for building 'permits $239.00; 'of the Electrical Inspector showing
y{ fees collected for electrical permits $29.25; of the Plumbing Inspector showing

The reports of the Clerk of Municipal Court for the week ending May 24,
1952 showing total criminal fines and costs collected $1,391,79 and civil fees
received $2.95 and for the week ending MfLy 31, 1952 showing total criminal fines
and costs collected $1,089,00 and civil fees received $8.55, were each read and
having been approved by the City Attorney, President Bach ordered the same placed
on file.
The application of K. X. Krakow for a license to sell cigarettes was
read and upon motion by Brumm, second by Morris, the license was granted.
The application of A. P. Barry for license to sell non-intoaiaating
malt liquors °off sale" was read and upon motion by BFumm,,second by Anderson, the
license was granted.
The application of I. R.,Wescott for a Journeyman Plumber's License was
read and upon motion by Anderson; second by Brumm, the license was granted.
The applications of Roy Schermerhorn, Norbert Fitzpatrick and Earl
Franck for Real Estate Brokers license were each read and upon motion by
Morris, second by Schroeder, the licenses were granted.
The application of William Bliesmer for a Real Estate Salesman's
License was read and upon motion by Morris; second by Schroeder, the same was
referred to the Real Estate Commission.
The license bonds of Earl Franck'iu the amount of $1,000.00 with the
Western Surety Company as surety and Roy Schermerhorn and Norbert ritzpatrick
each in the amount of $1,000.00 with the Anchor Casualty Company as surety, were
each read and upon motion by Anderson, second by Thiem,'the bonds were approved,
the 'surety thereon accepted and it was ordered that the same be placed on file.
The contract bonds of'Blacktop Maintenance Company in the amount of
$15,665.80 with the Standard Accident Insurance Company as surety and Carlisle G.
Fraser in the amount of $17,463.25 with the United States Guarantee Company as
surety were each read and referred to the Mayor for his approval.
The following resolutionswere each introduced and read:
Alderman S&roeder introduced a resolution accepting the bid of Universal
Motors, Inc. for furnishing one patrol car and upon motion by Anderson, second
by Brumm, and all voting in favor thereof, Bresident Bach declared the resolutio n
duly passed and adopted.
Alderman Schroeder introduced a resolution accepting the bid of H.T.-
Earle for construction of a curb and gutter on 12th Avenue N.E. from 9th to 14th
Street N.E. and upon motion by Brumm, second by Davis, and all voting in favor
thereof, President Bach declared the resolution duly passed and adopted.
Alderman Schroeder introduced a resolution accepting the bid of
Carlisle G. Fraser for construction of a sanitary sewer in 2nd Avenue N,W. from

Alderman Brumm introduced a resolution appropriating $776.47 from the

Alderman Morris recommended to -the Council that adjustments be made in
the fees for certain licenses now collected by the City -of Rochester. A motion
was made by Davis, second by Thiem, that Alderman Morris be authorized to
publicize the recommended changes in license fees.
The matter of*the width of driveways authorized by the traffic ordinance,
in and out of filling stations was discussed and upon motion by'Schroeder, second
by Brumm, the City Engineer was instructed to bring in information as to the
width of present -drives -now in use leading in and out of filling stations.
A motion was made by Thiem, second by Schroeder, that curbs now

said curb grey, so. as to permit regular parking. All voted in favor of the motion:
The members of the Council discussed the matter of condensing the minute's
of the various council meetings and upon motion by Thiem,,Isecond by Davis,, —the
same was referred to the -City Attorney and•the City Clerk.

Officials were authorized to attend the League of Minnesota Municipalities
Convention to be held at St. Cloud on June 11, 12 and 13, at city expense.
A motion was made by Morris,.vecond by Brumm, that the City Attorney be
authorized to employ such additional professional services as may be required.
A motion was made by Brumm, second by Davis, that an assessment in the
amount of $1.00.per foot be made against the real estate annexed; known as
Schlief's Addition, when a connection is made to the sewer. All voted in favor
of the motion:
Upon motion by Schroeder, second by Davis, the meeting was adjourned
until 1: 30 o'clock P. M. on June 16, 1952.
